El presente trabajo investiga las tesis sobre el poder civil de Alonso de la Veracruz que buscan incorporar en la comunidad política española a los habitantes autóctonos del Nuevo Mundo, tesis que suelen relacionarse con F. de Vitoria y el tomismo español, y que últimamente son consideradas parte del republicanismo novohispano elaborado desde la periferia americana. Se busca demostrar que su propósito era aplicar una teoría de derechos naturales, sin que ello implique participación política de los indios americanos. The paper explores Alonso de la Veracruz's theses on civil power, which sought to integrate the native inhabitants of the New World into the Spanish political community. These theses, which have usually been associated with F. de Vitoria and Spanish Thomism, have recently come to be considered part of a Novohispanic republicanism developed in the American periphery. The article seeks to show that the purpose of such theses was to apply a theory of natural rights that did not entail the political participation of the indigenous population, as well as to analyze Veracruz's position regarding cultural diversity and the war against the indigenous peoples. Os exemplos da monarquia sagrada, da pena de morte e da distinção arcaica amigo-inimigo permitem-nos compreender de que forma evoluíram o poder político, a lei e a guerra. Segundo Girard, todos estas instituições políticas estão enraizadas no mecanismo do bode expiatório, uma forma colectiva de violência contra uma vítima singular e que está na origem da religião e da cultura. TJie examples of sacred kingship, capital punishment and archaic friend-enemy-distinctions enable us to understand how political power, law and war evolved. According to Girard, all these political institutions are rooted in the scapegoat mechanism, an archaic form of collective violence against a single victim that created religion and culture. Girard's deconstruction of these institutions reveals their relativity. They are not eternal and unchangeable forms belonging to the political nature of human beings as such but offsprings of human violence beginning in the most intimate relationships. Although institutions like capital punishment or war help to contain human violence they can be abolished if human beings turn towards nonviolence and love of enemies as recommended in the Sermon on the Mount. Principles of Philosophy. Author’s Letter to the Translator (Preface).

While National Human Rights Institutions are widely regarded as particularly promising tools in the emerging transnational regime for the regulation of business and human rights, we still know little about their potential and actual contribution to this field. This article bridges the gap between business and human rights research and NHRI scholarship, proceeding in three steps: Firstly, I analyze the structural conditions for NHRIs to tackle business-related human rights abuses effectively, focusing on the key conditions of legitimacy and competences. Secondly, (...) I examine the envisaged role and functions of NHRIs in business and human rights regulation according to the Paris Principles and the UN Guiding Principles. Thirdly, I reconstruct and critically assess NHRIs’ mandates and powers to address corporate human rights abuse, based on the analysis of surveys and reports. I argue that there is a significant mismatch between the essential structural conditions for effective NHRI engagement with business and human rights, the expected contribution of NHRIs to the prevention and remedy of corporate human rights abuses, and the limitations of their mandates and powers in practice. To overcome that misalignment and unlock NHRIs’ full potential, this article proposes a reform of the Paris Principles which would provide these institutions with a robust source of international legitimacy and increase the pressure on state governments to extend their powers. Degree-sentences, i.e. sentences that seem to refer to things that allow of degrees, are widely used both inside and outside of philosophy, even though the metaphysics of degrees is much of an untrodden field. This paper aims to fill this lacuna by addressing the following four questions: [A] Is there some one thing, such that it is degree sensitive? [B] Are there things x, y, and z that stand in a certain relation to each other, viz. the relation that x (...) has more y than z? [C] In those cases in which degree sentences do not refer to phenomena that are degree sensitive, what is responsible for their prima facie seeming to do so? [D] If there are degree sensitive things, to which ontological categories do they belong? We answer each of these questions by arguing that there are, metaphysically speaking, different phenomena that degree sentences refer to: some refer to determinates that emanate from a certain determinable, others to tokens that are instantiations of a certain type, and yet others to what we call ‘complex, resultant properties that are constituted by stereotypical properties’. Finally, we show the relevance of our answers by applying them to the notions of freedom and belief. (shrink)

In this paper I explore, in sections 2 and 3, respectively, Herman Dooyeweerd’s notion of naive experience and the notion of common sense as found in the writings of Thomas Reid and G. E. Moore. I argue in section 4 that naive experience and common sense are assigned a structurally similar functional role by their advocates—viz., the role of touchstone for philosophy. In the final section I stage a conversation between Dooyeweerd and Reid about the touchstones they adopt.

How is it possible for a picture to depict a picture? Proponents of perceptual theories of depiction, who argue that the content of a picture is determined, in part, by the visual state it elicits in suitable viewers, that is, by a state of seeing-in, have given a plausible answer to this question. They say that a picture depicts a picture, in part, because, under appropriate conditions of observation, a suitable viewer will be able to see a picture in the (...) picture. In this article, I first argue that this answer is in conflict with the way in which some of the most influential perceptual theories of depiction – Robert Hopkins's version of the experienced resemblance theory and Dominic Lopes's version of the recognition theory – construe seeing-in. I then formulate a version of the recognition theory that avoids this conflict and show how it can explain the depiction of pictures. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Thomas Reid on MemoryRené van Woudenbergthis paper is a discussion of Thomas Reid’s views on memory as an “avenue of knowledge.” Part 1 deals with various remarks Reid makes concerning memory, knowledge, and belief which he holds to be “obvious and certain.” Part contains a more detailed discussion of Reid’s thesis that “memory is unaccountable.” Part 3 inquires how Reid’s critique of the Way of Ideas fits with his (...) own views on memory.Reid’s dealings with memory are part of his broader inquiries into the intellectual faculties of the human mind. In the Essays on the Intellectual Powers of Man Reid discusses not only memory, but other avenues of knowledge as well, such as perception and reasoning. In these essays Reid is doing straight epistemology. This is not to deny that Reid addresses other topics as well. In the essay on memory, for instance, Reid criticizes John Locke’s account of personal identity. But even then his discussion focusses on epistemological matters; one of his conclusions, for example, is that Locke confounded personal identity with the evidence we have of our personal identity, a thesis, Reid points out, that is bristled with absurd consequences. Although, then, Reid’s views on memory are related with his views on personal identity, I will abstain from a discussion of the latter. His epistemology of memory, I think, warrants attention in its own right.11. memory, knowledge, and beliefI.IIn Essay III of his Essays on the Intellectual Powers of Man [1784],2 entitled “Of Memory,” Reid writes: [End Page 117]It is by memory that we have an immediate knowledge of things past. The senses give us information of things only as they exist in the present moment.(EIP 339)Memory, says Reid, gives us knowledge of things past, whereas sense perception gives us knowledge of things present. Reid takes it to be “obvious and certain” (as the title of the first chapter of Essay III indicates) that “The object of memory, or thing remembered, must be something that is past; as the object of perception... must be something which is present. What now is, cannot be an object of memory; neither can that which is past and gone be an object of perception” (EIP 340).These remarks may, however, occasion some doubts. One way of explaining Reid’s remark that the object of memory is something that is past, is that whenever someone, S, remembers something, viz., that p, p will be a proposition about something that is past.3 This explanation gives the right result for such propositions as there was snowfall in late August, and she once visited Finland4 But, as Norman Malcolm has observed, it does not always give the right results.5 For, he says, there are cases of S remembering that p, where p is not a proposition about the past. Let p be his telephone number is 2 79-289-59 75, or his car is in the garage. What is remembered, in these cases, is a proposition about something that is not past, but present (or: about what is presently the case). It is, so it seems at least, possible for S to remember the present.It even seems possible for S “to remember the future” (something Aristotle deemed impossible).6 S can remember, for instance, that the game starts at 8:00 P.M., or that there will be elections next year.No doubt some will find these suggestions preposterous. Still, we say such things as “I remember my telephone number” and “I remember the game starts at 8:00 P.M.” Someone who balks at the suggestion that we can remember present and even future things, therefore, has to find a way of dealing with these quite common modes of saying. One way would be to argue that these manners of saying are incorrect, another that they are elliptical. Since the first thesis is unconvincing (it is, after all, correct, i.e., correct English to use the expressions under consideration), we are left with the second, viz., that these modes of saying are elliptical. We investigate sequent calculi for the weak modal (propositional) system reduced to the equivalence rule and extensions of it up to the full Kripke system containing monotonicity, conjunction and necessitation rules. The calculi have cut elimination and we concentrate on the inversion of rules to give in each case an effective procedure which for every sequent either furnishes a proof or a finite countermodel of it. Applications to the cardinality of countermodels, the inversion of rules and the derivability of Löb (...) rules are given. (shrink)

The development of executive functions is recognizably correlated to culture, contextual and social factors. However, studies considering all the basic EF are still scarce in Brazil, most notably in the Northeast region, which is known for its social inequality and economic gap. This study aimed to analyze the developmental trajectories and structure of four EF, namely inhibition, flexibility, working memory and planning. In addition, the potential effects of socioeconomic status and gender were examined. The sample included 230 Brazilian children between (...) 7-12 years old, homogeneously distributed by age, gender and type of school. The EF were assessed through the Brazilian version of the Child Executive Functions Battery. A global effect of age was found for most of the EF measures evaluated. Gender effect was mostly non-significant, except for 4 of the 12 tasks. There was a significant SES effect on 8 tasks, all in favor of private school children. Exploratory factorial and correlation analysis showed a 4-factor EF structure, corroborating the theoretical distribution considered in the CEF-B. A developmental progression is evident in the results for all of the EF measures evaluated. While gender had little influence on EF, SES seems to significantly impact the development of EF. As normative data are still lacking in Northeast Brazil, this study may help to understand EF development trajectories and provide tools for neuropsychological evaluation. (shrink)

Seeking a historical-philosophical approach to science teaching, narrative texts have been used as pedagogical tools to improve the learning experience of students. A review of the literature of different types of narrative texts and their different rates of effectiveness in science education is presented. This study was developed using the so-called Historical Narrative as a tool to introduce science content from a historical-philosophical approach, aiming to discuss science as a human construction. This project was carried out in a 9th grade (...) Physics class in K-12 school, in Rio de Janeiro, Brazil. The steps involved in constructing a Historical Narrative based on the controversy over animal electrical fluid between Luigi Galvani and Alessandro Volta is reported herein. Finally, qualitative research results of the activities inspired by this Historical Narrative are presented with the purpose of answering the research question: to what extent do Historical Narratives support and enhance discussions about the Nature of Science, through teaching the scientific content in a historical-philosophical approach with 9th grade students? The results indicate that Historical Narrative, based on historical episodes, is a good “door opener” to teach scientific content in a historical-philosophical approach, introducing discussions about the Nature of Science without neglecting the scientific content or simplifying the discussions about the NOS. Este artículo tiene por objetivo realizar una crítica inmanente a la obra de Freud. Su principal hipótesis es que el concepto antropológico hobbesiano del estado de naturaleza, como la guerra de todos contra todos, infl uencia Freud y produce algunos impasses mayores en su obra: la imposibilidad de fundar una clínica que no dependa de la sugestión y la imposibilidad de pensar un lazo social ateo, es decir, no regulado por la culpa. Para llevar adelante este encuentro entre Freud (...) y Hobbes, este artículo recurre al concepto de “paradigma inmunitario” de Roberto Esposito. En este sentido el artículo muestra, junto a la lectura que René Girard hace de Totem y Tabú, que el concepto freudiano de sacrifi cio, lejos de apaciguar la ley totémica, la produce retroactivamente. La consecuencia de esta relación invertida entre ley y sacrifi cio ha sido caracterizada como la inevitable deriva tanatopolítica del liberalismo moderno: para conservar la vida, hay que sacrifi carla; para conservar la ley, hay que fundarla y refundarla con violência ilegítima. Es decir, una vez que la obra de Freud asume los presupuestos antropológicos hobbesianos, queda atrapada entre el fantasma del retorno destructivo del salvaje pre-social y la ley superyoica que, si bien parece ser la única capaz de controlar al salvaje, no hace sino que perpetuar su violencia y la necesidad de repetir el sacrificio. The paper is intended to focus on peculiarities of nanomedicine and the importance of social concerns implicated, in order to understand if existing regulations are appropriate to maintain its safety or if a new ad hoc regulatory framework is needed. Consideration of social challenges will underline the crucial role of medical ethics in regulatory discussion.

This article seeks to state, first, what traditionally has been assumed must be the case in order for an infinite epistemic regress to arise. It identifies three assumptions. Next it discusses Jeanne Peijnenburg's and David Atkinson's setting up of their argument for the claim that some infinite epistemic regresses can actually be completed and hence that, in addition to foundationalism, coherentism, and infinitism, there is yet another solution (if only a partial one) to the traditional epistemic regress problem. The article (...) argues that Peijnenburg and Atkinson fail to address the traditional regress problem, as they don't adopt all of the three assumptions that underlie the traditional regress problem. It also points to a problem in the notion of making probable that Peijnenburg and Atkinson use in their account of justification. (shrink)

Our lives are increasingly intertwined with the digital realm, and with new technology, new ethical problems emerge. The academic field that addresses these problems—which we tentatively call ‘digital ethics’—can be an important intellectual resource for policy making and regulation. This is why it is important to understand how the new ethical challenges of a digital society are being met by academic research. We have undertaken a scientometric analysis to arrive at a better understanding of the nature, scope and dynamics of (...) the field of digital ethics. Our approach in this paper shows how the field of digital ethics is distributed over various academic disciplines. By first having experts select a collection of keywords central to digital ethics, we have generated a dataset of articles discussing these issues. This approach allows us to generate a scientometric visualisation of the field of digital ethics, without being constrained by any preconceived definitions of academic disciplines. We have first of all found that the number of publications pertaining to digital ethics is exponentially increasing. We furthermore established that whereas one may expect digital ethics to be a species of ethics, we in fact found that the various questions pertaining to digital ethics are predominantly being discussed in computer science, law and biomedical science. It is in these fields, more than in the independent field of ethics, that ethical discourse is being developed around concrete and often technical issues. Moreover, it appears that some important ethical values are very prominent in one field (e.g., autonomy in medical science), while being almost absent in others. We conclude that to get a thorough understanding of, and grip on, all the hard ethical questions of a digital society, ethicists, policy makers and legal scholars will need to familiarize themselves with the concrete and practical work that is being done across a range of different scientific fields to deal with these questions. This book tells the curious story of an unexpected finding that sheds light on a crucial moment in the development of physics: the discovery of artificial radioactivity induced by neutrons. The finding in question is a notebook, clearly written in Fermi's handwriting, which records the frenzied days and nights that Fermi spent experimenting alone, driven by his theoretical ideas on beta decay. The notebook was found by the authors while browsing through documents left by Oscar D'Agostino, the chemist among Fermi's (...) group. From Fermi's notes, they reconstruct with skill and expertise the detailed timeline of the critical days leading up to his vital discovery. While much is already known about the road that led Fermi to his important result, this is the first time that it has been possible to reconstruct precisely when and how the initial evidence of neutron-induced decay was obtained. In relating this fascinating story, the book will be of great interest not only to those with a passion for the history of science but also to a wider audience. (shrink)

Since the UN Guiding Principles on Business and Human Rights were adopted by the UN Human Rights Council in 2011, they have diffused into policy frameworks, laws, and regulations across the globe. This special issue seeks to advance the interdisciplinary field of human rights research by examining key elements of the emerging transnational regime for the regulation of business and human rights. In seven original contributions, scholars from political science, law, accounting, and philosophy critically reflect on the theoretical foundations of (...) the UNGPs, they analyze the effectiveness of implementation mechanisms and current regulatory practice, and they advance proposals for the future development of the business and human rights regime. In this introduction, we prepare the ground for these analyses, proceeding in three steps. Firstly, we argue that the adoption of the UNGPs has triggered a norm cascade which requires a distinctive, empirically oriented research agenda focusing on the scope, governance, and effectiveness of corporate human rights accountability norms and instruments. Secondly, we explain how the articles in this special issue contribute to that research agenda by addressing these themes. Thirdly, we provide an overview of the individual contributions and point out avenues for future research. (shrink)
