La prise en charge de ces enjeux ne saurait s'opérer simplement par des mesures ponctuelles ou locales. Elle doit aujourd'hui être repensée la temporalité de l'action politique, confrontée à une urgence qui ne cessera de s'accroître dans les prochaines années.

"Thought Projections Are Nothing but Scenarios We Construct About Others and Are the Products of Our Own Closed-Mindedness. Report on the ""Living Philosophy"" Project. This text is a reflection on Projections. The aim here is to show that it is necessary to go beyond the Freudian concept to offer a more open reading of the concept of projections. The term is taken in its true sense. Projection is mainly used today in the world of cinema and entertainment. To be victim (...) of a projection is to “make himself is proper film” of reality and live in an imaginary world. Our idea is to maintain that these projections develop in the era of the spectacle which is ours. The term “société du spectacle” is borrowed from Guy Debord. However, we distinguish ourselves from him by maintaining that the spectacle is only an epiphenomenon which is only the result of a culture of secret itself produced by contemporary narcissism. This work is the continuation of a series of conferences which are organized within the framework of a movement called Living Philosophy. This movement aims to bring philosophy back to life by leading it into living spaces and bringing it down into bodies, streets and villages. To do this, she wants to be creative and bring together the Ancients, the Moderns and the post-moderns. Living Philosophy is a movement built on the idea of dialogue and mediation. Comment la pensée médiévale continue-t-elle à agir dans la philosophie juridico-politique moderne, c'est-à-dire dans un horizon intellectuel et historique qui n'est plus le sien? Telle est la question qui anime les contributions au présent ouvrage. Cette action persistante de la pensée médiévale, qui est en même temps transformation de ce qui agit, est étudiée dans le cadre de trois grandes problématiques. 1. Le transfert de la notion de plenitudo potestatis de l'ordre ecclésiastique à l'ordre politique. 2. Le déplacement d'un univers (...) qui trouvait son fondement en Dieu vers un univers qui comporte, non un, mais deux fondements possibles entre lesquels se développe une tension (laquelle deviendra plus tard une concurrence) : Dieu et l'homme. C'est dans le cadre de cette tension entre les deux fondements théologique et éthique que se forment les doctrines du sujet psychologique et affectif, d'une part, et du sujet de droit, d'autre part. 3. Enfin, la constitution d'une théorie du pouvoir politique sur les hommes qui n'est plus pensée dans les catégories de la propriété des choses alors que celles-ci fournissaient, au Moyen Age, le principe d'intelligibilité de celle-là. Les violations des droits de la personne sont de plus en plus fréquentes et de plus en plus graves dans les sociétés occidentales. C’est la conséquence de « l’entreprisation » de notre monde. Devenue l’organisation domi­nante dans nos sociétés, l’entreprise constitue dans son principe même une menace pour la dignité de la personne, dans la mesure où elle est fondée sur l’ins­trumentalisation des êtres humains. Quiconque veut protéger l’homme de l’ex­ploi­tation et de l’aliénation ne peut donc que souhaiter l’abolition de (...) l’entreprise. Mais, dans ce cas, il faut supprimer les conditions qui la rendent possible. Or, paradoxalement, certains droits fondamentaux font partie de ces conditions. D’où la nécessité de les repenser. There exists increasing pressure for small and medium-sized enterprises (SMEs) to engage in corporate social responsibility (CSR) practices, including social reporting. Curiously in this promotional programme of CSR reporting, the only group whose ideas are not sought in this debate are the SME leaders themselves. The present ethnographic field analysis, based on discussions within entrepreneurs' circles, tends to suggest that the argument for expanding formalisation of CSR to SMEs rests upon several fallacies. It implicitly assumes that an apparent solution for (...) large multinationals can be transposed to SMEs, and it underestimates the drawbacks of bureaucracy. Moreover, many SMEs experience inconsistency between the idealistic CSR communication of some large companies and their actions, especially in the supply chain. The author concludes that reports do not constitute the validation for real CSR, nor the proof of superior ethical behaviour. Formalisation can even be counterproductive. Conversely, the absence of social reporting does not imply that SMEs do not behave responsible. CSR in SMEs needs a specific approach, adapted to the informal nature and entrepreneurial character of the small business. The essence of CSR lies in the implementation of responsible business practices. It lies in the right attitudes, in the corporate culture, not in formalisation. (shrink)

Niccolò Machiavelli is the most prominent and notorious theorist of violence in the history of European political thought - prominent, because he is the first to candidly discuss the role of violence in politics; and notorious, because he treats violence as virtue rather than as vice. In this original interpretation, Yves Winter reconstructs Machiavelli's theory of violence and shows how it challenges moral and metaphysical ideas. Winter attributes two central theses to Machiavelli: first, violence is not a generic technology (...) of government but a strategy that tends to correlate with inequality and class conflict; and second, violence is best understood not in terms of conventional notions of law enforcement, coercion, or the proverbial 'last resort', but as performance. Most political violence is effective not because it physically compels another agent who is thus coerced; rather, it produces political effects by appealing to an audience. As such, this book shows how in Machiavelli's world, violence is designed to be perceived, experienced, remembered, and narrated. (shrink)

Pathologizing ugliness refers to the framing of unattractive features as a type of disease or deformity. By framing ugliness as pathology, cosmetic procedures are reframed as therapy rather than enhancement, thereby potentially avoiding ethical critiques regularly levelled against cosmetic surgery. As such, the practice of pathologizing ugliness and the ensuing therapeuticalization of cosmetic procedures require an ethical analysis that goes beyond that offered by current enhancement critiques. In this article, I propose using a thick description of the goals of medicine (...) as an ethical framework for evaluating problematic medical practices. I first describe the goals of medicine based on Daniel Callahan's account. I then propose that the goals work best in conjunction with ancillary ethical concepts, namely medical knowledge and skills, standards of practice and medical duties and virtues. Next, I apply the thick description of the goals of medicine in critiquing the practice of framing ugliness as disease. Here, I demonstrate ethical conflicts between aesthetic judgments that underpin the practice of pathologizing ugliness and medical judgments that inform ethical medical practices. In particular, the thick description of the goals of medicine helps reveal ethical conflicts in at least three key domains common to clinical practices, which include (a) disease determination, (b) diagnostic evaluation and (c) establishing clinical indications. My analysis offers a novel way of critiquing the practice of pathologizing ugliness in cosmetic surgery, which tends to be neglected by enhancement critiques. (shrink)

In his Florentine Histories, Machiavelli offers an ambivalent portrayal of the revolt of the textile workers in late fourteenth-century Florence, known as the tumult of the Ciompi. On the face of it, Machiavelli's depiction of the insurgent workers is not exactly flattering. Yet this picture is undermined by a firebrand speech, which Machiavelli invents and attributes to an unnamed leader of the plebeian revolt. I interpret this speech as a radical and egalitarian vector of thought opened up by Machiavelli's text. (...) The revolutionary address reveals an untimely and not entirely self-conscious political radicalism, a plebeian politics that repudiates the logic of oligarchic privilege and is simultaneously not available for subsumption under the mantle of civic republicanism. The success of the stakeholder theory in management literature as well as in current business practices is largely due to the inherent simplicity of the stakeholder model––and to the clarity of Freeman’s powerful synthesised visual conceptualisation. However, over the years, critics have attacked the vagueness and ambiguity of stakeholder theory. In this article, rather than building on the discussion from a theoretical point of view, a radically different and innovative approach is chosen: the graphical framework is used as the central (...) perspective. The major shortcomings of the popular stakeholder framework are systematically confronted with the graphical scheme to illustrate their visual impact. The graphical illustrations of the imperfections help explain the sometimes-oversimplified generalisation inherent to every graphical model. They also make some interrelationships easier to understand. The analysis demonstrates that, with the tacit but implicit acceptance of simplification of the discussed explanatory elements, Freeman’s framework remains a rather good approximation of reality. This article analyzes the use of crowdsourcing to promote corporate sustainability by assessing compliance with supply chain disclosure laws. It draws on a case study of WikiRate.org as a novel example of crowdsourcing compliance with respect to the UK Modern Slavery Act and U.S. conflict minerals legislation (section 1502 of the Dodd-Frank Financial Reform Act). WikiRate is an open research platform whose mission is to crowdsource better companies by motivating corporations to be transparent about their environmental, social, and governance performance. (...) In particular, WikiRate’s projects on modern slavery and conflict minerals harness the power of citizens to evaluate the quality of corporate disclosures produced in accordance with these laws. Following an analysis of its projects on modern slavery and conflict minerals, I evaluate the challenges of using crowdsourcing to assess legal compliance, including the potential manipulation of data and the difficulty of relying on non-expert citizens to assess complex information in corporate disclosures. I argue that one must identify the appropriate “crowd” that would be most capable of assessing compliance with a given law. While crowdsourcing platforms such as WikiRate invite a broad range of stakeholders to assess compliance, the reality is that only a limited set of individuals may be able to meaningfully participate given the complexity of supply chain disclosures. Thus, “expertsourcing” may be a more appropriate tool for assessing compliance with certain laws as it limits participation to citizens with specialized expertise. (shrink)

Pour des raisons souvent historiques, la pensée occidentale moderne a surtout pensé la norme et la loi. Elle a parfois aussi – mais plus rarement – réfléchi sur le principe mais elle a souvent négligé l'exception. Or cette dernière joue un rôle central en droit en ce qu'elle le crée réellement et en tous les sens du terme. Certains auteurs ont tenté de mettre en évidence l'importance de ladite exception mais leur vision a souvent été trop réductrice et l'exception a (...) trop souvent été réduite à l'idée négative de crise. L'auteur de ce travail, juriste et philosophe, après avoir envisagé les différents aspects pris par l'exception en droit et ouvert pour la première fois en philosophie du droit le sens de cette notion, propose ici de définir l'exception comme le hors du commun et de ne tenir vraiment pour exceptionnelles que les "belles" exceptions, à savoir celles qui rendent l'homme meilleur. Un droit ne peut en effet porter dignement ce nom que lorsqu'il aide chacun à devenir plus grand et à se tenir plus droit qu'il ne se tenait avant qu'il soit édicté. Cependant, pour ne pas se réduire aux simples déclarations d'intention, un tel droit ne peut réellement exister que par des beaux gestes – aussi modestes et quotidiens soient-ils – car ce sont eux en effet qui nous donnent chaque jour l'envie de devenir meilleur que nous le sommes et qui créent véritablement le droit. Nous vivons dans l'inversion et la confusion. Ce qui est en bas a pris la place du haut et ce qui a de la valeur est méprisé. Dans cette confusion des valeurs, le droit n'est pas épargné. Plus personne ne sait à quoi il correspond. Ce mot est désormais employé en toutes occasions, soit pour culpabiliser le plus faible, soit pour justifier des pratiques purement bureaucratiques mais vides de sens, soit pour signifier un ensemble formel de normes creuses, soit pour (...) glorifier celui qui souhaite ainsi légitimer sa violence sur autrui, soit tout simplement pour signifier l'égarement de celui qui exprime un sentiment d'injustice qui n'est pas toujours justifié. Une telle situation de confusion est dangereuse car une société sans un droit digne de ce nom est une société qui s'égare et qui finit tôt ou tard par sombrer. Dans ce texte, il s'agit donc de se saisir ce problème en distinguant deux types de droit : le droit au sens propre et le droit dénaturé. Seul un droit digne, propre, qui élève l'individu et qui lui redonne foi en l'existence peut être qualifié de véritable droit. Cependant un tel concept ne peut exister par de simples promesses ou de belles paroles. Il suppose, pour être crédible et légitime, une application concrète au quotidien qui n'est possible que si une élite de magistrats formés à une éthique rigoureuse – mais non pas susceptible de conduire au sacrifice de leur être ou de leur personne – existe et est sélectionnée non en fonction de critères formels ou de culture dite « générale » ou technique, mais d'une part en fonction de leur engagement pour le bien commun et singulier de chacun et d'autre part en raison de leur valeur personnelle et humaine. Pour redonner sens au droit il faut donc le repenser dans son essence mais aussi et surtout le mettre ensuite en œuvre en mettant au-dessus ce qui est digne de l'être et en confiant sa mise en œuvre à une élite digne de ce nom : une élite au sens propre du terme. Quel statut sémio-linguistique conférer à une réalité admise comme un allant de sol? Plusieurs disciplines sont concernées par cette recherche. Au premier chef, les sciences du langage, à partir de leurs différentes théorisations : l'herméneutique et la sémantique des textes, la linguistique textuelle, l'analyse du discours, les pragmatiques, la sémiotique narrative, la socio-sémiotique, ainsi que l'ensemble des disciplines qui rencontrent la problématique discursive du sens commun, comme un niveau d'analyse le plus souvent sous-estimé : l'histoire, la sociologie - fonctionnelle ou (...) compréhensive -, la praxéologie, la psychologie sociale, les sciences de l'éducation, ainsi que les sciences cognitives, etc. La compréhension et la modélisation des formations du sens commun intéressent encore l'ensemble des référentiels thérapeutiques - depuis la psychanalyse qui est leur source commune - puisqu'il y est toujours question de la manière dont le sujet se rapporte au monde commun, à partir de la problématisation de ses propres évidences. Pathologizing ugliness refers to the use of disease language and medical processes to foster and support the claim that undesirable features are pathological conditions requiring medical or surgical intervention. Primarily situated in cosmetic surgery, the practice appeals to the concept of “aesthetic pathology”, which is a medical designation for features that deviate from some designated aesthetic norms. This article offers a two-pronged conceptual analysis of aesthetic pathology. First, I argue that three sets of claims, derived from normativist and naturalistic accounts (...) of disease, inform the framing of ugliness as a disease. These claims concern: (1) aesthetic harms, (2) aesthetic dysfunction, and (3) aesthetic deviation. Second, I introduce the notion of a hybridization loop in medicine, which merges the naturalist and normative understanding of the disease that potentially enables pathologizing practices. In the context of cosmetic surgery, the loop simultaneously promotes the framing of beauty ideals as normal biological attributes and the framing of normal appearance as an aesthetic ideal to legitimize the need for cosmetic interventions. The article thus offers an original discussion of the conceptual problems arising from a specific practice in cosmetic surgery that depicts ugliness as the disease. (shrink)

Dans la tradition théologique, tantôt l'être est identifié au bien, tantôt le bien se situe au-delà de l'être. Ces deux postures métaphysiques ont convergé dans deux pensées différentes de l'analogia entis. Parcourir ces grandes pensées selon une relecture phénoménologique fait surgir la problématique d'une méprise sur le sens de l'être : Y aurait-il deux manières de considérer l'être, l'une où l'être serait quelque chose qui nécessiterait un geste antérieur de donation, l'autre où l'être serait lui-même donation et bonté? Le défi (...) heideggérien pousserait la théologie vers une question fondamentale. Y répondre, ce serait, d'une part, mettre au jour le présupposé sur lequel est fondé la critique de l'onto-théologie et, d'autre part, par une remise en question de la "déconstruction", laisser émerger une construction métaphysique entièrement transformée par la Révélation. Pour opérer cette entreprise, le chemin est déjà balisé du côté phénoménologique par les travaux de Paul Ricoeur, Jean-Luc Marion et Michel Henry. Leurs études sont stimulantes pour la théologie dont le point de vue est cependant différent. Comme Jean-Yves Lacoste le fait remarquer, considérer la Révélation comme un fait, et non comme une possibilité, ouvre une intentionnalité qui donne accès à une autre description des phénomènes et, par là, à une nouvelle herméneutique. Par conséquent, la foi permet une pensée de l'être impensable sans elle. La Révélation provoque à penser une différence ontologique où l'être ne se retire pas dans sa donation. Cette logique est surprenante au regard de la pensée de Heidegger. Elle se propose comme une alternative à la logique de l'alètheia. (shrink)

The popularity of the stakeholder model has been achieved thanks to its powerful visual scheme and its very simplicity. Stakeholder management has become an important tool to transfer ethics to management practice and strategy. Nevertheless, legitimate criticism continues to insist on clarification and emphasises on the perfectible nature of the model. Here, rather than building on the discussion from a philosophical or theoretical point of view, a different and innovative approach has been chosen: the analysis will return to the origin (...) of stakeholder theory and will keep the graphical framework firmly in perspective. It will confront the stakeholder model’s graphical representation to the discussion on stakeholder definition, stakeholder identification and categorisation, to re-centre the debate to the strategic origin of the stakeholder model. The ambiguity and the vagueness of the stakeholder concept are discussed from managerial and legal approaches. The impacts of two major shortcomings of the popular stakeholder framework are examined: the boundaries and the level of the firm’s environment, and the ambivalent position of pressure groups and regulators. Working pragmatically, with a focus on the managerial and organisational perspective, an attempt is made to clarify the categorisations and classifications by introducing new terminology with a distinction between stakeholders, stakewatchers and stakekeepers. The analysis will finally lead to a proposed upgraded and refined version of the stakeholder model, with incremental ameliorations close to Freeman’s original model and a return of focus to its essence, the managerial implications in a strategic approach. This article defends four claims. The first is that in the last few decades, two waves of democratic innovation based on random selection must be differentiated by their partly different concrete devices, embodying different social dynamics and pointing toward different kinds of democracy. The second claim is that the rationale of the first wave, based on randomly selected minipublics, largely differs from the dynamic of political sortition in Athens, as it points toward deliberative democracy rather than radical democracy. Conversely, empowered (...) sortition processes that have emerged during the second wave capture better the spirit of radical Athenian democratic traditions. The third claim is normative: these empowered sortition processes are more promising for a real democratization of democracy. The last claim is that any proposal of a legislature by lot must rely on this lesson when trying to defend a normatively convincing and politically realistic perspective. (shrink)

The popularity of surgical modifications of race-typical features among Asian women has generated debates on the ethical implications of the practice. Focusing on blepharoplasty as a representative racial surgery, this article frames the ethical discussion by viewing Asian cosmetic surgery as an example of medicalization, which can be interpreted in two forms: treatment versus enhancement. In the treatment form, medicalization occurs by considering cosmetic surgery as remedy for pathologized Asian features; the pathologization usually occurs in reference to western features as (...) the norm. In the enhancement form, medicalization occurs by using medical means to improve physical features to achieve a certain type of beauty or physical appearance. Each type of medicalization raises slightly different ethical concerns. The problem with treatment medicalization lies in the pathologization of Asian features, which is oppressive as it continues to reinforce racial norms of appearance and negative stereotypes. Enhancement medicalization is ethically problematic because cosmetic surgery tends to conflate beauty and health as medical goals of surgery, overemphasizing the value of appearance that can further displace women’s control over their own bodies. I conclude that in both forms of medicalization, cosmetic surgery seems to narrowly frame a complex psychosocial issue involving physical appearance as a matter that can be simply solved through surgical means. Dans ses travaux des années 1950 sur les « rites d'interaction », l'inspiration de Goffman est quasi-exclusivement durkheimienne. Les interactions sont des cérémonies que de petits prêtres rendent à de petits dieux. Mais Relations in Public marque un tournant: l'analyse des interactions, sous l'influence de l'éthologie, devient (...) beaucoup plus comportementale. Dans ses tout derniers travaux, l'analyse conversationnelle prend le relais de l'éthologie. Goffman réduit l'interaction à un déroulement de séquences formalisées. Les dieux sont redevenus des primates, mais des primates bavards.The article's objective is to show that the notion of ritual Goffman is at the crossroads of two major intellectual traditions: the sociology of religion inspired Durkheim, on the one hand, ethology, on the other hand. In his work in the 1950s on "interaction ritual" inspiration Goffman is almost exclusively Durkheim. Interactions are small ceremonies that priests to make little gods. But relations in Public marked a turning point: the analysis of interactions under the influence of ethology, behavioral becomes much more. The ritual becomes a ritual. In his latest work, conversational analysis takes over ethology. Goffman reduces the interaction to a sequence of sequences formalized. The gods have returned to primates, but primates much. The first was that CIHR, unlike MRC, was entrusted with the challenge of supporting the whole spectrum of health research, from the basic biomedical perspective to clinical research, research on health services and policies as well as social aspects of health research, not to mention research on ethics and other perspectives (including the science of research). The second characteristic of the nascent CIHR that impacted the community of research on aging was the decision that a small part of the overall CIHR budget would be used to address priority-driven questions or topics (strategic competitions), while the majority of the budget would be invested in grants and awards programs that would be investigator-initiated, as in the time of the MRC (open competition). Since its inception, CIHR has included 13 institutes that are central to the priority-driven actions. Institutes not only play an important convener role within their communities and among their stakeholders, but they are also expected to listen to the needs, gaps and opportunities in their area and to introduce initiatives---most of the time involving more than one Institute---in order to tackle these needs and gaps and to seize upon the opportunities.The Institute of Aging was introduced at the same time as the other 12 Institutes and it is clear that many challenges were awaiting the new Institute since, at that time, research on aging was still in its early years. This article is about the trajectory of the CIHR Institute of Aging in its first 18 years of existence. Having now reached an age that is either the age of majority or quite close to it, it is important to be able to provide a reflection on the evolution of the priorities over this period, while also taking a peek at some of the priorities that will surely come in the near future.The Early Years (2001-2004)The founding Scientific Director of the Institute of Aging was Dr. Réjean Hébert. A well-known and prolific [End Page 1] geriatrician and researcher, Dr. Hébert was the perfect person to launch the Institute. One of his first actions was, in fact, to harmonize the French and English names of the Institute. In French, the name of the Institute focused on Aging (Institut du vieillissement) while, in English, the name of the Institute focused on Healthy Aging. The CIHR Institute of Healthy Aging thus became the CIHR Institute of Aging in all versions of its documentation. But above and beyond this important name change, the real work of Dr. Hebert, accompanied by the first Institute Advisory Board1, chaired by Prof. Dorothy Pringle, was to identify the gaps, the needs and the opportunities. After a rigorous process came the first Strategic Plan of the CIHR Institute of Aging, which was clearly influenced by Dr. Réjean Hébert's vision of the aging population as an opportunity, instead of a catastrophe, for our society that comes, of course, with its own challenges. Dr. Hébert left CIHR during his first mandate as he was called upon to become the Dean of his Faculty, and then went on to become the first CIHR Scientific Director to sit as a Minister of Health and Social Services in the Québec Government. Pathologizing ugliness refers to the use of disease language and medical processes to foster and support the claim that undesirable features are pathological conditions requiring medical or surgical intervention. Primarily situated in cosmetic surgery, the practice appeals to the concept of "aesthetic pathology", which is a medical designation for features that deviate from some designated aesthetic norms. This article offers a two-pronged conceptual analysis of aesthetic pathology. First, I argue that three sets of claims, derived from normativist and naturalistic accounts (...) of disease, inform the framing of ugliness as a disease. These claims concern: (1) aesthetic harms, (2) aesthetic dysfunction, and (3) aesthetic deviation. Second, I introduce the notion of a hybridization loop in medicine, which merges the naturalist and normative understanding of the disease that potentially enables pathologizing practices. In the context of cosmetic surgery, the loop simultaneously promotes the framing of beauty ideals as normal biological attributes and the framing of normal appearance as an aesthetic ideal to legitimize the need for cosmetic interventions. The article thus offers an original discussion of the conceptual problems arising from a specific practice in cosmetic surgery that depicts ugliness as the disease. (shrink)
