SUMMARYCharles Howard Ellis, born in Sydney in 1895 and a Great War veteran, was working as a journalist in Vienna and Geneva when he wrote one of the most comprehensive books of the time on the League: The Origin, Structure and Working of the League of Nations. Dedicated to the progressive literary figures of the era and showing a particular debt to the writings of the British Labour left, Ellis argued that the internationalism of the age marked a necessary rejection (...) of the anarchic conditions that brought forth the Great War. The League and its associated institutions constituted ‘the first step toward a world society’ that would facilitate the suppression and ultimate removal of the causes of conflict. A remarkable work in itself, this progressive volume was written by a member of British intelligence who had already made a reputation in this sphere and was to go on to hold very senior positions in the 1940s. The question is considered whether the ideas expressed were a product of Ellis's genuine beliefs, or whether they were a mask for his substantive professional role. The circumstances around the writing of this book are also reviewed in an attempt to answer this question, especially given the hitherto accepted scholarly view that Konni Zilliacus of the League Secretariat was the actual author. Pollitt and Bouckaert and their neo-Weberian state (NWS) have been chosen as the subject for this essay because the book has become a standard work in the public management movement. It is frequently cited and has been re-published in multiple editions (most recently in 2017). The authors also refer explicitly to Max Weber.This contribution seeks to draw attention to three important aspects, which inevitably overlap with one another:1. There is no Weber in the neo-Weberian State (introduction, 1; section II). (...) Pollitt and Bouckaert fail to grasp that Weber’s understanding of the state [the state as an “institution” (Anstalt); and the state as an “idea of validity” (Geltungsvorstellung)] is not identical to his ideal type of modern bureaucracy; it is the features of the latter on which they draw. The ideal type is a standard measure constructed in order to establish how close any concrete, given instance of bureaucracy comes to it (introduction, 3). Meanwhile, the “neutral official” insisted upon by Weber has “taken their leave” in Germany from important positions (section III, 3). Furthermore, Weber did not address those structures and processes internal to the administration which are precisely the object of interest for the new public management reformers. Weber’s lack of interest arises from the fact the members of anAnstalt, whether it is the state or the Church (WuG, § 15, no. 2), are subject to imposed orders (oktroyierte Ordnungen) and, as such, do not enjoy the “right to have a say”. Scharpf (1973a) was the first to pay particular attention to the problems brought about by specialisation and by the division of labour within the administration that are responsible for an incremental form of politics (section III, 3); even if he later ascribes advantages to the combination of “negative” and “positive coordination” (Scharpf 1991: 18ff.).2. The “legalistic culture” that characterises Germany will be considered in a more differentiated way, drawing on empirical studies which provide information, for example, on how laws (i.e. programmes)actuallyoriginate inside the ministerial apparatus (introduction, 2; section III, 2 and 3) or how use is made of the power of authority (Weisungsrecht) in practice (introduction, 2; section III, 2 and 3), even when, formally, it claims to have validity (section III). In this way, only empirical studies (Benz 1994; Bohne 1981; Dose 1997; Dose/Voigt 1995; Treiber 2007a) prove that the administration that implements laws has often, in practice, become a “negotiative administration” (introduction, 2). Such a phenomenon as a “co-operative administration”, which negotiates rather than rules, is a “foreign concept” in Weber’s discussion of the state and modern bureaucracy. Scharpf’s (1970) comparison between constitutional governance in Germany and legal relief in America is enlightening when it comes to the meaning of the constitutional state (Rechtsstaat) (introduction, 2; section III); the same applies to his discussion of the failed federalist reforms, which sought, among other things, to mitigate, if not entirely eliminate, the opportunities for blockades provided by political entanglement (Politikverflechtung) (section III). Neither was it possible to realise long overdue proposals to reform administrative law (Verwaltungsrecht) (section III, 1), which involved weakening or removing altogether three important assumptions in the dominant administrative doctrine (the “dogmatic normality”) and which also included the ambitious intention for the law to achieve tangible impact (Hoffmann-Riem 1994). Nonetheless, while no-one would dispute that reform of the federal government and administration remained “on the agenda” (Scharpf 1991, Mayntz/ Scharpf 1973), the priorities of such a reform were, and still are, different to those of new public management reform [the key terms here arePlanung(“planning”) and the term that replaced it,Steuerung(“management”)]1.3. Pollitt and Bouckaert ascribe to the neo-Weberian state extremely varied functions without providing any (theoretical) basis for them. In this way, the notion of public management reform that they present acquires the status of a “reformist philosophy” (introduction, 3; section IV). See Scharpf (1991) for a theoretically well-founded argumentation on the State’s ability to act in our days. Scharpf’s essay will be discussed briefly (section IV).ConclusionThere is no Weber in the neo-Weberian state. In the second half of the nineteenth century, geologists created the International Geological Congress (IGC) to achieve the methodological and terminological uniformity that they thought their science lacked. Their desire to standardize their practice and their use of the conference to do so was neither new nor unique. Although late nineteenth-century international conferences have been recognized as important arenas of standardization, relatively little is known of the ways in which conferences organized standardization negotiations. This article aims to fill this gap (...) by exploring how the IGC practically and socially organized standardization work. It appears that the session hall was not the sole and not even the main stage of geological standard-setting. The standardization process was also enacted through comparative study and informal exchanges that regular visits to purpose-built comparative geological exhibitions made possible. Relying on a sophisticated apparatus of commissions and subcommittees, the IGC also socially organized standards negotiation beyond the space and time of the triennial sessions. By tracing the material, spatial and social practices engineered through the IGC to serve geological standardization, this article unboxes the conference process and in so doing enriches our understanding of the period's wave of standardization. Drawing on Membership Categorization Analysis, we aim to tease out how narrators talk into being the social group constellations in their storyworlds and how these – potentially shifting – constellations can be related to the narrator’s identity constructions. We investigate two World War II-testimonies narrated by Belgian concentration camp survivors and scrutinize whether the expected Standardized Relational Pair of victim-perpetrator – viz. the camp prisoners versus the Nazis – is in operation, how these two categories are talked into being, whether (...) other social groups are mentioned and how all these processes affect the narrators’ identity work. It proved to be the case that, even though the victim-perpetrator Standardized Relational Pair is indeed present in both testimonies, it functions very differently in both stories, resulting in almost opposing identity work by the two narrators. Although brain size and the concept of intelligence have been extensively used in comparative neuroscience to study cognition and its evolution, such coarse-grained traits may not be informative enough about important aspects of neurocognitive systems. By taking into account the different evolutionary trajectories and the selection pressures on neurophysiology across species, Logan and colleagues suggest that the cognitive abilities of an organism should be investigated by considering the fine-grained and species-specific phenotypic traits that characterize it. In such a way, we (...) would avoid adopting human-oriented, coarse-grained traits, typical of the standard approach in cognitive neuroscience. We argue that this standard approach can fail in some cases, but can, however, work in others, by discussing two major topics in contemporary neuroscience as examples: general intelligence and brain asymmetries. Global Health involves, among many things the intensified travelling of people, resources, technologies, knowledge, standards, and ideas. This book describes what happens when innovations are transferred to new settings: What work is needed to make them work, but also how they change the setting into which they are introduced.

In “All Play and No Work,” Andrew Kania claims that standard form jazz involves no works, only performances. This article responds to Kania by defending one of the alternative ontological proposals that he rejects, namely, that jazz works are ontologically continuous with works of classical music. I call this alternative “the standard view,” and I argue that it is the default position in the ontology of standard form jazz. Kania has three objections to the (...) standard view. Sexual morality is not keeping up with the new sexual practices of young people, even in cultures oriented toward gender equality. The Norwegian high school graduation celebration constitutes an exceptionally liberal context for sexual practices. Many of the 18-year-old participants in this three-week-long celebration engage in “hookup” activities, involving kissing, fondling, and sexual intercourse. Through an analysis of qualitative interviews with 25 women and 16 men, we argue that while they avoided overt slut-shaming, the morally abject position of the “slut” (...) was still sustained by implication. The young women drew symbolic boundaries against anonymous other women who failed to value safety, hygiene, and self-control. This boundary-work was combined with declarations of tolerance of hookup practices, reflecting a sexually liberal culture geared toward gender equality. That young women who hooked up also drew boundaries against “other” women indicates a lack of alternative gender beliefs that allow young women to positively associate with hooking up. The young men also drew symbolic boundaries in their talk about sex, but enjoyed more freedom in their moral positioning. Although the liberal context was evident, the gendered difference in sexual boundary-work may contribute to the persistence of a sexual double standard among young people. (shrink)

I review some theoretical ideas in cosmology different from the standard “Big Bang”: the quasi-steady state model, the plasma cosmology model, non-cosmological redshifts, alternatives to non-baryonic dark matter and/or dark energy, and others. Cosmologists do not usually work within the framework of alternative cosmologies because they feel that these are not at present as competitive as the standard model. Certainly, they are not so developed, and they are not so developed because cosmologists do not work on them. It (...) is a vicious circle. The fact that most cosmologists do not pay them any attention and only dedicate their research time to the standard model is to a great extent due to a sociological phenomenon . We might well wonder whether cosmology, our knowledge of the Universe as a whole, is a science like other fields of physics or a predominant ideology. (shrink)

This new edition of work that has evolved over the past seven years completes the derivation of the form of The Standard Model from quantum theory and the extension of the Theory of Relativity to superluminal transformations. The much derided form of The Standard Model is established from a consideration of Lorentz and superluminal relativistic space-time transformations. So much so that other approaches to elementary particle theory pale in comparison. In previous work color SU(3) was derived from space-time (...) considerations. This book shows that the SU(2) U(1) Weak Interaction sector follows directly from the extension of Lorentz transformations to superluminal (faster-than-light) transformations. In fact, ElectroWeak symmetry is shown to have an SU(2) U(1) U(1) symmetry that naturally includes WIMPs (Weakly Interacting Massive Particles), a candidate for Dark Matter. Thus the form of the Standard Model is dictated by space-time considerations fulfilling a dream of Einstein. Using a new matrix formulation of Logic - Operator Logic - we show that Dirac-like equations can be constructed. This edition also derives broken SU(4) four fermion generations as well as a non-Higgsian (Dimensional Mass Generation) derivation of fermion and ElectroWeak gauge boson masses from GL(4). The program of the book is completed by reprinting the book Quantum Theory of the Third Kind, which describes Two-Tier quantum field theory. This theory yields finite results (No Feynman diagram calculations diverge!) in The Standard Model and Quantum Gravity calculations to all orders in perturbation theory. Lastly, the book also contains a description of Operator Logic, Probabilistic Operator Logic, Quantum Operator Logic (for q-number statements). In this paper, I argue that there is a picture of how law works that most legal theorists are implicitly committed to and take to be common ground. This Standard Picture (SP, for short) is generally unacknowledged and unargued for. SP leads to a characteristic set of concerns and problems and yields a distinctive way of thinking about how law is supposed to operate. I suggest that the issue of whether SP is correct is a fundamental one for (...) the philosophy of law, more basic, for example, than the issue that divides legal positivists and anti-positivists, at least as the latter issue is ordinarily understood. The goals of the paper are fourfold: 1) to identify and articulate in some detail the Standard Picture; 2) to show that SP is widely held and has important consequences for other debates in the philosophy of law; 3) to show that SP leads to a serious theoretical problem; 4) to sketch an alternative picture that promises to avoid this problem. I emphasize the modesty of these goals in one respect. I make no claim to refute SP or to fully develop and defend an alternative picture. (shrink)

"The Austin of the Jurisprudence of Administrative Law" This book originated as a series of lectures presented at Johns Hopkins in 1915. It proposes a method to supplement the established doctrine of constitutional law, which enforces legislative norms through negation and review, by a system of positive principles that would guide the making of statutes and give more definite meaning and content to the concept of due process. Highly regarded since its original publication in 1917 and the winner of Harvard (...) Law School's Ames Prize in 1919, it went on to become a standard work. It was recommended, to cite two examples, in Roscoe Pound's Introduction to American Law (1919) and Arthur Vanderbilt's Studying Law (1945). A comment published at the end of Freund's career summarizes a general opinion: "The great quality which Ernst Freund brought to the study of administrative law was his capacity for analysis. He was the Austin of the jurisprudence of administrative law." -W.I.J., Law Quarterly Review 49 (1933): 588. Ernst Freund [1864-1932] was Professor of Jurisprudence and Public Law at the University of Chicago. Biomedical research funding bodies across Europe and North America increasingly encourage—and, in some cases, require—investigators to involve members of the public in funded research. Yet there remains a striking lack of clarity about what ‘good’ or ‘successful’ public involvement looks like. In an effort to provide guidance to investigators and research organisations, representatives of several key research funding bodies in the UK recently came together to develop the National Standards for Public Involvement in Research. The Standards have critical implications for (...) the future of biomedical research in the UK and in other countries as researchers and funders abroad look to the Standards as a model for their own policy development. We assess the Standards and find that despite offering useful suggestions for dealing with practical challenges associated with public involvement, the Standards fail to address fundamental questions about when, why and with whom public involvement should be undertaken in the first place. We show that presented without this justificatory context, many of the recommendations in the Standards are, at best, fragments that require substantial elaboration by those looking to apply the Standards in their own work and, at worst, subject to potentially harmful misapplication by well-meaning investigators. As funding bodies increasingly push for public involvement in research, the key lesson of our analysis is that future recommendations about how public involvement should be conducted cannot be coherently formulated without a clear sense of the underlying goals and rationales for public involvement. The aim of the research is to identify the relationship between the performance criteria and the achievement of the objectives of supervision which is represented in the performance of the job at the Islamic University in Gaza Strip. To achieve the objectives of the research, the researchers used the descriptive analytical approach to collect information. The questionnaire consisted of (22) paragraphs distributed to three categories of employees of the Islamic University (senior management, faculty members, their assistants and members of the (...) administrative board). A random sample of 314 employees was selected, 276 responses were retrieved with a return rate of 88.1%. The SPSS program was used to enter, process, and analyze the data. The results of the study showed a positive relationship between the performance criteria and the achievement of the control objectives represented by the job performance in the Islamic University from the point of view of the members (senior management, faculty and their assistants and the administrative board). The researchers also recommended a number of recommendations, including the provision of an appropriate level of control system components today through the continuous updating and development of performance standards and the need to provide the necessary physical and financial resources to continue the development and achievement within the university. Expand the development of technology in the various activities of the university through the construction of a complete and integrated system to support the control systems in the university to suit its size. The researchers also recommended the follow-up, review of the performance standards and work to modify them in line with the mission of the university and the goals that the university seeks to reach. The role of private food standards in agriculture is increasingly raising questions of legitimacy, particularly in light of the impacts such standards may have on food producers. While much work has been carried out at a macro policy level for developing countries, there have been relatively few empirical case studies that focus on particular food supply chains, and even fewer studies still of the impact of private standards on developed countries such as Australia. This study seeks to address this imbalance, (...) with a particular focus on examining the impact of private standards on an Australian vegetable supply food system in North Tasmania as well as tracing the impact of perceived and actual power relations among actors. Applying a governance framework and adopting a Foucauldian position we show that private standards are a “technology of power” that have risen out of a crisis discourse in the mid-1990s about on-farm food safety. Private standards have the effect of using knowledge from particular actors to establish truths about good agricultural practice (GAP), however we show that Tasmanian vegetable growers are not docile bodies and are employing alternative knowledge and technologies of power to challenge how GAP is implemented on-farm. This work clarifies the role of the best interest standard (BIS) as ethical principle in the medical care of children. It relates the BIS to the ethical framework of medical practice. The BIS is shown to be a general principle in medical ethics, providing grounding to prima facie obligations. The foundational BIS of Kopelman and Buchanan and Brock are reviewed and shown to be in agreement with the BIS here defended. Critics describe the BIS as being too demanding, narrow, (...) opaque, not taking the family into account and not suitable as limiting principle. This work responds to these criticisms, showing that they do not stand up to scrutiny. They either do not apply to the BIS, only apply to misuses of the BIS or criticise a BIS that is not seriously defended in the literature. (shrink)

This thesis provides an introduction to the physics of the Standard Model and beyond, and to the methods used to analyse Large Hadron Collider (LHC) data. The 'hierarchy problem', astrophysical data and experiments on neutrinos indicate that new physics can be expected at the now accessible TeV scale. This work investigates extensions of the Standard Model with gravitons and gravitinos (in the context of supergravity). The production of these particles in association with jets is studied as one of (...) the most promising avenues for researching new physics at the LHC. Advanced simulation techniques and tools, such as algorithms allowing the computation of Feynman graphs and helicity amplitudes are first developed and then employed. (shrink)

Book synopsis: The causal theory of action is widely recognized in the literature of the philosophy of action as the "standard story" of human action and agency—the nearest approximation in the field to a theoretical orthodoxy. This volume brings together leading figures working in action theory today to discuss issues relating to the CTA and its applications, which range from experimental philosophy to moral psychology. Some of the contributors defend the theory while others criticize it; some draw from historical (...) sources while others focus on recent developments; some rely on the tools of analytic philosophy while others cite the latest empirical research on human action. All agree, however, on the centrality of the CTA in the philosophy of action. The contributors first consider metaphysical issues, then reasons-explanations of action, and, finally, new directions for thinking about the CTA. They discuss such topics as the tenability of some alternatives to the CTA; basic causal deviance; the etiology of action ; teleologism and anticausalism; and the compatibility of the CTA with theories of embodied cognition. Two contributors engage in an exchange of views on intentional omissions that stretches over four essays, directly responding to each other in their follow-up essays. As the action -oriented perspective becomes more influential in philosophy of mind and philosophy of cognitive science, this volume offers a long-needed debate over foundational issues. (shrink)

I have stressed here and elsewhere that perspective cannot and need not claim to represent the world "as we see it." The perceptual constancies which make us underrate the degree of objective diminutions with distance, it turns out, constitute only one of the factors refuting this claim. The selectivity of vision can now be seen to be another. There are many ways of "seeing the world," but obviously the claim would have to relate to the "snapshot vision" of the stationary (...) single eye. To ask, as it has so often been asked, whether this eye sees the world in the form of a hollow sphere or of a projection plane makes little sense, for it sees neither. The one point in focus can hardly be said to be either curved or flat, and the remainder of the field of vision is too indistinct to permit a decision. True, we can shift the point of focus at will, but in doing so we lose the previous perception, and all that remains is its memory. Can we, and do we, compare the exact extension of these changing percepts in scanning a row of columns extended at right angles from the central line of vision—to mention the most recalcitrant of the posers of perspectival theory?1 I very much doubt it. The question refers to the convenient choice of projection planes, not to the experience of vision.· 1. This work tests two conflicting views about double standards: whether they reflect evolved sex differences in behavior or a manipulative morality serving male interests. Two questionnaires on jealous reactions to mild (flirting) and serious (cheating) sexual transgressions were randomly assigned to 172 young women and men. One questionnaire assessed standards for appropriate behavior and perceptions of how young women and men usually react. The second asked people to report how they had reacted or, if naive, how they would react. The (...) questions concerned anger at and blame of partner and rival and the self-oriented responses of loss of self-esteem, feelings of hurt, and fear of losing the partner. As predicted by the idea of manipulative morality, both sexes advanced sets of double standards that serve the interests of their own sex at the expense of the opposite sex. Much of the data contradict the idea of a match between double standards and evolved sex differences. First, subjects who set self-serving double standards did not perceive gender differences in jealous reactions. Second, there were few gender differences in judgments regarding jealous responses. Third, in contrast with the familiar double standard, women were more aggressively reactive to a flirting rival than men. Fourth, self-reports of the strength of aggressive jealous reactions suggest that women’s behavior is stronger than the prescriptions for it. These data suggest that double standards represent a communication strategy which assists men’s control of women. The data on jealous reactions were interpreted in terms of the degree of threat to fitness posed by infidelity in different situations. (shrink)

A standard formalization of a scientific theory is a system of axioms for that theory in a first-order language (possibly many-sorted; possibly with the membership primitive $$\in$$ ). Suppes (in: Carvallo M (ed) Nature, cognition and system II. Kluwer, Dordrecht, 1992) expressed skepticism about whether there is a “simple or elegant method” for presenting mathematicized scientific theories in such a standard formalization, because they “assume a great deal of mathematics as part of their substructure”. The major difficulties amount (...) to these. First, as the theories of interest are mathematicized, one must specify the underlying applied mathematics base theory, which the physical axioms live on top of. Second, such theories are typically geometric, concerning quantities or trajectories in space/time: so, one must specify the underlying physical geometry. Third, the differential equations involved generally refer to coordinate representations of these physical quantities with respect to some implicit coordinate chart, not to the original quantities. These issues may be resolved. Once this is done, constructing standard formalizations is not so difficult—at least for the theories where the mathematics has been worked out rigorously. Here we give what may be claimed to be a simple and elegant means of doing that. This is for mathematicized scientific theories comprising differential equations for $$\mathbb{R}$$ -valued quantities Q (that is, scalar fields), defined on n (“spatial” or “temporal”) dimensions, taken to be isomorphic to the usual Euclidean space $$\mathbb{R}^n$$. For illustration, I give standard (in a sense, “text-book”) formalizations: for the simple harmonic oscillator equation in one-dimension and for the Laplace equation in two dimensions. (shrink)

The question of aesthetic judgment is related to a lot of paradoxes that have marked sustainably the reflection on arts, and even arts as such during their modern history. These paradoxes have found a first formulation, apparently clear, in the very famous Hume's essay: "On the standard of taste", but without to lead to a real resolution. In this paper, I would like to approach the question of Hume by starting from what Wittgenstein suggested about aesthetic judgment in his (...) Cambridge lectures. To this end, I will try to give a wittgensteinian reading of Hume's essay, in order to show that though the question of aesthetic judgment makes certainly sense, the way of considering it - like the way Kant shall consider it later - can be regarded as typical of difficulties Wittgenstein tried to overcome in his investigations on rules. By giving an alternative formulation to this question, we should be able to examine differently the problems of the aesthetic judgment, to underline more precisely the originality of Wittgenstein's approach, and perhaps to better grasp what are its consequences, not only for a better comprehension of the relationship between Wittgenstein’s philosophy and art, but for the type of perplexity to which we must face everytime we meet the paradox inherent to the question of aesthetic appreciation as such: how can we conceive the very idea of a standard involving a normative meaning without making to faint what gives to a work of art its value. We shall see that Wittgenstein’s suggestions, though their contribution to a better understanding of this question is still affected by some ambiguities, are to be reconsidered under the light of his anti-essentialism, and that these ambiguities can be dissipated by dissociating, on one hand, what belongs to his own tastes or to his related thoughts and on the other hand what we can conceive through the ways which were opened by his philosophy beyond his personal inclinations. Despite what gives to the sphere of Wittgenstein's artistic interests its limited character; despite also what drives his attention towards another kind of problems, it may well be that his thought cast a bright light on current artistic practices and therefore on the questions they ask to philosophy. If a person is competent to consent to a treatment, is that person necessarily competent to refuse the very same treatment? Risk relativists answer no to this question. If the refusal of a treatment is risky, we may demand a higher level of decision-making capacity to choose this option. The position is known as asymmetry. Risk relativity rests on the possibility of setting variable levels of competence by reference to variable levels of risk. In an excellent 2016 article inJournal of (...) Medical Ethics(JME), Rob Lawlor defends asymmetry of this kind by defending risk relativity, using and developing arguments and approaches found in earlier work such as that of Wilks. He offers what we call the two-scale approach: a scale of risk is to be used to set a standard of competence on a scale of decision-making difficulty. However, can this be done in any rational way? We argue it cannot, and in this sense, and to this extent, risk relativity is a nonsense. (shrink)

In 1942 a coalition of twenty scientific societies formed the Conference on the Supply of Experimental Animals in an attempt to pressure the Medical Research Council to accept responsibility for the provision of standardised experimental animals in Britain. The practice of animal experimentation was subject to State regulation under the Cruelty to Animals Act of 1876, but no provision existed for the provision of animals for experimental use. Consequently, day-to-day laboratory work was reliant on a commercial small animal market which (...) had emerged to sustain the hobby of animal fancying. This paper explores how difficulties encountered in experimental practice within the laboratory led to the problematisation of biomedical science’s reliance upon a commercial market for animals during the inter-war period. This is shown to have produced a crisis within animal reliant experimental science in the early 1940s which enabled the left-wing Association of Scientific Workers to cast science’s reliance on a free market as economically inefficient and a threat to the reliability of British research. It is argued that the development of standard experimental animals in Britain was, therefore, embedded within the wider cultural, societal, political and economic national context of the time. Amartya Sen reconsiders the idea of 'the standard of living'. He rejects the more conventional economic interpretations in terms of 'unity' and of wealth or 'opulence', and suggests an interpretation in terms of the 'capabilities and freedoms' that states of affairs do or do not allow. His argument is conceptual, but it refers to a wide range of examples. In elaborations of it, John Muellbauer explains how parts of it might be applied; Ravi Kanbur discusses the difficulties raised by (...) choice ex ante, under uncertainty, and choice ex post; Keith Hart discusses the ways in which one might think about living standards in societies in which there is a substantial amount of what he calls 'self provisioning' outside the market; and Bernard Williams reflects on some of the moral and political implications of Sen's argument. There is a bibliography of most of the more important works on the subject. The book will be of interest to economists, sociologists, students of development and moral and political philosophers; it will also be of interest to those concerned with public policy. (shrink)

This article describes the work of negotiating and reinterpreting "standard" protocols and criteria at the level of local practice, using the example of the procurement of human cadaver organs for transplantation. The tension between efforts to starulardize and globalize biomedical science, on the one hand, and fitting these efforts into everyday practices and understandings of practitioners, on the other, results in new constructions of medical knowledge about bodies and persons.

It has become more common recently for epistemologists to advocate the pragmatic encroachment on knowledge, the claim that the appropriateness ofknowledge ascriptions is dependent on the relevant practical circumstances. Advocacy of practicalism in epistemology has come at the expense of contextualism, the view that knowledge ascriptions are independent of pragmatic factors and depend alternatively on distinctively epistemological, semantic factors with the result that knowledge ascriptions express different knowledge properties on different occasions of use. Overall, my goal here is to defend (...) a particular version of contextualism drawn from work by Peter Ludlow, called ‘standards contextualism.’ My strategy will be to elaborate on this form of contextualism by defending it from various objections raised by the practicalists Jason Stanley, Jeremy Fantl and Matthew McGrath. In showing how standards contextualism can effectively repel these criticisms I hope to establish that standards contextualism is a viable alternative to practicalism. (shrink)

We proposed the Standards of Conducts to provide a general framework that will serve as the basis for guiding each biostatistician and stem cell researcher to formulate their personal standards, rather than as rules with which they are required to comply. Given the responsibility and characteristics of their work, they are expected to maintain independence and work autonomously as professionals. Each of the Standards of Conducts comprises a preamble, mission and values to uphold, Standards of Conducts, and background. When one (...) internalizes “self-formulated” standards, to make excuses for oneself would be akin to a self-betrayal; responsible actions can be anticipated. If one begins and continues to consider “who I am and what do I work for,” this will become their inner energy, and a source of motivation and pride to inspire oneself. In addition, this aspirational style might help citizens to recognize the autonomous stance of the professional body and that they share the same values. (shrink)

Spiritual care is a profession in transformation. It is evolving from a denominationally bound profession into a specific kind of healthcare profession. In the Netherlands, as elsewhere, debates are going on about the introduction of standards in public services such as health care. Many spiritual counsellors oppose standardization of spiritual care. Most importantly, standards seem to conflict with their sanctuary position as well as with the ?theory of presence? that many spiritual counsellors adhere to. A questionnaire was distributed among spiritual (...) counsellors asking them about the nature and number of standards they work with and the positive and negative effects of these standards on their daily work. This exploratory study shows that only a few spiritual counsellors work with standards. It also reveals that those who work with standards are neutral to positive about the ways in which standards influence their work. In particular, spiritual counsellors working with standards state that doing so does not conflict with their sanctuary position, nor with their ?being present?. The responses suggest that it does not seem to be standards as such but rather the social setting within which the standards are used that determines the effects that standards have on the content and quality of spiritual care. The paper concludes with some recommendations and suggestions for further investigation. (shrink)

The emphasis on the limitations of objectivity, in specific guises and networks, has been a continuing theme of contemporary analytic philosophy for the past few decades. The popular sport of baiting feminist philosophers — into pointing to what's left out of objective knowledge, or into describing what methods, exactly, they would offer to replace the powerful objective methods grounding scientific knowledge — embodies a blatant double standard which has the effect of constantly putting feminist epistemologists on the defensive, on (...) the fringes, on the run.This strategy can only work if objectivity is transparent, simple, stable, and clear in its meaning. It most certainly is not. In fact, taking objectivity as a sort of beautiful primitive, self-evident in its value, and all-powerful in its revelatory power, requires careless philosophy, and the best workers in metaphysics, epistemology, and philosophy of science have made reworked definitions of objectivity absolutely central to their own projects. In fact, classic feminist concerns with exploring the impact of sex and gender on knowledge, understanding, and other relations between human beings and the rest of the world fall squarely within the sort of human and social settings thatare already considered central in most current analytic metaphysics, epistemology, and philosophy of science. I argue that the burden of proof is clearly on those who wish toreject the centrality and relevance of sex and gender to our most fundamental philosophical work on knowledge and reality. (shrink)

The standards of energy and environmental design are improving day by day, are flexible enough, and in continuous change. The designers are the first ones which introduce the inputs into the system in order to improve it. The overall city should be planned as a socio-natural hybrid system. The LEED program has been developed in the US since 1998. It has been adopted in almost 40 countries and it is widely used by public. The LEED standards are based on reducing (...) overall impact rather than on a specific issue or topic, trying to be green as much as possible. The reliance to outside sources (programs and standards) is also important in order to enlarge the expertise area and the variety of subjects. The green city should be well planned and well documented since the early stage of design, reducing the costs and synchronizing the work of different systems that operates within the building. The LEED standards involve the environmental, economic, and social impact, regardless at this point the standards are socially neutral. The city planned according to LEED standards is a socio-neutral hybrid one. On the other hand, BREEAM is established since 1990 in the UK and certifies the sustainability of buildings. For each environmental certification, there exist differences between various criteria related to building energy efficiency. The evaluation of the performance improvement over specified baseline requirements is the common point of the two building standards. The sustainable assessments such as BREEAM or LEED can be applied or adopted in any region of the world. The Albanian case does not adopt any of them. Based on EPC (energy performance certificate), the building is considered to be in compliance with the minimum performance requirements of energy, aiming to achieve optimal levels of energy consumption for a typical use of the building. The building is considered as zero energy building when the ratio of the total energy consumption of the current building per sqm of the surface is equal or be less than 50% and the ratio of renewable energy produced in the building during a year compared to the consumption of total energy of the current building for one sqm of the surface. This volume provides a philosophical introduction to and analysis of the study of metaphor. By proceeding from the concrete analysis of complex metaphors, White is able to identify a range of features which are incompatible with standard accounts of the way words function in metaphor.

While the best interest standard (BIS) enjoys wide endorsement as the ethical and decision-making standard in pediatrics, it has been criticized as vague and indeterminate. Alternate decision-making standards have been proposed to replace or augment the BIS, notably the harm principle (HP) and constrained parental autonomy (CPA) model. In this edition of The Journal of Clinical Ethics, Lainie Friedman Ross argues that CPA is a better standard than the BIS or the HP as both guide and limiter (...) in pediatrics. In response, I review the important work done by the BIS in pediatrics, and argue that neither the HP nor the CPA can take over these functions or replace the BIS. Among other things I argue: (1) The BIS provides more robust protections for the moral claims of children. (2) The CPA model and the HP do not resolve the indeterminacy and vagueness present in complex medical situations, and the BIS is better suited to deal with this vagueness and indeterminacy. (3) The BIS is a general principle of medical ethics with special application in pediatrics; it fits seamlessly into the system of medical ethics and fulfills many functions within pediatrics. The HP and the CPA model do not fit so readily within medical ethics, and are not equipped to take over the functions of the BIS. (shrink)

In this new book, Foley defends an epistemology that takes seriously the perspectives of individual thinkers. He argues that having rational opinions is a matter of meeting our own internal standards rather than standards that are somehow imposed upon us from the outside. It is a matter of making ourselves invulnerable to intellectual self-criticism. Foley also shows how the theory of rational belief is part of a general theory of rationality. He thus avoids treating the rationality of belief as a (...) fundamentally different kind of phenomenon from the rationality of decision or action. His approach generates promising suggestions about a wide range of issues--e.g., the distinction between epistemic and non-epistemic reasons for belief; the question of what aspects of the Cartesian project are still worth doing; the significance of simplicity and other theoretical virtues; the relevance of skeptical hypotheses; the difference between a theory of rational belief and a theory of knowledge; the difference between a theory of rational belief and a theory of rational degrees of belief; and the limits of idealization in epistemology.
