This paper deals with the exceptions-tolerance property of generic sentences with indefinite singular and bare plural subjects (IS and BP generics, respectively) and with the way this property is connected to some well-known observations about felicity differences between the two types of generics (e.g. Lawler's 1973, Madrigals are popular vs. #A madrigal is popular). I show that whereas both IS and BP generics tolerate exceptional and contextually irrelevant individuals and situations in a strikingly similar way, which indicates the existence of (...) a basically equivalent tolerance mechanism, there is also a difference between them, unnoticed so far, which concerns the degree to which the properties of the legitimate exceptions can be characterized in advance. Following claims in Greenberg (2003), I argue that both this newly observed difference as well as the traditional felicity differences result from an underlying contrast in the type of ‘non-accidentalness’ expressed by the two types of generic sentences, and more formally, in the accessibility relations that their generic quantifier (Gen) is compatible with. To capture the new difference in tolerance of exceptions, I develop an improved version of the exceptions-tolerance mechanism for generic sentences suggested in Kadmon & Landman (1993), namely, a restriction on the set of individuals and situations quantified by Gen, which is partially vague to two different degrees using supervaluationist methods. The different degrees of vagueness in this restriction are shown to be systematically dependent on the two types of accessibility relations that IS and BP generics are compatible with, which are redefined as precise and vague restrictions on the generic quantification over worlds. This paper deals with the role of Judaism in Walter Benjamin's famous 1921 essay on violence and law, Zur Kritik der Gewalt. Despite the intense attention devoted to this essay, the role of Jewish myth in it has not yet been thoroughly explained. This study contends that the association between what Benjamin termed revolutionary violence and the Jewish messianic tradition, which plays a central role in the evaluation of Benjamin's text, is far more problematic than has hitherto been assumed, and (...) poses a serious challenge, which has not been fully examined in its historical context. Second, this essay claims that the subversive elements that many have supposedly found in Benjamin's text and the attempts to link these elements to messianic traditions are also unconvincing. Third, the paper contextualizes Benjamin's thought within the framework of the Jewish political–theological debate of the period. It contends that Benjamin's theory of law and justice should be understood not as a revolutionary, anti-republican text, as has been generally accepted, but as a secularized conservative orthodox one. In doing so, it seeks to shed light not only on Benjamin's early thinking and its influences, but also on the neglected element of Jewish orthodoxy within the broader topic of political theology. Work requirements are the centerpiece of HHS's Trump Administration strategy to undo the ACA expansion for low income working age adults. This article examines the June 29, 2018 trial court opinion in Stewart v. Azar which held that HHS's approval of Kentucky's Section 1115 work demonstration was “arbitrary and capricious.” The purpose of Medicaid is to provide health coverage and HHS may not ignore the loss of coverage that will result from a work requirement.

Providing versus foregoing enteral nutrition is a central issue in end-of-life care, affecting patients, families, nurses, and other health professionals. The aim of this article is to examine Jewish ethical perspectives on nourishing the dying and to analyze their implications for nursing practice, education, and research. Jewish ethics is based on religious law, called Halacha. Many Halachic scholars perceive withholding nourishment in end of life, even enterally, as hastening death. This reflects the divide they perceive between allowing a fatal disease (...) to naturally run its course until an individual’s vitality (life force or viability) is lost versus withholding nourishment for the vitality that still remains. The latter they maintain introduces a new cause of death. Nevertheless, coercing an individual to accept enteral nourishment is generally considered undignified and counterproductive. A minority of Halachic scholars classify withholding enteral nutrition as refraining from prolonging life, permitted under certain circumstances, especially in situations where nutritional problems flow directly from a fatal pathology. In the very final stages of dying, moreover, there is a general consensus that enteral nourishment may be withheld, providing that this reflects the dying individuals’ wishes. In the event of enteral nourishment becoming a source of overwhelming discomfort, two Halachic ethical mandates would come into conflict: sustaining life by providing nourishment and alleviating suffering. As in all moral conflicts, these would have to be resolved in practice. This article presents the issue of enteral nourishment as it unfolds in Halacha in comparison to secular and other religious perspectives. It is meant to serve as a foundation for nurses to reflect on their own practice and to explore the implications for nursing practice, education, and research. In a world that remains broadly religious, it is important to sensitize health practitioners to the similarities and differences among religions and between secular and religious approaches to ethical issues. Development projects in Sub-Saharan Africa propose to alleviate hunger in rural areas by introducing new agricultural practices and technologies, yet there is limited empirical evidence of how an agricultural intervention can lead farming households to transition to food security. Research on food security pathways considers agricultural interventions that increase farmers’ income to be particularly effective for reducing food insecurity. Consistent with this stance, Malawian agricultural policy aims to address hunger by encouraging smallholder farmers to intensify and commercialize maize production. This (...) paper explores if smallholders’ market and livelihood orientations do indeed lead them to favor an income pathway to food security. Qualitative analysis of 60 smallholder farmer interviews in Malawi found that, upon achieving improvements in production yields and diversity, rather than commercialize, many farmers re-organized their production and consumption to reduce market dependency. Farmers deployed this strategy to increase their food security, explaining that the choice to self-provision food and farming inputs was both an expression of farming identity and a lived understanding of their marginal position in commodity markets. The author finds that, in failing to consider how production relations affect food access, scholarship inadequately theorizes farm-level food security transitions and reproduces discursive framings of hunger. Food sovereignty narratives more accurately captured what mattered for Malawian smallholders’ food security, suggesting that engagement with this concept could improve scientific understandings of food security transitions. The New Transnational Activism shows how even the most prosaic activities can assume broader political meanings when they provide ordinary people with the experience of crossing transnational space. This means that we cannot be satisfied with defining transnational activists through the ways they think. The defining feature of transnationalism in this book is relational, and not cognitive. This emphasis on activism's relational structure means that even as they make transnational claims, transnational activists draw on the resources, the networks, and the (...) opportunities in which they are embedded, and only then - if at all - on more distant transnational links. But we can no more sharply draw a line between domestic and international politics in studying transnational activism than we could ignore local politics in studying its national equivalent. In the rationalist tradition in ethics, the emotions are morally suspect. In a corrective swing of the pendulum, burgeoning philosophical interest is “rehabilitating” the emotions in ethical decisionmaking. The emotions and reason should be mutually correcting resources in moral reflection.

In this paper I will focus on what might be meant by fairness in a democratic regime. There may be more general fairness criteria applicable to any political system, democratic or authoritarian, but fairness in relation to political decisions is especially central in a democracy. Democratic regimes are supposed to be run by the citizenry, or at least the citizenry ought to be the ultimate authority. Democracies depend on legitimacy to function effectively; only when a regime is considered legitimate can (...) it rule by consent rather than coercion. Democratic regimes cannot rely on coercion to govern and long remain democratic. Thus, public acceptance is important. This also explains why the public determination of what is fair, both as a matter of principle and in the evaluation of particular actions of particular governments, is central in democratic rule. Though a radical critic of capitalist society, Thorstein Veblen was a political quietist. His ideas of social evolution, cultural lag, and predatory power help to explain why. Veblen saw the need for deep-seated social change but despaired of its chances. He was in crucial ways a tragic writer, a radical realist who refused to yield to the temptations of political life. Veblen's quietism also helps to explain the hesitant, often unwelcome reception more ideologically minded scholars have given to his work. (...) Attributing Veblen's quietism to timidity or confusion, they have frequently avoided coming to grips with his distinctions between theory and pragmatism, science and politics, which lie at the heart of his political refusal. Theory and science push toward reasonable explanations and accounts of things; pragmatic and predatory political actors apply “worldly wisdom” to the exploit of others. Scientists cannot change institutions; political actors cannot dispense with the operations of power. Veblen asks much of us: for he struggled to undrape the veils of power while puncturing false hopes in the prospects of democracy. His quietism situates itself within this awful contradiction. Above all, Veblen's work serves the purpose of reminding us that neither science nor democracy constitutes a self-evident ground for belief in the inherent reasonableness or justice of action per se. For these reasons alone, an acquaintance with his work should be part of any solidly grounded education in the possibilities and limits of democratic political life in a scientific age. (shrink)

Among the continuities and differences that Tilman develops, none stands out more than his strikingly original claim that in important ways Veblen's work parallels that of Ferdinand Tonnies. This essay reviews Tilman's study, with a particular emphasis on Veblen's idea of community, particularly its political and utopian aspects. Most notable in these regards is Veblen's idea that a free and insurgent (...) “spirit of insubordination” is the chief animating principle of self-regulating anarchistic communities. The essay examines tensions between Veblen's embrace of the free spirit of anarchism and his belief in the centralizing thrust of modern technology. It suggests, however, that by dramatically curtailing needs for human labor, Veblen's industrial republic might, as most systems do, fumble its way toward a rough working balance between predominant values in conflict, in this case, industry and insubordination. This paper examines the interplay of semantics and pragmatics within the domain of film. Films are made up of individual shots strung together in sequences over time. Though each shot is disconnected from the next, combinations of shots still convey coherent stories that take place in continuous space and time. How is this possible? The semantic view of film holds that film coherence is achieved in part through a kind of film language, a set of conventions which govern the relationships (...) between shots. In this paper, we develop and defend a new version of the semantic view. We articulate it for a pair of conventions that govern spatial relations between viewpoints. One such rule is already well-known; sometimes called the "180° Rule," we term it the X-Constraint; to this we add a previously unrecorded rule, the T-Constraint. As we show, both have the effect, in different ways, of limiting the way that viewpoint can shift through space from shot to shot over the course of a film sequence. Such constraints, we contend, are analogous to relations of discourse coherence that are widely recognized in the linguistic domain.
