In this roundtable discussion, early-career researchers working in the field of law, gender, and sexuality discuss international and trans-national developments to legal gender. ‘The Future of Legal Gender’ research project focused on the legislative framework of England and Wales to develop a prototype for decertification. The domestic legislation, however, was situated within a wider international context throughout the project. This roundtable discussion, therefore, provided an opportunity for reflection on the transnational issues raised by decertification, with a particular focus on developments (...) arising in the jurisdiction(s) studied by the early career researchers. The roundtable began with a brief outline of these recent developments before moving to an open discussion on key themes including the value of reform on wider society, changes on-the-ground by non-state actors, and alternative processes for tackling gender inequalities without certifying legal gender. This paper contributes to business ethics by focusing on consumption that is characterized by normative violence. By drawing on the work of Judith Butler this study of kajer lok—a female subaltern group of Indian domestic service providers—and their higher status clients shows how codes of status-based consumption shaped by markets, class, caste, and patriarchy create a social order that reduces kajer lok to “ungreivable” lives. Our study contributes to business ethics by focusing on exploitation and coercion in consumption rather than (...) in production and of woman rather than of men. It adds to consumer research by revealing how social distinctions not only manifest in status contests in which symbolic power is at stake but also may produce violent exploitation and ungrievable lives. It has been well established in literature that small industry clusters (SICs) have an impressive record of innovation and knowledge transmission. This paper explores the possibilities in this regard in third-world clusters through an empirical study of three SICs in India. The paper first examines the essential reasons for the survival and growth of clusters temporally over centuries. Then, it critically assesses the factors that threaten the clusters at present—some of which, it appears, might actually be fatal for these clusters. (...) And finally, the paper concludes that though an enhancement in capacity to innovate and transfuse knowledge would contribute to the sustenance of these clusters, this cannot happen unless decisive intervention occurs to preserve and sustain the fundamental strengths of these clusters. The formation of NGOs appears to be a response to perceptions of need that are so far removed from the local level that they fail to prioritize amongst levels and locations of poverty. In the absence of objective feedback mechanisms, the global—and therefore indiscriminate—perspective of international funding sources may help (...) explain the lack of correspondence between need and NGO location, combined with the inevitably limited and blinkered knowledge of regional disparities that can be obtained through local NGOs. This preliminary “epistemological” approach to the question of the sub-optimal formation of NGOs is buttressed by consideration of the factors that may bring perception, reality, and organizational responses into better alignment when natural disasters occur, namely the factors that make natural disasters compelling news stories, unlike chronic underdevelopment. Bu makale, Kant’ın felsefesinde özgürlük konusunu incelemeyi ve tartışmayı amaçlamaktadır. Bu amaçla öncelikle Kant’ın özgürlük anlayışının ahlak felsefesiyle olan ilişkisi irdelenmiştir. İnsanın çevresini olduğu gibi kabul etmesi ve kendi özgür iradesi ile çevresine müdahale etmesi, onu değiştirmesi ve deneyimleri ile idrak etme süreci onun eylemlerinin dolayısıyla özgürlüğünün sınırları olduğu bilincine varması koşuluyla gerçekleşir. Dolayısıyla istediği biçimde eylemde bulunma ve her istediğini yapma anlamında bir özgürlük nasıl gerçekleşir. Bu anlamda İnsan özgür olduğunu biliyorsa bu bilginin nereden geldiğini belirtmek gerekir. Kant’a göre (...) özgürlüğü teorik olarak anlayamasak da bütün ideler içinde doğuştan olarak bildiğimiz tek idedir. Çünkü özgürlüğü ahlak yasasının koşulu olarak görmekteyiz. Kavramlar doğru anlamlandırılmadığı takdirde meselelerin anlaşılması noktasında yanlış sonuçlara varmanın kaçınılmaz olduğu bir hakikattir. Fıtrat kavramı bu manada insanın neliği bağlamında başat kavram olarak her daim farklı değerlendirmelere konu olmuştur. İnsanın, gerek kendisini var eden Allah ile olan ilişkisi gerekse hemcinsleriyle ve içerisinde yaşadığı âlemle ilişkisi çerçevesinde bu kavramın anlam alanının tespiti yine ait olduğu dünya üzerinden yapıldığı zaman konu hakkında doğru sonuçların elde edilmesine imkân tanıyacaktır. Kur’ân ve hadislerde yerini bulan fıtrat kavramının anlam alanına yönelik çalışmaların bu alanlarda derinlemesine (...) tahlili noktasında söz konusu metinleri, kendi iç bütünlükleri ve birbirleriyle olan ilişkileri bağlamında meseleyi ele alması, en sağlıklı yol olacaktır. Bu çalışmada kavramın önce sözlük anlamı, türevleri üzerinden ele alınmış daha sonra Kur’ân ve hadislerde geçtiği durumları, belirtilen usûl üzerinden değerlendirmeye tâbi tutulmuştur. Sonuç olarak luğavî anlamı da dikkate alınarak fıtrat kavramı ile Kur’ân’da insanın Allah’la ilişkisine, hadislerde ise insanın doğasındaki sâfiyete ve insanlarla olan ilişkisinde dikkat gerektiren yönüne vurgu yapıldığı ortaya konulmaya çalışılmıştır. Kojin Karatani dünya tarihi üzerine yaptığı çalışmalarda, İyonya’da, M.Ö. 6. ve 5. yüzyıllarda, bugün izi silinmiş bir yönetim biçimi olduğunu öne sürdüğü, hareket serbestliğine dayalı göçebe bir toplum modelini ortaya koyan izonominin (hükmetmenin olmaması) söz konusu olduğunu, aynı tarihlerde, Atina’nın ise demokrasiyle yönetildiğini iddia eder. Karatani yaptığı bu radikal karşılaştırmayı, kendi mübadele tarzları teorisinde de belli bir çerçeveye yerleştirerek, Sokrates’in izonominin son temsilcisi olduğunu; öğrencisi Platon’un ise Pythagorasçılardan filozof-kral fikrini edinmiş, Devlet diyaloğunda Sokrates üzerinden bu fikri savunmuş olduğunu ileri sürer. (...) Karatani bu iddiasını gerekçelendirmek üzere; Sokrates ve Platon arasındaki felsefi ilişkide, izonomiyi temsil ettiğini ileri sürdüğü Sokrates’i İyonya felsefesine; Platon’u ise Pythagoras’a yaklaştırarak, dolayısıyla bu iki filozofu birbirinden ayırarak okumayı dener. Bu makalede, çeşitli Antik Yunan kaynaklarında; örneğin Herodotos’ta, demokrasiyle eş anlamlı kullanılabilen izonominin, esasen çok-anlamlı bir kavram olduğu ve Antik Yunan politik tarihinde demokrasiye yön veren ilkelerden birini teşkil ettiği gösterilecektir. Thukydides’in bize aktardığına göre, oligarşik politik rejimlerde de izonomiye rastlarız. Fakat bu durumda da demokrasi modeline yakın olduğu ölçüde, oligarşilerin izonomik olduğu görülmektedir. Bu makalede, Karatani’nin bir yönetim biçimi anlamıyla kullandığı izonominin, yalnızca İyonya’da gerçekleştiği sonucuna varmanın spekülatif olduğu ortaya konacak, Karatani’nin projesini İyonya’ya uygulama gerekçesi irdelenerek, bunun için izlediği stratejiler analiz edilecektir. Karatani’nin Platon okumasında, Devlet diyaloğuna doğrudan odaklanmayan, bunun yerine dönemin dramatik dönüşümlerini merkeze alan bir okuma yaptığı ileri sürülecek; Yasalar’da ve Mektuplar’da izonomik bir politik rejim üzerine tartışma yürüten Platon’un izonomiyi ve demokrasiyi nasıl anladığını görmenin yolunun, filozof-kral fikrinin dile getirildiği Devlet diyaloğuna bakmaktan geçtiği gösterilecektir. Platon’un demokrasiden hoşnutsuzluğunun izonomiyle karşıtlığı üzerinden anlaşılamayacağı, Platon’un, Karatani’nin iddia ettiği gibi demokrasi ve izonomi arasında keskin bir ayrım yapmadığı ortaya konacaktır. Sonuç olarak izonominin ayrı bir yönetim biçimi değil, demokrasiyle ilişkili bir ilke olduğu savunulacaktır. (shrink)
