This is the second volume in a six-volume translation of the major writings of Wilhelm Dilthey, a philosopher and historian of culture who continues to have a significant influence on Continental philosophy and a broad range of scholarly disciplines. In addition to his landmark works on the theories of history and the human sciences, Dilthey made important contributions to hermeneutics, phenomenology, aesthetics, psychology, and the methodology of the social sciences. This volume presents Dilthey's main theoretical works from (...) the 1890s, the period between the Introduction to the Human Sciences and The Formation of the Historical World. A common thread of the writings included here is an interest in the relation between the self and the world. In "The Origin of Our Belief in the Reality of the External World and Its Justification," Dilthey argues that our engagement with the world is rooted in our practical drives and the resistance they meet. The basic nexus of our beliefs about reality is volitional rather than representational. The next essay, "Life and Cognition," examines the main categories with which we organize our experience of life into an understanding of the human world: selfsameness; doing and undergoing; and essentiality. These categorial relations are further articulated with the aid of Dilthey's structural psychology in ways that rival some of the insights of phenomenology. By focusing on how lived experience places everything in a temporal continuum that can be described and analyzed, Dilthey saw the opportunity to establish a structural psychology that could be of great use to the human sciences in general. In the final essay, "Contributions to the Study of Individuality," Dilthey attacks Windelband's thesis that the human sciences are idiographic. Many human sciences have systematic and structural aims that combine the study of uniformities with the examination of individuation. Applying the comparative method, Dilthey argues that living beings share many basic similarities within which typical variations tend to recur. Critics currently argue that applied ethics approaches to artificial intelligence (AI) are too principles-oriented and entail a theory–practice gap. Several applied ethical approaches try to prevent such a gap by conceptually translating ethical theory into practice. In this article, we explore how the currently most prominent approaches of AI ethics translate ethics into practice. Therefore, we examine three approaches to applied AI ethics: the embedded ethics approach, the ethically aligned approach, and the Value (...) Sensitive Design (VSD) approach. We analyze each of these three approaches by asking how they understand and conceptualize theory and practice. We outline the conceptual strengths as well as their shortcomings: an embedded ethics approach is context-oriented but risks being biased by it; ethically aligned approaches are principles-oriented but lack justification theories to deal with trade-offs between competing principles; and the interdisciplinary Value Sensitive Design approach is based on stakeholder values but needs linkage to political, legal, or social governance aspects. Against this background, we develop a meta-framework for applied AI ethics conceptions with three dimensions. Based on critical theory, we suggest these dimensions as starting points to critically reflect on the conceptualization of theory and practice. We claim, first, that the inclusion of the dimension of affects and emotions in the ethical decision-making process stimulates reflections on vulnerabilities, experiences of disregard, and marginalization already within the AI development process. Second, we derive from our analysis that considering the dimension of justifying normative background theories provides both standards and criteria as well as guidance for prioritizing or evaluating competing principles in cases of conflict. Third, we argue that reflecting the governance dimension in ethical decision-making is an important factor to reveal power structures as well as to realize ethical AI and its application because this dimension seeks to combine social, legal, technical, and political concerns. This meta-framework can thus serve as a reflective tool for understanding, mapping, and assessing the theory–practice conceptualizations within AI ethics approaches to address and overcome their blind spots. Environmentalists do not appear to walk their walk as consistently as animal liberationists and anti-abortionists. Are we therefore more hypocritical? Maybe; but there's another explanation. Unlike concern for individual animals or individual fetuses, environmental concerns are holistic —air and waterpollution, species extinction, diminished ecological health and integrity. One pro-life pregnant woman may preserve the life of one unborn baby, the one in her uterus; and one animal liberationist can save the life of one animal, the one he didn't eat. But (...) one environmentalist who refuses to own and operate an automobile has no measurable effect on air pollution. Only collective, social change—universal banning of automobiles, mandatory recycling, etc.—will effectively redress environmental insults. Thus, the best way to put environmental ethics into practice is not to try to do one's bit—retire one's own car, recycle one's own waste—and leave it to every other person to do his or her bit and hope that all such individual environmental ethical acts will aggregate into significance. The best way to put environmental ethics into practice is to work to instill environmental values in society as the foundation for coercive environmental policies, regulations, and laws. The mechanistic-materialistic worldview and its associated consumerist value system trickled down into the collective consciousness via its technological manifestation in a plethora of machines. The systemic worldview in which environmental values are embedded may be communicated to the general public less by means of discursive discourse than by a new generation of systemic-electronic technologies. Pope John Paul II's opposition to the Iraq War was not that it failed to meet the conditions of Just War Theory. Indeed, we cannot tell from what he publicly said whether he thought it met those conditions or not, for he would have opposed it in any case. His thinking was rather that even just and necessary wars always come, as it were, too late, and are never able to solve the problems that made wars just and necessary. (...) In their article, van Gils Schmidt and Salloch defend the claim that physicians have a duty to protect the climate. The logic of the argument in broad terms is that (i) there is a relationship between climate change and the burden of disease, (ii) the healthcare sector is a significant emitter of global greenhouse gasses, thereby enhancing the burden of disease and (iii) since doctors are advocates of health and stakeholders in the healthcare sector, they have a duty to respond (...) to climate change. The authors recognise the ‘ethical basis for the claim of healthcare professionals having a special responsibility in climate change is far from being obvious’. The theoretical framework they choose for making this tentative link more apparent is Korsgaard’s theory of practical identities. The main argument of the authors seems to be that practical identities are pluralistic—a person can identify as a physician and environmentalist simultaneously—and the normative positions attributable to these identities may come into conflict. The fundamental issues raised by Gertrude Stein in her "radical language experiment" bear a remarkable resemblance to the problems posed by Ludwig Wittgenstein in his later philosophy of language . Wittgenstein's philosophy is an important meta-view infusing our perception of modern and postmodern literature with his contention that philosophy is concerned most centrally with the description of the use of language, his notion of language as practice. Stein was the first writer who fully incorporated the idea of universal indeterminacy (...) into her work. Carefully utilizing such stylistic devices as repetition, her exploitation of both the axis of selection and that of combination, and rejection of logical relations and formal systems, she questioned traditional notions of meaning-making. She accepted readily the vagueness of meaning inherent in language, and by molding language through associative meaning and context, she set stage for much of the writing that we now call post-modern. For Stein meaning arises not in terms of rules of interpretation, but in ways in which language is used: in the form of her composition. ;This dissertation examines ways in which exploring connections between the work of the two can refine our understanding of each in turn. In the context of a general introduction to the conceptual connections between Stein and Wittgenstein, Chapter I concludes with a presentation of the key biblio-bigraphical facts about the careers of both and rejection of any possible direct contact or influence. Chapter II focuses on the related biographical connections of Stein and conceptual connections of Wittgenstein to Pragmatism and the ways in which relations can be demonstrated between the ideas of all three. In Chapters III, IV and V, stressing intertextuality rather than indebtedness, I give close readings of the work of Stein and Wittgenstein, identifying the major contentions that they share, and showing how Stein's creative works put Wittgensteinian theories into practice. Throughout, my major concern will be to demonstrate how connections between the two writers can help to clarify our understanding of each and enable us to appreciate their mutual contributions to notions in the philosophy of language. I discuss this standard from the perspective of the sociology of knowledge and replace it by a challenge unknown to all empirical procedures relying on primary verbalizations of informants. Descriptions have to solve the problems of the voiceless, (...) the silent, the unspeakable, the pre-linguistic, and the indescribable. Ethnography puts something into words, which did not exist in language before. Sartre’s Critique of Dialectical Reason ranks with Being and Nothingness as a work of major philosophical significance, but it has been largely neglected. The first volume, published in 1960, was dismissed as a Marxist work at a time when structuralism was coming into vogue; the incomplete second volume has only recently been published in France. In this commentary on the first volume, Joseph S. Catalano restores the Critique to its deserved place among Sartre’s works and within (...) philosophical discourse as a whole. Sartre attempts one of the most needed tasks of our times, Catalano asserts—the delivery of history into the hands of the average person. Sartre’s concern in the Critique is with the historical significance of everyday life. Can we, he asks, as individuals or even collectively, direct the course of our history? A historical context for our lives is given to us at birth, but we sustain that context with even our most mundane actions—buying a newspaper, waiting in line, eating a meal. In looking at history, Sartre argues, reason can never separate the historical situation of the investigator from the investigation. Thus reason falls into a dialectic, always depending upon the past for guidance but always being reshaped by the present. Clearly showing the influence of Marx on Sartre’s thought, the Critique adds the historical dimension lacking in Being and Nothingness. In placing the Critique within the corpus of Sartre’s philosophical writings, Catalano argues that it represents a development rather than a break from Sartre’s existentialist phase. Catalano has organized his commentary to follow the Critique and has supplied clear examples and concrete expositions of the most difficult ideas. He explicates the dialogue between Marx and Sartre that is internal to the text, and he also discusses Sartre’s Search for Method, which is published separately from the Critique in English editions. Theory and Practice is a series of nine lectures that Jacques Derrida delivered at the École Normale Supérieure in 1976 and 1977. The topic of “theory and practice” was associated above all with Marxist discourse and particularly the influential interpretation of Marx by Louis Althusser. Derrida’s many questions to Althusser and other thinkers aim at unsettling the distinction between thinking and acting. Derrida’s investigations set out from Marx’s “Theses on Feuerbach,” in particular the eleventh thesis, which (...) has often been taken as a mantra for the “end of philosophy,” to be brought about by Marxist practice. Derrida argues, however, that Althusser has no such end in view and that his discourse remains resolutely philosophical, even as it promotes the theory/practice pair as primary values. We outline our central reasons for pursuing the project of equality studies and some of the thinking we have done within an equality studies framework. We try to show that a multi-dimensional conceptual framework, applied to a set of key social contexts and articulating the concerns of subordinate social groups, can be a fruitful way of putting the idea of equality into practice. Finally, we address some central questions about how to bring about egalitarian social change.

Though he uses the term "faculties" as synonymous with energies or powers, he warns against the "faculty psychology" that uses faculties as explanations or causes. Hume writes: "By will I mean nothing but the internal impression we feel.., when we knowingly give rise to any new motion of our body or new perception of our mind." A (...) voluntary action, being "knowingly" aroused, is not a mere "direct " passion arising immediately from sensation; nevertheless, it belongs to the realm of passions rather than of judgments. It is included in the "bundle of impressions" psychology. Hume attempts to explain how the passion of sympathy serves to communicate impressions. Emotional expressions require the operation of the "imagination" to generate the social controls of conscience and to explain the origin of responsibility in terms of approvals and disapprovals. In this connection, /~rdal points out the differences between Hume's and Adam Smith's psychology of sympathy, ttume is content to rely largely on "imagination" to explain social sensitivities, whereas Adam Smith develops the theory that by sympathy men are led to put themselves in the place of others and thus to get a "disinterested spectator" view of passions. This seems to me a minor difference, and Hume, though he knew of Adam Smith's theory, and though he criticized him on other points, does not directly obiect to this particular doctrine of Adam Smith. It is, in fact, related to Hume's own analysis of justice as an "artificial" virtue, not directly related to the self-regarding passions. What separates Smith from Hume is his discussion of sympathy in the context of pity and benevolence which the Scottish moralists had made basic, whereas ttume keeps sympathy as a passion distinct from the virtues. In general, I have the "impression" that Hume, after he made this elaborate effort to apply experimental method to the passions and to valuational expressions, left the further development of this psychology to his close friend, Adam Smith, while he turned to "political essays" and to the more practical problems of the Enquiry. In his political essays, which brought him into public recognition in England and on the Continent while the Treatise continued to be basic for the Scottish social psychologists, Hume became especially concerned to call attention to the social operation of "opinions" and faiths. Therefore, it seems to me to be a mistake to regard the Enquiry as merely a "popular" edition of the Treatise. Hume shifted his interest from the critique of Locke's psychology to the practical problems of politics and morals. His History deals less with the psychological "origins" of customs, beliefs, and habits, more with their power in shaping the course of events. In other words, for Hume's ideas about judgments of value and the motivation of policies and principles, one must turn to Hume's later writings. The reader of ~rdal's excellent analysis of the Treatise cannot refrain from hoping that the author will make a similar examination of Hume's later "moral science." For, in addition to clarifying Hume, it will give.Ardal an opportunity to continue his own critical insights on present-day discussion of emotivist and intuitional ethics, which are not the least valuable feature of this volume. POPKIN THE THEORY that the revival of ancient scepticism, and the application of its arguments to the controversies of the sixteenth century, played a vital role in the development of modern philosophy was first suggested by me almost forty years ago. A three-part article in the Review of Metaphysics entided "The Sceptical Crisis and the Rise of Modern (...) Philosophy" contained much of the theory.' There were practically no articles about or studies of scepticism as a philosophical attitude or activity in modern philosophy before we went to work. The American philosopher Roderick Chisholm had written an article on Sextus and modern empiricism, and that was about it.6 When I took my first course in the history of philosophy with John Herman Randall, I frankly could not make much out of Plato or Aristotle, but when we were assigned to read Sextus Empiricus, I found an author who made sense. Later in the course I was introduced to Hume, whom Randall hated, and I loved. In a course with Paul Oskar Kristeller a few years later, on Hellenistic philosophy, Sextus appeared as a serious figure. A couple of years after that, in a seminar with Charles Hendel on Hume, I wrote a paper on Sextus and Hume. I showed it to Kristeller, who said drily and carefully that it might be worth looking into whether Hume had read Sextus, and whether there was a prior tradition of scepticism in European philosophy. Thus was I set off on the quest. Schmitt and I not only offered a lot of evidence previously ignored or unknown about the recovery of sceptical texts and their use in the philosophical discussions of the sixteenth and early seventeenth centuries, but we also offered a new paradigm, a new way of conceiving what problems were being agitated, a new way of understanding the kinds of answers being given as ways of resolving the sceptical crisis. In this paper, I discuss the discovery of the DNA structure by Francis Crick and James Watson, which has provoked a large historical literature but has yet not found entry into philosophical debates. I want to redress this imbalance. In contrast to the available historical literature, a strong emphasis will be placed upon analysing the roles played by theory, model, and evidence and the relationship between them. In particular, I am going to discuss not only Crick and Watson's (...) well-known model and Franklin's x-ray diffraction pictures (the evidence) but also the less well known theory of helical diffraction, which was absolutely crucial to Crick and Watson's discovery. The insights into this groundbreaking historical episode will have consequences for the ‘new’ received view of scientific models and their function and relationship to theory and world. The received view, dominated by works by Cartwright and Morgan and Morrison ([1999]), rather than trying to put forth a ‘theory of models’, is interested in questions to do with (i) the function of models in scientific practice and (ii) the construction of models. In regard to (i), the received view locates the model (as an idealized, simplified version of the real system under investigation) between theory and the world and sees the model as allowing the application of the former to the latter. As to (ii) Cartwright has argued for a phenomenologically driven view and Morgan and Morrison ([1999]) for the ‘autonomy’ of models in the construction process: models are determined neither by theory nor by the world. The present case study of the discovery of the DNA structure strongly challenges both (i) and (ii). In contrast to claim (i) of the received view, it was not Crick and Watson's model but rather the helical diffraction theory which served a mediating purpose between the model and the x-ray diffraction pictures. In particular, Cartwright's take on (ii) is refuted by a comparison of Franklin's bottom-up approach with Crick and Watson's top-down approach in constructing the model. The former led to difficulties, which only a strong confidence in the structure incorporated in the model could circumvent. There has been a long-standing interest in the putative roles that various so-called ‘theory of mind’ abilities might play in enabling us to understand and enjoy narratives. Of late, as our understanding of the complexity and diversity of everyday psychological capacities has become more nuanced and variegated, new possibilities have been articulated: (i) that our capacity for a sophisticated, everyday understanding of actions in terms of reason (our folk psychology) may itself be best characterized as a kind of narrative (...) practice and (ii) that acquiring the capacity for supplying and digesting reasons explana- tions might (at least normally) depend upon having a special training with narratives. This introductory paper to the volume situates the claims of those who support the narrative approach to folk psychology against the backdrop of some traditional and new thinking about intersubjectivity, social cognition and ‘theory of mind’ abilities. Special emphasis is laid on the different reasons for being interested in these claims about narrative practice and folk psychology in light of various empirical and philosophical agendas. (shrink)

In this paper based on original fieldwork, I seek to contribute to critical scholarship in international law by providing an investigation into the engagement with international law by actors in civil society working against son preference primarily in Tirupati, India. I suggest that the turn to the international legal order by civic actors should be theorized as something else than as merely coming ‘from above’, ‘from below’ or as a ‘translation’ of ‘global’ law to ‘local’ conditions. Instead, I propose (...) that the mobilization of international law within Tirupati’s civil society should be seen as an emancipatory undertaking, an act of resistance with the overarching ambition to reclaim the zenana. In that, I argue, the strategies within Tirupati’s civil society are more appropriately understood as critical international law put into practice. (shrink)

In this commentary on the first volume, Joseph S. Catalano restores the Critique to its deserved place among Sartre’s works and within (...) philosophical discourse as a whole. Sartre attempts one of the most needed tasks of our times, Catalano asserts—the delivery of history into the hands of the average person. Sartre’s concern in the Critique is with the historical significance of everyday life. Can we, he asks, as individuals or even collectively, direct the course of our history? A historical context for our lives is given to us at birth, but we sustain that context with even our most mundane actions—buying a newspaper, waiting in line, eating a meal. In looking at history, Sartre argues, reason can never separate the historical situation of the investigator from the investigation. Thus reason falls into a dialectic, always depending upon the past for guidance but always being reshaped by the present. Clearly showing the influence of Marx on Sartre’s thought, the Critique adds the historical dimension lacking in Being and Nothingness. In placing the Critique within the corpus of Sartre’s philosophical writings, Catalano argues that it represents a development rather than a break from Sartre’s existentialist phase. Catalano has organized his commentary to follow the Critique and has supplied clear examples and concrete expositions of the most difficult ideas. He explicates the dialogue between Marx and Sartre that is internal to the text, and he also discusses Sartre’s Search for Method, which is published separately from the Critique in English editions. In lieu of an abstract, here is a brief excerpt of the content:BOOK REVIEWS 373 in the analysis of the "artificial" virtue of justice. Though he uses the term "faculties" as synonymous with energies or powers, he warns against the "faculty psychology" that uses faculties as explanations or causes. Hume writes: "By will I mean nothing but the internal impression we feel.., when we knowingly give rise to any new motion of our body or new perception of our mind." A (...) voluntary action, being "knowingly" aroused, is not a mere "direct " passion arising immediately from sensation; nevertheless, it belongs to the realm of passions rather than of judgments. It is included in the "bundle of impressions" psychology. Hume attempts to explain how the passion of sympathy serves to communicate impressions. Emotional expressions require the operation of the "imagination" to generate the social controls of conscience and to explain the origin of responsibility in terms of approvals and disapprovals. In this connection, /~rdal points out the differences between Hume's and Adam Smith's psychology of sympathy, ttume is content to rely largely on "imagination" to explain social sensitivities, whereas Adam Smith develops the theory that by sympathy men are led to put themselves in the place of others and thus to get a "disinterested spectator" view of passions. This seems to me a minor difference, and Hume, though he knew of Adam Smith's theory, and though he criticized him on other points, does not directly obiect to this particular doctrine of Adam Smith. It is, in fact, related to Hume's own analysis of justice as an "artificial" virtue, not directly related to the self-regarding passions. What separates Smith from Hume is his discussion of sympathy in the context of pity and benevolence which the Scottish moralists had made basic, whereas ttume keeps sympathy as a passion distinct from the virtues. In general, I have the "impression" that Hume, after he made this elaborate effort to apply experimental method to the passions and to valuational expressions, left the further development of this psychology to his close friend, Adam Smith, while he turned to "political essays" and to the more practical problems of the Enquiry. In his political essays, which brought him into public recognition in England and on the Continent while the Treatise continued to be basic for the Scottish social psychologists, Hume became especially concerned to call attention to the social operation of "opinions" and faiths. Therefore, it seems to me to be a mistake to regard the Enquiry as merely a "popular" edition of the Treatise. Hume shifted his interest from the critique of Locke's psychology to the practical problems of politics and morals. His History deals less with the psychological "origins" of customs, beliefs, and habits, more with their power in shaping the course of events. In other words, for Hume's ideas about judgments of value and the motivation of policies and principles, one must turn to Hume's later writings. The reader of ~rdal's excellent analysis of the Treatise cannot refrain from hoping that the author will make a similar examination of Hume's later "moral science." For, in addition to clarifying Hume, it will give.Ardal an opportunity to continue his own critical insights on present-day discussion of emotivist and intuitional ethics, which are not the least valuable feature of this volume. Surely it is not because he lacks the credentials of a serious thinker; the Second Discourse alone, not to mention the Emile and Social Contract, would presumably ensure Rousseau's place in any historical survey of Western... Error is a neglected epistemological category in the history of science. This neglect has been driven by the commonsense idea that its elimination is a general good, which often renders it invisible or at least not worth noticing. At the end of the sixteenth century across Europe, medicine increasingly focused on “popular errors,” a genre where learned doctors addressed potential patients to disperse false belief about treatments. By the mid-seventeenth century, investigations into popular error informed the working methodology of (...) natural philosophers, rather than just physicians. In 1646, Thomas Browne published Pseudodoxia Epidemica, a large volume on popular error. Despite Browne’s formal training as a physician, this work examined only a few medical errors and instead aspired to be an encyclopedia of error. Pseudodoxia Epidemica was highly popular, running to six editions, and was known by the Fellows of the Royal Society. Influenced by Browne, alongside Bacon’s theory of the idols, natural philosophic practice in the late sixteenth and seventeenth century developed a focus on error that revised traditional attention to the discovery of knowledge. Fellows such as Robert Boyle and Robert Hooke proposed new ways to secure truth under the far-reaching influence of Bacon’s refutations of “natural human reason” distorted by false idols, of syllogistic logic, and of “theories,” his label for traditional philosophical systems that bias thought toward falsity. In three parts, this article traces the progression in early modern scientific approaches to handling error, and especially medical error – from physicians’ efforts to identify and eradicate it through collaborative effort, to the striking tension in Browne’s work between seeking to eliminate error while also showing a marked tolerance for it, to the Royal Society’s Baconian objective of instrumentalizing error to find truth. Error emerges as its own epistemic category that serves as a driving force toward knowledge production. (shrink)

I would like to suggest another way to go further toward a new economy of power relations, a way which is more empirical, more directly related to our present situation, and which implies more relations between theory and practice. It consists of taking the forms of resistance against different forms of power as a starting point. To use another metaphor, t consists of using this resistance as a chemical catalyst so as to bring to light power relations, locate (...) their position, and find out their point of application and the methods used. Rather than analyzing power from the point of view of its internal rationality, it consists of analyzing power relations through the antagonism of strategies.[…]Let us come back to the definition of the exercise of power as a way in which certain actions may structure the field of other possible actions. What, therefore, would be proper to a relationship of power is that it be a mode of action upon actions. That is to say, power relations are rooted deep in the social nexus, not reconstituted "above" society as a supplementary structure whose radical effacement one could perhaps dream of. In any case, to live in a society is to live in such a way that action upon other actions is possible-- and in fact ongoing. A society without power relations can only be an abstraction. Which, be it said in passing, makes all the more politically necessary the analysis of power relations in a given society, their historical formation, the source of their strength or fragility, the conditions which are necessary to transform some or to abolish others. For to say that there cannot be a society without power relations is not to say either that those which are established are necessary or, in any case, that power constitutes a fatality at the heart of societies, such that it cannot be undermined. Instead, I would say that the analysis, elaboration, and bringing into question of power relations and the "agonism" between power relations and the instransitivity of freedom is a permanent political task inherent in all social existence.[…]In effect, between a relationship of power and a strategy of struggle there is a reciprocal appeal, a perpetual linking and a perpetual reversal. At every moment the relationship of power may become a confrontation between two adversaries. Equally, the relationship between adversaries in society may, at every moment, give place to the putting into operation of mechanisms of power. The consequence of this instability is the ability to decipher the same events and the same transformations either from inside the history of struggle or from the standpoint of the power relationships. The interpretations which result will not consist of the same elements of meaning or the same links or the same types of intelligibility, although they refer to the same historical fabric, and each of the two analyses must have reference to the other. In fact, it is precisely the disparities between the two readings which make visible those fundamental phenomena of "domination" which are present in a large number of human societies.Michel Foucault has been teaching at the Collège de France since 1970. This book presents the current state of the art regarding the application of logical tools to the problems of theory and practice of lawmaking. It shows how contemporary logic may be useful in the analysis of legislation, legislative drafting and legal reasoning concerning different contexts of lawmaking. Elaborations of the process of lawmaking have variously emphasised its political, social or economic aspects. Yet despite strong interest in logical analyses of law, questions remains about the role of logical tools (...) in lawmaking. This volume attempts to bridge that gap, or at least to narrow it, drawing together some important research problems-and some possible solutions-as seen through the work of leading contemporary academics. The volume encompasses 20 chapters written by authors from 16 countries and it presents diversified views on the understanding of logic (from strict mathematical approaches to the informal, argumentative ones) and differentiated choices concerning the aspects of lawmaking taken into account. The book presents a broad set of perspectives, insights and results into the emerging field of research devoted to the logical analysis of the area of creation of law. How does logic inform lawmaking? Are legal systems consistent and complete? How can legal rules be represented by means of formal calculi and visualization techniques? This collection contains studies on justice, juridical reasoning and argumenta tion which contributed to my ideas on the new rhetoric. My reflections on justice, from 1944 to the present day, have given rise to various studies. The ftrst of these was published in English as The Idea of Justice and the Problem of Argument. The others, of which several are out of print or have never previously been published, are reunited in the present volume. As justice is, for me, (...) the prime example of a "confused notion", of a notion which, like many philosophical concepts, cannot be reduced to clarity without being distorted, one cannot treat it without recourse to the methods of reasoning analyzed by the new rhetoric. In actuality, these methods have long been put into practice by jurists. Legal reasoning is fertile ground for the study of argumentation: it is to the new rhetoric what mathematics is to formal logic and to the theory of demonstrative proof. It is important, then, that philosophers should not limit their methodologi cal studies to mathematics and the natural sciences. They must not neglect law in the search for practical reason.
