Leo Strauss’s early book Philosophy and Law has remained a stumbling block in current Strauss scholarship. This article seeks to explore the text by way of the ensuing debate between Strauss and Julius Guttmann concerning the historical and systematic presuppositions of Jewish philosophy. In decisive respects Guttmann was unable to follow Strauss’s argument, particularly because he could not solve the riddle whether Philosophy and Law was a precursor of the “exoteric” Strauss or not. Furthermore, he (...) miscast the perspective of political philosophy as an all-out politicization of philosophy. On the one hand there emerged a new sense of the irreplaceability of individual people, of the finality of death and the immeasurable preciousness of a single life. On the other hand death, that which followed one's demise, became conceptually (...) more austere. For the first time since antiquity, perhaps ever, the belief that death is pure negativity or nothingness asserted itself with enough success to become a generally accepted cultural attitude. 1 This image of sheer nonexistence, this death stripped down to its ontological minimum, is the most extreme form of mortality that has arisen in the history of the West, the hardest perhaps to take, the most naked. In ways that could not have occurred before, these two developments in the history of death have worked with and against each other to create a new understanding of subjectivity, a set of theorizations about human individuality that, for all their diversity of detail, are bound together by a certain historical determinacy. Hegel's views on the relation between mortality and subjectivity, for instance, like Heidegger's or Blanchot's, have no precedent, but they do have endless repercussions. Whatever their causes, the newness and the effectiveness of these theories indicate that during the nineteenth century a unique cultural formation arose in relation to mortality. The moment still has not passed, since the basic elements of the new death continue to operate on contemporary imaginations and theorizations. What follows is an attempt to draw the portrait of the death that emerged for the first time in the nineteenth century: to critically and analytically examine formulations of the relation between death and identity in order to determine the value of absolute mortality as an individualizing principle. Often these formulations are most clearly articulated by post-nineteenth-century thinkers, but they are the products, and indeed the expressions, of that historical transformation that occurred sometime after the Revolution. When we read these texts and arguments, we are asking not merely whether they are valid as arguments, but about the value of the general attitude they reflect—the value not only of a specific kind of death, but of a kind of subjectivity that is unique to the last two hundred years. And since that subjectivity is probably the most significant product of those centuries, the most pervasive and the most intimately affecting, we are also, intentionally or not, asking about the value of a whole period.To read this relation between mortality and subjectivity, we must come to some understanding about the terms at issue, especially what death is or is not when considered in its most extreme form as simple nothingness. It may seem odd that this is an issue at all, but nonexistence has proven a difficult concept to integrate into theorizations [End Page 90] of human life. The first question to raise in this context is whether death can be considered a state, a divisive proposition on which much hangs. In the introduction to a recent collection of essays on metaphysics and death, John Martin Fischer baldly asserted that "being dead is a condition or a state" [4]. The philosopher Paul Edwards, however, has pointed to some of the "absurdities," as he puts it, of considering death as an ontological condition. To imagine death as a state is, he argues, to attribute to it some sort of being, but death, understood as the permanent loss of consciousness and experience, has no being and is simply absence. These two texts are published together and in this order because the contrast between their respective contents and methods would show that only in the last fourth of the first, as opposed to the whole of the second, "does Alfarabi consider political life as it usually is", that is, shorn of what Leo Strauss's disciples regard as metaphysical humbug. Claude Levi-Strauss mentioned several times in his work that the notion of transformation is the keystone of the structural analysis he pratices. By his own admission, this notion stems from his reading of D’Arcy Thomson’s book On Growth and Form during World War II in the United States. But Levi-Strauss makes use of two very different meanings of transformation, relating to two distinct morpho-genetic traditions. On the one hand, he is inspired by Goethe’s Morphology. All forms can be (...) seen as transformation of a Urform, an original form, from which they grow out like a tree. But on the other hand, D’Arcy Thomson’s emphasis lies on the geometric simplicity of a transformation grid that allows the transition from one biological form to the other without considering any original from which other forms would be derivable. Levi-Strauss’ epistemological choice to study myths and masks can be better understood when his concept of transformation is clearly defined in relation to Goethe and D’Arcy Thomson. In current debates, many philosophers of science have sympathies for the project of introducing a new approach to the scientific realism debate that forges a middle way between traditional forms of scientific realism and anti-realism. One promising approach is perspectivism. Although different proponents of perspectivism differ in their respective characterizations of perspectivism, the common idea is that scientific knowledge is necessarily partial and incomplete. Perspectivism is a new position in current debates but it does have its forerunners. Figures that are (...) typically mentioned in this context include Dewey, Feyerabend, Leibniz, Kant, Kuhn, and Putnam. Interestingly, to my knowledge, there exists no work that discusses similarities to the phenomenological tradition. This is surprising because here one can find systematically similar ideas and even a very similar terminology. It is startling because early modern physics was noticeably influenced by phenomenological ideas. And it is unfortunate because the analysis of perspectival approaches in the phenomenological tradition can help us to achieve a more nuanced understanding of different forms of perspectivism. The main objective of this paper is to show that in the phenomenological tradition one finds a well-elaborated philosophy of science that shares important similarities with current versions of perspectivism. Engaging with the phenomenological tradition is also of systematic value since it helps us to gain a better understanding of the distinctive claims of perspectivism and to distinguish various grades of perspectivism. The 1992 incorporation of an article by referendum in the SwissConstitution mandating that the federal government issue regulations onthe use of genetic material that take into account the dignity ofnonhuman organism raises philosophical questions about how we shouldunderstand what is meant by ``the dignity of nonhuman animals,'' andabout what sort of moral demands arise from recognizing this dignitywith respect to their genetic engineering. The first step in determiningwhat is meant is to clarify the difference between dignity when appliedto humans and (...) when applied to nonhumans. Several conceptions of humandignity should be rejected in favor of a fourth conception: the rightnot to be degraded. This right implies that those who have it have thecognitive capacities that are prerequisite for self-respect. In the caseof nonhuman organisms that lack this capacity, respecting their dignityrequires the recognition that their inherent value, which is tied totheir abilities to pursue their own good, be respected. This value isnot absolute, as it is in the case of humans, so it does not prohibitbreeding manipulations that make organisms more useful to humans. But itdoes restrict morally how sentient animals can be used. In regard togenetic engineering, this conception requires that animals be allowedthe uninhibited development of species specific functions, a positionshared by Holland and Attfield, as opposed to the Original Purposeconception proposed by Fox and the Integrity of the Genetic Make-upposition proposed by Rolston. Starting from a microanalysis of money's function, a reassessment of the current laws concerning the practice is encouraged, with the aim not only to rectify economic irregularities but also to realign depositors' rights with the obligations of the banking sector. Barnett and Block (J Bus Ethics 18(2):179–194, 2011 ) argue that one cannot distinguish between deposits and loans due to the continuum problem of maturities and because future goods do not exist—both essential characteristics that distinguish deposit from loan contracts. In a similar way but leading to opposite conclusions (Cachanosky, forthcoming) maintains that both maturity mismatching and fractional reserve banking are ethically justified as these contracts are equivalent. We argue herein that the economic and legal differences between genuine deposit and (...) loan contracts are clear. This implies different legal obligations for these contracts, a necessary step in assessing the ethics of both fractional reserve banking and maturity mismatching. While the former is economically, legally, and perhaps most importantly ethically problematic, there are no such troubles with the latter. (shrink)

The aim of this paper is twofold. The first is an interpretative one as I wish to provide a detailed account of Husserl’s conception of experiential justification. Here Ideas I and Introduction to Logic and Theory of Knowledge: Lectures 1906/07 will be my main resources. My second aim is to demonstrate the currency and relevance of Husserl’s conception. This means two things: Firstly, I will show that in current debates in analytic epistemology there is a movement sharing with Husserl the (...) basic idea that certain experiences gain their justificatory force simply from their distinctive phenomenal character. Secondly, I shall reveal the benefits of Husserl’s specific version of this view. Thus, one of my aims is to show that debates in current analytic epistemology could profit from adopting certain Husserlian elements. More precisely, I will defend Husserl’s claim that perceptual experiences are justifiers due to their self-giving phenomenal character as opposed to the currently popular view that it is the phenomenology of pushiness that makes them justifiers. To put it differently, what matters is what is originally given within experience and not how you feel about what is given. (shrink)

The aim of this paper is to shed light on and develop what I call a phenomenological conception of experiential justification. According to this phenomenological conception, certain experiences gain their justificatory force from their distinctive phenomenology. Such an approach closely connects epistemology and philosophy of mind and has recently been proposed by several authors, most notably by Elijah Chudnoff, Ole Koksvik, and James Pryor. At the present time, however, there is no work that contrasts these different versions of PCEJ. This (...) paper not only bridges this gap, but also reveals problems in current versions of PCEJ. This book offers a phenomenological conception of experiential justification that seeks to clarify why certain experiences are a source of immediate justification and what role experiences play in gaining (scientific) knowledge. Based on the author's account of experiential justification, this book exemplifies how a phenomenological experience-first epistemology can epistemically ground the individual sciences. More precisely, it delivers a comprehensive picture of how we get from epistemology to the foundations of mathematics and physics. The book is unique as it utilizes methods (...) and insights from the phenomenological tradition in order to make progress in current analytic epistemology. It serves as a starting point for re-evaluating the relevance of Husserlian phenomenology to current analytic epistemology and making an important step towards paving the way for future mutually beneficial discussions. This is achieved by exemplifying how current debates can benefit from ideas, insights, and methods we find in the phenomenological tradition. (shrink)

As is well known, the late Husserl warned against the dangers of reifying and objectifying the mathematical models that operate at the heart of our physical theories. Although Husserl’s worries were mainly directed at Galilean physics, the first aim of our paper is to show that many of his critical arguments are no less relevant today. By addressing the formalism and current interpretations of quantum theory, we illustrate how topics surrounding the mathematization of nature come to the fore naturally. Our (...) second aim is to consider the program of reconstructing quantum theory, a program that currently enjoys popularity in the field of quantum foundations. We will conclude by arguing that, seen from this vantage point, certain insights delivered by phenomenology and quantum theory regarding perspectivity are remarkably concordant. Our overall hope with this paper is to show that there is much room for mutual learning between phenomenology and modern physics. (shrink)

In 1981, David Hubel and Torsten Wiesel received the Nobel Prize for their research on cortical columns—vertical bands of neurons with similar functional properties. This success led to the view that “cortical column” refers to the basic building block of the mammalian neocortex. Since the 1990s, however, critics questioned this building block picture of “cortical column” and debated whether this concept is useless and should be replaced with successor concepts. This paper inquires which experimental results after 1981 challenged the building (...) block picture and whether these challenges warrant the elimination “cortical column” from neuroscientific discourse. I argue that the proliferation of experimental techniques led to a patchwork of locally adapted uses of the column concept. Each use refers to a different kind of cortical structure, rather than a neocortical building block. Once we acknowledge this diverse-kinds picture of “cortical column”, the elimination of column concept becomes unnecessary. Rather, I suggest that “cortical column” has reached conceptual retirement: although it cannot be used to identify a neocortical building block, column research is still useful as a guide and cautionary tale for ongoing research. Abstract.Carrying out a suggestion by Kreisel, we adapt Gödel’s functional interpretation to ordinary first-order predicate logic(PL) and thus devise an algorithm to extract Herbrand terms from PL-proofs. The extraction is carried out in an extension of PL to higher types. The algorithm consists of two main steps: first we extract a functional realizer, next we compute the β-normal-form of the realizer from which the Herbrand terms can be read off. Even though the extraction is carried out in the extended language, (...) the terms are ordinary PL-terms. In contrast to approaches to Herbrand’s theorem based on cut elimination orɛ-elimination this extraction technique is, except for the normalization step, of low polynomial complexity, fully modular and furthermore allows an analysis of the structure of the Herbrand terms, in the spirit of Kreisel ([13]), already prior to the normalization step. It is expected that the implementation of functional interpretation in Schwichtenberg’s MINLOG system can be adapted to yield an efficient Herbrand-term extraction tool. (shrink)

The iconoclastic Brazilian anthropologist and theoretician Eduardo Viveiros de Castro, well known in his discipline for helping initiate its “ontological turn,” offers a vision of anthropology as “the practice of the permanent decolonization of thought.” After showing that Amazonian and other Amerindian groups inhabit a radically different conceptual universe than ours—in which nature and culture, human and nonhuman, subject and object are conceived in terms that reverse our own—he presents the case for anthropology as the study of such “other” metaphysical (...) schemes, and as the corresponding critique of the concepts imposed on them by the human sciences. This article develops a comparative and recursive approach to political ontology by drawing on the ontological turn in anthropology. It claims that if ontological commitments define reality, then the use of ontology by recent pluralist political theorists must undercut pluralism. By charting contemporary anthropology’s rereading of structuralism as part of a plural understanding of ontology, it will be shown that any political ontology places limits on the political, and thus cannot exhaust political experience. This position will be established through an (...) analysis of the role of Claude Lévi-Strauss in the work of Ernesto Laclau and Chantal Mouffe and a comparison with the political ontology represented by perspectivism and potential affinity. Anthropology’s lesson for political theory is that ontology cannot simply be revised and treated in the singular, but that political ontologies must be analysed comparatively to reveal the shortcomings of, and recursively alter, one’s own political frame of reference. Why is it rational for scientists to pursue multiple models of a phenomenon at the same time? The literatures on mechanistic inquiry and scientific pursuit each develop answers to a version of this question which is rarely discussed by the other. The mechanistic literature suggests that scientists pursue different complementary models because each model provides detailed insights into different aspects of the phenomenon under investigation. The pursuit literature suggests that scientists pursue competing models because alternative models promise to solve outstanding (...) empirical and conceptual problems. Looking into research on visual processing as a case study, we suggest an integrated account of why it is rational for scientists to pursue both complementary and competing models of the same mechanism in scientific practice. Depositors have perceived banks as acting unethically during the most recent recession. One area of consternation is the ambiguity of the legal obligations entailed by the deposit contract when it is backed with only fractional reserves. In this article, we apply an existing analysis of the legitimacy and ethicality of banking practices to a wider range of financial transactions, including insurance policies, securities lending, perpetual bonds, and callable loans. Securities lending in particular creates rights violations analogous to those in fractional-reserve (...) banking. Both callable loans and perpetual bonds have clear legal obligations which are not inherently problematic, though we herein clarify what these obligations are. Finally, we apply our ethical framework to demonstrate that insurance products are distinct from banking deposit contracts, and that perceived parallels between the two products underestimate these differences. ‘India’s founding moment’ a moment of breath-taking political imagination and it is one of the great achievements of Madhav Khosla. to unpack important parts of its pre-history and emergence. This article will look at two questions—one about alternatives and the other about contexts. Regarding alternatives, I am interested in the paths not taken and an understanding of possibilities. I try to get a sense of possible alternative futures or modernities that the founding generation pondered, in the best case allowing us (...) to wonder what we can learn from the choices made as well as from the paths rejected. The other question I raise is the question of the intellectual contexts, in which the founding took place. Coming from a non-Indian perspective, I am interested in the entanglements, the contexts and potentially migrating ideas that emerge. (shrink)

Foundationalism and coherentism are two fundamentally opposed basic epistemological views about the structure of justification. Interestingly enough, there is no consensus on how to interpret Husserl. While interpreting Husserl as a foundationalist was the standard view in early Husserl scholarship, things have changed considerably as prominent commentators like Christian Beyer, John Drummond, Dagfinn Føllesdal, and Dan Zahavi have challenged this foundationalist interpretation. These anti-foundationalist interpretations have again been challenged, for instance, by Walter Hopp and Christian Erhard. One might suspect that (...) inconsistencies in Husserl’s writings are the simple reason for this disagreement. I shall argue, however, that the real question is not so much how to read Husserl, but how to define foundationalism and that there is overwhelming textual evidence that Husserl championed the most tenable version of foundationalism: a moderate foundationalism that allows for incorporating coherentist elements. The concept of the cortical column refers to vertical cell bands with similar response properties, which were initially observed by Vernon Mountcastle’s mapping of single cell recordings in the cat somatic cortex. It has subsequently guided over 50 years of neuroscientific research, in which fundamental questions about the modularity of the cortex and basic principles of sensory information processing were empirically investigated. Nevertheless, the status of the column remains controversial today, as skeptical commentators proclaim that the vertical cell bands are (...) a functionally insignificant by-product of ontogenetic development. This paper inquires how the column came to be viewed as an elementary unit of the cortex from Mountcastle’s discovery in 1955 until David Hubel and Torsten Wiesel’s reception of the Nobel Prize in 1981. I first argue that Mountcastle’s vertical electrode recordings served as criteria for applying the column concept to electrophysiological data. In contrast to previous authors, I claim that this move from electrophysiological data to the phenomenon of columnar responses was concept-laden, but not theory-laden. In the second part of the paper, I argue that Mountcastle’s criteria provided Hubel Wiesel with a conceptual outlook, i.e. it allowed them to anticipate columnar patterns in the cat and macaque visual cortex. I argue that in the late 1970s, this outlook only briefly took a form that one could call a ‘theory’ of the cerebral cortex, before new experimental techniques started to diversify column research. I end by showing how this account of early column research fits into a larger project that follows the conceptual development of the column into the present. (shrink)

ABSTRACTFor Husserl, noetics is the most fundamental science and the centrepiece of a phenomenological epistemology. Since in his major works Husserl does not develop noetics systematically but uses its main ideas and achievements often in apparent isolation without clarifying their systematic unity, the significance of noetics is often overlooked. Although Husserl has repeatedly stressed the importance of a phenomenological epistemology, what the concrete theses of such an undertaking are supposed to be often remains obscure. We shall see that the best (...) way to clarify this is by providing a detailed account of Husserl’s noetics as it is developed in Husserl’s lecture courses “Introduction to Logic and Theory of Knowledge” and “Logic and General Theory of Science”. Perceptual experiences justify. When I look at the black laptop in front of me and my perceptual experience presents me with a black laptop placed on my desk, my perceptual experience has justificatory force with respect to the proposition that there is black laptop on the desk. The present paper addresses the question of why perceptual experiences are a source of immediate justification: What gives them their justificatory force? I shall argue that the most plausible and the most straightforward answer (...) to this question consists in what I call the phenomenological conception of perceptual justification. Perceptual experiences justify by virtue of their distinctive presentive phenomenology. This is a truly internalist conception that enjoys significant advantages over rival conceptions. In the course of his paper, I demonstrate the advantages of the phenomenological conception and defend it against a recent objection. (shrink)

Formal spaces have become commonplace conceptual and computational tools in a large array of scientific disciplines, including both the natural and the social sciences. Morphological spaces are spaces describing and relating organismal phenotypes. They play a central role in morphometrics, the statistical description of biological forms, but also underlie the notion of adaptive landscapes that drives many theoretical considerations in evolutionary biology. We briefly review the topological and geometrical properties of the most common morphospaces in the biological literature. In contemporary (...) geometric morphometrics, the notion of a morphospace is based on the Euclidean tangent space to Kendall’s shape space, which is a Riemannian manifold. Many more classical morphospaces, such as Raup’s space of coiled shells, lack these metric properties, e.g., due to incommensurably scaled variables, so that these morphospaces typically are affine vector spaces. Other notions of a morphospace, like Thomas and Reif’s skeleton space, may not give rise to a quantitative measure of similarity at all. In his influential paper “Grasping the Third Realm,” John Bengson raises the question of how we can non-accidentally grasp abstract facts. What distinguishes successful intuition from hallucinatory intuition? Bengson answers his “non-accidental relation question” by arguing for a constitutive relationship: The intuited object is a literal constituent of the respective intuition. Now, the problem my contribution centers around is that Bengson’s answer cannot be the end of the story. This is because, as Bar Luzon and Preston Werner have recently pointed (...) out, this answer leads to the follow-up question of why certain intuitional experiences are constituted by the facts, but others are not. My objective is to answer this question by specifying precisely what is epistemically defective about intellectual hallucinations. My result is that, in stark contrast to perception, intellectual hallucinations are epistemically defective in the sense that something is overlooked. In successful intuition, by contrast, all relevant possibilities/scenarios are considered/imagined. This has crucial epistemological implications. In particular, I argue that intuitions exhibiting a certain phenomenology cannot fail to successfully grasp abstract facts. I call this the non-accidental correctness thesis, which constitutes the main thesis of this paper. (shrink)

This paper shows that the law, in subtle ways, may set hitherto unrecognized incentives for the adoption of explainable machine learning applications. In doing so, we make two novel contributions. First, on the legal side, we show that to avoid liability, professional actors, such as doctors and managers, may soon be legally compelled to use explainable ML models. We argue that the importance of explainability reaches far beyond data protection law, and crucially influences questions of contractual and tort liability for (...) the use of ML models. To this effect, we conduct two legal case studies, in medical and corporate merger applications of ML. As a second contribution, we discuss the trade-off between accuracy and explainability and demonstrate the effect in a technical case study in the context of spam classification. (shrink)

The aim of this paper is to establish a phenomenological mathematical intuitionism that is based on fundamental phenomenological-epistemological principles. According to this intuitionism, mathematical intuitions are sui generis mental states, namely experiences that exhibit a distinctive phenomenal character. The focus is on two questions: what does it mean to undergo a mathematical intuition and what role do mathematical intuitions play in mathematical reasoning? While I crucially draw on Husserlian principles and adopt ideas we find in phenomenologically minded mathematicians such as (...) Can phenomenologists allow for the existence of unobservable entities such as atoms, electrons, and quarks? Can we justifiably believe in the existence of entities that are in principle unobservable? This paper addresses the relationship between Husserlian transcendental phenomenology and scientific realism. More precisely, the focus is on the question of whether there are basic epistemological principles phenomenologists are committed to that have anti-realist consequences with respect to unobservable entities. This question is relevant since Husserl’s basic epistemological principles, such as the (...) “principle of all principles,” seem to suggest that epistemic justification is limited to what can be originally given in the sense that if an object cannot be given in an originary presentive intuition, then one cannot be justified in believing that this object exists. It is the main aim of this paper to show (i) that interpretative reasons exist for not reading Husserl in such a way and (ii) that systematic reasons exist as to why phenomenologists should not subscribe to this criterion. I shall put forward a different criterion of justification that satisfies the spirit of Husserlian transcendental phenomenology and allows for justifiably believing in the existence of unobservable scientific entities. The focus of this paper are the ethical, legal and social challenges for ensuring the responsible use of “big brain data”—the recording, collection and analysis of individuals’ brain data on a large scale with clinical and consumer-directed neurotechnological devices. First, I highlight the benefits of big data and machine learning analytics in neuroscience for basic and translational research. Then, I describe some of the technological, social and psychological barriers for securing brain data from unwarranted access. In this context, I then (...) examine ways in which safeguards at the hardware and software level, as well as increasing “data literacy” in society, may enhance the security of neurotechnological devices and protect the privacy of personal brain data. Regarding ethical and legal ramifications of big brain data, I first discuss effects on the autonomy, the sense of agency and authenticity, as well as the self that may result from the interaction between users and intelligent, particularly closed-loop, neurotechnological devices. I then discuss the impact of the “datafication” in basic and clinical neuroscience research on the just distribution of resources and access to these transformative technologies. In the legal realm, I examine possible legal consequences that arises from the increasing abilities to decode brain states and their corresponding subjective phenomenological experiences on the hitherto inaccessible privacy of these information. Finally, I discuss the implications of big brain data for national and international regulatory policies and models of good data governance. (shrink)

This paper proposes an analysis of the discursive dynamics of high-impact concepts in the humanities. These are concepts whose formation and development have a lasting and wide-ranging effect on research and our understanding of discursive reality in general. The notion of a conceptual practice, based on a normative conception of practice, is introduced, and practices are identified, on this perspective, according to the way their respective performances are held mutually accountable. This normative conception of practices is then combined with recent (...) work from philosophy of science that characterizes concepts in terms of conceptual capacities that are productive, open-ended, and applicable beyond the original context they were developed in. It is shown that the formation of concepts can be identified by changes in how practitioners hold exercise of their conceptual capacities accountable when producing knowledge about a phenomenon. In a manner similar to the use of operational definitions in scientific practices, such concepts can also be used to intervene in various discourses within or outside the conceptual practice. Using the formation of the concepts “mechanism” and “performative” as examples, the paper shows how high-impact concepts reconfigure what is at issue and at stake in conceptual practices. As philosophy and other humanities disciplines are its domain of interest, it is a contribution to the methodology of the humanities. (shrink)
