Der Gottinger Philosoph, Politiker und Padagoge Leonard Nelson (1882-1927) entwickelte eine umfassende integrale Theorie, die sich von der philosophischen Grundlegung uber eine Gesellschaftsanalyse bis zu einer politischen Programmatik hin erstreckte.Mit diesem Werk liegt eine erste umfassende, auf neuen Quellen basierende kritische Gesamtdarstellung der politischen Theorie Nelsons vor. Neben der Darstellung der Biographie Nelsons entwickelt der Autor dessen neukantianische Philosophie. In der Gesellschaftstheorie wird die Auseinandersetzung mit Liberalismus, Sozialismus und Kommunismus deutlich.Die Monographie basiert auf ausfuhrlichen Quellenstudien und bezieht eine kritische analysierende (...) Some health-care professionals refuse to perform certain services because doing so would violate their conscientiously held beliefs. Arguments for and against their accommodation claims continue both in the public square and in the courts, as well as in bioethics. This chapter introduces this debate by discussing jurisdictions in which accommodation is granted. We offer evidence of the detrimental effects it has on access to health-care services. An overview of influential ethical arguments for and against conscientious objection accommodation, including but not (...) limited to the incompatibility thesis and the moral integrity defense, is presented. We conclude with a discussion of arguments based on the values of diversity and equality of opportunity. (shrink)

This paper makes a conceptual inquiry into the notion of ‘publics’, and forwards an understanding of this notion that allows more responsible forms of decision-making with regards to technologies that have localized impacts, such as wind parks, hydrogen stations or flood barriers. The outcome of this inquiry is that the acceptability of a decision is to be assessed by a plurality of ‘publics’, including that of a local community. Even though a plurality of ‘publics’ might create competing normative demands, its (...) acknowledgment is necessary to withstand the monopolization of the process of technology appraisal. The paper presents four ways in which such an appropriation of publicness takes place. The creation of dedicated ‘local publics’, in contrast, helps to overcome these problems and allows for more responsible forms of decision-making. We describe ‘local publics’ as those in which stakeholders from the different publics that are related to the process of technology implementation are brought together, and in which concerns and issues from these publics are deliberated upon. Emotions are often met with suspicion in political debates about risky technologies, because they are seen as contrary to rational decision making. However, recent emotion research rejects such a dichotomous view of reason and emotion, by seeing emotions as an important source of moral insight. Moral emotions such as compassion and feelings of responsibility and justice can play an important role in judging ethical aspects of technological risks, such as justice, fairness, and autonomy. This article discusses how this idea can (...) be integrated into approaches for political decision making about risk. The article starts with an analysis of the dichotomous view of reason and emotion in risk theory, in approaches to participatory risk assessment as well as in relevant approaches to political philosophy. This article then presents alternative approaches in political philosophy and political theory that do explicitly endorse the importance of emotions. Based on these insights, a procedural approach for policy making is presented, in which emotional responses to technological risks, and the ethical concerns that lie behind them, are taken seriously. This approach allows for morally better political decisions about risky technologies and a better understanding between experts and laypeople. (shrink)

Despite the opening of the market and partial privatization of state‐owned companies in China, the state still represents the controlling shareholder in larger companies. By analyzing the weaknesses of Chinese corporate governance we illustrate the framework for harmful corruption. China is characterized by a weak legal system and strong influences of traditions such as guanxi. In this article we analyze the influence of guanxi on the Chinese corporate governance system. We find that guanxi is in general a double‐edged sword, but (...) business‐to‐government guanxi in particular can harm the weak Chinese corporate governance system and hamper its further economic development and growth. Knowing that technologies are inherently value-laden and systemically interwoven with society, the question is how individual engineers can take up the challenge of accepting the responsibility for their work? This paper will argue that engineers have no institutional structure at the level of society that allows them to recognize, reflect upon, and actively integrate the value-laden character of their designs. Instead, engineers have to tap on the different institutional realms of market, science, and state, making their work a ‘hybrid’ activity (...) combining elements from the different institutional realms. To deal with this institutional hybridity, engineers develop routines and heuristics in their professional network, which do not allow societal values to be expressed in a satisfactory manner. To allow forms of ‘active’ responsibility, there have to be so-called ‘accountability forums’ that guide moral reflections of individual actors. The paper will subsequently look at the methodologies of value-sensitive design and constructive technology assessment and explore whether and how these methodologies allow engineers to integrate societal values into the design technological artifacts and systems. As VSD and CTA are methodologies that look at the process of technological design, whereas the focus of this paper is on the designer, they can only be used indirectly, namely as frameworks which help to identify the contours of a framework for active responsibility of engineers. In der sog. »aristotelischen Zeitaporie« (Physik IV) äußert sich Aristoteles zum Verhältnis von Zeit und Seele. Dieser Text gehört zu den umstrittensten Abschnitten seines Zeittraktates. Zur Interpretation rekonstruiert die vorgelegte Untersuchung die Entwicklungslinien der Analysen zur Zeitaporie von der Spätantike über die arabische Philosophie bis zur Frühphase der lateinischen Aristoteleskommentierung im 13. Jahrhundert. Der erste Abschnitt zeigt, wie die antike Physik-Kommentatoren diesen Text erklärten. Im Zentrum steht dabei die Auslegung des Alexander von Aphrodisias. Den der Spätantike diskutierten die Araber. Ein (...) zweite Abschnitt stellt daher die Analysen der arabischen Zeitphilosophie vor. Vermittelt durch lateinische Übersetzungen, beeinflussen arabische und jüdische Theoretiker die Zeitphilosophie des 13. Jahrhunderts. Die Geschichte des sukzessiven Vordringens der Konzeption des Averroes in die Auslegung der Zeitaporie im 13. Jahrhundert expliziert daher ein dritter Teil. Erst die Philosophen dieser Zeit konnten die These des Aristoteles zum Verhältnis von Zeit und Seele mit der Konzeption des Augustinus vergleichen. This volume illuminates ways in which Jerusalem was represented in Western Europe during the Middle Ages, c. 700-1500. Focusing on maps and plans in manuscripts and early printed books, it also considers views and architectural replicas.

This chapter focuses on two closely related diagrammatic maps of Jerusalem and the Holy Land in two thirteenth-century manuscripts now in Brussels and London. On the basis of a comparison between the maps and their transmission contexts it is argued that the maps served as didactic tools, aiding the study of biblical history. The layout of the maps is analysed in relation to wider developments in Western medieval manuscript production and learning during the second half of the twelfth and first (...) half of the thirteenth centuries, particularly in relation to the emphasis on a more systematic and rigorous structuring of knowledge. The manuscripts are seen as indicative of how topographical information concerning the Holy Land was put to use in biblical study, and of how scholasticism could have influenced the ways in which Jerusalem was represented and perceived. Clinical trials in emergency situations present unique challenges, because they involve enrolling individuals who lack capacity to consent in the context of acute illness or injury. The US Department of Health and Human Services and Food and Drug Administration regulations allowing an Exception from Informed Consent in these circumstances contain requirements for community consultation, public disclosure and restrictions on study risks and benefits. In this paper, we analyse an issue raised in the regulations that has received little attention or analysis (...) but is ethically complex. This challenge is when to solicit and honour objections to EFIC trial enrolment, including from non-legally appointed representatives. We address novel questions involving whose objections should be honoured, what level of understanding is necessary for objections to be considered valid and how hard investigators should work to offer an opportunity to object. We present a set of criteria that provide conceptual and practical guidance. We argue that objections should be honoured if they undermine one of the key assumptions that allows for the permissibility of EFIC trials: that individuals would likely not object to enrolment based on their values or preferences. We then clarify the practical implications of this approach through examination of three cases of refusal in an EFIC study. (shrink)

We argue that, in certain circumstances, doctors might beprofessionallyjustified to provide abortions even in those jurisdictions where abortion is illegal. That it is at least professionally permissible does not mean that they have an all-things-considered ethical justification or obligation to provide illegal abortions or that professional obligations or professional permissibility trump legal obligations. It rather means that professional organisations should respect and indeed protect doctors’ positive claims of conscience to provide abortions if they plausibly track what is in the best (...) medical interests of their patients. It is the responsibility of state authorities to enforce the law, but it is the responsibility of professional organisations to uphold the highest standards of medical ethics, even when they conflict with the law. Whatever the legal sanctions in place, healthcare professionals should not be sanctioned by the professional bodies for providing abortions according to professional standards, even if illegally. Indeed, professional organisation should lobby to offer protection to such professionals. Our arguments have practical implications for what healthcare professionals and healthcare professional organisations may or should do in those jurisdictions that legally prohibit abortion, such as some US States after the reversal ofRoe v Wade. The question of whether problems with the social determinants of health that might impact decision-making justify denying eligibility for assisted dying has recently come to the fore in debates about the legalisation of assisted dying. For example, it was central to critiques of the 2021 amendments made to Canada’s assisted dying law. The question of whether changes to a country’s assisted dying legislation lead to descents down slippery slopes has also come to the fore—as it does any time a jurisdiction (...) changes its laws. We explore these two questions through the lens of Canada’s experience both to inform Canada’s ongoing discussions and because other countries will confront the same questions if they contemplate changing their assisted dying law. Canada’s Medical Assistance in Dying law has evolved through a journey from the courts to Parliament, back to the courts, and then back to Parliament. Along this journey the eligibility criteria, the procedural safeguards, and the monitoring regime have changed. In this article, we focus on the eligibility criteria. First, we explain the evolution of the law and what the eligibility criteria were at the various stops along the way. We then explore the ethical justifications for Canada’s new criteria by looking at two elements of the often-corrosive debate. First, we ask whether problems with the social determinants of health that might impact decision-making justify denying eligibility for assisted dying of decisionally capable people with mental illnesses and people with disabilities as their sole underlying medical conditions. Second, we ask whether Canada’s journey supports slippery slope arguments against permitting assisted dying. All data relevant to the study are included in the article. (shrink)

This article provides an analysis of moral emotions from an attributional point of view, guided by the metaphors of man as a naïve scientist (Heider, 1958) and as a moral judge (Weiner, 2006). The theoretical analysis focuses on three concepts: (a) The distinction between the actor and the observer, (b) the functional quality of moral emotions, and (c) the perceived controllability of the causes of events. Moral emotions are identified (admiration, anger, awe, contempt, disgust, elevation, embarrassment, envy, gratitude, guilt, indignation, (...) jealousy, pity, pride, rage, regret, remorse, resentment, respect, schadenfreude, scorn, shame, and sympathy). A classification of these moral emotions is suggested and the empirical evidence briefly summarized. In discussing our results, we identify unresolved issues awaiting further analyses and research. New network technologies are framed as eliminating ‘transaction costs’, a notion first developed in economic theory that now drives the design of market systems. However, the actual promise of the elimination of transaction costs seems unfeasible, because of a cyclical pattern in which network technologies that make that promise create processes of institutionalization that create new forms transaction costs. Nonetheless, the promises legitimize the exemption of innovations of network technologies from critical scrutiny.

The way pollution is managed in Western countries is based on the preservation of the taboo character of waste, which is conceived to be privately produced and seen as a threat to public health. Public authorities have been given the responsibility to isolate waste and hide it from public eyes. However, this dominant approach is challenged by the emergence of new forms of pollution. New conceptual and policy frameworks to manage environmental degradation have to be developed. The prevailing institutional structures, (...) however, obstruct the successful societal uptake of alternative frameworks. (shrink)

The COVID-19 pandemic brought about at least two normative challenges on unprecedented scale for liberal democracies. One concerned prioritization decisions when health care resources were constrained. The other, which arguably led to lasting damage to social cohesion and citizens’ trust in government and government public health institutions, concerned policies introduced with the aim of reducing the spread of SARS-CoV2, some of which turned out to be mistaken. I discuss in this essay a few examples of misguided, liberty-limiting public health policies (...) and describe how public health and public health ethics principlism provided cover for such policies. Citizens had reasons to be concerned about the duration of such liberty-infringing policies, the absence of predictable government policies, and the absence of transparent justifications for the policies that were implemented. This paper examines the intrinsic relation between institutions and social justice. Its starting point is that processes of institutionalization invoke societal groups to articulate justice demands which, in their turn, give rise to processes of institutional redesign. In liberal democracies, demands for justice are articulated as a pursuit for emancipation and empowerment of groups that feel excluded by dominant categorizations. The imminent presence of this twin pursuit for justice can be explained by the conceptual inconsistencies that characterize the distinction between (...) the public and private sphere. These inconsistencies also explain why demands for emancipation and empowerment are intrinsically ambiguous and inconsistent. In order to reconsider the question how institutions are to be adapted to allow for social justice while acknowledging the plurality, ambiguity and volatility of justice demands, the paper will propose an empirical and normative research agenda. Apoptosis is a physiological mechanism for the removal of unwanted or damaged cells. Apoptotic cells are rarely seen in living tissues, however, because of their rapid and efficient removal by phagocytosis. Phagocytotic cells such as macrophages or dendritic cells recognize apoptotic cells by specific changes of cell surface markers, which usually are not present on normal cells. One such event is the exposure of phosphatidylserine, which moves from the plasma membrane inner leaflet to the outer leaflet in preapoptotic cells. An (...) unresolved problem, however, was the nature of the phosphatidylserine receptor on the phagocytotic cells. In a recent issue of Nature, Fadok et al.(1) have reported the cloning of a phosphatidylserine receptor using an antibody raised against activated macrophages.
