In Cardano’s classification in the Ars Magna, the cubic equations were arranged in thirteen families. This paper examines the well-known solution methods for the families $$x^3 + a_1x = a_0$$ x 3 + a 1 x = a 0 and $$x^3 = a_1x + a_0$$ x 3 = a 1 x + a 0 and then considers thoroughly the systematic interconnections between these two families and the remaining ones and provides a diagram to visualize the results clearly. In the analysis (...) of these solution methods, we pay particular attention to the appearance of the square roots of negative numbers even when all the solutions are real—the so-called casus irreducibilis. The structure that comes to light enables us to fully appreciate the impact that the difficulty entailed by the casus irreducibilis had on Cardano’s construction in the Ars Magna. Cardano tried to patch matters first in the Ars Magna itself and then in the De Regula Aliza. We sketch the former briefly and analyze the latter in detail because Cardano considered it the ultimate solution. In particular, we examine one widespread technique that is based on what I have called splittings. (shrink)

CASUS is an authoring system, which should enable physicians to produce problem-based computer learning programs with minimal technical effort and give them sound instructional support. The theoretical background of CASUS are constructivist approaches to learning and instruction, which deal mainly with the question, how to design problem-based learning environments. The paper presents the constructivist concept of CASUS and results of a forma-tive evaluation. Four authors were observed and interviewed while developing a learning case with CASUS. The (...) evaluation pursued mainly the question of which difficulties arise while producing a case with CASUS and which measures are necessary in order to improve the authoring system. Results show that with regard to technical aspects physicians can produce learning cases even without any special prior knowledge. There were far more problems with instructional aspects of the production of cases. Most of these difficulties were very specific to the content of the cases. Therefore, it seems that an appropriate way to design learning cases with high quality, is a cooperation between some authors with different expertise. (shrink)

Since cyberattacks are nonphysical, standard theories of casus belli — which typically rely on the violent and forceful nature of military means — appear inapplicable. Yet, some theorists have argued that cyberattacks nonetheless can constitute just causes for war — generating a unilateral right to defensive military action — when they cause significant physical damage through the disruption of the target's computer systems. I show that this view suffers from a serious drawback: it is too permissive concerning the types (...) of actions that generate casus belli since many essentially peaceful and non-violent mechanisms can nonetheless cause physical damage. I resolve this difficulty by developing a sovereignty-based account of casus belli and applying it to cyberwarfare. I argue that legitimate states have a constrained right to unilaterally respond with military force to unfriendly actions that bypass or overwhelm the political deliberations of the target state in order to force a change in behaviour contrary to the determinations of the people of the target state. This new account of casus belli avoids the problems of the consequence-based view by plausibly restricting the types of unfriendly action that give rise to casus belli and yet offers an attractive explanation for why some cyberattacks nonetheless do generate a potential right to a unilateral defensive response. Sara Confalonieri presents an overview of Cardano's mathematical treatises and, in particular, discusses the writings that deal with cubic equations. The author gives an insight into the latest of Cardano's algebraic works, the De Regula Aliza (1570), which displays the attempts to overcome the difficulties entailed by the casus irreducibilis. Notably some of Cardano's strategies in this treatise are thoroughly analyzed. Far from offering an ultimate account of De Regula Aliza, by one of the most outstanding scholars of the (...) 16th century, the present work is a first step towards a better understanding. This article explores the use of the Multilevel Governance concept to understand why EU Member-States, such as Belgium, sometimes fail to transpose EU directives correctly or in time. Firstly, it discusses the nature and the value of the MLG concept. It is argued that a theoretical incorporation of the MLG concept in the Neo-Institutional paradigm is necessary to gain explanatory power. Secondly, an overview is presented of the Belgian implementation record. In the last part, the combined use of the MLG (...) concept and the NI theory identifies several factors to explain failing implementation. It is argued that governance as well as multilevel institutions can constrain the desired smooth implementation. Examples of such hard and soft institutions include the multi-layeredfederal structure of Belgium, the complex co-ordination and implementation mechanisms, the role of advisory bodies and the Council of State, the relation between administrations and 'cabinets', and cultural features such as knowledge of the EU. This study aims at investigating vagueness in Security Council Resolutions by focussing on a selection of nouns and phrases used as the main casus belli for the Second Gulf War. Analysing a corpus of Security Council Resolutions relating to the conflict, the study leads a qualitative and quantitative analysis drawing upon Mellinkoff’s theories on “weasel words”, which are “words and expressions with a very flexible meaning, strictly dependent on context and interpretation”. Special attention is devoted to the historical/political consequences (...) of such vague and indeterminate expressions. The findings indicate that excessive vagueness might have led to biased or even strategically-motivated interpretations of the Resolutions, triggering the Iraqi conflict instead of a diplomatic solution. The analysis of the “weasel words” used in the Resolutions suggests the double-faced strength of such expressions: though they can guaranteed a wide degree of applicability of the Resolutions, their subjective interpretability might become a source of manipulation and elusiveness, with the overall legislative intent of using intentional vagueness as a political strategy. The focus of the paper is a sophism based on the proposition ‘This is Socrates’ found in a short treatise on obligational casus attributed to William Heytesbury. First, the background to the puzzle in Walter Burley’s traditional account of obligations (the responsio antiqua), and the objections and revisions made by Richard Kilvington and Roger Swyneshed, are presented. All six types of obligations described by Burley are outlined, including sit verum, the type used in the sophism. Kilvington and Swyneshed disliked (...) the dynamic nature of the responsio antiqua, and Kilvington proposed a revision to the rules for irrelevant propositions. This allowed him to use a form of reasoning, the “disputational meta-argument”, which is incompatible with Burley’s rules. Heytesbury explicitly rejected Kilvington’s revision and the associated meta-argument. Swyneshed also revised Burley’s account of obligations, formulating the so-called responsio nova, characterised by the apparently surprising thesis that a conjunction can be denied both of whose conjuncts are granted. On closer inspection, however, his account is found to be less radical than first appears. (shrink)

W artykule przedstawiam genezę wprowadzenia w 2002 roku do brytyjskich szkół sektora państwowego przedmiotu obywatelstwo (Citizenship), omawiam jego założenia oraz prezentuję tłumaczenie jego sylabusa. Klasyfikuję przy tym ten przedmiot jako formę edukacji etycznej. W liberalnej tradycji angielskiej państwo unikało wpływania na rozstrzygnięcia aksjologiczne w obszarze wychowania, stąd wykazanie inicjatywy w sferze edukacji etycznej jest faktem znaczącym. W pierwszej części artykułu, odwołując się do historii państwowego szkolnictwa w Wielkiej Brytanii, rekonstruuję kontekst historyczny, w którym sytuuję wprowadzenie przedmiotu obywatelstwo i wskazuję na (...) czynniki, które doprowadziły do przełamania powściągliwości państwa w tej kwestii. W części drugiej wskazuję na bezpośrednie okoliczności wprowadzenia nowego przedmiotu przez brytyjską Partię Pracy. W części trzeciej analizuję teoretyczne podstawy programu przedmiotu obywatelstwo, które zostały przedstawione w dokumencie znanym jako „Raport Cricka”, opublikowanym w 1998 roku. Moim celem jest pokazanie, że edukacja obywatelska jest wartym rozważenia wariantem edukacji etycznej, a casus angielski może stanowić okazję do przyjrzenia się wyzwaniom, ograniczeniom i możliwościom, jakie wiążą się z wdrażaniem tego rodzaju edukacji. In this paper I will examine the relation between the theory of obligations and its use in sophismatic contexts through the lens of certain pragmatic concerns. In order to do this, I will take a sophism discussed by Peter of Mantua in his treatise on obligations as a case-study. I will first provide a brief outline of the structure of the treatise and then examine a concrete case that shows how the relationship between background assumptions (casus and context of (...) utterance) and criteria of response seems to suggest a way to qualify the application of general rules (especially for irrelevant sentences) in certain limit-cases. By discussing Peter's presentation of the sophism, I will also argue for a connection between Peter of Mantua's text and Mesino de Codronchi's Questiones on the De Interpretatione. (shrink)

This contribution sketches the path that St. Ignatius traversed from excluding in 1541 educational work as a Jesuit ministry to his decision to found colleges and universities as apostolic woks of the Society for the formation of young lay students. Ignatius determined in 1553 that the Collegio Romano should be marked by universality in its make-up and outreach, and furthermore should exercise influence on the other colleges of the Society in Europe. From these beginnings, a comprehensive instructional program emerged in (...) the definitive Ratio studiorum of 1599. We relate the organisation of the courses in literature and in the Faculty of Philosophy, which included pure and applied mathematics. The Faculty of Theology included a course on casus conscientiae or moral theology, and in the 18th century it added chairs of Canon Law, Church History, and Liturgy. In conclusion this article describes the three public «academies» founded for the intellectual and religious formation of select groups of students. Also, we tell of the instruction given in the exact sciences, with mention of some of more famous professors. (shrink)

In legal methodology (usul al-fiqh), the problem of the defining istiḥsān and the legitimacy of its definition is among the critical discussion topics. To overcome the rigorism of law, istiḥsān was used by the founder scholars of Ḥanafī school of law and Malik b. Anas - however this use received various objections. Although the Mālikī scholars also used istiḥsān strong criticisms of istiḥsān have been directed on the Ḥanafīs. After the severe criticism of Muḥammad b. Idrīs al-Shāfiʿī, the Ḥanafī scholars (...) carried out various intellectual activities to define istiḥsān and to prove that it is legitimate. This process -which started especially with Abū’l-Ḥasan al-Karkhī and Abū Bakr al-Jaṣṣāṣ, revealed a rich accumulation with the contribution of the legal theorists in other school of laws. It is known that al-Karkhī's definition of istiḥsān has become widespread among the legal theorists, and the legitimacy of istiḥsān in the works of legal theory was based on his definition. Al-Karkhī's considerations on the legaliticamy of using istiḥsān can be traced in his student al-Jaṣṣāṣ, in the following centuries, Abū Zayd al-Dabūsī, Abū l-‘Usr al-Bazdawī and al-Sarakhsī’s works. Al-Jaṣṣāṣ' explanations on the legitimacy of istiḥsān begin with the criticism of Imam al-Shāfiʿī's against istiḥsān. He provides the proof of legitimacy for istiḥsān in divided two sub-headings. Al-Jaṣṣāṣ, who deals with istiḥsān in two parts as word and meaning, argues that there is no disagreement about the use of istiḥsān and that all mujtahids accept istiḥsān, and even al-Shāfiʿī, who opposes to the use of istiḥsān, employs istiḥsān in this sense. The type of istiḥsān on which there is a deabte is the istiḥsān used in relation to its meaning. Al-Jaṣṣāṣ states that this use is a qiyas operation; he justifies his point of view by referring to the works of Muḥammad b. Hasan al-Shaybānī. Indeed, when we look at how al-Shaybānī explained the istiḥsān’s examples in his works, it is seen that there are two conflicting juristic analogy (qiyas) made in many examples. Moreover, al-Shaybānī openly considered some types of istiḥsān part of qiyas by stating that some examples “can be included in this type of istiḥsān” Ḥanafī scholars wanted to break the hostile atmosphere toward istiḥsān by defining and evaluating the istiḥsān in a way that their opponents could accept. The definition of Istiḥsān “to abandon the judgment given to similar ones due to stronger evidence.” has been generally accepted. In this definition, istiḥsān is defined by associating with qiyas, and referred to an istihsan that is presented as the more substantial evidence, and qiyas is the weaker evidence. Although it is appropriate to define istiḥsān in relation to qiyas, the claim that in the definition istiḥsān is put in stronger place than qiyas might casuse to some the contradictions- in particular when the example’s of al-Shaybānī are taken into consideration. Because in most cases, when qiyas conflicts with istiḥsān, istiḥsān is taken. But in an opposite case, qiyas might be taken. Apart from these, there are examples of the types of istiḥsān that al-Karkhī has classified in the works of al-Shaybānī, but sometimes there are also strange situations such as taking the qiyas by istiḥsān. This also means that the term is not sufficiently defined. The negative attitude towards istiḥsān in some Shāfiʿī circles and the criticisms against the legitimacy of istiḥsān continued in the works of the fiqh method. Istiḥsān is defined as making a judgment without evidence by Shāfiʿī circles. Therefore, they did not accept the abandonment of qiyas, which is a sharī proof, because of istiḥsān, which is a non-sharī notable proof. Based on the examples given by the users of istiḥsān, Ibn Ḥazm, one of the Ẓāhirītes, claims that istiḥsān opens the door to arbitrariness. According to him, a situation that is accepted as istiḥsān according to Ḥanafīs can be taken as istiḥsān according to Mālikīs. This creates an apparent contradiction. There are some valid points in the assessment of Ibn Ḥazm. Because while it is seen that the istiḥsān of Mālikīs is criticized in al-Shaybānī's book named al-Ḥujjah, it can be also found that the istiḥsān of Ḥanafīs is charged in the works of Abū’l-Walīd al-Bājī, one of the Mālikīs. The criticism toward istiḥsān was continued by Shāfiʿīs such as Abū Isḥāq al-Shīrāzī, Imam al-Haramayn al-Juwaynī and Abū Ḥāmid al-Ghazālī. While al-Juwaynī sees istiḥsān as a method based on the lust of the soul, not istinbat/legal deduction, al-Ghazālī understands istiḥsān as a personal comment. The main reason for the negative attitude towards istiḥsān is that the content based on the definitions, has been neglected most of the time. However, when we look at the works of al-Shaybānī, it can be seen that there is a proof of istiḥsān contrary to what is believed-and that this can be sometimes a work, sometimes a necessity, sometimes another comparison, or sometimes a custom. This article argues that the traditional jus ad bellum and jus in bello criteria are fully capable of providing the ethical guidance needed to legitimately conduct military cyber operations. The first part examines the criteria’s foundations by focusing on the notion of liability to defensive harm worked out by revisionist just war thinkers. The second part critiques the necessity of alternative frameworks, which its proponents assert are required to at least supplement the traditional just war criteria. Using the latter, the (...) third part evaluates ethical issues germane to responding to cyber force, including casus belli, moral aspects of “the attribution problem,” and respective rights and duties when attacks involve innocent third-party states. The fourth part addresses in bello issues, including compliance with discrimination, necessity, and civilian due care imperatives; whether civilians may be targeted with sub-“use of force” cyber-attacks and the permissibility of using civilian contractors to conduct cyber-attacks. Throughout these analyses, conclusions are brought into conversation with those of The Tallinn Manual on the International Law Applicable to Cyber Warfare. (shrink)

In the framework of the De Regula Aliza, Cardano paid much attention to the so-called splittings for the family of equations $$x^3 = a_1x + a_0$$ x3=a1x+a0 ; my previous article deals at length with them and, especially, with their role in the Ars Magna in relation to the solution methods for cubic equations. Significantly, the method of the splittings in the De Regula Aliza helps to account for how Cardano dealt with equations, which cannot be inferred from his other (...) algebraic treatises. In the present paper, this topic is further developed, the focus now being directed to the origins of the splittings. First, we investigate Cardano’s research in the Ars Magna Arithmeticae on the shapes for irrational solutions of cubic equations with rational coefficients and on the general shapes for the solutions of any cubic equation. It turns out that these inquiries pre-exist Cardano’s research on substitutions and cubic formulae, which will later be the privileged methods for dealing with cubic equations; at an earlier time, Cardano had hoped to gather information on the general case by exploiting analogies with the particular case of irrational solutions. Accordingly, the Ars Magna Arithmeticae is revealed to be truly a treatise on the shapes of solutions of cubic equations. Afterwards, we consider the temporary patch given by Cardano in the Ars Magna to overcome the problem entailed by the casus irreducibilis as it emerges once the complete picture of the solution methods for all families of cubic equations has been outlined. When Cardano had to face the difficulty that appears if one deals with cubic equations using the brand-new methods of substitutions and cubic formulae, he reverted back to the well-known inquiries on the shape of solutions. In this way, the relation between the splittings and the older inquiries on the shape of solutions comes to light; furthermore, this enables the splittings to be dated 1542 or later. The last section of the present paper then expounds the passages from the Aliza that allow us to trace back the origins of the substitution $$x = y + z$$ x=y+z, which is fundamental not only to the method of the splittings but also to the discovery of the cubic formulae. In this way, an insight into Cardano’s way of dealing with equations using quadratic irrational numbers and other selected kinds of binomials and trinomials will be provided; moreover, this will display the role of the analysis of the shapes of solutions in the framework of Cardano’s algebraic works. Kant scholars have rarely addressed the centuries-old tradition of casuistry and the concept of conscience in Kant’s writings. This book offers a detailed exploration of the period from Pascal’s Provincial Letters to Kant’s critique of probabilism and discusses his proposal of a (new) casuistry as part of an moral education. *** -/- Die Debatte um Kasuistik und Probabilismus zählt zu den wichtigsten Themen der Moraltheologie und Moralphilosophie der frühen Neuzeit. In der enormen Verbreitung der Literatur über die Gewissensfälle (casus (...) conscientiae) und in der großen Resonanz der Lehre von den wahrscheinlichen Meinungen (opiniones probabiles) in der ersten Hälfte des 17. Jahrhunderts findet sich ein wirkungsmächtiges Modell für die Analyse des moralischen Handelns, in welchem Universalität des Gebots und Kontingenz der Handlung, Notwendigkeit der Norm und individuelle Freiheit miteinander versöhnt werden. Dennoch erregt dieses Modell heftige Kritik, die in Pascals berühmtem Angriff in den Briefen in die Provinz (1656–1657) gipfelt. So beginnt für die Kasuistik und den Probabilismus eine lange Krise, welche die Entstehung der modernen Moralphilosophie und den Siegeszug des kantischen Paradigmas ankündigt. Die Krise von Kasuistik und Probabilismus fällt zusammen mit einer einsetzenden rigoristischen Reaktion der christlichen Moraltheologie sowohl katholischer als auch protestantischer Prägung,welche die moralischen und spekulativen Folgen eines Rückgriffs auf Gewissensfälle und wahrscheinliche Meinungen als inakzeptabel ablehnt. Die Ablehnung geht aber weiter und dringt bis in den Kern der philosophischen Reflexion vor: Die rigoristische Reaktion gegen Kasuistik und Probabilismus entzündet sich im moralphilosophischen Denken Kants als Folge seiner umfassenden kritischen Revision der Grundbegriffe der Moralphilosophie sowie insbesondere seiner Neubestimmung des Verhältnisses von Gewissen und praktischem Urteil. Dem Grundsatz des Probabilismus setzt Kant das Kriterium der moralischen Gewißheit („quod dubitas, ne feceris!“) entgegen, das er als „Postulat des Gewissens“ bezeichnet (RGV 6:185.23–186.9).Und die Kasuistik wird als eine „Critic der Handlungen nach Sophistic“ abgestempelt, als eine „Uebung, um nach der Sophistic das Gewissen zu hintergehen oder es zu chicaniren, insofern man es in Irrthum zu setzen denkt“ (V-MS/Vigil 27:620.2–5). Dennoch weist Kant den kasuistischen Fragen eine herausragende Stellung in der Tugendlehre zu und legt der Kasuistik im Rahmen der ethischen Methodenlehre, also im Hinblick auf pädagogische Anwendungen, letztlich eine positive Funktion bei. Vermutlich ist Kants Angriff auf Kasuistik und Probabilismus durch den Einfluss Pascals philosophisch vermittelt. Kants Verhältnis zu Pascal und, allgemeiner, zu dem historischen Hintergrund, welchem dieser angehört, sind gleichwohl noch erstaunlich wenig erforscht: Trotz der wiederholten (stillschweigenden oder sogar ausdrücklichen) Hinweise an wichtigen Stellen in Kants Schriften richtet die Kant-Forschung ihre Aufmerksamkeit nur selten auf die Jahrhunderte währende Tradition der Kasuistik und den Begriff des Gewissens, der in ihrem Rahmen ausgearbeitet wird. Aus dieser langen Geschichte wird in diesem Band insbesondere der Zeitraum „von Pascal bis Kant“ eingehend untersucht, d.h. der noch wenig erkundete Zeitabschnitt von der beißenden Polemik von Pascals Briefe in die Provinz bis zu Kants eigener Kritik des Probabilismus und seinem Entwurf einer (neuen) Kasuistik als Teil der ethischen Methodenlehre. Hoe denken vrijdenkers, anarchisten en humanisten over opvoeding en onderwijs en hoe hebben ze bijgedragen aan de ontwikkeling van pedagogiek en onderwijs in Nederland? Dat zijn de vragen die in 'Tussen autonomie of humaniteit' centraal staan. Het boek beantwoordt deze vragen in drie casestudies binnen de periode 1850-1970. De eerste casus gaat over vrijdenkers rond 1860, een periode waarin een nieuwe schoolwet veel pedagogische discussies teweeg bracht over de rol van natuur en godsdienst in de school. In de tweede (...) casus (1912-1920) treden vrijdenkers en anarchisten op. Zij worden onderzocht tegen de achtergrond van de Eerste Wereldoorlog en de opkomst van de reformpedagogiek in Nederland. In de derde casus (1945-1970) staan de humanisten van het Humanistisch Verbond centraal en hun bijdrage aan de ontwikkeling van levensbeschouwelijk onderwijs en de openbare school. 0Deze casussen worden beschreven met de vraag voor ogen of deze groepen humanisten vooral autonomie in de opvoeding nastreefden of de bevordering van humaniteit. Dat levert een boeiend beeld op van de diversiteit van humanistische pedagogische perspectieven, waaronder het naturalistisch-romantische, het radicaal-kritische en het existentialistische perspectief. This paper will survey and assess the ways in which moral thinkers in the early modern tradition of casuistry considered a range of cases of conscience (casus conscientiae) relating to lying, deception, and witholding the truth. Arguing that the position of the casuists has been unjustly maligned — not least by Pascal's brillant yet partizan Les Proviniciales — casuistical theories of lying and simulation will be placed in a broad intellectual context which will examine attihules to mendacity among early (...) modern medical writers, political theorists, anbl philosophers. Contrasting casuistical theoriessuch as equivocation and mental reservation with the approach to lying of other early modern writers, the lecture will advancfcahe view that the casuists promulgated a conceptual outlook on the differences betweefc lying and deception which is of inherent interest, and which helps to clarify some of the salient issues that attend a philosophical account of lying.
