Perú es un caso claro de conflicto interno violento. Este conflicto, dominado por las acciones del grupo guerrillero Sendero Luminoso tuvo sus años más duros durante las décadas de los años 80 y 90. Sin embrago, es peculiar la poca producción académica que existe analizando los aspectos de paz y conflicto del país. Este trabajo busca repasar los trabajos realizados en el país sobre la violencia y analizar la existencia de contribuciones académicas que traten el conflicto peruano desde la perspectiva (...) de los estudios de paz y conflicto. Para ello se presentan los conceptos de construcción de paz y reconciliación según los autores seminales de los estudios de paz y se contrastan esos conceptos con las contribuciones académicas más destacadas. Este artículo concluye que existe un cuerpo limitado de trabajo al respecto, generado en dos épocas diferenciadas. Durante los años de la violencia serán trabajos que cuestionan las acciones de Sendero Luminoso y después de la creación de la Comisión de la Verdad aparecerán trabajos más alineados con los estudios de paz, sobre todo con los conceptos de memoria y reconciliación. El 10 de abril de 1998 se firmó en Belfast el denominado Acuerdo de Viernes Santo o acuerdo de Belfast, por parte de los gobiernos británico e irlandés, así como por los principales líderes políticos de Irlanda del Norte y fue aprobado en referéndum popular tanto en Irlanda del Norte como en la República de Irlanda, dando inicio al fin de un conflicto desarrollado en el Ulster durante tres décadas. El acuerdo, y sus posteriores modificaciones dan una importancia central a (...) los aspectos simbólicos de la memoria a través de lugares de recuerdo. Este trabajo busca, a través del análisis simbólico y la simbología de la memoria, articulados tanto en el arte político desplegado en murales en la ciudad de Derry y Belfast, y de los testimonios presentados tanto en entrevistas como en documentos audiovisuales, analizar los procesos de reivindicación y contestación de los lugares de memoria vinculados a diferentes identidades políticas implicadas en el conflicto norirlandés, así como las diferentes herramientas de resignificación de la memoria colectiva del mismo y su importancia en el actual proceso de construcción de paz. It has been argued that neural data are an especially sensitive kind of personal information that could be used to undermine the control we should have over access to our mental states, and therefore need a stronger legal protection than other kinds of personal data. The Morningside Group, a global consortium of interdisciplinary experts advocating for the ethical use of neurotechnology, suggests achieving this by treating legally ND as a body organ. Although the proposal is currently shaping ND-related policies, it (...) is not clear what its conceptual and legal basis is. Treating legally something as something else requires some kind of analogical reasoning, which is not provided by the authors of the proposal. In this paper, I will try to fill this gap by addressing ontological issues related to neurocognitive processes. The substantial differences between ND and body organs or organic tissue cast doubt on the idea that the former should be covered by bodily integrity. Crucially, ND are not constituted by organic material. Nevertheless, I argue that the ND of a subject s are analogous to neurocognitive properties of her brain. I claim that s’ ND are a ‘medium independent’ property that can be characterized as natural semantic personal information about her brain and that s’ brain not only instantiates this property but also has an exclusive ontological relationship with it: This information constitutes a domain that is unique to her neurocognitive architecture. This study explores the rationality behind firms’ decision to admit or deny their involvement in bribery when responding to confidential surveys conducted by international agencies. Specifically, we posit that firms’ reluctance to provide accurate information about their engagement in bribery is at least to some extent contingent on certain situational factors. In other words, we claim that this behavior is context dependent. The paper uses the notions provided by the theory of planned behavior to understand the way in which the (...) corruption of the legal environment, the intensity of market competition, and identification risk influence firms’ decision to lie about their involvement in bribery. To test these notions, we use databases from the fifth wave of the EBRD-World Bank Business Environment and Enterprise Performance Survey, country-level data from the Kauffman Foundation and macroeconomic information from the World Bank database. We run ordinary least squares with geographic region-clustered standard errors on data from 30 countries and 6122 individual firms during the period 2012–2013. Consistent with our expectations, the results indicate that firms operating within more corrupt legal environments, facing more competition, and bearing a higher risk of being identified are less likely to deny their involvement in bribery. We conclude that not all firms have the same incentives to lie about their participation in bribery, and therefore, identifying the drivers of this heterogeneity may help policymakers better assess the reliability of bribery information collected through confidential surveys. The current human rights framework can shield people from many of the risks associated with neurotechnological applications. However, it has been argued that we need either to articulate new rights or reconceptualise existing ones in order to prevent some of these risks. In this paper, we would like to address the recent discussion about whether current reconceptualisations of the right to mental integrity identify an ethical dimension that is not covered by existing moral and/or legal rights. The main challenge of (...) these proposals is that they make mental integrity indistinguishable from autonomy. They define mental integrity in terms of the control we can have over our mental states, which seems to be part of the authenticity condition for autonomous action. Based on a fairly comprehensive notion of mental health (ie, a notion that is not limited to the mere absence of illness), we propose an alternative view according to which mental integrity can be characterised both as a positive right to (medical and non-medical) interventions that restore and sustain mental and neural function, and promote its development and a negative right protecting people from interventions that threaten or undermine these functions or their development. We will argue that this notion is dissociated from cognitive control and therefore can be adequately distinguished from autonomy. (shrink)

It has been argued that the approximate number system (ANS) constitutes a problem for the grounded approach to cognition because it implies that some conceptual tasks are performed by non-perceptual systems. The ANS is considered non-perceptual mainly because it processes stimuli from different modalities. Jones (2015) has recently argued that this system has many features (such as being modular) which are characteristic of sensory systems. Additionally, he affirms that traditional sensory systems also process inputs from different modalities. This suggests that (...) the ANS is a perceptual system and therefore it is not problematic for the grounded view. In this paper, I defend the amodal approach to the ANS against these two arguments. In the first place, perceptual systems do not possess the properties attributed to the ANS and therefore these properties do not imply that the ANS is perceptual. In the second place, I will propose that a sensory system only needs to be dedicated to process modality-specific information, which is consistent with responding to inputs from different modalities. I argue that the cross-modal responses exhibited by traditional sensory systems are consistent with modality-specific information whereas some responses exhibited by the ANS are not. (shrink)

Experiments in cognitive neuroscience build a setup whose set of controlled stimuli and rules elicits a cognitive process in a participant. This setup requires researchers to decide the value of quite a few parameters along several dimensions. We call ‘’contextual factors’’ the parameters often assumed not to change the cognitive process elicited and are free to vary across the experiment’s repetitions. Against this assumption, empirical evidence shows that many of these contextual factors can significantly influence cognitive performance. Nevertheless, it is (...) not entirely clear what it means for a cognitive phenomenon to be context-sensitive and how to identify context-sensitivity experimentally. We claim that a phenomenon can be context-sensitive either because it is only triggered within a specific context or because different contexts change its manifestation conditions. Assessing which of these forms of context-sensitivity is present in a given phenomenon requires a criterion for individuating it across contextual variations. We argue that some inter-level experiments that, within the mechanistic approach to explanation, are required to identify relations of constitutive relevance between a phenomenon and a mechanism, are also necessary for individuating the phenomenon across its contextual variations. We articulate a criterion according to which behavioral variations across contexts indicate different phenomena if and only if the mechanistic activities, components and/or organizational properties recruited in each context are different. We support this approach by showing how it is applied in paradigmatic studies addressing cognitive performance differences resulting from contextual variations of task features, such as stimulus type and response modality. Finally, we address the challenge that a form of context-sensitivity possessed by the so-called ‘multifunctional mechanisms’ is incompatible with our proposal because it entails that the same mechanism can be recruited in different contexts to produce different phenomena. We examine key cases of multifunctionality and argue that they are consistent with our proposal because a single mechanism can have different components, activities and/or organizational properties in different contexts. Thus, these modifications may not affect the identity of a mechanism, and they could explain how it produced different phenomena in those contexts. (shrink)

Autocracies draw their political power from cronyism and organized repression. The opacity of business information protects these regimes and their crony firms from any opposition. However, autocracies might also desire to eliminate cronyism because it dampens economic growth. Autocracies survive through repression that engenders tensions, as evident in the Spanish newspaper industry during the Francoist dictatorship. State control over this industry was important because the press disseminated news to the public. From 1939 to 1957, the autocracy institutionalized both cronyism and (...) the opacity of circulation figures to sustain the political powers of Franco and the single party state. Opacity concealed the economic performance of newspapers owned by sole legal party and any distribution of resources in its favor. Franco authorized voluntary disclosure of reliable circulation figures in 1964, after eliminating cronyism in favor of a freer market. Repression guaranteed support for this industry until Franco's death. (shrink)

The extent to which English law remedies injury to autonomy as a stand-alone actionable damage in negligence is disputed. In this article I argue that the remedy available is not only partial and inconsistent but also gendered and discriminatory against women. I first situate the argument within the broader feminist critique of tort law as failing to appropriately remedy gendered harms, and of law more broadly as undervaluing women’s interest in reproductive autonomy. I then show by reference to English remedies (...) law’s first principles how imposed motherhood cases—Rees v Darlington and its predecessor McFarlane v Tayside Health Board—result in gender injustice when compared with other autonomy cases such as Chester v Afshar and Yearworth v North Bristol NHS Trust: A minor gender-neutral ITA is better remedied than the significant gendered harm of imposing motherhood on the claimant; men’s reproductive autonomy is protected to a greater extent than women’s; women’s reproductive autonomy is protected by an exceptional, derisory award. Worst of all, courts refuse to recognise imposed motherhood as detriment; and the deemed, mansplained, nonpecuniary joys of motherhood are used to offset pecuniary upkeep costs, forcing the claimant into a position she sought to avoid and thus further undermining her autonomy. The recent Singaporean case ACB v Thomson Medical Pte Ltd, awarding compensation for undermining the claimant’s genetic affinity in an IVF wrong-sperm-mix-up demonstrates some improvement in comparison to English law, and some shared gender injustices in the context of reproductive autonomy. ACB’s analysis is oblivious to the nature of reproductive autonomy harm as gendered; and prioritises the father’s interest in having genetic affinity with the baby over a woman’s interest in not having motherhood imposed upon her. The adaptive BCI known as ‘closed-loop deep brain stimulation’ (clDBS) is a device that stimulates the brain in order to prevent pathological neural activity and automatically adjusts stimulation levels based on computational algorithms that detect or predict those pathological processes. One of the prominent ethical concerns raised by clDBS is that, by inhibiting or modulating the undesirable neural states of a cognitive agent automatically, the device potentially undermines her autonomy. It has been argued that clDBS is not a threat because (...) autonomy is fundamentally relational, i.e., it essentially depends on external (e.g., social or cultural) factors. If the relational approach to autonomy includes human-computer interaction, then the mechanisms of clDBS, even if external to the brain and exerting some degree of control over the individual, may support her autonomy. However, DBS applications are substantially different from one another, each involving a specific neurological or psychiatric condition, neural target, mechanism and symptom(s), and therefore at least some of them may not fit into the relational analysis. I examine different clDBS applications for treatment resistant depression and claim that while internal capsule/ventral striatum (VC/VS) clDBS is a case of relational autonomy, subgenual cingulate gyrus (Cg25) clDBS is not. Autonomy (relational or otherwise) requires some degree of self-regulation of our motivational states, which is supported by VC/VS DBS but is absent in Cg25 DBS. In Cg25 DBS the device itself directly influences motivational states, thus substituting or overriding (instead of supporting) the auto-regulatory cognitive processes required for autonomous action. Empleando algunos conceptos de Greco y Pritchard y Kallestrup para caracterizar (...) a las habilidades cognitivas y el caso del mentiroso consistente de Lackey, argumento que TEMP, el caso clave de Pritchard para mostrar que puede haber seguridad sin habilidad, no funciona porque el proceso cognitivo relevante constituye una realización legítima, aunque anómala, de una habilidad. Pritchard maintains that the ability and the safety conditions impose independent demands on knowledge, i.e., that satisfying only one of them is not sufficient to acquire knowledge. I argue that there are no good reasons to suppose that the safety condition is not sufficient. I claim that TEMP, the key case proposed by Pritchard to show that there can be safety without ability, fails because therelevant cognitive process constitutes a legitimate, although anomalous, realization of a cognitive ability. Resumen El objetivo de este trabajo es determinar la relevancia de la teoría informacional del conocimiento para el problema de la suerte epistémica. Argumento que el clásico enfoque de Dretske es equivalente a la condición de seguridad de Pritchard. Sin embargo, considero que esta manera de eludir la suerte epistémica exige lidiar con el llamado "problema de la generalidad". Argumento que una respuesta a este problema requiere una noción de seguridad diferente y propongo un enfoque informacional equivalente a esta versión (...) del requisito. Concluyo que este enfoque es preferible a la condición de seguridad propuesta porque desvela relaciones conceptuales entre los elementos que constituyen el conocimiento.The aim of this paper is to determine the relevance of an informational theory of knowledge to address recently discussed epistemic problems. I argue that Dretske's classical approach is equivalent to the safety condition proposed by Pritchard to avoid epistemic luck. However, I claim that Pritchard's condition has to be modified to avoid the so-called "generality problem" for reliabilism. I propose an alternative version of the requirement to deal with these problems and provide an equivalent informational condition. I conclude that this informational version is preferable since it reveals conceptual relationships between the constituents of knowledge. (shrink)

Although the study of emotion regulation constitutes a thriving research field, there is still an ongoing debate about the very notion of emotion regulation. According to a popular approach, regulation is a second-order process which is different from (and modifies) emotion. This view has been challenged by the fact that emotion regulates itself through different feedback loops. Emotional feedback suggests that regulation may be a form of control (as defined in control theory). In this paper, I argue that none of (...) these characterizations captures all the intended applications of the notion and propose instead to identify regulation with modulation. In neuroscience, modulation is the process of changing the shape of an input-output relation. This is a notion that can be applied to the different regulatory strategies proposed in the literature and which is compatible both with second-order and feedback regulation. (shrink)

RESUMEN D. Pritchard ha sostenido que el conocimiento requiere la satisfacción de una condición de habilidad y una anti-suerte que no guardan relación de implicación entre sí. Se sostiene que la satisfacción de una condición anti-suerte implica cumplir con la condición de habilidad, primero, porque, las características centrales del caso de D. Pritchard en contra de esta implicación son compartidas con casos en los que hay habilidad; y segundo, el caso de A. Goldman del dios benevolente es más efectivo que (...) TEMP, pero involucra un tipo de seguridad diferente a la requerida para el conocimiento. Por último, se muestra que la respuesta de D. Pritchard al problema de la generalidad bloquea la implicación de seguridad a habilidad. Se propone un contraejemplo, adaptando un caso tomado de la epistemología del testimonio. ABSTRACT D. Pritchard holds that knowledge requires the satisfaction of an ability condition and an anti-luck condition that bear no relation of implication to each other. The article argues that the satisfaction of the anti-luck condition implies satisfying the ability condition for two reasons: first, that the main characteristics of Pritchard's case against this implication are shared by cases in which there is ability; and, second, that although A. Goldman's benevolent demon case is more effective than TEMP, it involves a different type of certainty than that required for knowledge. Finally, the article shows that Pritchard's response to the generality problem blocks the implication between certainty and ability, and proposes a counterexample that draws on the epistemology of testimony. Modern management reporting on its company''s performance is influenced by individuals ethical considerations. Stakeholders philosophies have continued to change over the last 75 years affecting reporting systems for companies reporting information internally and externally. These fundamental changes in philosophy have affected how information is conveyed. We are not claiming that only one philosophical viewpoint dominates companies reporting practices, but there does appear to be a changing trend of philosophies building on one another. We use resource dependence theory in relationship to (...) a decision-making model to explain changing stakeholders positions over time. This paper argues that six dominant philosophical theories have influenced the way individuals and organizations report financial and other information. Further, these philosophies then are depicted in a model that helps us to understand what influences companies to present themselves to the outside world. This article develops and applies a knowledge-based framework for understanding and interpreting executive compensation under the rubric of ethical consideration. This framework classifies six major ethical considerations that reflect issues in compensation design. We emphasize that these six ethical considerations are influenced by liberty and equality concepts. This framework helps to highlight areas where executive compensation has not been well spelled out.

In the present article, we attempt to elucidate the conceptual rela- tionship between censorship and emotional development. We employ a framework from emotion regulation studies in order to clarify how censorship works and to ex- plain why it cannot affect emotional development in the same way as the remaining types of emotional regulation. Nevertheless, we argue that, by focusing on Plato’s ac- count of censorship, and specifically of its sociocultural function, one can find that it is not a useless device (...) for emotional development. Censorship affects relevant variables in the dynamics of contraposed emotional processes that compete for dominance. (shrink)

The two leading theoretical approaches to tort law — economic analysis and corrective justice — are blind to distributive considerations. Moreover, even the main distributive approaches to tort law — loss-spreading and fairness — fail to emphasize egalitarianism as a distributive consideration. This article argues that egalitarianism should influence the normative evaluation of one’s conduct as negligent or not. It first explains why normatively negligence law should be sensitive to the egalitarian concern, suggesting three different accounts for this claim, based (...) on needs, equality, and desert as criteria for distribution. Second, it argues that egalitarianism is commensurate with the basic understanding of negligence law as reflecting corrective justice and notions of fault. The notion of fault is, therefore, reformulated from within, in order to accommodate egalitarianism. Third, I maintain that in order for egalitarianism to accommodate notions of corrective justice, egalitarian concerns should matter also at the stage of the standard of care. While the egalitarian concern can and should be integrated into the duty stage, I argue that such integration is insufficient. A correct and full understanding of the egalitarian concern and the tort of negligence requires a conclusion that the normative evaluation of one’s action as negligent or not cannot be separated from the distributive results that this action entails. The egalitarian concern works at the duty stage as an excuse for not imposing liability for wrongful activity. In contrast, at the standard stage, it works as a justification that turns an otherwise wrongful activity into a legitimate one. My claim is that morally we should usually expect more care from the better-off than from the disadvantaged. Findings of negligence are based on the failure to balance properly between one’s interests and those of another. In deciding to what extent the defendant should burden herself in order to prevent a loss to potential victims, one morally relevant criterion is the relative ability of the injurer and victim to bear precaution costs and expected accident loss, respectively. La técnica no es un fenómeno más de nuestra época, sino que ha llegado a convertirse en la figura metafísica que la define. El estudio analiza el alcance de esta tesis planteada por Jaspers y Heidegger. Para ello ofrecemos, en un primer momento, una tematización del elemento innovador que caracteriza a la técnica moderna respecto de épocas anteriores, atendiendo especialmente a su carácter totalizador y a la inversión antropológica que supone. A continuación, discutiremos algunas de las consecuencias antropológicas del estatuto (...) ontológico de la técnica. Un fenómeno sin precedentes en la historia de la humanidad, por cuanto la técnica ha dejado de ser un medio o instrumento al servicio de las necesidades y fines humanos para convertirse en un fenómeno capaz de producirlos, estableciendo posibilidades de sentido. The recent frauds in organizations have been a point for reflection among researchers and practitioners regarding the lack of morality in certain decision-making. We argue for a modification of decision-making models that has been accepted in organizations with stronger links with ethics and morality. With this aim we propose a return to the base value of Christianity, supported by Bible scriptures, underlying six dominant ethical approaches that drive practices in organizations.

Technoscience is increasingly present in our daily lives, establishing new social rules and patterns of communication and interaction in a physical space, which implements electronic devices and telematic systems in its design. In the race for scientific progress, the goal is making man a God, like Nietzsche’s Superman, without determining how the new human morphology will be fitted. This paradigm is treated by artists who warn of the possible fate of humanity while the technoscientific, as if he or she was (...) Prometheus, dares to defy the laws of nature. Art exposes the actual course of science, and some artists complain that the false promises of scientific discourse, which is dominated by male vision, fail to be aware of the impossibility that technology is going to improve the moral dimension of human being. Some artists say that the science sermon does not deal with humanity and that the building of our future is merely phallocentric, an excessive anthropocentric vision. (shrink)

This paper aims at understanding the concept of convention in mechanics as a notion transferred from the field of jurisprudence. This enables us to clarify it as a new epistemic category having a pertinent role in the transformation of mechanics in the nineteenth century. Such understanding permits a separation from linguistic and arbitrary conventions, thus highlighting its epistemic features and not transforming fundamental principles into mere arbitrary agreements. After addressing the main references in the literature discussing the role of convention (...) in mechanics, we analyze its classical use as a concept originating from law. Then we explain its use by Carl G. Jacobi, Ferdinand F. Reech, and J. Henri Poincaré. Here we also show how their uses conform to the features analyzed regarding conventions in jurisprudence. Finally, we try to explain how the use of this concept, among other factors, contributed to the transformation of mechanics. (shrink)

In the introduction to his famous book, La Science et l’hypothèse, Poincaré remarks on the necessary role and legitimacy of hypotheses. He establishes a triple classification of hypotheses, dividing them into verifiable, useful, and apparent. However, in chapter 9, entitled ‘Les hypothèses en physique’, he gives a slightly different triadic classification: natural hypotheses, indifferent hypotheses, and real generalizations. The origin of this second classification is a lecture given at the International Congress of Physics, Paris, 1900. What are the similarities and (...) differences between these two classifications? My main purpose is to provide a possible equivalence between the two classifications in order to clarify the role of hypotheses in Poincaré’s epistemology of natural science. The discussion will be based on the two fundamental texts mentioned above and on the contrast between Poincaré’s use of the notion of hypothesis and that of some of his contemporaries. (shrink)

This research aims to study possible effects or impacts of COVID-19 in the context of a democratic organizational system analyzing how COVID-19 has influenced employees’ perception of their participation in decision-making and its impact on some psychological outcomes and emotions. COVID-19 has accelerated the process of implementation of new frameworks at work that have generated the modification of culture and employee management practices. Our hypothesis are, on the one hand, that COVID-19 has generated changes in participation structures and internal communication (...) mechanisms, having to make modifications not to deteriorate the perception of employees about their participation in decision making. On the other hand, COVID-19 has generated changes in the psychological outcomes and emotions of the employees. In the study, we analyze a cooperative belonging to the MONDRAGON cooperative group, where participation in decision-making and ownership is in its DNA. Through qualitative and quantitative methodologies, involving 42 employees, we investigate firstly, how COVID-19 has affected perceptions about participation in decision-making analyzing what role has played internal communication in these perceptions. Secondly, we investigate how COVID-19 has affected psychological outcomes and emotions. In this case, the perceptions arising from participation in decision-making focus on the assessment that participators make of the governance channels and the day-to-day meetings. Therefore, their appropriateness seems to be a key factor in the perception of participation in the COVID-19 era. Differences have been detected between the perceptions of blue and white collar employees. Such differences have also been founded in the psychological outcomes and emotions. Although this is a single case study, the analysis carried out provides elements of reflection to modify and restructure the decision-making and participation mechanisms, adapting them to the needs of blue and white collar employees in order to “guarantee” the expected outcomes. Uno de los cambios a considerar remite al impacto del desarrollo de internet y a los dispositivos asociados para un tipo de “participación mediatizada” en vivo, que transforma sustantivamente el lugar y la posición que tenía el espectador de los viejos medios masivos de comunicación. Con relación al “objeto” de estos programas, es posible identificar y reconstruir una modelización recurrente en el qué se dice y cómo; construcción ideológica que encuentra en la macro forma compartida del panel, por ejemplo, una manera de presentar “diversidad de voces”, en tanto expresión resultante del proceso de trabajo que vincula estética y política en la construcción de una “verdad” sobre el contexto político actual.La estrategia expositiva y argumentativa es la siguiente: 1) Presentamos y caracterizamos estructuralmente a los programas seleccionados y los vinculamos con expresiones rescatadas de los grupos de discusión. 2) Seleccionamos ejes de comparación que posibilitan la precisión de recurrencias entre ellos. 3) Finalmente, con los resultados del recorrido descriptivo y analítico, exponemos rasgos y dinámicas de las novedosas formas de estetización de lo político —en el sentido benjaminiano— como proceso orientado a que las masas —en nuestro caso, los individuos— expresen sus demandas. The dispute on mongrelization starts to play a fundamental role in Latin America inside the modernist debates about the national unity between the end of the XIX century and the beginning of the XX century, to later acquire an unprecedented global diffusion in the eighties and the nineties of the last century. Using the writings of the Bolivian sociologist Silvia River Cusicanqui and of the Argentinian anthropologist, who has long since been active in Brazil, Rita Segato, the essay reconstructs the (...) historic and political happening of metissage in Latin America. The authors show that it is an historical concept which worked as an instance of legitimation both in the period of colonial oppression and later in the epoch of republican modernization. It represents the instrument to hide – if not to delete – the original character of modern State; for this reason it has been able to play a fundamental role in the epoch of liberalism as much as in the neoliberal one. However in mongrelization what is also at stake is that it can express the radically de-colonizing impulse of the differences as forms of litigation which inhabit the complex contemporary Latin American territories. The concept of mental privacy can be defined as the principle that subjects should have control over the access to their own neural data and to the information about the mental processes and states that can be obtained by analyzing it. Our aim is to contribute to the current debate on mental privacy by identifying the main positions, articulating key assumptions and addressing central arguments. First, we map the different positions found in current literature. We distinguish between those who dismiss (...) concerns about mental privacy and those who endorse them. In this latter group, we establish a further disagreement between conservative and liberal strategies to protect mental privacy. Then, we address the first discussion by articulating and criticizing different skeptical views on mental privacy. Finally, we try to identify what are the unique features of neural data and examine how they may be connected to the ways in which neurotechnological mindreading could put mental privacy at risk. We suggest that even if neural data is unique, it may not require new strategies to protect people from its misuse. However, identifying the special features and risks of neurotechnological mind-reading is necessary for the second discussion on mental privacy to properly take off. (shrink)

El trabajo presenta una revisión analítica de la literatura alrededor de los debates regionales en Argentina, Chile y Uruguay sobre familia, matrimonio y filiación suscitados en torno a la redacción de los códigos civiles en las últimas décadas del siglo XIX y sus primeras reformas, acontecidas en la primera mitad del siglo XX. Today, the notion of identity is usually linked with ethical-political discussions like multiculturalism, gender or sexual diversity, recognition of plurality, etc. Nevertheless, the flourishing of this vision that interprets “identity” mainly in its plural form (as “identities”) contrasts sharply with the sense that “identity” has had during most of the history of philosophy (in which identity was understood in connection with “unity” or “selfsameness”, not with “diversity” or “otherness”). In order to explain the passage from one notion of identity to (...) the other (a passage mainly made in the last third of the 20th century), we will focus on the reflections made by Ludwig Wittgenstein towards the middle of that century. Our contention is that these reflections open the way to a more plural understanding of human identity, against the many interpreters of Wittgenstein that defend the opposite: that he offered a strong notion of common human identity in his writings, a notion based on the idea of “human nature”. In order to sustain our thesis, we will have to give an interpretation of some key terms of Wittgenstein’s philosophy (like “forms of life” or “natural history”) from a pluralistic point of view; this is the only way of understanding to what extent he is a predecessor of contemporary discussions about plural identities. For centuries, various disciplines have tried to tackle the topic of how legitimate it is to use violence in order to solve social problems. One of the most recent interdisciplinary approaches, most successful in present-day Latin America, is the so-called "Ethics of Liberation," designed by Enrique Dussel. Based on the Theology of Liberation, this theory goes beyond the limits of theology as a discipline and pleads for three ethical criteria that every political revolution must fulfill to use violence in a (...) legitimate way. The first is a formal criterion, which basically takes after the ideal dialogue situation endorsed by Karl-Otto Apel and Jürgen Habermas, and purports to be rooted in yet another discipline, linguistics. The second is a material criterion, defined as the upshot of an acceptable welfare for all citizens, thus intimately linked with the discipline of economics and political philosophy. The third is a criterion of feasibility, which makes a revolt legitimate if, and only if, it has a reasonable possibility of succeeding; hence strategic issues take a leading role. This essay contends that each of these criteria is conceptually incompatible with violence. Hence, Dussel's arguments involve multiple contradictions as he aims to justify the use of violence precisely with these interdisciplinary criteria. (shrink)
