Samantha Besson sees the relationship between moral and legal human rights as one of mutuality.: “legal rights recognize, modify or even create moral rights“, and vice versa. She thus appears to ascribe agency to legal rights, or “the law“, and to moral rights, or morality. This ascription can only be understood as metaphorical: abstract concepts have no agency. Replacing the abstract concepts by human beings, “the law“ and morality must be understood as the respective norm-givers. This reveals what is hidden (...) by the metaphorical account: the supposed mutuality is no automatism but depends on the autonomous decision of human beings who are likely to be influenced by extant legal or moral norms, respectively, and/or by the values represented in those norms. The supposed mutuality should thus be seen rather as the result of the sociological influence exercised by extant norms, or the values they represent, on human norm-givers. (shrink)

Calls to hold artificial intelligence to account are intensifying. Activists and researchers alike warn of an “accountability gap” or even a “crisis of accountability” in AI. Meanwhile, several prominent scholars maintain that accountability holds the key to governing AI. But usage of the term varies widely in discussions of AI ethics and governance. This chapter begins by disambiguating some different senses and dimensions of accountability, distinguishing it from neighboring concepts, and identifying sources of confusion. It proceeds to explore the idea (...) that AI operates within an accountability gap arising from technical features of AI as well as the social context in which it is deployed. The chapter also evaluates various proposals for closing this gap. I conclude that the role of accountability in AI ethics and governance is vital but also more limited than some suggest. Accountability’s primary job description is to verify compliance with substantive normative principles—once those principles are settled. Theories of accountability cannot ultimately tell us what substantive standards to account for, especially when norms are contested or still emerging. Nonetheless, formal mechanisms of accountability provide a way of diagnosing and discouraging egregious wrongdoing even in the absence of normative agreement. Providing accounts can also be an important first step toward the development of more comprehensive regulatory standards for AI. (shrink)

The adoption of the French Duty of Vigilance law has been celebrated as a milestone for advancing the transnational business and human rights regime. The law can contribute to harden corporate accountability by challenging the “separation principle” of transnational companies and by obligating companies to report on their duty of vigilance. However, the question of whether the law actually contributes to human rights and environmental protection along global supply chains requires empirically grounded research that connects processes in home and host (...) state countries. This paper contributes to such a new research agenda by linking political ecology literature and empirical insights from the Global South to research on due diligence regulations. With reference to field research data on contestations between the oil and gas company Total E&P and indigenous communities in Bolivia, I argue that the burden of proof and contestations over valid knowledge represent major obstacles when trying to establish legal liability. Often this takes the form of an appeal to the so-called Argument from Evil: if God were to exist, then he would not permit as much suffering in the world as there actually is. Hence the fact that there is so much suffering constitutes evidence for God's non-existence. In this essay I propose a variation which I shall call ‘The Argument from Non-belief’. Its basic idea is that if God were to exist, (...) then he would not permit as much non-belief in the world as there actually is. Eli Hirsch has argued in many places that non-commonsensical ontological claims just couldn't be true, since there is strong metasemantic pressure to charitably interpret natural language---correct interpretations must, unless all else is highly unequal, count a sentence (especially a perceptual sentence) as true if ordinary speakers regard it as being obviously true. In previous work I replied that ontologists can stipulatively introduce a new language, "Ontologese", that is exempt from this pressure toward charity. Traditional debate on the metaphysics of gender has been a contrast of essentialist and social-constructionist positions. The standard reaction to this opposition is that neither position alone has the theoretical resources required to satisfy an equitable politics. This has caused a number of theorists to suggest ways in which gender is unified on the basis of social rather than biological characteristics but is “real” or “objective” nonetheless – a position I term social objectivism. This essay begins by making explicit the (...) motivations for, and central assumptions of, social objectivism. I then propose that gender is better understood as a real kind with a historical essence, analogous to the biologist’s claim that species are historical entities. I argue that this proposal achieves a better solution to the problems that motivate social objectivism. Moreover, the account is consistent with a post-positivist understanding of the classificatory practices employed within the natural and social sciences. (shrink)

A certain conception of Hell is inconsistent with God's traditional attributes. My argument is novel in focusing on considerations involving vagueness. God is in charge of the selection procedure, so the selection procedure must be just; any just procedure will have borderline cases; but according to the traditional conception, the afterlife is binary and has no borderline cases.

The article, as part of a broader reflection on the criticism of the right to development and its impact on the modes of legal and political subjectivation of children and adolescents, questions the child's condition as a subject without speech, or a speech conditioned to criteria of maturation, dictated by the adult referential, in a field, moreover, limited to what is said to be pertinent to their manifestation. Guided by the thought of exteriority, we return to the Foucauldian debate on (...) the relation between truth and justice, in light of the monstrous unspeakability of legal and judicial practices and the ubuesco of state power. We will analyze, through the contributions of classic cynicism, supported by Foucault, and Sloterdijk, Nieheus-Pröbsting, the resistant practices - beyond language – available to children and adolescents, and rethink these power struggles in the context of human rights and the possibility of justice, through the thought of Derrida, Rancière, Butler and Foucault. Our text will develop along the following axes of analysis: 1. Contextualizing the Foucaultian debate on truth and justice and the place of the “sayable”; 2. Considering the sayability at the heart of law, childhood and monstrosity; 3. Framing the struggle between ubuesco power and cynic resistance, and 4. Speculating on our notions of “child” and the possibility of justice. (shrink)

According to four dimensionalism, the material world is divided into momentary stages. In a four-dimensional world, which objects are the ordinary things, the things we normally name and quantify over? Aggregates of stages, according to most four-dimensionalists, but according to stage theorists (or exdurantists), ordinary objects are instead to be identified with the stages themselves. (A temporal counterpart theoretic account of de re temporal predication is then given.) This paper argues that a stage theorist is best positioned to accept David (...) Lewis's argument from temporary intrinsics for four-dimensionalism, since stage theorists are the only four-dimensionalists who attribute monadic temporary intrinsic properties to ordinary things. As a critical rationalist, using the methods of science, Watkins hopes to construct a world-view which challenges competing hypotheses and supports his own. He (...) recognizes that his view is, also, a candidate for critical rejection. All scientific views are, in principle, fallible. He divides his book into two parts: Naturalism and Freedom. [End Page 137]In evolutionary development, he accepts, as critically established, the sequence: matter before life, life before mind, and, no mind without a brain. Thus, naturalism is preferred beforesupernaturalism or divine intervention. These guides may support a continuous, steady evolutionaryprocess or discontinuity, mutations, and various stages of change. Darwin acceptedthe former and held physical changes were unaffected by consciousness. All change is, in principle,present from the beginning and unfolds over time. Darwin's view, then, is deterministic.Watkins challenges this position and argues for consciousness affecting physical change in new and unpredictable ways. It is herein that the possibility of animal and human freedom lies. Watkins gives examples of the actions of the hunter and hunted among animals, and of strategies developed by humans during crises, to support the view that there are novel and unpredictable actions by conscious beings. These actions can hardly be called predetermined in the nature of things. There is a huge difference between a general genetic structure for kinds of behavior and specific actions during crises (not that these are the only instances of freedom). He gives brief, but penetrating, analyses of Hobbes, Descartes, Hume, Kant, Schopenhauer, and Spinoza. Either they account for human action in strictly physical terms that are causally deterministic or they turn to non-empirical sources that are not verifiable. Since the latter make no difference in our account of behavior, they are entities multiplied beyond necessity. Those who give a completely deterministic view—Hobbes, Hume, and Schopenhauer—offer no continuum between cause and chance. Chance turns out to depend upon our ignorance of causes; further examination would show it causally determined.Watkins seems most sympathetic to Spinoza's treatment. In his hard-headed naturalism, Spinoza rejects any non-natural or supernatural accounts of human behavior. He is a strict determinist where man's confrontation with nature is concerned. Human emotions are passive and react to our environment; they do not affect it. Human reason makes no difference, but in its capacity to contemplate eternal truths it offers a way out. Instead of reacting to nature, man may transcend it. This transcendence is the key to Spinoza's view of the intellectual love of God, and human freedom. Watkins criticizes this flight from man's place in nature and the limited use of reason. In this vein, Spinoza seems to abandon the confrontation of nature for a flight to eternal truths. For Watkins, however, reasons must be used in confronting nature. As we saw, he claims that reason may have an effect upon the environment that is novel and unpredictable. Human agency is a part of the evolutionary story. Human agency is not an either/or proposition. There are degrees of effectiveness in human response to nature.In his analysis of human freedom, Watkins turns to the works of Newton, Faraday, Einstein, and others. In studying the problems posed by the consideration of natural phenomena during their time, they showed intellectual perspicacity of the highest order. Faraday's unified field theory brought electrical and magnetic phenomena, previously thought to be disparate, together. Newton's laws of motion brought celestial and terrestrial mechanics under one theory. Einstein changed the way in which space, time, mass, energy, and light were conceived. Chinese and Greco-Roman ethics present highly articulate views on how one should live; both of these traditions remain influential in modern philosophy. The question arises how these traditions can be compared with one another. Comparative ethics is a relatively young discipline; this volume is a major contribution to the field. Fundamental questions about the nature of comparing ethics are treated in two introductory chapters, and core issues in each of the traditions are addressed: harmony, virtue, friendship, knowledge, the relation of (...) ethics to morality, relativism, emotions, being and unity, simplicity and complexity, and prediction. In "Sider on Existence" (Noužs, 2007), David Liebesman and Matti Eklund argue that my "indeterminacy argument", according to which quantifiers are never vague, clashes with my "naturalness argument", according to which quantifiers "carve at the joints". There is, I argue, no outright inconsistency. But Liebesman and Eklund have shown that my arguments are not as independent as it may have appeared. The best defense of the indeterminacy argument is via the naturalness argument.

The kinds of real or natural kinds that support explanation and prediction in the social sciences are difficult to identify and track because they change through time, intersect with one another, and they do not always exhibit their properties when one encounters them. As a result, conceptual practices directed at these kinds will often refer in ways that are partial, equivocal, or redundant. To improve this epistemic situation, it is important to employ open-ended classificatory concepts, to understand when different research (...) programs are tracking the same real kind, and to maintain an ongoing commitment to interact causally with real kinds to focus reference on those kinds. A tempting view of these non-idealized epistemic conditions should be avoided: that they signal an ontological structure of the social world so plentiful that it would permit ameliorated classificatory schemes to achieve their normative aims regardless of whether they defer to real-kind classificatory schemes. To ground these discussions, the essay appeals to an overlooked convergence in the systematic naturalistic frameworks of Richard Boyd and Ruth Millikan. (shrink)

This article discusses the importance of social interaction for the development of the representations for symbolic communication. We suggest that there is no need to distinguish between different representational systems emerging at different stages of development. Instead, we propose that representations are rich right from the beginning of a child’s life, and that they are driven mainly by acting and interacting in the physical and social world. The more variety in a child’s interactional experience, the more enriched and abstracted the (...) representations become. We review literature providing evidence for the ways in which infants’ development toward symbolic communication benefits from repeated social action and consider some implications for computational approaches.
