In the domain of legal information retrieval, an important challenge is to compute similarity between two legal documents. Precedents play an important role in The Common Law system, where lawyers need to frequently refer to relevant prior cases. Measuring document similarity is one of the most crucial aspects of any document retrieval system which decides the speed, scalability and accuracy of the system. Text-based and network-based methods for computing similarity among case reports have already been proposed in prior works but (...) not without a few pitfalls. Since legal citation networks are generally highly disconnected, network based metrics are not suited for them. Till date, only a few text-based and predominant embedding based methods have been employed, for instance, TF-IDF based approaches, Word2Vec and Doc2Vec based approaches. We investigate the performance of 56 different methodologies for computing textual similarity across court case statements when applied on a dataset of Indian Supreme Court Cases. Among the 56 different methods, thirty are adaptations of existing methods and twenty-six are our proposed methods. The methods studied include models such as BERT and Law2Vec. It is observed that the more traditional methods that rely on a bag-of-words representation performs better than the more advanced context-aware methods for computing document-level similarity. Finally we nominate, via empirical validation, five of our best performing methods as appropriate for measuring similarity between case reports. Among these five, two are adaptations of existing methods and the other three are our proposed methods. (shrink)

In a Common Law system, legal practitioners need frequent access to prior case documents that discuss relevant legal issues. Case documents are generally very lengthy, containing complex sentence structures, and reading them fully is a strenuous task even for legal practitioners. Having a concise overview of these documents can relieve legal practitioners from the task of reading the complete case statements. Legal catchphrases are (multi-word) phrases that provide a concise overview of the contents of a case document, and automated generation (...) of catchphrases is a challenging problem in legal analytics. In this paper, we propose a novel supervised neural sequence tagging model for the extraction of catchphrases from legal case documents. Specifically, we show that incorporating document-specific information along with a sequence tagging model can enhance the performance of catchphrase extraction. We perform experiments over a set of Indian Supreme Court case documents, for which the gold-standard catchphrases (annotated by legal practitioners) are obtained from a popular legal information system. The performance of our proposed method is compared with that of several existing supervised and unsupervised methods, and our proposed method is empirically shown to be superior to all baselines. Leadership styles vary across the vast Indian sub‐continent and are in a state of flux and change. The norms are influenced by ancient mythology and by imprints of world‐wide movements of political liberalism, socialism and economic globalization. But through all these styles, one discerns basic values which are universal and can be intuitively grasped by multi‐national managers. The paper describes the various sources of leadership understandings in India and relates them to Western traditions, notably to Aristotle’s ‘virtue ethics’.

In this article we investigate origins of several cases of failure of Artificial Intelligence (AI) systems employing machine learning and deep learning. We focus on omission and commission errors in (a) the inputs to the AI system, (b) the processing logic, and (c) the outputs from the AI system. Our framework yields a set of 28 factors that can be used for reconstructing the path of AI failures and for determining corrective action. Our research helps identify emerging themes of inquiry (...) necessary for developing more robust AI-ML systems. We are hopeful that our work will help strengthen the use of machine-learning AI by enhancing the rates of true positive and true negative judgements from AI systems, and by lowering the probabilities of false positive and false negative judgements. Background: Risks to healthcare workers have escalated during the pandemic and they are likely to experience a greater level of stress. This cross-sectional study investigated mental distress among healthcare workers during the early phase of Coronavirus disease-2019 outbreak in India.Method: 140 healthcare workers of a tertiary care hospital in India were assessed for perceived stress and insomnia. A factor analysis with principal component method reduced these questions to four components which were categorized as insomnia, stress-related anxiety, stress-related irritability, and stress-related (...) hopelessness. Further statistical analyses were done on these factor scores to identify the predictors and investigate the differences between the different categories of healthcare workers.Result: Doctors had the highest level of anxiety among the healthcare workers. Both doctors and nurses perceived a greater level of irritability than the other HCWs. Compared to doctors and nurses, other HCWs were more likely to experience insomnia. Lower age, higher education, female gender, and urban habitat were associated with greater perception of anxiety. Older age, being quarantined, and single marital status were the significant predictors of irritability. Female gender, single marital-status, and higher number of medical ailments contributed to perceived hopelessness. Quarantine significantly predicted insomnia.Conclusion: Different categories of healthcare workers are experiencing varied mental health problems owing to their heterogeneous socio-demographic backgrounds. Tailored and personalized care, as well as policies, might help in alleviating their problems. Further research is warranted to explore the psychological distress and remedies among these frontline workers during and after the ongoing pandemic crisis. (shrink)

PurposeThe purpose of this study is to identify the major factors influencing the adoption of health-care wearables in generation Z (Gen Z) customers in India. A conceptual framework using push pull and mooring (PPM) adoption theory was developed.Design/methodology/approachData was collected from 208 Gen Z customers based on 5 constructs related to the adoption of health-care wearables. Confirmatory factor analysis and structural equation modelling was used to analyse the responses. The mediation paths were analysed using bootstrapping method and examination of the (...) standardized direct and indirect effects in the model.FindingsThe study results indicated that the antecedent factors consisted of push (real-time health information availability), pull (normative environment) and mooring (decision self-efficacy) factors. The mooring factor (MOOR) was related to the push factor but not the pull factor. The MOOR, in turn, was related to the switching intention of Gen Z customers for health wearables adoption.Research limitations/implicationsThe research study extended the literature related to the PPM theory in the context of the adoption of health wearables among Gen Z customers in India.Practical implicationsThe study outcome would enable managers working in health wearable organizations to understand consumer behaviour towards health wearables.Social implicationsThe use of health wearables among Gen Z individuals would lead to future generations adopting a healthy lifestyle resulting in an effective workforce and better economy.Originality/valueThis was one of the few studies which have explored the PPM theory to explore the factors for the adoption of health wearables among Gen Z customers in India. Incompatibilists and compatibilists (mostly) agree that there is a strong intuition that a manipulated agent, i.e., an agent who is the victim of methods such as indoctrination or brainwashing, is unfree. They differ however on why exactly this intuition arises. Incompatibilists claim our intuitions in these cases are sensitive to the manipulated agent’s lack of ultimate control over her actions, while many compatibilists argue that our intuitions respond to damage inflicted by manipulation on the agent’s psychological and volitional capacities. Much (...) hangs on this issue because manipulation-based arguments are among the most important for defending incompatibilist views of free will. In this paper, I investigate this issue from a experimental perspective, using a set of statistical methods well suited for identifying the features of hypothetical cases people’s intuitions are responding to. Results strongly support the compatibilist view—subjects’ tendency to judge that a manipulated agent is unfree was found to depend on their judgments that the agent suffers impairments to certain psychological/volitional capacities that compatibilists say are the basis for free will. I discuss the significance of these results for the use of manipulation cases in the philosophical debate about free will. (shrink)

BackgroundRationing of care in nursing is nurses' inability to complete all care activities for patients because of scarcity in time and resource. Literature suggests that rationing of care is closely related to patient safety and quality of care. The phenomena have been defined and studied from varied perspectives and contexts. A systematic review of studies related to the concept was aimed at identifying and synthesizing the finding.MethodsThe review followed Preferred Reporting Items for Systematic Reviews and Meta‐analysis guidelines, and literature searches (...) were conducted in MEDLINE, CINAHL, PsycInfo, Web of Science and EMBASE databases. Fifty‐seven quantitative studies were included in the review.FindingsThe review observed that nursing activities addressing the emotional, educational, mobility and hygiene needs of the patients were commonly rationed. Antecedents of rationing included resource inadequacy and organizational work environment. Rationing influenced patient satisfaction, mortality and a number of adverse events and was associated with decreased job satisfaction, increased intention to leave and high turnover among nurses.DiscussionsThis review concludes that rationing in nursing is ubiquitous, embedded in the work environment and poses a threat to the professional health and philosophical base of nursing in addition to having serious implications on patients' safety. Strategies to reframe and reconsider organizational traits, and open discussion with other healthcare stakeholders can reduce rationing of nursing care. The review suggests future researchers adopt different methodological layout to study rationing. (shrink)

Recent studies by experimental philosophers demonstrate puzzling asymmetries in people’s judgments about intentional action, leading many philosophers to propose that normative factors are inappropriately influencing intentionality judgments. In this paper, I present and defend the Deep Self Model of judgments about intentional action that provides a quite different explanation for these judgment asymmetries. The Deep Self Model is based on the idea that people make an intuitive distinction between two parts of an agent’s psychology, an Acting Self that contains the (...) desires, means-end beliefs, and intentions that are the immediate causal source of an agent’s actions, and a Deep Self, which contains an agent’s stable and central psychological attitudes, including the agent’s values, principles, life goals, and other more fundamental attitudes. The Deep Self Model proposes that when people are asked to make judgments about whether an agent brought about an outcome intentionally, in addition to standard criteria proposed in traditional models, people also assess an additional ‘Concordance Criterion’: Does the outcome concord with the psychological attitudes of the agent’s Deep Self? I show that the Deep Self Model can explain a very complex pattern of judgment asymmetries documented in the experimental philosophy literature, and does so in a way that has significant advantages over competing models. Recently, a number of philosophers have advanced a surprising conclusion: people's judgments about whether an agent brought about an outcome intentionally are pervasively influenced by normative considerations. In this paper, we investigate the ‘Chairman case’, an influential case from this literature and disagree with this conclusion. Using a statistical method called structural path modeling, we show that people's attributions of intentional action to an agent are driven not by normative assessments, but rather by attributions of underlying values and characterological dispositions (...) to the agent. In a second study, we examined people's judgments about what they think drives asymmetric intuitions in the Chairman case and found that people are highly inaccurate in identifying which features of the case their intuitions track. In the final part of the paper, we discuss how the statistical methods used in this study can help philosophers with the critical features problem, the problem of figuring out which among the myriad features present in hypothetical cases are the critical ones that our intuitions are responsive to. We show how the methods used in this study have some advantages over both armchair methods used by traditional philosophers and survey methods used by experimental philosophers. (shrink)

A model is presented that examines the interactions between employee and organizational values toward the natural environment and its influence on important sustainability-related outcomes. Perspectives from the new environmental paradigm , anthropocentric value orientation , behavioral view of HRM , and person-organizational are applied. The overall proposition is that level of congruence between employee and company values toward the natural environment influences employee attitudes toward firm green initiatives, organizational commitment, and turnover intentions.

This paper explores the ethical dimensions of some of the current issues engaging rural India, affecting 600 million people. It uses the evolutionary framework of Sri Aurobindo's integral yoga, and also tags on to it the rights concepts of Amartya Sen's ethics. It attempts to take a balanced view between Ambedkar's perception of the ancient Indian village as a sink of localism, a den of ignorance, narrow-mindedness and communalism, and the more common and traditional, but historically untrue, idealized view of (...) the Vedic times. In this process it also steers clear of the pitfalls in the Marxist writings or positivist research, which has taken a wrong position that there was no rule of law and therefore no ethics as understood in modern times. It then attempts to show the more eternal features of perennial ethics in India, the idiom, institutions and the instruments it has nurtured, and the manner it is getting integrated with and is supportive of evolving modern values of democracy and social justice in Indian villages. The problem of moral compliance is the problem of explaining how moral norms are sustained over extented stretches of time despite the existence of selfish evolutionary incentives that favor their violation. There are, broadly speaking, two kinds of solutions that have been offered to the problem of moral compliance, the reciprocity-based account and the punishment-based account. In this paper, I argue that though the reciprocity-based account has been widely endorsed by evolutionary theorists, the account is in fact deeply implausible. I (...) provide three arguments that suggest that moral norms are sustained by punishment, not reciprocity. But in addition to solving the problem of moral compliance, the punishment-based account provides an additional important theoretical dividend. It points the way for how theorists might build an evolutionary account of a feature of human groups that has long fascinated and troubled social scientists and moral philosophers – the existence of moral diversity. Sumit K. Mandal uncovers the hybridity and transregional connections underlying modern Asian identities. By considering Arabs in the Malay world under European rule, Becoming Arab explores how a long history of inter-Asian interaction was altered by nineteenth-century racial categorisation and control. Mandal traces the transformation of Arabs from familiar and multi-faceted creole personages of Malay courts into alienated figures defined by economic and political function. The racialisation constrained but did not eliminate the fluid character of Arabness. Creole Arabs (...) responded to the constraints by initiating transregional links with the Ottoman Empire and establishing modern social organisations, schools, and a press. Contentions emerged between organisations respectively based on Prophetic descent and egalitarianism, advancing empowering but conflicting representations of a modern Arab and Islamic identity. The article attempts to describe adonization, a specific tactic for exerting influence which employs physical attraction, as well as its determinants. The article presents a proprietary model of determinants and motivational mechanisms which constitute the basis of the attitude toward adonization. A cycle of 3 studies on individual determinants for the attitude toward adonization was described. Results of study 1 confirmed that male gender, psychological masculinity, narcissism, Machiavellianism and high self-monitoring were correlates of a positive attitude toward adonization. Study 2 (...) showed that extraversion was the predictor of a positive attitude toward adonization of men and women and that agreeableness was the predictor of a less positive attitude of women. In Study 3 it was established that there were no differences in the attitude toward adonization in young and middle-aged men. Comparison among young and middle-aged women proved that younger women had a more positive attitude toward adonization in the cognitive and in the affective components than older women. (shrink)

The topic of the article concerns the issue of place attachment and its determinants. An analysis of place attachment was performed in terms of place identity and place dependence. Moreover, links between place attachment and selected geographical, demographic and psychological variables were investigated. The study group included 759 respondents: 398 women and 361 men, aged 18-83 years, residing in 74 places in the Silesian Province, a region in Poland: in 10 sub-regions in the Upper Silesian conurbation and outside the conurbation. (...) The study used the Place Attachment Scale, the Satisfaction with Life Scale and a personal information section containing questions regarding place of permanent residence, sex and age. Results showed that subjects residing in smaller and non-industrial places had a stronger place attachment than those residing in larger and industrial cities. People living outside the Upper Silesian conurbation were more strongly attached to their place of residence in terms of place identity than those residing in the Upper Silesian conurbation. People living in the Zagłębie sub-region were more strongly attached in terms of place dependence than those residing in the Bytom sub-region. Satisfaction with life was positively correlated with place attachment. Older subjects were more strongly attached to their place of residence. Men and women did not differ in the sense of place attachment and life satisfaction. (shrink)
