Biobank-based research is not specifically addressed in Indian statutory law and therefore Indian Council for Medical Research guidelines are the primary regulators of biobank research in India. The guidelines allow for broad consent and for any level of identification of specimens. Although privacy is a fundamental right under the Indian Constitution, courts have limited this right when it conflicts with other rights or with the public interest. Furthermore, there is no established privacy test or actionable privacy right in the common (...) law of India. In order to facilitate biobank-based research, both of these lacunae should be addressed by statutory law specifically addressing biobanking and more directly addressing the accompanying privacy concerns. A biobank-specific law should be written with international guidelines in mind, but harmonization with other laws should not be attempted until after India has created a law addressing biobank research within the unique legal and cultural environment of India. Existing research on the financial implications of corporate social responsibility (CSR) for firms has predominantly focused on positive aspects of CSR, overlooking that firms also undertake actions and initiatives that qualify as negative CSR. Moreover, studies in this area have not investigated how both positive and negative CSR affect the financial risk of firms. As such, in this research, the authors provide a framework linking both positive and negative CSR to idiosyncratic risk of firms. While investigating these relationships, the authors (...) also analyze the moderating role of financial leverage of firms. Overall, analysis of secondary information for firms from multiple industries over the years 2000–2009 shows that CSR has a significant effect on the idiosyncratic risk of firms, with positive CSR reducing risk and negative CSR increasing it. Results also show that the reduction in risk from positive CSR is not guaranteed, with firms having high levels of financial leverage witnessing lower idiosyncratic risk reduction. (shrink)

These resemblances, relating both to the fundamental structures of the two mythological systems and to a number of curious details, constitute an assemblage which seems too conspicuous to be regarded as either accidental or the result (...) of a similitude of human mentalities, manifesting itself, so it seems, through the creation of a great many similar myths and legends throughout the length and breadth of the surface of our planet. The literature on human and animal learning suggests that individuals attend to and act on cues differently based on the order in which they were learned. Recent studies have proposed that one specific type of learning outcome, the highlighting effect, can serve as a framework for understanding a number of early cognitive milestones. However, little is known how this learning effect itself emerges among children, whose memory and attention are much more limited compared to adults. Two experiments were conducted using (...) different versions of the general highlighting paradigm: Experiment 1 tested 3 to 6 year olds with a newly developed image-based version of the paradigm, which was designed specifically to test young children. Experiment 2 tested the validity of an image-based implementation of the highlighting paradigm with adult participants. The results from Experiment 1 provide evidence for the highlighting effect among children 3–6 years old, and they suggest age-related differences in dividing attention among multiple cues during learning. Experiment 2 replicated results from previous studies by showing robust biases for both image-based and text-based versions of the highlighting task. This study suggests that sensitivity to learning order emerges early through the process of cued attention, and the role of the highlighting effect in early language learning is discussed. (shrink)

Perceptual grouping has traditionally been thought to be governed by innate, universal principles. However, recent work has found differences in Japanese and English speakers' non-linguistic perceptual grouping, implicating language in non-linguistic perceptual processes (Iversen, Patel, & Ohgushi, 2008). Two experiments test Japanese- and English-learning infants of 5-6 and 7-8 months of age to explore the development of grouping preferences. At 5-6 months, neither the Japanese nor the English infants revealed any systematic perceptual biases. However, by 7-8 months, the same age (...) as when linguistic phrasal grouping develops, infants developed non-linguistic grouping preferences consistent with their language's structure (and the grouping biases found in adulthood). These results reveal an early difference in non-linguistic perception between infants growing up in different language environments. The possibility that infants' linguistic phrasal grouping is bootstrapped by abstract perceptual principles is discussed. (shrink)

This case describes the background of cigarette product placement in commercial movies and the emergence of the Smoke Free Movies Initiative. It draws onresearch by tobacco control activists on the impact of smoking in movies on youth smoking initiation. Voluntary and mandated restrictions on the use of cigarettes in film productions are discussed. Historic documents from tobacco industry archives reveal the explicit goals and intentions of tobacco companies to use films to market their products to unsuspecting observers.

This paper examines the relationship between the public health community and the tobacco industry within the framework of a two-factor model of trust and distrust (Lewicki, McAllister & Bies, 1998). We assert that public health’s historical and current interaction with Big Tobacco is best characterized as one of Low Trust/High Distrust, marked by ongoing hostility and preemption. Forced-trust measures based on regulation and litigation and efforts by the tobacco industry to collaborate with public health activists are unlikely to elevate the (...) longer-term level of trust in this relationship, without significantly fuller or more voluntary compliance by tobacco companies. We conclude that distrust of the industry has served and continues to serve multiple purposes for public health activists. There is little incentive for tobacco control activists to adopt a more trusting stance toward the industry, and significant justification for them to maintain a high level of distrust. (shrink)

Cyclic nucleotides can regulate the sensitivity of retinal rods to light through phosducin. The phosphorylation state of phosducin determines the amount of G available for activation by Rho*. Phosducin phosphorylation is regulated by cyclic nucleotides through their activation of cAMP-dependent protein kinase. The regulation of phosphodiesterase activity by the noncatalytic cGMP binding sites as well as Ca2+/calmodulin dependent regulation of cGMP binding to the cation channel are also discussed.

Biologists often study particular biological systems as models of a phenomenon of interest even if they already know that the phenomenon is produced by diverse mechanisms and hence none of those systems alone can sufficiently represent it. To understand this modeling practice, the present paper provides an account of how multiple model systems can be used to study a phenomenon that is produced by diverse mechanisms. Even if generalizability of results from a single model system is significantly limited, generalizations concerning (...) specific aspects of mechanisms often hold across certain ranges of biological systems, which enables multiple model systems to jointly represent such a phenomenon. Comparing mechanisms that operate in different biological systems as examples of the same phenomenon also facilitates characterization and investigation of individual mechanisms. I also compare my account with two existing accounts of the use of multiple model systems and argue that my account is distinct from and complementary to them. (shrink)

The aim of this paper is to investigate how we can reunite social philosophy and philosophy of science to address problems in science and technology. First, referring to Don Howard?s, George Reisch?s, and Philip Mirowski?s works, I shall briefly explain how philosophy of science was depoliticised during the cold war. Second, I shall examine Steve Fuller?s criticism of Thomas Kuhn. Third, I shall scrutinise Philip Kitcher?s view of well-ordered science. Fourth, I shall emphasise the importance of autonomy and argue that (...) philosophy of science needs to cultivate a critical attitude towards authority. Fifth, drawing upon Ian Jarvie?s social reading of Karl Popper, I shall argue that Popper?s philosophy can be a model for reuniting social philosophy and philosophy of science. (shrink)

Comatose survivors of cardiac arrest may die following withdrawal of life-sustaining therapy (WLST) due to poor neurologic prognosis. Family members, acting as surrogate decision makers, are frequently asked to decide whether the patient should continue to receive ongoing life-sustaining therapy such as mechanical ventilation in this context of risk of death following removal. Sometimes, physicians and family members disagree about what is in the patient's best interest, and this conflict causes distress for both families and medical personnel. This article examines (...) themes recorded in the medical records of 24 cardiac arrest patients at Columbia University Medical Center (CUMC) whose families chose to pursue continued life support despite physician recommendations for withdrawal. In documented conversations between patients' families and their providers, the most prominent themes included faith in miracles, the inappropriateness of "playing God," the value of more time with the patient, and differences in how providers and family members perceived the patient's status. The use of technology and innovation in developing long-term global food security, and ensuring sustainable and adequate food production, is contextualized by values and controversies associated with food technologies. The framing and context of these technologies may impact on consumer perceptions and acceptance. In some countries this can influence policy decisions. Analysis of the public discourses on the themes of innovation, risk, power and control, and their socio-economic and ethical implications, is applied to explain the utility of novel and emerging (...) food technologies. Potential differences in stakeholder interests are taken into account in different economic and regulatory environments, contrasting Europe with the emerging economies of China and India. In the case of India, there is considerable public debate on finding a balance between various technological choices for food production, viz transgenic, traditional breeding and organic production. In China, the debate about technological innovation is driven largely by political and scientific elites with relatively little consumer debate. European agri-technological innovation is framed by ‘post-productivism’, which informs both implementation strategies and regulatory and governance issues. Economic values cannot be dismissed as irrelevant to the European innovation process, in particular in relation to investment and scientific endeavour. (shrink)

This paper will defend scientific study of the social by scrutinizing Clifford Geertz's interpretive anthropology, and evolutionary psychologists' criticism of it. I shall critically examine Geertz's identification of anthropology with literary criticism, his assumption that a science of society is possible only on a positivist model, his view of the relation between culture and mind, and his anti anti-relativism. Then I shall discuss evolutionary psychologists' criticism of Geertz's view as an exemplar of the so-called "Standard Social Science Model." Finally, I (...) shall claim that both Geertz and evolutionary psychologists misunderstand the aim of the social sciences, which is to explain the unintended consequences of human actions in institutional contexts. Facial expressions influence our experience and perception of emotions—they not only tell other people what we are feeling but also might tell us what to feel via sensory feedback. We conducted three experiments to investigate the interaction between facial feedback phenomena and different environmental stimuli, by asking participants to remember emotional autobiographical memories. Moreover, we examined how people with schizotypal traits would be affected by their experience of emotional facial simulations. We found that using a directed approach (gripping a pencil (...) with teeth/lips) while remembering a specific autobiographical memory could successfully evoke participants’ positive (e.g. happy and excited)/negative (e.g. angry and sad) emotions (i.e. Experiment 1). When using indirective environmental stimuli (e.g. teardrop glasses), the results of our experiments (i.e. Experiments 2 and 3) investigating facial feedback and the effect of teardrop glasses showed that participants who scored low in schizotypy reported little effect from wearing teardrop glasses, while those with high schizotypy reported a much greater effect in both between- and within-subject conditions. The results are discussed from the perspective of sense of ownership, which people with schizophrenia are believed to have deficits in. (shrink)

Luck egalitarianism assigns a central role to personal responsibility in egalitarian justice. In the context of healthcare, luck egalitarianism is the view that the distribution of medical and healthcare resources—or common resources in general—should respond to the (im)prudence of individuals. Recently, Joar Björk, Gert Helgesson, and Niklas Juth have argued that it is impractical to use luck egalitarianism as a normative framework in healthcare because it has no reasonable way of dealing with the imprudent. In response to their argument, this (...) paper first suggests that the epistemic problems of applying luck egalitarianism to the healthcare context raised by Björk et al. can be circumvented by using the exemption system as a policy application of luck egalitarian healthcare justice. This paper then shows that an _ex ante_ policy, a tax system with refunds, can reasonably be adopted as a luck egalitarian institutional design of healthcare policy. We argue that the proposed conception of luck egalitarianism can deal with the problem of differential option luck. Finally, we show that the threshold problem for the definition of imprudence does not refute the proposed _ex ante_ policy. (shrink)

Court judgments contain valuable information on how statutory laws and past court precedents are interpreted and how the interdependence structure among them evolves in the courtroom. Data-mining the evolving structure of such customs and norms that reflect myriad social values from a large-scale court judgment corpus is an essential task from both the academic and industrial perspectives. In this paper, using data from approximately 110,000 court judgments from Japan spanning the period 1998–2018 from the district to the supreme court level, (...) we propose two tasks that grasp such a structure from court judgments and highlight the strengths and weaknesses of major machine learning models. One is a prediction task based on masked language modeling that connects textual information to legal codes and past court precedents. Another is a dynamic link prediction task where we predict the hidden interdependence structure in the law. We make quantitative and qualitative comparisons among major machine learning models to obtain insights for future developments. (shrink)
