In this roundtable discussion, early-career researchers working in the field of law, gender, and sexuality discuss international and trans-national developments to legal gender. ‘The Future of Legal Gender’ research project focused on the legislative framework of England and Wales to develop a prototype for decertification. The domestic legislation, however, was situated within a wider international context throughout the project. This roundtable discussion, therefore, provided an opportunity for reflection on the transnational issues raised by decertification, with a particular focus on developments (...) arising in the jurisdiction(s) studied by the early career researchers. The roundtable began with a brief outline of these recent developments before moving to an open discussion on key themes including the value of reform on wider society, changes on-the-ground by non-state actors, and alternative processes for tackling gender inequalities without certifying legal gender. This theory is more or less orthogonal to the standard entropy-based notions of information known from physics, information theory, and computer science that all define the amount of information in a certain system as a scalar value without any direct semantic implication. In this context the question rises what the exact relation between these various conceptions of information is and (...) whether there is a real need to enrich these mathematically more or less rigid definitions with a less formal notion of semantic information. I investigate various philosophical aspects of the more formal definitions of information in the light of Floridi’s theory. The position I defend is that the formal treatment of the notion of information as a general theory of entropy is one of the fundamental achievements of modern science that in itself is a rich source for new philosophical reflection. This makes information theory a competitor of classical epistemology rather than a servant. In this light Floridi’s philosophy of information is more a reprise of classical epistemology that only pays lip service to information theory but fails to address the important central questions of philosophy of information. Specifically, I will defend the view that notions that are associated with truth, knowledge, and meaning all can adequately be reconstructed in the context of modern information theory and that consequently there is no need to introduce a concept of semantic information. In this reply I try to show that, contrary to Milberry’s apparent assertion, the general intellect of the multitude does not have the explanatory robustness she accredits to it. Digital network technologies are currently overwhelmingly effective in proletarianizing and disempowering the cognitariat and only an active technopolitics of deproletarianization could reverse this hegemonic situation. In my response to Verbeek, I attempt to correct his misinterpretation of the Stieglerian approach as being dialectical in nature and show that, far from reinstating the (...) humanist dichotomy between human beings and technologies, my analysis assumes their original, albeit fundamentally ambiguous and even ‘uncanny’ [unheimlich] interconnection. I conclude with pointing out some implications of this view for a ‘really realistic’ political theory of technology. (shrink)

Essentialism is one of the most pervasive problems in mental health research. Many psychiatrists still hold the view that their nosologies will enable them, sooner or later, to carve nature at its joints and to identify and chart the essence of mental disorders. Moreover, according to recent research in social psychology, some laypeople tend to think along similar essentialist lines. The main aim of this article is to highlight a number of processes that possibly explain the persistent presence and popularity (...) of essentialist conceptions of mental disorders. One such process is the general tendency of laypeople to essentialize conceptual structures, including biological, social, and psychiatric categories. Another process involves the allure of biological psychiatry. Advocating a categorical and biological approach, this strand of psychiatry probably reinforced the already existing lay essentialism about mental disorders. As such, the question regarding why we essentialize mental disorders is a salient example of how cultural trends zero in on natural tendencies, and vice versa, and how both can boost each other. This article has two general aims. It first of all critically reconsiders the empirical turn’s dismissal of transcendentalism in the philosophy of technology, in particular through the work of Ihde and Verbeek, and defends the continuing relevance of the notion of the transcencental in thinking about technology today, illustrating this mainly through a reading of Stiegler’s understanding of the human condition as a technical condition and his view of human (noetic) evolution as proceeding from a process of technical exteriorization. The (...) crucial issue that is missed by postphenomenology and the empirical turn is that technology itself in its empiricity occupies the (periodically changing) place of the transcendental. It thus fails to consider the transcendental operativity of technical artifacts within its own empiricist stance. Secondly, it argues for the continuing importance and usefulness of the idea of Technology with a capital T, equally discarded by the representatives of the empirical turn, in particular against the emerging backdrop of the Anthropocene as the age of decisive anthropogenic forcing of the planet and the growing dominance of what has recently been called the technosphere in Earth system science. With Stiegler I show that a proper, inherent dynamic of technology must be acknowledged historically, anthropologically, techno-evolutionarily as well as (techno)phenomenologically. I conclude by demonstrating that our time of planetary crisis summons us to redirect our attention to technology from the empirical to the transcendental, and from the micro-level to the macro-level again. Evolutionary psychiatrists invariably consider schizophrenia to be a paradox: how come natural selection has not yet eliminated the infamous ‘genes for schizophrenia’ if the disorder simply crushes the reproductive success of its carriers, if it has been around for thousands of years already, and if it has a uniform prevalence throughout the world? Usually, the answer is that the schizophrenic genotype is subject to some kind of balancing selection: the benefits it confers would then outbalance the obvious damage it does. (...) In this paper, however, I will show that the assumptions underlying such evolutionary accounts of schizophrenia are at least implausible, and sometimes even erroneous. First of all, I will examine some factual assumptions, in particular about schizophrenia’s impact on reproductive success, its genetics, its history, and its epidemiology. Secondly, I will take a critical look at a major philosophical assumption in evolutionary psychiatric explanations of schizophrenia. Indeed, evolutionary psychiatrists take it for granted that schizophrenia is a natural kind, i.e. a bounded and objectively real entity with discrete biological causes. My refutation of this natural kind view suggests that schizophrenia is in fact a reified umbrella concept, covering a heterogeneous group of disorders. Therefore, schizophrenia, as we now know it, simply doesn’t have an evolutionary history. (shrink)

Vladimir Putin’s legitimation of Russia’s brutal war of aggression against Ukraine raises questions about traditional understandings of nation and empire. Should we contrast the two in terms of values and practices? In this case, Putin uses both nationalist and Imperialist rhetoric to justify his actions. My essay questions how we understand nation and empire using the example of the Austro-Hungarian Empire. How did this empire develop laws, institutions and administrative practices to manage conflicts and claims around language use and nationalism? (...) How did Austria’s governments rule a multi-lingual, multi-confessional society effectively, without resorting to brutal policies of nationalization? When nationalist conflicts arose in different settings, how and why did they originate? I conclude that in European terms, Imperial Austria and even nationalist Hungary apparently managed daily-life issues around diverse language use and religious practice far more humanely and effectively than did the successor nation states after 1918. In Metaphysics M.2, 1077a9-14, Aristotle appears to argue against the existence of Platonic Forms on the basis of there being certain universal mathematical proofs which are about things that are ‘beyond’ the ordinary objects of mathematics and that cannot be identified with any of these. It is a very effective argument against Platonism, because it provides a counter-example to the core Platonic idea that there are Forms in order to serve as the object of scientific knowledge: the universal of which (...) theorems of universal mathematics are proven in Greek mathematics is neither Quantity in general nor any of the specific quantities, but Quantity-of-type-x. This universal cannot be a Platonic Form, for it is dependent on the types of quantity over which the variable ranges. Since for both Plato and Aristotle the object of scientific knowledge is that F which explains why G holds, as shown in a ‘direct’ proof about an arbitrary F (they merely disagree about the ontological status of this arbitrary F, whether a Form or a particular used in so far as it is F), Plato cannot maintain that Forms must be there as objects of scientific knowledge - unless the mathematics is changed. ‘The art of living with ICTs ’ today not only means finding new ways to cope, interact and create new lifestyles on the basis of the new digital technologies individually, as ‘consumer-citizens’. It also means inventing new modes of living, producing and, not in the least place, struggling collectively, as workers and producers. As the so-called digital revolution unfolds in the context of a neoliberal cognitive and consumerist capitalism, its ‘innovations’ are predominantly employed to modulate and control both production processes (...) and consumer behavior in view of the overall goal of extracting surplus value. Today, the digital networks overwhelmingly destroy social autonomy, instead engendering increasing social heteronomy and proletarianization. Yet it is these very networks themselves, as technical pharmaka in the sense of French ‘technophilosopher’ Bernard Stiegler, that can be employed as no other to struggle against this tendency. This paper briefly explores this possibility by reflecting upon current diagnoses of our ‘technological situation’ by some exemplary post-operaist Marxists from a Stieglerian, pharmacological perspective. One of the older questions in the debate about Corporate Social Responsibility (CSR) is whether it is worthwhile for organizations to pay attention to societal demands. This debate was emotionally, normatively, and ideologically loaded. Up to the present, this question has been an important trigger for empirical research in CSR. However, the answer to the question has apparently not been found yet, at least that is what many researchers state. This apparent ambivalence in CSR consequences invites a literature study that (...) can clarify the debate and allow for the drawing of conclusions. The results of the literature study performed here reveal that there is indeed clear empirical evidence for a positive correlation between corporate social and financial performance. Voices that state the opposite refer to out-dated material. Since the beginnings of the CSR debate, societies have changed. We can therefore clearly state that, for the present Western society, “Good Ethics is Good Business.”. (shrink)

Synodical unity in the Dutch Reformed Church in 1911 – an attempt that failed. In 1862 the Supreme Court of the Cape Colony terminated the synodical unity of the Dutch Reformed Church in South Africa. Delegates of congregations outside the Colony could no longer represent them in the Cape or Mother Synod. The court used Ordonnance 7 of 1843 of the Colony. In 1907 the newly founded Federal Council of Dutch Reformed Churches decided to lead an effort in the Church (...) to replace this federal bond with a closer synodical bond. The Council was a combined body of the four Dutch Reformed Churches of respectively the Transvaal, Free State, Natal and Cape. However, to achieve this, they needed the help of the state authorities of the Union of South Africa to scrap all legal obstacles in the way of the Dutch Reformed Church. After consultations with the authorities, the Church was asked to formulate a concept act to replace these hindrances. The act was accepted by Parliament, but the Church could not get the required three quarters of a majority in three quarters of its consistories for the bill to be accepted. Thus, the effort for a new synodical unity failed. Contribution: This article adds to the history of the synodical structure in the Dutch Reformed Church. In doing so it concentrates on the failed attempt in this church in 1911 to form an all-inclusive – as far as congregations are concerned – synodical bond with attention to the required church political principles behind such a structure. This is also relevant to the present efforts for unity in the family of Dutch Reformed Churches, as well as other reformed churches in Southern Africa. The approach is a reformed perspective on the relationship between state and church. (shrink)

: This article focuses on cognitive enhancement technologies and their possible anthropological implications, and argues for a reconsideration of the human-technology relation so as to be able to better understand and assess these implications. Current debates on cognitive enhancement consistently disregard the intimate intertwinement of humans and technology as well as the fundamentally technogenic nature of anthropogenesis. Yet, an adequate assessment of CET requires an in-depth and up-to-date re-conceptualization of both. Employing insights from the work of Bernard Stiegler, this article (...) proposes an organology and pharmacology of CE. What is typical about new CET is their interiorizing nature, which can be expected to fundamentally reshape organological configurations. Starting from the premise that CE is a phenomenon that predominantly unfolds within the current conjuncture of cognitive capitalism, I will present the issue of cognitive proletarianization as being of crucial importance for considering CE. I conclude by providing some methodological guidelines for the development of a positive pharmacology of CET and by suggesting that CET should be considered as technologies of the self sensu Michel Foucault. Abstractabstract:Most of Charles Darwin's ideas have withstood the test of time, but some of them turned out to be dead ends. This article focuses on one such dead end: Darwin's ideas about the connection between piloerection and mental illness. Piloerection is a medical umbrella term to refer to a number of phenomena in which our hair tends to stand on end. Darwin was one of the first scientists to study it systematically. In The Expression of the Emotions in Man and (...) Animals (1872), he discusses piloerection in the context of his analysis of the expressions involved in fear and anger, relying heavily on the evidence provided by one of his correspondents, the British psychiatrist James Crichton Browne. This essay reveals how Darwin's initial doubts about the similarity between piloerection in animals and psychiatric patients were eased when studying photographic portraits of female psychiatric patients sent to him by Crichton Browne. It considers arguments against Darwin's reading of these portraits and the apparent contrast between this reading and his own skepticism, in later years, about the value of documentary photography. The article concludes with some notes regarding the reception of Darwin's ideas about psychopathology. (shrink)

Maladapting Minds discusses a number of reasons why philosophers of psychiatry should take an interest in evolutionary explanations of mental disorders and, more generally, in evolutionary thinking. First of all, there is the nascent field of evolutionary psychiatry. Unlike other psychiatrists, evolutionary psychiatrists engage with ultimate, rather than proximate, questions about mental illnesses. Being a young and youthful new discipline, evolutionary psychiatry allows for a nice case study in the philosophy of science. Secondly, philosophers of psychiatry have engaged with evolutionary (...) theory because evolutionary considerations are often said to play a role in defining the concept of mental disorder. The basic question here is: Can the concept of mental disorder be given an objective definition, or is it rather a normative concept? Thirdly and finally, evolutionary thinking in psychiatry has often been a source of inspiration for a philosophical view on human nature. Thus evolutionary psychiatrists have suggested, for example, that man's vulnerability to mental disorders may well be one of the defining features of our species. -/- Written by leading authors in philosophy, psychiatry, biology and psychology, this volume illustrates that many debates in contemporary philosophy of psychiatry are profoundly influenced by evolutionary approaches to mental disorders. Conversely, it also reveals how philosophers can help contribute to the burgeoning field of evolutionary psychiatry. In chapter 8 of the Sophistical Refutations, Aristotle claims that his theory of fallacy is complete in the sense that there cannot be more fallacies than the ones he lists. In this article I try to explain how Aristotle could have justified this completeness claim by analysing how he conceptualizes fallacies (dialectical mistakes which do not appear so) and what conceptual ingredients play a role in his discussion of fallacies. If we take the format of dialectical discussions into account, we (...) will see that there are only so many mistakes one can make which still do not appear to be mistakes. Aristotle’s actual list is almost identical to these apparent mistakes. (shrink)

The aim of this doctoral dissertation is to closely explore the nature of Einstein’s block universe and to tease out its implications for the nature of time and human freedom. Four questions, in particular, are central to this dissertation, and set out the four dimensions of this philosophical investigation: (1) Does the block universe view of time follow inevitably from the theory of special relativity? (2) Is there room for the passage of time in the block universe? (3) Can we (...) distinguish past from future in the block universe? (4) Is there room for human freedom in the block universe? Although the answer of most philosophers would be yes, triple no, my own answer, controversially, is no, triple yes. -/- I thereby challenge the status quo with respect to each of these metaphysical questions, and argue that none of these questions can be answered from looking at physics alone. Physics may constrain our metaphysics, but it certainly does not settle it. What is needed in order to answer these questions, are additional metaphysical assumptions that fall outside the scope of modern physics. My primary goal in this dissertation, therefore, is not to settle the debates on the nature of time and human freedom, but to clarify them by expliciting the metaphysical assumptions that are otherwise left implicit. Since Aristotle and the Stoa, there has been a clash, worsened by modern predicate logic, between logically defined operator meanings and natural intuitions. Pragmatics has tried to neutralize the clash by an appeal to the Gricean conversational maxims. The present study argues that the pragmatic attempt has been unsuccessful. The “softness” of the Gricean explanation fails to do justice to the robustness of the intuitions concerned, leaving the relation between the principles evoked and the observed facts opaque. Moreover, there are (...) cases where the Gricean maxims fail to apply. A more adequate solution consists in the devising of a sound natural logic, part of the innate cognitive equipment of mankind. This account has proved successful in conjunction with a postulated cognitive mechanism in virtue of which the universe of discourse is stepwise and recursively restricted, so that the negation selects different complements according to the degree of restrictedness of Un. This mechanism explains not only the discrepancies between natural logical intuitions and known logical systems; it also accounts for certain systematic lexicalization gaps in the languages of the world. Finally, it is shown how stepwise restriction of Un produces the ontogenesis of natural predicate logic, while at the same time resolving the intuitive clashes with established logical systems that the Gricean maxims sought to explain. In this reply I further defend my claim that the transcendental should always remain a primary concern for philosophy of technology as a philosophical enterprise, contra the empirical turn’s rejection of it. Yet, instead of emphasizing the non-technological conditions of technology, as ‘classic’ thinkers of technology such as Heidegger did, it should recognize technology itself as the transcendental operator par excellence. Starting from Heidegger’s ontological understanding of transcendence I show that while technical artifacts may indeed always conform to a certain (...) horizon of understanding, they also constitute this horizon in specific ways. Following Stiegler I show that concrete technologies (technology with a small ‘t’) are not just empirical effects of an overarching movement of transcendence (Technology with a capital ‘T’) but are originally constitutive of it. In response to Romele’s critique that the social, language, images, imaginaries, symbols, etc. are also transcendentals, I argue that all these phenomena are always already conditioned by technical milieus. As for Besmer’s contention that I offer a reductive interpretation of postphenomenology’s notion of multistability, I argue that there are decisive systemic and organological limits to multistability offered by technical artefacts and that all variation in use and implementation is always constrained by inherent technical tendencies and processes of concretization. Agreeing with Besmer that the transcendental and the empirical should be understood not oppositional but compositional I argue that technology may be that which constantly ‘mediates’ between the two. This paper investigates the impact of negative screening on the investment universe as well as on financial performance. We come up with a novel identification process and as such depart from mainstream socially responsible investing literature by concentrating on individual firms’ conduct and by studying a much wider range of issues. Firstly, we study the size and financial performance of fourteen potentially controversial issues: abortion, adult entertainment, alcohol, animal testing, contraceptives, controversial weapons, fur, gambling, genetic engineering, meat, nuclear power, pork, (...) stem cells, and tobacco. We investigate an international sample of more than 1,600 stocks for more than twenty years. We then analyze the impact of applying negative screens to a market portfolio. Our findings suggest that the choice for negative screening strategies does matter for the size of the investment universe as well as for risk-adjusted return performance. Investing in controversial stocks in many cases results in additional risk-adjusted returns, whereas excluding them may reduce financial performance. These findings suggest that there are opportunity costs to negative screening. (shrink)

How do, according to Aristotle, peirastic arguments, which are employed by nonscientists to put professed scientists to the test, work, and how do they differ from genuine scientific arguments? A peirastic argument succeeds in unmasking a would-be scientist if it establishes an inconsistency among the answers given. These answers may only comprise: propositions which are proper to the field and which everybody can know; propositions which only scientists may know; “common” propositions that everybody, including various sciences, uses in all kind (...) of arguments. On the other hand, a peirastic argument fails to do its job if it either features or presupposes in addition propositions which would justify a fallacy, or if it purports to be scientific. The latter type of bad peirastic argument crucially depend on common propositions where scientific arguments explain by reference to combinations of the primitive items of the science in question. Scientific opinions are divided on this issue, ranging from militantly positive to cautiously positive to markedly negative, with many in between suggesting we should at least change the vocabulary.
