Malcolm Feeley, one of the founding giants of the law and society field, is also one of its most exciting, diverse, and contemporary scholars. His works have examined criminal courts, prison reform, the legal profession, legal professionalism, and a variety of other important topics of enduring theoretical interest with a keen eye for the practical implications. Current treatments of practical rationality understand reasons as considerations counting in favor of or against some practical option, treating the positive and the negative case as symmetrical. Typically the focus is on examples of positive reasons. However, I want to shift the spotlight to negative reasons, as making a tighter or more direct link to rationality — and ultimately to morality, which is what much of the current interest in reasons is meant to clarify. Recognizing a positive/negative asymmetry in normative (...) force will let us reconcile the view of moral or other requirements as based on reasons with the denial that reasons as such, even all-thingsconsidered reasons, yield requirements — or as I like to put it, rationally compel. One, it is said, went insane, another became a heretic, a third died and only the (...) fourth emerged unscathed. A modern variation of this story might go like this. Four or perhaps  philosophers entered the jungle of nationalism and for the most part went insane. There were those who embraced nationalism and consequently abandoned the universality of philosophy for the promotion of xenophobia, racism and even Nazism. Others remained internationalist and hence became futile—philosophical Canutes—commanding the raging beasts of nationality to be still. No one struggled harder with nationalism than Bertrand Russell. In , writing as an internationalist, he announced the demise of the principle of nationality only to see nationalisms explode in every region of the world (see his “National Independence and Internationalism”, Papers ). He opposed it relentlessly and without compromise until near the end of his life when he found himself endorsing wars of national liberation. Nationalism is often depicted as a howling beast. It would be better to think of it as an anaconda that wraps itself around everyone who ventures into its domain. Joan Cocks’ Passion and Paradox is an important book on nationalism and the intelligentsia. She traces the intellectual encounter with nationalism of a number of figures—Karl Marx, Rosa Luxemburg, Isaiah Berlin and the Scottish nationalist Tom Nairn, among others. All are exiles, most are Jews, and all try to hack their way through a jungle of conundrums of nationalist thought. Her accounts of these thinkers sometimes read like complex legal briefs, but are always illuminating. Though an internationalist, she sees the power of nationalist imperatives. Her approach to the contradictory strains of nationalism and hostility to nationalism echoes that of Hegel. She presents critical but sympathetic accounts of each side of the nationalist problematic and shows how their difficulties might be resolved in a higher synthesis. Alas! her resolution suffers from the unworldliness that she finds in other versions of internationalism. Her argument begins with a personal experience. In the early ’s she joined a group of Arabs and Jews against the Gulf War. In the course of their associ- Reviews  ation she learned that the Jews were all internationalists, while the Arabs were outspoken nationalists. This experience presumably demonstrated that a happy collusion of nationalism and internationalism was possible. But, of course, there was another side: those prosecuting the war she opposed were also nationalists. Her central thesis addresses the tragedy of opposition. It states that nationalism is “dilemmatic”, that is, that “all paths of thought obscured equally telling contrary thoughts; all courses of action were strewn with causes for regret and remorse” (p. ). The horns of the dilemma are the valid claims of the internationalist who sees the underlying self-destructive deep structures of nationalism on one side, and the claims of the national particularistic who is engaged in the compelling theatre of national liberation and the protection of local customs and roots on the other. Her book is an account of how her thinkers are framed by this dilemma, locked in by the imperatives of either side. In the period between the Gulf War and the composition of this book in  Cocks was able to observe what she identifies as the destructive logic of nationalism. The ’s were a period of postmodernist celebration of the local, a sensibility that helped to legitimate nationalism. The explosion of nationalism that followed the breakup of the Communist imperium was a time of liberation of the imprisoned nations—a springtime when it was good to be alive. But as the decade wore on the concealed pit bulls came out—in Yugoslavia, in Rwanda and elsewhere. In Cocks’ view nationalism showed an inner logic, of a sort that Russell called attention to in the early ’s—a logic that led from euphoria to self-destruction (see his Prospects). Many authors treat freedom and responsibility as interchangeable and simply apply conclusions about responsibility to freedom. This paper argues that the two are distinct, thus allowing for a “semi-compatibilist” view, on which responsibility but not freedom (in the sense of freedom to do otherwise) is compatible with determinism. It thereby avoids the implausible features of recent compatibilist accounts of freedom without alternative possibilities—as if one could make oneself free just by accepting the limitations on one’s choice. In particular, the paper (...) puts forth two main arguments that responsibility does not imply freedom: an argument from “the stakes,” meaning what is at stake in a given action, or how seriously wrong it is, as affecting responsibility more than freedom, and an argument from temporal standpoint, that responsibility is often assessed from a standpoint farther back in time, when the agent could have taken steps to prevent being unfree later, whereas freedom is typically assessed at the time of action. These arguments are applied to the well-known case of Robert Alton Harris as in Watson (1988), in contrast to a Watsonian account of psychopaths as lacking moral responsibility because of “moral blindness.” Instead, what makes responsibility moral is the reasons for our blame, not necessarily what motivates the agent we take to be blameworthy. P.S. Greenspan uses the treatment of moral dilemmas as the basis for an alternative view of the structure of ethics and its relation to human psychology. In its treatment of the role of emotion in ethics the argument of the book outlines a new way of packing motivational force into moral meaning that allows for a socially based version of moral realism.

Rousseau in Drag is a provocative new interpretation of Rousseau's gender politics. Rosanne Terese Kennedy reads Rousseau's well-known but brief flirtation with cross-dressing as a starting point to dramatically reconsider the standard reading of Rousseau as a misogynist. This study argues that rather than a figure of misogyny, Rousseau challenges normative gender identites, the couple, and traditional kinship relations. Reading Rousseau's classical political and philosophical works alongside his literary texts, Kennedy offers us an alternative vision of both Rousseau's sexual politics (...) and his politics in general. This study examined knowledge of sea lions for both residents and tourists on San Cristóbal Island in the Galápagos, a famous nature tourism destination. Participants obtained through convenience and snowball sampling answered questionnaires about their knowledge of sea lions. Participants with higher education received higher overall scores, but participants’ education and age influenced answers on only a few questions. Residents and tourists obtained comparable overall scores, exhibiting extensive knowledge of sea lion behavior and life history. Whether participants were residents or (...) tourists influenced answers to several questions, but when only participants with 13 years of education or more were examined, few differences in answers remained between residents or tourists. Participants’ broad knowledge of sea lions may be attributed to the items of knowledge tested, participants’ motivations for travel to the Galápagos, and the fact that sea lions are an engaging and ubiquitous animal. McMaster University acquired the Russell collection in 1968. Since that time hundreds of researchers have come from every corner of the world and have collectively revealed a treasure of the intellectual and political life of the twentieth century. Russell’s name is not on everyone’s lips today, but the archive still contains material vital to our own concerns: to our concern about what has gone wrong in the twentieth century, to the status of science as a paradigm of knowledge, to the (...) rise and fall of communism, and to the prospects of world order. In Emotions and Reasons, Patricia Greenspan offers an evaluative theory of emotion that assigns emotion a role of its own in the justification of action. She analyzes emotions as states of object-directed affect with evaluative propositional content possibly falling short of belief and held in mind by generalized comfort or discomfort.

Using the social-psychological literature on the antecedents of environmental behaviour and comparative data from Germany, India, Israel and South Korea, we test four value types that correspond with environmental behaviour. Our cross-national context represents varying social, economic, cultural and environmental configurations, giving credence to the effects of values. The authors collected survey data among students on a variety of environmental behaviours and on questions that comprise Schwartz's value scale. The results show similarities between the countries in the effect of biospheric (...) values and differences in the effects of the other values tested. We also find that biospheric value is the most important value type for explaining environmental behaviour, and that biospheric values, universalism and benevolence - three key values that we analyse - have different effects on environmental behaviour, and therefore should be treated separately rather than in a unified self-transcendence value orientation. We finally demonstrate the importance of conformity in the analysis of environmental behaviour. Our conclusions point to the importance of further exploring the mechanism that links values and environmental behaviour while contextualising it in different national and cultural settings. The world’s first living donor liver transplant from an HIV-positive mother to her HIV-negative child, performed by our team in Johannesburg, South Africa in 2017, was necessitated by disease profile and health system challenges. In our country, we have a major shortage of donor organs, which compels us to consider innovative solutions to save lives. Simultaneously, the transition of the HIV pandemic, from a death sentence to a chronic illness with excellent survival on treatment required us to rethink our policies (...) regarding HIV infection and living donor liver transplantation. Although HIV infection in the donor is internationally considered an absolute contraindication for transplant to an HIV-negative recipient, there have been a very small number of unintentional transplants from HIV-positive deceased donors to HIV-negative recipients. These transplant recipients do well on antiretroviral medication and their graft survival is not compromised. We have had a number of HIV-positive parents in our setting express a desire to be living liver donors for their critically ill children. Declining these parents as living donors has become increasingly unjustifiable given the very small deceased donor pool in SA; and because many of these parents are virally suppressed and would otherwise fulfil our eligibility criteria as living donors. This paper discusses the evolution of HIV and transplantation in SA, highlights some of the primary ethical considerations for us when embarking on this case and considers the new ethical issues that have arisen since we undertook this transplant. An imperfect duty such as the duty to aid those in need is supposed to leave leeway for choice as to how to satisfy it, but if our reason for a certain way of satisfying it is our strongest, that leeway would seem to be eliminated. This paper defends a conception of practical reasons designed to preserve it, without slighting the binding force of moral requirements, though it allows us to discount certain moral reasons. Only reasons that offer criticism of (...) alternatives can yield requirements, but our reasons for particular ways of satisfying imperfect duties merely count in favor of the acts in question. When the state is authorized to take over charitable obligations, it should not be seen as enforcing fulfillment of our imperfect duties, but rather as forcing us to help fulfill collective duties that may be substantially modified by transfer to the state, replacing imperfect duties with perfect. Besides the cost to us in freedom of choice there is a moral cost to replacing the virtuous motives of charity with those that tend to accompany paying taxes. However, a compensating feature of state involvement is the fact that its more precise demands come with limits. (shrink)

This is a study involving three HIV clinics in the Canadian provinces of Newfoundland and Labrador, and Manitoba. We sought to identify ethical issues involving health care providers and clinic clients in these settings, and to gain an understanding of how different ethical issues are managed by these groups. We used an institutional ethnographic method to investigate ethical issues in HIV clinics. Our researcher conducted in-depth semi-structured interviews, compiled participant observation notes, and studied health records in order to document ethical (...) issues in the clinics, and to understand how health care providers and clinic clients manage and resolve these issues. We found that health care providers and clinic clients have developed work processes for managing ethical issues of various types: conflicts between client-autonomy and public health priorities, difficulties associated with the criminalization of nondisclosure of HIV positive status, challenges with non-adherence to HIV treatment, the protection of confidentiality, barriers to treatment access, and negative social determinants of health and well-being. Some ethical issues resulted from structural disadvantages experienced by clinic clients. The most striking findings in our study were the negative social determinants of health and well-being experienced by some clinic clients – such as experiences of violence and trauma, poverty, racism, colonization, homelessness, and other factors affecting well-being such as problematic substance use. These negative determinants were at the root of other ethical issues, and are themselves of ethical concern. (shrink)

Mental retardation is an invented bureaucratic category, currently undergoing radical rethinking and likely renaming, that includes many who have biologically based brain disorders, but is itself determined on functional criteria that are purely arbitrary. People with MR are socially vulnerable and thus are more likely to be "naíve confessors," "naíve defendants," and "naíve offenders." That is most likely the rationale and justification for the Supreme Court's decision, in Atkins v. Virginia, to exempt the class from execution. Although the decision is (...) to be applauded as a step in a more humane direction, it is problematic to use an indirect, artificial, and insufficiently inclusive category to determine who should or should not be executed. Limited social intelligence is a characteristic of a wide range of brainbased syndromes and disorders, including many who fall above the upper IQ limit and, thus, are ineligible for the MR label and the legal protections associated with it. A more equitable, and logical, policy would be to extend execution exemption to all who demonstrate the same kinds of vulnerabilities, especially if they can be linked to some brain-based medical condition, regardless of whether one qualifies for the label of MR. Psychopaths are agents who lack the normal capacity to feel moral emotions (e.g. guilt based on empathy with the victims of their actions). Evidence for attributing psychopathy at least in some cases to genetic or early childhood causes suggests that psychopaths lack free will. However, the paper defends a sense in which psychopaths still may be construed as responsible for their actions, even if their degree of responsibility is less than that of normal agents. Responsibility is understood in Strawsonian terms, (...) as a question of our appropriate reactive attitudes toward an agent for what she does, and as distinct from the question of the agent's own motivating attitudes, which lead him to do what he does. The latter is the question more directly relevant to free will, though moral motivation normally depends on the capacity in early childhood to pick up motivating attitudes from others' reactive attitudes. Reactive attitudes based on hatred rather than anger (e.g. disgust or contempt) count as alternative forms of blame that may be appropriately directed toward agents manifesting bad qualities of will, even as a matter of motivational impairment. So psychopaths may still be said to deserve blame, even if they are incapable of modifying their behavior in response to blame. (shrink)

Empirically minded philosophers have raised questions about judgments and theories based on moral intuitions such as Rawls’s method of reflective equilibrium. But they work from the notion of intuitions assumed in empirical work, according to which intuitions are immediate assessments, as in psychologist Jonathan Haidt’s definition. Haidt himself regards such intuitions as an appropriate basis for moral judgment, arguing that normal agents do not reason prior to forming a judgment and afterwards just “confabulate” reasons in its defense. I argue, first, (...) that the notion of “considered intuitive judgment” that Rawls spells out when he first presents his method is pre-theoretical, but not at all pre-reflective, in the way Haidt’s definition supposes; it may rest on various forms of reasoning short of systematic derivation from theoretical principles. I go on to take issue with Haidt’s dismissal of ex post facto moral reasoning, arguing that it can play both a causal role in an individual’s later intuitions or judgments and a legitimate normative role, as required by moral competence in judging non-taboo cases. I suggest that the move from intuition to judgment and thence to ex post facto reasoning makes sense as a justificatory version of Peircean abduction, or what is now mainly called “inference to the best explanation.”. This paper updates, modifies, and extends an account of psychopaths’ responsibility and blameworthiness that depends on behavioral control rather than moral knowledge. Philosophers mainly focus on whether psychopaths can be said to grasp moral rules as such, whereas it seems to be important to their blameworthiness that typical psychopaths are hampered by impulsivity and other barriers to exercising self-control. I begin by discussing an atypical case, for contrast, of a young man who was diagnosed as a psychopath at one point (...) but who lacks the element of impulsivity. He exhibits the usual deficits of empathy and related moral emotions, but by now he has developed effective alternative means of conforming to moral rules, essentially on the basis of self-interest. I think it does seem reasonable to hold him morally responsible if he should violate a rule, despite his refusal to acknowledge any specifically moral reasons. I then turn to more typical cases, arguing that blameworthiness is mitigated by the difficulty of learning alternative means of self-control. In a departure from my earlier work, I do not take responsibility to have degrees. But since both blameworthiness and freedom to do otherwise have degrees that depend on the same factors, I go on to explain how it can be reasonable to blame a typical psychopath for an act he may not have been free to avoid. More generally, my suggestion is that notions commonly conflated in philosophers’ treatments of responsibility should be prized apart. (shrink)

This is worse, I argue, Than a choice between conflicting obligations, Where the agent has an overriding obligation "to choose", And does nothing wrong, Once the choice is made, By ignoring one of his prior obligations. Here, "contra" marcus, Guilt seems inappropriate.

There is a well-known scene from The Adventures of Tom Sawyer that illustrates what might be considered benign manipulation: Tom has the job of whitewashing a fence but would rather spend the time with friends. By feigning enthusiasm for the job he manages to get his friends to hang around and do it for him. They even pay to do it - with various little items that he later trades for..

Owen Flanagan is a highly prolific writer and speaker whose work brings together results of research in several empirical disciplines overlapping with philosophy, particularly neuroscience and other areas of psychology. This book of thirteen essays, most of them revisions of work published elsewhere, exhibits both his intellectual and his stylistic range. Many of the essays are light and chatty, others analytical and slower-going.

Morality is a source of reasons for action, what philosophers call practical reasons. Kantians say that it ‘gives’ reasons to everyone. We can even think of moral requirements as amounting to particularly strong or stringent reasons, in an effort to demystify deontological views like Kant’s, with its insistence on inescapable or ‘binding’ moral requirements or ‘oughts.’¹ When we say that someone morally ought not to harm others, perhaps all we are saying is that he has a certain kind of reason (...) not to, one that wins out against any opposing reasons such as those touting benefits to him of ignoring others’ concerns. The category of emotions covers a disputed territory, but clear examples include fear, anger, joy, pride, sadness, disgust, shame, contempt and the like. Such states are commonly thought of as antithetical to reason, disorienting and distorting practical thought. However, there is also a sense in which emotions are factors in practical reasoning, understood broadly as reasoning that issues in action. At the very least emotions can function as "enabling" causes of rational decision-making (despite the many cases in which they are (...) disabling) insofar as they direct attention toward certain objects of thought and away from others. They serve to heighten memory and to limit the set of salient practical options to a manageable set, suitable for "quick-and-dirty" decision-making. (shrink)

This paper presents the Functional/Emotional approach to language development, which explains the process leading up to the core capacities necessary for language; shows how this process leads to the formation of internal symbols; and how it shapes and is shaped by the child's development of language.

This paper attempts to connect recent cross-disciplinary treatments of the cognitive or rational significance of emotions with work in contemporary philosophy identifying an evaluative propositional content of emotions. An emphasis on the perspectival nature of emotional evaluations allows for a notion of emotional rationality that does not seem to be available on alternative accounts.
