Without succumbing to standard interpretations of physical science, chemical methods of experimental investigation, classification, reference, theorizing, prediction and production of new entities are developed one by one as first steps towards a philosophy of chemistry. Chemistry challenges traditional concepts of empirical object, empirical predicate, reference frame and theory, but also the distinction commonly drawn between natural science and (...) technology. This paper aims to propose a version of the description theory of reference –for short, descriptivism– on natural kind terms. This version is grounded on some proposals of descriptivists, such as Searle and Strawson, about proper names, which will be extended to natural kind terms. According to Searle and Strawson the reference of a proper name is determined by a sufficient number of the descriptions that speakers associate with the name, but among the sorts of descriptions admitted by (...) these authors are those in which the average speaker defers the reference of a term to other speakers. In this regard, descriptivism can accept Putnam’s thesis of the division of linguistic labour and claim that some of the descriptions associated by non-experts have the function of deferring the reference of natural kind terms to their reference in the use by experts. Thus, descriptivism can maintain that the reference of a natural kind term is determined by a sufficient number of the descriptions that experts concerning a natural kind associate with the term. I will argue that this version of descriptivism, which grants more weight to social links than to historical links, can explain better than Kripke’s theory the reference of the use of natural kind terms by the average speaker. Terence Horgan and Mark Timmons have written a number of articles where they use their Moral Twin Earth thought experiment to attack the new moral realism. The new moral realism is based on advances made in the philosophy of language that allows us to introduce synthetic definitions of moral terms. The Moral Twin Earth thought experiment relies in crucial ways on the use of intuitions. Specifically, it relies on the intuitions that were Earthers and Twin Earthers to meet, they (...) would be able to have genuine moral disagreements. Horgan and Timmons rely on that intuition when they argue that the meaning of the relevant terms on Earth and Twin Earth must be the same. I will argue that we can accept that Earthers and Twin Earthers can have genuine moral disagreement while at the same time claim that the terms they use have different referents and so different semantic meaning. That is, having genuine disagreements does not require that the semantic meaning or the reference of the terms used in the debate being the same. (shrink)

The volume presents the proceedings of the international symposium, fruit of a common research project engaged in by 48 scholars, that took place in Rome to celebrate the 8th centennial of Saint Bonaventure's birth. The theme, "Deus summe cognoscibilis", could sound, in the contemporary agnostic, secular context, like a provocation. The approach, however, of the symposium was to consider "the current theological relevance of Saint Bonaventure", focusing on thinking with our author about a number of themes: theological method (philosophy, (...) theology and mysticism); revelation (in Scripture and history); creation (in Laudato si' and evolution); Christology (the triplex Verbum and logos of the Cross); ecclesiology and Trinitarian dimensions of sacramental theology; pre-phenomenological Trinitarian theology, and our own divine filiation. An appendix contains a previously unpublished text of J. Ratzinger about Bonaventure's theological method. The volume has also two indexes (authors' names and references to the works of Bonaventure). To explain evaluation we need to take into account the perspective of an evaluator, we need to turn to phenomenological approach in moral theory. This is the approach proposed by John McDowell. According to him, we need to approach to the question ‘How to live right?’ via the concept of a virtuous person. To lendsupport to his views McDowell employs Wittgensteinean philosophy that could be a good basis for establishing moral phenomenology as a metaethical approach to moral phenomena. First (...) of all, introducing the notion of language-game we can provide a metaethical explanation of moral terms referring to roles they play in certain language-games. From this point of view there is no difference between moral terms and other terms. But understanding a language-game not just as a model of a certain kind of behavior formed by external observer, but as a form of life we can capture moral phenomena form within. The language-game considered as the form of life allows us to discern certain phenomena as moral ones. That is why trying to answer the question about right livingfrom the virtuous person perspective we should be involved in a language game that carves moral phenomena from the brute stuff of the world and forms a certain kind of sensitivity in us to these properties. Wittgensteinean philosophy also allows us to answer the question: how can mere knowledge of situation make us behave? Following Wittgensteinean ideas, we can present moral knowledge as something uncodifiable, which is exhibited in our everyday life, in our way of living and ‘going on doing the same thing’. It is impossible to understand this knowledge from the external point of view. To see how this knowledge can motivate someone, we need to capture the way the person appreciates a particular situation. (shrink)

According to Kant, we refer to what is out there in the world by performing a demonstrative act, like pointing at an object with a finger. A Kantian mode of demonstrative reference is characterized by the existence of a real, 2-placed affective relation between an intuiting subject and the referent. Parsons suggests that Kantian intuition is both singular and immediate, and immediacy demands an object of intuition to be present, a condition clearly satisfied by objects within our immediate perceptual (...) field. But since we do not have an immediate relation with remote objects, the scope of our demonstrative reference is severely restricted by intuitional immediacy. I wish to develop a global Kantian intuition in order to extend the scope of demonstrative reference. Kant's ontology of space entails that the global representability of space be given to an intuiting subject as a form of intuition. According to Melnick, Kantian intuition is a kinematic operation which involves directing attention and moving about. To make contact with the world, the subject must move away from its locale: although a spatially remote object is not immediately present, we can shift our location by taking a path such that W will become so. Once we are close enough to be affected by W, we will be able to point at W and say "This." Thus, the intuitive scope of demonstrative reference is globalized as we shift our location. (shrink)

Since the first half of the nineteenth century in which English was introduced as the language of higher education in India, the word and concept of “philosophy” has played an important role in Indian intellectual life. First the study of philosophy must have meant the study of Western philosophy in Indian universities, butlater various attempts were made to discover the Indian versions of philosophical traditions in Sanskrit literature. Today no one doubts that there has been a rich (...) and very long tradition of such intellectual activities as are fully compatible with what European philosophers have actually been doing. Nevertheless, it is sometimes very difficult to draw a strict line between philosophy and religion in Indian thought. The present study will focus on that passage of the Nyāyamañjarī by a Kashmirian Nyāya scholar Jayanta which deals with the justification of the authority of the Vedas and other religious scriptures. From the analysis of the passage we may detect that there are two different dimensions in his application of logic for this issue. On the one hand he appeals to logical thinking for the defence of the Vedic authority and tries to establish the proper proof. But on the other hand he seems to be conscious of the limitation of reasoning, for he refers to those thinkers without refuting them in the latter half of the passage, according to whom every religious scripture must be accepted as valid insofar as the path of reasoning and argumentation is taken. The Paleolithic art interpretation is still a polemical subject. Nearly 300 caves covered with Paleolithic paintings have been discovered and more than 90% are located in Spain and in France. Surprisingly, more than half the painted illustrations are abstract patterns such as dots and lines. The high realism of naturalist figures also stands out. We will present the four groups of theories that have been formulated since the end of the XIXth century in order to interpret the Paleolithic art: the (...) artistic theory from Lartet and Piette; the magical hunting theory from anthropologists such as Tylor and Frazer and archeologists like Breuil; the structuralist theory from Raphael, Leroi- Gourhan and Laming-Emperaire; and lastly the shamanist theory from Lewis-Williams and Clottes. We will also refer to the agglutinative theory gathering all of these from Ucko and Rosefeld. Afterwards I will offer my own thought. This paper is an interpretation of the thought of the twentieth century Korean religious thinker, Yoo Yŏng-mo (柳永模, 1890-1981), a pioneer figure who sought to re-conceptualise a Christian understanding of the Ultimate Reality in the light of a positive openness to the plurality of Korean religions. Yoo Yŏng-mo considered that it was possible to present an overall picture of harmony and complementarity between the three traditions of Korea and Christianity, and this is endorsed by the present thesis. This essay is (...) aimed at providing a religious rationale for inter-faith dialogue. Using the principles of ‘Change’ (易, i) and ‘Yin-ying’ (陰陽)dominated in Chinese Classics and East Asian way of thinking, this paper lays out a methodology for envisaging harmony and mutual complementarity between traditions. The effect of some central concepts from within Confucian, Buddhist and Taioist tradition on the Christian thought of Yoo Yŏng-mo is then analysed and examined. In this respect, this paper argues that the Ultimate Reality based on the principle of harmony and mutual complementarity is not only both personal and impersonal as well as both transcendent and imminent, but also neither personal nor impersonal as well as neither transcendent nor imminent. Essentially, therefore, this essay accepts that Yoo Yŏng-mo’s equating of the Christian idea of God with the ‘Great Ultimate’ (太極) in Confucianism, with ‘Nothingness’ (無) in Buddhism and with the ‘One’ or Tao (道) in the thought of Lao-Chuang (老莊思想) of Taoism is a legitimate equivalence to make and that this does indeed pave the way for a potentially fruitful dialogue between Korea’s main religions. The drawing together of the Great Ultimate, Absolute Nothingness, the One Absolute from the Tao and the traditional personal God of Christianity gives the discussion an entirely new direction which has become a challenge for traditional orthodoxChristian theology and also for a pluralistic religious society. Buddhist logicians have rejected the reality of universals on the one hand, and, on the other hand, given a substitute in the form of the doctrine of Apoha. The doctrine of apoha first appears in Dinnaga’s Pramanasamuccaya, according to which words and concepts are negative by their very nature. They proceed on thebasis of negation. They express their own meaning only by repudiating their opposite meaning. The Buddhist logicians talk of two types of knowledge, viz., pratyaksa, which is non- relational (...) and anumana, which is relational. They accept nirvikalpaka pratyaksa as a pure pratyaksa, and savikalpaka pratyaksa has been merged with anumana by them. According to them, cognition is either a direct awareness of an object, which is independent of any mentalconstructionor it is an awareness of an object which is a mentalconstruction. Further, according to the Buddhist logicians inferences are of two kinds, viz., svarthanumana and pararthanumana. But they do not accept pararthanumana as a source of knowledge. Now, since perception is devoid of kalpana, perceptual knowledge is essentially non-linguistic and does not involve any general concept or universal. Thus,Apoha has no role to play in perceptual knowledge. On the other hand, savikalpaka pratyaksa and anumana are based on kalpana, thus according to the Buddhist logicians knowledge of universal is essential for both, savikalpaka pratyaksa and anumana. The paper starts by stating that the concept of progress, which is a key factor in the Enlightenment programme on the philosophy of history, has vanished from our society of risk, and posits whether it is possible today to rethink the philosophy of history. The second part refers to the negation of this philosophy by Badiou and Lyotard, due to the disappearance of the “modern subject”, which lay at its heart. There are many “histories”, but there is (...) no single “History”. The third part of the paper seeks to counteract that negation through the Sartrean concept of “alienation”, which involves a change in human relationships (“reification”), resulting from the “subject matter worked by praxis”. This is a concept that allows us to speak today of a universal history, whose “no-subject” would be that “worked subject matter”. The paper concludes by affirming that the aim of philosophy today is not to “contemplate the world” or “change the world” but rather to “take care of the world”. (shrink)

The link between empiricism and realism is crucially important in analytic philosophy. Empiricism is roughly the claim that knowledge must arise out of experience; it cannot, as Descartes thought, be innate. Realism is roughly the associated claim that whatever thought refers to is real, in a word, exists, independently of the mind. However, idealism (or idealism as understood by analytic philosophers) not only violates the rigorous philosophical standards that analytical philosophy has always claimed to exemplify, but undermines empiricism (...) (which in turn depends on realism) as well. For this reason, analytic philosophers particularly view idealism as the official enemy. There is a commonly held endoxon that idealism did not exist and could not exist before Plato, since the «Presocratics» did not yet distinguish between the material and the ideal etc. This preconception is based on the misleading conception of «Presocratics» as physicalists and the simplistic evolutionist scheme of Aristotle’s Metaph. A. In fact, religious and idealist metaphysics are attested in different archaic traditions before Plato, whereas «simple» physical theories of elements of the Milesian type did not exist before (...) the 6th century B.C. scientific revolution. 2. Those who deny the existence of idealism in Greek philosophy commonly refer to Myles F. Burnyeat. We will argue against this article on the following grounds: a) it is based on a selective and incomplete data from early Greek philosophy, b) Burnyeat understands by «idealism» subjective idealism and anti-realism. But Greek idealism as a rule is a form of objective idealism and has nothing to do with anti-realism. The two basic forms are: dualstic idealism and monistic idealism. 3. We will argue against modern naturalist interpretations of the Pythagorean first principles by Huffmann and others. Both in the table of opposites and in Philolaus πέρας καὶ ἄπειρον denote self-subsistent mathematical essences, ‘out of which’ physical bodies are composed. It is impossible to interpret “the limit and the unlimited” as physical bodies themselves or as properties of physical bodies. 4. We will argue for the Pythagorean origin of the 5th centu-ry graffiti on bones’ plates from Olbia. According to this early table of oppo-site, the body is ψεῦδος, i.e., an illusion. 5. The Zeller-Burnet interpretation of Parmenides B3 is grammatically impossible. The fragment states the identity of νοεῖν καὶ εἶναι, i.e., affirms mental nature of Being.6.The basic opposition of Parmenides’ Aletheia exactly corresponds to the basic opposition of doxa. Light is the active and thinking element, night is the «heavy», dense, corporeal substance. Sine light corresponds to Being, night corresponds to non-Being. The philosophy of Parmenides is a radical form of immaterialism and idealistic monism. (shrink)

In existential thought the thinking subject includes itself in its own thinking; this subject is not conceived as a substance that may be objectively determined, for its being lies in a making or constituting itself. Choice is thus the crucial concept of existential thought. Since choice involves awareness of the uncertainty of itspossible outcomes, anguish is inherent in it. Hence anguish in the face of our own freedom is essential to the human reality, and authenticity lies in facing anguish rather (...) than fleeing it. The term metaexistential refers, (1) to those systems that acknowledge absolute authenticity and truth to consist in going beyond existence in all its manifestations—those which are more unauthentic and less conflictive and distressful, as well as those which are less unauthentic and more conflictive and distressful—and (2) to those Paths of Awakening possessing the means for effectively going beyond existence and thus achieving absolute authenticity and truth. In fact, (1) only the Contemplation state of higher bodhisattvas and the state of Buddhahood, which are free from the subject-objectduality and thus beyond the bounds of existence and of the human reality, constitute a genuine surpassing of alienation and delusion, and hence only these conditions are true to our innermost nature; and (2) only a really effective practice of metaexistential methods such as Buddhist Paths can be conducive to these realizations. Philosophy should not be understood as a Eurocentric project of Greco-Judaic origin, but as a critical and fundamentally reflective intellectual practice which occurs worldwide, in many different forms. If this is so, anthropology has a crucial role to play in the project of reshaping philosophy's self-conception, to include the multiplicity of regional intellectual histories that have been neglected, and thus acknowledge and take seriously philosophical reflections from around the world. Through empirical observation, documentation, and comparative analysis, an anthropology (...) of philosophy can help philosophy reach a better self-understanding, particularly in times of rising awareness of globally operating interdependencies and suspicions that philosophy is a smoke-screen for Eurocentric power interests. Anthropological investigation, if performed carefully and in combination with philosophical expertise, can provide concrete details, accounts and assessments of philosophical practice around the world, different from those that a sociology of philosophies (Collins 1998) or a history of philosophy can offer. It can integrate understanding of local languages and sensitivity for relevant social contexts, and need not be philosophically naive. Philosophy is linked to knowledge, the quest for knowledge, the critique of knowledge, and to the various perspectives from which forms of knowledge can be described and conceptualised. An anthropology of philosophy can be developed in relation to an anthropology of knowledge (Lambek 1993), where various locally relevant forms of knowledge are identified, observed, described and discussed, in relation to social practice. Making the case for an anthropology of philosophy, my paper refers to arguments of African philosophers, and the debate on African philosophy, while also drawing from my own fieldwork experience on philosophical discourse in a Swahili context. In this paper, I will try to make clear that aspect of wisdom which relates to the practical application of revealed commands through prophetic practices and traditions of the other founders of religions. Here, I also refer to the wisdom in the Qur’an and the Old and New Testaments of the Bible as examples of the use of this concept in religion. Although both philosophy and religion require using the form of wisdom within a holistic approach, in the course (...) of time the concept of wisdom was neglected both in philosophy and religion. Because of this, after that one cannot judge the evaluation of complex situations in these two areas.Shortly, in this paper, I am going to discuss the place of wisdom in the Philosophy of Religion as a dynamic factor of thought and then propose a new understanding in the Philosophy of Religion because today this discipline is not fully appreciated by all the world religions. With the destruction of the Soviet Union and the fall of the Communist Party, Russia in the past few years has experienced a philosophical revolution unparalleled in suddenness and scope. Among the salient features of this revolution are the displacement of Marxism from its former, virtually monopolistic status to a distinctly subordinate and widely scorned position; the rediscovery of Russia’s pre-Marxist and anti-Marxist philosophers, in particular the religious thinkers of the past two centuries; increasing interest in Western philosophical traditions that (...) were neglected or condemned during the Soviet period; and special attention to the philosophy of culture, with particular reference to the role of philosophy in the national culture of Russia. In all of these new directions, a recurring and controversial theme is the widely perceived need for a new “Russian idea,” or something to “fill the ideological vacuum” left by the demise of Russian Marxism. This paper deals with the problem of the methodological foundations of social philosophy. The notion of "multidimensionality" as one of the key concepts in the new social philosophy paradigm is analyzed. This notion reflects some expanded pictures of the social and cultural world. The paper makes reference to H. Marcuse's, A. Toynbee's, R. Dahrendorfs, and P. Bourdieu's interpretations of multidimensionality. Their different approaches are considered. The author underlines the common positions of scholars' interpretations and shows the differences (...) in terminology. Primary attention is paid to the analysis of how researchers develop and use this new notion. The significance of this notion for the analysis of social phenomenon is underlined. This explication demonstrates the heuristic possibilities of the concept "multi-dimensionality" for the exploration of society. (shrink)

Chou and it is based on the physical/chemical principle of the massaction law (J. Theor. Biol. 59: 253-276, 1976 (質量作用中效定理) and Pharmacological Rev. 58: 621-681, 2006) (普世中效指數定理). The theory was developed by the principle of mathematical induction and deduction (數學演繹歸納法). Rearrangements of the median-effect equation lead to Michaelis-Menten, Hill, Scatchard, (...) and Henderson-Hasselbalch equations. The “median” serves as the universal reference point and the “common link” for the relationship of all entities and is also the “harmonic mean” of kinetic dissociation constants. Over 300 mechanism-specific equations have been derived and published using the mathematical induction-deduction process. These equations can be deduced into several general equations, including the median-mediated whole/part equation, combination index theorem, isobologram equation, and polygonogram. It is proven that “dose” and “effect” are interchangeable, thus, “substance” and “function” are interchangeable, which leads to “the unity theory” (劑效、心物、知行一元論) in quantitative mathematical philosophy (數學的定量哲學) in functional context. Therefore, a general theory centered on the “median” and based on equilibrium dynamics has evolved. In other words: [「中」的宇宙觀： 以「中」爲基凖的動力學生態平衡]. Based on the median-effect equation of the mass-action law, the fundamental claim is that we can draw “a specific cure” for only two data points, if they are determined accurately. This claim has far reaching consequences since it defies the general held belief that two points can dray only a straight line. Remarkably, the unity theory (一元論) providesscientific/mathematical interpretation in equations and in graphics of Chinese ancient philosophy, including Fu-Si Ba Gua (伏羲八卦), Dao’s Harmony (和諧), the Confucian doctrine of the mean (儒家中庸之道), Chou Dun-Yi’s (周敦頤, 1017-1073) From Wu-ji to Tai-ji and Taiji Tu Sho (無極而太極及太極圖說). The moderntopological analysis for trinity yields an exact correspondence to the Ba-Gua, which was introduced over 4,000 years ago. Furthermore, the median-centered algorithm, promotes modern ecological content (生態學) in the equilibral dynamic state of harmony. It is concluded that Western science and Eastern philosophy are directly linked and complementary to each other. Since the truth in mathematical quantitative philosophy (數學的定量哲學) has no boundaries, East and West philosophies can flourish together for the common goal and ideal in science and in humanity (世界大同). German idealist philosopher J. G. Fichte (1762‐1814), as an heir to Kant, sought to uniformity of reason in his own philosophical system Wissenschaftslehre. However, the political implications of his philosophy have dual aspects. The first is his own political theory presented in accordance with his philosophical principles. The second is a set of political influences concerning his practical position together with his philosophy. By and large it has been the second aspect that Fichte’s nationalistic perspectives were interpreted upon. (...) So the political implications of his philosophy have been frequently reduced as a prophet of ethnic German nationalism and Nazism. But we need to distinguish his systematic theory from the influences resulted from his practical attitudes. Because he proposed an alternative idea of nationalism built on the basis of his philosophical principles. In reference to ‘nationality’, what Fichte has in mind was the activeness of man and the universality of the structure which operates while he or she is acting. For Fichte, activeness of consciousness and life are the one thing. With this presupposition, ‘nationality’ is conceptualized as the phase of commonness and reciprocity that comes into being among the self-forming conscious beings. Therefore his idea of ‘nationality’ couldn’t be grasped all in primordial dimension such as in ethnic nationalism. The original and fundamental base of nationality is man’s acting power working constantly toward perfection of man himself. (shrink)

The latest publication of the series, Sovietica of the Institute of East-European Studies, University of Fribourg is a synopsis by the indefatigable Father Bocheński of the official text-book, Osnovy Marksistsjoj Filosofi which was published in 1958 by the Institute of Philosophy of the Academy of Sciences of the Soviet Union. From that volume of some 700 pages, written by a team of eleven philosophers under the direction of F V Cinstantinov, the central theses have been collected into a slim (...) catechism of 62 pages, with their aphoristic propositions decimally numbered and referred to the pagination of the original Russian text, and served with a 15-page systematic index. The result is an orthodox summary of post-Stalinistic Marxist-Leninist philosophy, which remains close to the classic formulations and was revised only slightly in 1959 by the twenty-first Congress of the CPSU. In his Welcome Message for the XXII World Congress of Philosophy hosted by Seoul National University in August 2008 the President of the International Federation of Philosophical Societies (FISP), Peter Kemp, said that—inter alia—it will be an occasion “for rethinking the great philosophical questions.” Amongst there questions how we in the present understand the philosophical past is surely a perennial query before us. In this short paper I will refer to the endeavor of understanding past philosophical thought on its (...) own terms or as presented in a current idiom as “philosophical translation.” The latter can take three forms: logical, analytical, or hermeneutic. This paper will briefly discuss all three forms vis-à-vis modern attempts to understand the medieval concept of “supposition” with special regard to the role metalanguage plays in philosophical translation. Les fondements de la théorie du choix rationnel, dans ses multiples déclinaisons (économie théorique, théorie de la décision, théorie des jeux, théorie de l'action que l'on trouve au cœur de la philosophie analytique, etc.), ne sont plus aussi assurés en cette fin du XXe siècle qu'ils semblaient l'être durant, ou immédiatement après, la Seconde Guerre mondiale, lorsqu'un John von Neumann ou un Leonard Savage en posaient les prolégomènes. A la source des difficultés présentes, on trouve l'ambition croissante de la théorie (...) du choix rationnel d'expliquer, et surtout de fonder, des phénomènes très éloignés du champ à l'intérieur duquel elle s'était d'abord confinée. Le défi le plus grand que le choix rationnel s'est fixé à lui-même est de rendre compte de la possibilité du jugement moral dans un monde d'individus isolés, autonomes et intéressés (et notamment de la promesse, de l'engagement, du contrat, de la parole donnée et tenue, de la menace, de la dissuasion crédible et efficace). C'est en tentant de relever ces défis que les théoriciens ont rencontré sur leur chemin, comme autant d'obstacles inattendus, des paradoxes redoutables. Ce livre présente les recherches les plus récentes dans le domaine. Il s'en dégage la thèse que le paradigme de la rationalité est radicalement incomplet. L'idéal de transparence qui est au cœur de la théorie du choix rationnel est incapable de venir à bout de l'extériorité et de l'opacité du collectif. Si elles ne prenaient appui sur des références extérieures qui les guident en les " poussant ", les interactions entre acteurs rationnels seraient en général incapables de produire à elles seules quoi que ce soit de déterminé. Les recherches ici présentées s'attachent à définir ce que sont ces dispositifs collectifs cognitifs qui encadrent et servent de support aux décisions individuelles. Elles s'inscrivent dans cette synergie entre sciences sociales, sciences cognitives et philosophie qui renouvelle aujourd'hui les sciences de l'homme. (shrink)

THE opening paragraph of the Declaration of Independence invokes, as every American should know, "the Laws of Nature and of Nature’s God." The import of this invocation may be discerned by examining the appeals to natural law in the polemical literature of the American revolutionary period against the background of natural law/natural rights philosophy in the seventeenth and eighteenth centuries, on the one hand, and, on the other hand, within the particular historical context of events constituting the American Revolution. (...) The phrase "the Laws of Nature and of Nature’s God" in the Declaration is revealing. It simplifies what had, in earlier times, been referred to as "fundamental law," omitting and de-emphasizing, however, some rather essential elements. Historically, fundamental law had always been esteemed to be a law superior to statutory or positive law. Unless the latter conforms to the former, it is not valid, and invalid positive laws are null and void, so that there is no obligation to obey them. In the history of British jurisprudence, which includes colonial American jurisprudence, fundamental law embraced divine law, natural law, the British constitution beginning with Magna Carta, common law, and the colonial charters. Appeals to fundamental law were made when protesting statutory or positive laws and decrees. Thus the Declaration and Resolves of the First Continental Congress in October, 1774, invokes "the immutable laws of nature, the principles of the British constitution, and the several charters and compacts" as the moral, rational, and ultimate legal basis for protesting alleged British encroachments on American rights. Yet less than two years later, the Declaration of Independence, abandoning the British constitution and dissolving the political band—the charters and compacts—between Great Britain and America, rests simply on "the Laws of Nature and of Nature’s God.". Le volume "Images de Platon et lectures de ses oeuvres" rassemble vingt et une contributions consacrees a diverses relectures qui ont ete faites de l'oeuvre ecrite de Platon entre le IIIe siecle (Diogene Laerce, Plotin) et le XXe sievle (K. Popper). Dans l'introduction, Ada Neschke met en lumiere le cheminement de ces relectures et souligne le fait que les lectures de Platon sont constamment alimentees par des preoccupations propres a ses lecteurs. Dans un premier temps, l'oeuvre de Platon est integree (...) dans une optique essentiellement theologique; apres l'avenement du kantisme, elle s'inscrit dans un cadre de pensee qui se veut critique et philosophique, c'est-a-dire emancipe de l'ancienne metaphysique. Ainsi, l'oeuvre de Platon represente, d'une part, pour les penseurs chretiens une source d'inspiration concernant les sujets les plus divers: la theologie chretienne (Clement d'Alexandrie, Ficin, les Platoniciens de Cambridge), la mytho-theologie neo-platonicienne (Plethon), l'iconographie de la trinite (Francisco di Hollanda), la politique catholique et le calviniste (Jean Bodin, Jean de Serres), le scepticisme face aux debats theologiques (Montaigne). D'autre part, Platon a la valeur d'une autorite pour les penseurs postkantiens, que ce soit pour construire une philosophie de la nature (Schelling), une ethique (Hegel), une epistemologie (les neo-kantiens Cohen et Natorp) ou encore une ontologie (Heidegger). Enfin, Platon sert de reference dans les debats politiques modernes et contemporains, en particulier dans les discussions sur le liberalisme (J. This essay combines information on the recent ISUD Sixth World Congress Humanity at the Turning Point: Rethinking Nature, Culture, and Freedom and some reflections inspired by presentations and discussions at the congress. It is focused on the presentation of one of the keynote speakers, Karl-Otto Apel, entitled “Discourse Ethics, Democracy, and International Law: Toward a Globalization of Practical Reason”. Apel argued that the transcendental-pragmatic foundation of morality serves as the ultimate basis for the universal conception of law, e.g., of human (...) rights. It establishes the transcendental basis of the idea of democracy, and at the same time establishes a regulative principle for a possible critique of the democratic states. Apel discussed the question of a political order of law able to represent the idea of human rights. In his approach to it, he referred to Kant’s idea of “a federation of free states” (as opposite to a “world state”) in the solution of the problem of a cosmopolitan system He noticed the tension between two orientations of international law: one towards “human rights” and hence a cosmopolitan law of single citizens and the other towards the sovereignty of single states. He asserted that the universal conception of law cannot be reduced to the legislative autonomy of any state. Consequently, the universal conception of human rights cannot be adequately realized either by particular democratic states or by a world state as a despotic superpower. Apel concluded that an adequate institution for the current debate regarding the issues of global peace and security can only be a federation of nations like the UN, the meta-institution of global discourse and the political representation of international law. At the heart of the essay is Kant’s cosmopolitan ideal and its relevance for today’s discussions about peace and security. Attention is paid to the attempts to rethink Kant by Karl-Otto Apel, Jürgen Habermas, Jaques Derrida, Martha Nussbaum, and David Held, among others. Some of the authors indicate the tension between the sovereignty ofstates and the universality of human rights. Other authors criticize cosmopolitanism as overly unifying in contrast to the socio-cultural diversity of societies. The essay draws a contrast between two tendencies concerning international relations. One is the current neoconservative course toward American domination throughout the world. An alternative to this is the philosophers’ call for “the cosmopolitan model of democracy” and strengthening the network of transnational grass-roots movements and international institutions, including the UN. The following paper presents a transcendental concept of time. It is based on Fichte’s theory of the cross-link between subjectivity and objectivity on the one hand and the manifestation of the absolute being in internal and external acts of existence on the other hand. Referring to the theme of the congress, “Fichte and his time”, and by applying the named four principles it is possible to deduce a complex structure of time divided into four dimensions. These dimensions are namely the (...) following: the biographical time, which means the external, yet subjective dimension of time; the contemporary time, which means the external, yet objective dimension of time; the eschatological time, which means the internal, yet objective dimension of time and the ontogenetic time, referring to the internal, yet subjective dimension of time.Understanding “Fichte and his time” cannot be reduced to explaining his thoughts in the light of the ideas of the philosophers of his time, including Kant, Schelling Reinhold etc. Neither is it possible to understand the topic just from the perspective of the contemporary, political and social circumstances Fichte lived in, e. g. the French Revolution. “Fichte and his time” should rather be explained from the context and the interaction between the four dimensions of time. According to Fichte’s own understanding it is mainly the eschatological and the ontogenetic dimensions that enable a true, meaningful and blessed time life. (shrink)
