Richerson et al. argue that relatively large culturalFSTvalues provide evidence for group structure and therefore scope for group selection. However, recent research on spatial patterns of cultural variation demonstrates that, as in the genetic case, apparent group structure can be a consequence of geographic clines, not group barriers. Such a pattern limits the scope for cultural group selection.

In a recent Article Carla Kary attempts to show that there should be a significant moral difference between instances of killing and letting die. I shall maintain in Section I that Kary's argument is somewhat weakened by the failure to note an important ambiguity in the notion of killing a person. I shall also argue in Section II that a similar ambiguity affects the notion of letting someone die, and that the failure to note this latter ambiguity also weakens the (...) position developed by Robert Coburn with regard to defective newborns. The United States Army’s Future Combat Systems Project, which aims to manufacture a “robot army” to be ready for deployment by 2012, is only the latest and most dramatic example of military interest in the use of artificially intelligent systems in modern warfare. This paper considers the ethics of a decision to send artificially intelligent robots into war, by asking who we should hold responsible when an autonomous weapon system is involved in an atrocity of the sort that would normally (...) be described as a war crime. A number of possible loci of responsibility for robot war crimes are canvassed; the persons who designed or programmed the system, the commanding officer who ordered its use, the machine itself. I argue that in fact none of these are ultimately satisfactory. Yet it is a necessary condition for fighting a just war, under the principle of jus in bellum, that someone can be justly held responsible for deaths that occur in the course of the war. As this condition cannot be met in relation to deaths caused by an autonomous weapon system it would therefore be unethical to deploy such systems in warfare. (shrink)

Robert Alexy develops his influential theory of legal reasoning exploring the nature of legal argumentation and its relation to practical reasoning. In doing so he sheds light on fundamental questions of law and rationality, which are as crucial to practising lawyers and law students as they are to scholars of legal theory.

Nozick argues, in “Anarchy, State, and Utopia”, correctly I think, that we can go from an equal distribution of wealth to an unequal one through just means. Nozick then asks: If people voluntarily move from a just distribution of wealth, D1, to a different distribution, D2, “isn’t D2 also just?” While Nozick thinks the new distribution of wealth, D2, is just, I think that it is at least possible to go from a just state of affairs to an un-just state (...) of affairs by just means. I then argue that any unequal distribution of wealth can not maximize the good derived from wealth. Therefore, on the basis of plausible utilitarian ideas, any distribution of wealth that isn’t at least roughly equal is un-just, even it was arrived at by just means from aa equal and just distribution of wealth. Philosophers and scientists from all over the world, thirty seven in all, comment on Kuipers’ philosophy, and each of their commentaries is followed by a reply from Kuipers. The present volume is devoted to Kuipers’ neo-classical philosophy of science, as laid down in his Structures in Science . Not referring to clinical schizophrenia, but to the fact that the culture is divided up into all sorts of classes and groups, etc., and that some of the old lines are breaking down. And that this is a healthy sign. -- William Burroughs, from _Schizo-Culture_ The legendary 1975 "Schizo-Culture" conference, conceived by the early Semiotext collective, began as an attempt to introduce the then-unknown radical philosophies of post-'68 France (...) to the American avant-garde. The event featured a series of seminal papers, from Deleuze's first presentation of the concept of the "rhizome" to Foucault's introduction of his _History of Sexuality_ project. The conference was equally important on a political level, and brought together a diverse group of activists, thinkers, patients, and ex-cons in order to address the challenge of penal and psychiatric institutions. The combination proved to be explosive, but amid the fighting and confusion "Schizo-Culture" revealed deep ruptures in left politics, French thought, and American culture. The "Schizo-Culture" issue of the Semiotext journal came three years later. Designed by a group of artists and filmmakers including Kathryn Bigelow and Denise Green, it documented the chaotic creativity of an emerging downtown New York scene, and offered interviews with artists, theorists, writers, and No Wave and pre-punk musicians together with new texts from Deleuze, Foucault, R. D. Laing, and other conference participants. This slip-cased edition includes _The Book: 1978_, a facsimile reproduction of the original Schizo-Culture publication; and _The Event: 1975_, a previously unpublished and comprehensive record of the conference that set it all off. At the heart of this book is the age-old question of how law and morality are related. The legal positivist, insisting on the separation of the two, explicates the concept of law independently of morality. The author challenges this view, arguing that there are, first, conceptually necessary connections between law and morality and, second, normative reasons for including moral elements in the concept of law. While the conceptual argument alone is too limited to establish a sufficiently strong connection between law (...) and morality, and the normative argument alone fails to address the nature of law, the two arguments together support a nonpositivistic concept of law, toppling legal positivism qua comprehensive theory of law. In this context, it mostly denotes a digital substitute for a real object or process. Virtual reality is perhaps the best-known term in this respect. With these digital (...) connotations, “virtuality” has also been used in science and research: Chemists use virtual laboratories, biologists do virtual scanning of molecular structures, and geologists engage in virtual field trips. But the concept of the virtual has a much longer tradition, dating back to long before the dawn of the digital age. Virtual images and virtual displacements were introduced in classical physics already in the late seventeenth and eighteenth centuries, respectively. They represent auxiliary objects or processes without instantiation, with the purpose of efficiently describing specific physical systems. In today’s physics, the term “virtual” is mostly associated with the quantum world, first and foremost with the “virtual particle” of quantum field theory. It has become such an integral part of modern high energy physics that its ontological character may be considered to go beyond the purely auxiliary, which is typically associated with the virtual. [End Page 263]In other disciplines, however, use of the term virtual without a digital connotation is much rarer. While concepts like “virtual adrenaline” show up in physiological research around 1940s, and Charles Darwin, in a private note in January 1840,1 spoke of “virtual change” in the context of embryology, these examples seem to be singular occurrences of entities that were explicitly called “virtual.” The basic idea behind the terminology of the virtual, however, might be much more common, even outside of physics. The “invisible hand” in economics, or the “vital force” in biology, for instance, may carry aspects of a virtual entity, even if they have not been referred to that way.These different observations raise several questions about the status of virtual entities in science. What has led scientists to call one entity “virtual” and not another? Do all virtual entities in science have the same roots and meet the same characteristics? Are they more than auxiliary objects or processes? Why does physics seem to occupy a specific position with respect to the use of the notion of virtuality? These are some points that led us to discuss virtual entities in science during a workshop, out of which grew the present collection. We invited contributions that addressed the historical formation and philosophical interpretation of concepts of virtual entities in physics and other disciplines—in whatever terms they may come. The main goal of the workshop was to bring to the fore similarities and differences in the meanings and functions of these concepts, so as to be able to precisely characterize why certain entities are considered virtual in specific contexts, why a different terminology was often used in each individual case, and in what sense the virtual entities relate to the real world.The organization of the workshop was part of our project “The formation and development of the concept of virtual particles,” a subproject of the Research Unit “The Epistemology of the Large Hadron Collider,” funded by the Deutsche Forschungsgemeinschaft (DFG) and Der Wissenschaftsfonds (FWF). This book analyses the general structure of constitutional rights reasoning under the German Basic Law. It deals with a wide range of problems common to all systems of constitutional rights review. In an extended introduction the translator argues for its applicability to the British Constitution, with particular reference to the Human Rights Act 1998.

In this paper we describe the impact that Walton’s conception of argumentation schemes had on AI and Law research. We will discuss developments in argumentation in AI and Law before Walton’s schemes became known in that community, and the issues that were current in that work. We will then show how Walton’s schemes provided a means of addressing all of those issues, and so supplied a unifying perspective from which to view argumentation in AI and Law.

In this paper we describe an approach to practical reasoning, reasoning about what it is best for a particular agent to do in a given situation, based on presumptive justifications of action through the instantiation of an argument scheme, which is then subject to examination through a series of critical questions. We identify three particular aspects of practical reasoning which distinguish it from theoretical reasoning. We next provide an argument scheme and an associated set of critical questions which is able (...) to capture these features. In order that both the argument scheme and the critical questions can be given precise interpretations we use the semantic structure of an Action-Based Alternating Transition System as the basis for their definition. We then work through a detailed example to show how this approach to practical reasoning can be applied to a problem solving situation, and briefly describe some other previous applications of the general approach. In a second example we relate our account to the social laws paradigm for co-ordinating multi-agent systems. The contribution of the paper is to provide firm foundations for an approach to practical reasoning based on presumptive argument in terms of a well-known model for representing the effects of actions of a group of agents. In this paper we consider persuasion in the context of practical reasoning, and discuss the problems associated with construing reasoning about actions in a manner similar to reasoning about beliefs. We propose a perspective on practical reasoning as presumptive justification of a course of action, along with critical questions of this justification, building on the account of Walton. From this perspective, we articulate an interaction protocol, which we call PARMA, for dialogues over proposed actions based on this theory. We outline (...) an axiomatic semantics for the PARMA Protocol, and discuss two implementations which use this protocol to mediate a discussion between humans. We then show how our proposal can be made computational within the framework of agents based on the Belief-Desire-Intention model, and illustrate this proposal with an example debate within a multi agent system. A Zenonian supertask involving an infinite number of colliding balls is considered, under the restriction that the total mass of all the balls is finite. Classical mechanics leads to the conclusion that momentum, but not necessarily energy, must be conserved. Relativistic mechanics, on the other hand, implies that energy and momentum conservation are always violated. Quantum mechanics, however, seems to rule out the Zeno configuration as an inconsistent system.

The digital humanities have developed in concert with online systems that increase the accessibility and speed of learning. Whereas previously students were immersed in the fluidity of campus life, they have become suspended and drawn-into various streams and currents of digital pedagogy, which articulate new forms of epistemological movement, often operating at speeds outside the lived time and rhythm of human thought. When assessing learning technologies, we have to consider the degree to which they complement the rhythms immanent to human (...) thought, knowledge, investigation, and experimentation.In this paper, we examine learning from a humanities perspective, arguing that reading, writing, and thinking are ways of learning underscored by various genres of movement that segue with or diverge from the movements inherent to digital technologies, especially those deployed in learning systems. Using the work of thinkers such as John Dewey and Michel Serres, we examine the importance of movement in dialogue, where to truly learn involves embedding oneself in the flow of thought, accepting the flexibility of concepts, and aligning oneself with a community of thinkers. Doug Walton, who died in January 2020, was a prolific author whose work in informal logic and argumentation had a profound influence on Artificial Intelligence, including Artificial Intelligence and Law. He was also very interested in interdisciplinary work, and a frequent and generous collaborator. In this paper seven leading researchers in AI and Law, all past programme chairs of the International Conference on AI and Law who have worked with him, describe his influence on their work.

What makes us conscious? Many theories that attempt to answer this question have appeared recently in the context of widespread interest about consciousness in the cognitive neurosciences. Most of these proposals are formulated in terms of the information processing conducted by the brain. In this overview, we survey and contrast these models. We first delineate several notions of consciousness, addressing what it is that the various models are attempting to explain. Next, we describe a conceptual landscape that addresses how the (...) theories attempt to explain consciousness. We then situate each of several representative models in this landscape and indicate which aspect of consciousness they try to explain. We conclude that the search for the neural correlates of consciousness should be usefully complemented by a search for the computational correlates of consciousness. (shrink)

This study of the political philosophy of William Ernest Hocking be gan as a doctoral dissertation at Tulane University. Hocking (1873- 1966) was for many years Alford Professor of Natural Religion, Moral Philosophy, and Civil Polity at Harvard University. Although he is relatively well-known among American philosophers, particularly by students of metaphysics and the philosophy of religion, very little atten tion has been given to his political philosophy. Some general studies of his thought summarize his political writings in a very (...) cursory fashion, but they do not discuss his contributions in detail or relate them to significant issues in political philosophy. Most important general works on modern political philosophy or American political thought do not even mention Hocking; a few note his name in passing. Because he is almost completely unknown in the social sciences, the original purpose of this study was to explore, systematize, and present his extensive writings in political philosophy. It then became apparent that his entire political philosophy is oriented around the concepts of liberty and community. When his thought is analyzed in terms of these themes, its unity and coherence are more obvious. Moreover, his writings become more significant when they are related to liberty and community, for these are focal concepts for important problems in modern political philosophy. This study of Hocking's political philosophy will, it is hoped, help us to see how liberty and community can be more understandable, attainable, and compatible with one another. (shrink)

So far no known measure of confirmation of a hypothesis by evidence has satisfied a minimal requirement concerning thresholds of acceptance. In contrast, Shogenji’s new measure of justification (Shogenji, Synthese, this number 2009) does the trick. As we show, it is ordinally equivalent to the most general measure which satisfies this requirement. We further demonstrate that this general measure resolves the problem of the irrelevant conjunction. Finally, we spell out some implications of the general measure for the Conjunction Effect; in (...) particular we give an example in which the effect occurs in a larger domain, according to Shogenji justification, than Carnap’s measure of confirmation would have led one to expect. There are two basic views concerning the relationship between constitutional rights and proportionality analysis. The first maintains that there exists a necessary connection between constitutional rights and proportionality, the second argues that the question of whether constitutional rights and proportionality are connected depends on what the framers of the constitution have actually decided, that is, on positive law. The first thesis may be termed ‘necessity thesis’, the second ‘contingency thesis’. According to the necessity thesis, the legitimacy of proportionality analysis is (...) a question of the nature of constitutional rights, according to the contingency thesis, it is a question of interpretation. Today it is generally assumed that epistemic justification comes in degrees. The consequences, however, have not been adequately appreciated. In this paper we show that the assumption invalidates some venerable attacks on infinitism: once we accept that epistemic justification is gradual, an infinitist stance makes perfect sense. It is only without the assumption that infinitism runs into difficulties.

This paper engages with the theme of disgrace from a Bourdieusian point of view. Starting out from a specific definition of ‘grace’ in terms of misrecognition, it goes on to consider some of the ways in which disgrace can be generated and some of the ways it can be handled by the disgraced party. While there are certainly many intra-field modalities of the genesis of disgrace, including violation of the rules of the game, the paper also emphasizes that disgrace can (...) be generated by cross-field events, necessitating a switch of perspective from individuals in one field to individuals in multiple fields. Galileo claimed inconsistency in the Aristotelian dogma concerning falling bodies and stated that all bodies must fall at the same rate. However, there is an empirical situation where the speeds of falling bodies are proportional to their weights; and even in vacuo all bodies do not fall at the same rate under terrestrial conditions. The reason for the deficiency of Galileo’s reasoning is analyzed, and various physical scenarios are described in which Aristotle’s claim is closer to the truth than is (...) Galileo’s. In this paper we apply a general account of practical reasoning to arguing about legal cases. In particular, we provide a reconstruction of the reasoning of the majority and dissenting opinions for a particular well-known case from property law. This is done through the use of Belief-Desire-Intention (BDI) agents to replicate the contrasting views involved in the actual decision. This reconstruction suggests that the reasoning involved can be separated into three distinct levels: factual and normative levels and a level connecting (...) the two, with conclusions at one level forming premises at the next. We begin by summarising our general approach, which uses instantiations of an argumentation scheme to provide presumptive justifications for actions, and critical questions to identify arguments which attack these justifications. These arguments and attacks are organised into argumentation frameworks to identify the status of individual arguments. We then discuss the levels of reasoning that occur in this reconstruction and the properties and significance of each of these levels. We illustrate the different levels with short examples and also include a discussion of the role of precedents within these levels of reasoning. (shrink)

As is well known, implication is transitive but probabilistic support is not. Eells and Sober, followed by Shogenji, showed that screening off is a sufficient constraint for the transitivity of probabilistic support. Moreover, this screening off condition can be weakened without sacrificing transitivity, as was demonstrated by Suppes and later by Roche. In this paper we introduce an even weaker sufficient condition for the transitivity of probabilistic support, in fact one that can be made as weak as one wishes. We (...) explain that this condition has an interesting property: it shows that transitivity is retained even though the Simpson paradox reigns. We further show that by adding a certain restriction the condition can be turned into one that is both sufficient and necessary for transitivity. (shrink)
