The market failures approach to business ethics has recently garnered substantial critical attention (see, e.g., Cohen and Peterson 2019; Moriarty 2020; Steinberg 2017; Hsieh 2017; von Kriegstein 2016; Smith 2018; Endorfer and Larue 2022; Singer 2018). Though precursors of this view can be found in the literature (e.g., McMahon 1981; Friedman 1970), it was Joseph Heath (2004, 2006, 2014, 2023) who developed the approach and gave it its name. The market failures approach (henceforth: MFA) is concerned with the ethical (...) obligations of managers of firms (Heath 2014, 69). Roughly, it holds that managers ought not to conduct their businesses in a way that exploits market failures. “Market failure” is a technical term, meaning any failure of the conditions of the first fundamental welfare theorem, sometimes called the “Pareto conditions” (see Arrow 1951). The theorem states that if the Pareto conditions hold, then the market equilibrium will use society’s scarce resources efficiently, meaning that no one could be made better-off without making anyone else worse off. Efficiency, according to Heath (2014, chapter 7), is the implicit morality of the market. We coordinate much of our shared activity using markets, Heath claims, because of their ability to produce efficient results. Markets are good forms of social organization, according to Heath, because they are the best way to promote our values given empirical facts about the frailties of human psychology and the informational constraints that we face. As such, managers ought not compromise the very conditions that justify a market economy by profiting from breakdowns in the market’s efficiency. Managers are permitted to maximize profits, so long as they do not violate the market’s norm of efficiency in so doing. This is because the fundamental justification for the profit motive is that it is necessary for the operation of the price system which is essential to the efficiency properties of markets. In this paper, I will argue that the MFA is more general than even Heath himself claims. The MFA describes the professional obligations of managers, but the view I develop, the generalized market failures approach, describes the obligations of all market participants. Since efficiency is the implicit morality of the market, it binds not just managers, but all market participants, including consumers, investors and workers. Market participants are permitted to maximize the benefit they gain from market interactions, as long as they do so in a way that does not take advantage of any market failures. Generalizing the MFA in this way has three benefits: first, we gain a unified understanding of the ethics of non-managerial market roles; second, we will develop an even better understanding of the duties of managers; finally, it gives us the resources to respond to some familiar objections to the MFA found in the literature. In the next section, I will further motivate the MFA and explain how this motivation can be easily generalized to other market roles. Importantly, one can avoid benefiting from a market failure in two distinct ways: by avoiding transactions that exploit market failures or by transacting in such markets and then remediating the harm done, by compensating those negatively affected by the market failure. This section concludes by discussing how the remediation duties are to be split between the transacting parties and how to identify the parties to whom compensation is owed. In section 3, I use the tools of the generalized MFA to develop a unified ethics of consumption, investment and labor, respectively. This is the basis of a grand abductive argument for the generalized MFA. The view is strongly supported by the fact that it provides attractive and unifying explanations of our obligations in domains as variegated as carbon offsetting, CEO compensation, the reparations white Americans owe to black Americans and occupational licensure. A simple model of a quantum clock is applied to the old and controversial problem of how long a particle takes to tunnel through a quantum barrier. The model has the advantage of yielding sensible results for energy eigenstates and does not require the use of time-dependent wave packets. Although the treatment does not forbid superluminal tunneling velocities, there is no implication of faster-than-light signaling because only the transit duration is measurable, not the absolute time of transit. In recent years, a number of commentators have expressed dissatisfaction with Spinoza’s account of practical reason. In this paper, I defend his account against the most prominent objections, showing that the dictates of reason play an important role in guiding thought and action. However, against the standard interpretation, I propose that we view these rules not as exceptionless, instrumental prescriptions—hypothetical imperatives with necessary antecedents, as Curley memorable put it—but rather as adaptable guideposts that aid us in the complex, dynamic process (...) of acquiring a habit of virtue. The dictates of reason are best understood as defeasible policies that help to orient one in the ars vivendi. (shrink)

It is often noted that Spinoza’s conception of striving (conatus) reflects the influence of Hobbes. While this is undoubtedly true, in this chapter I explore how an important difference in how Hobbes and Spinoza understand “striving” drives a wedge between them, resulting in remarkably different views of goodness, happiness, liberty, and the function of the state.

In The Afterlife of Moses, Steinberg addresses the story of Moses and the Exodus as a foundational myth of politics, of the formation not of a nation but of a political community grounded in universal law. Motivated in part by this recent period of reactionary insurgency in the US, Europe, and Israel, this work of intellectual history articulates the way in which a critique of myths of origin as a principle of democratic government, affect, and citizenship has equal relevance (...) in these places and equal fragility. Focusing on the logistics of perception, this title introduces the author's understanding of 'picnolepsy' - the epileptic state of consciousness produced by speed, or rather, the consciousness invented by the subject through its very absence: the gaps, glitches, and speed bumps lacing through and defining it.

In this paper I seek to shed light on Spinoza’s understanding of the relationship between the citizen and the state by briefly examining two interpretative questions: (1) Is the state an individual? (2) What grounds Spinoza’s claim that the human individual ought always to comply with civil laws? Several scholars, whom I refer to as Restrictive Individualists, have worried that answering (1) in the affirmative would entail an intolerable understanding of (2), according to which the human individual would be engulfed (...) in the functioning of the state. I argue that (1) should be answered affirmatively and that the worries of the Restrictive Individualists are unfounded. I then propose a way of answering (2) that is consistent with the normative priority of the human individual. (shrink)

Paul Thom's book presents Kilwardby's science of logic as a body of demonstrative knowledge about inferences and their validity, about the semantics of non-modal and modal propositions, and about the logic of genus and species. This science is thoroughly intensional. It grounds the logic of inference on "that in virtue of which" the inference holds. It bases the truth conditions of propositions on relations between conceptual entities. It explains the logic of genus and species through the notion of essence. (...) Thom interprets this science as a formal logic of intensions with its own proof theory and semantics. This comprehensive reconstruction of Kilwardby's logic shows the medieval master to be one of the most interesting logicians of the thirteenth century. (shrink)

Daniel and Frances Howard-Snyder suggest that it is possible for an omnipotent being, Jove, to create randomly a world from a continuum of ever more perfect possible worlds. They then go on to argue that Jove could be characterized as morally unsurpassable despite creating a surpassable world. I raise a number of problems for the view that Jove could be characterized as morally unsurpassable when he creates (randomly or not) a surpassable world.

This edition includes a new introduction by Peter J. Gomes that reflects on the impact of this book in the years since it was written.

How should we make choices when we know so little about our futures? L. A. Paul argues that we must view life decisions as choices to make discoveries about the nature of experience. Her account of transformative experience holds that part of the value of living authentically is to experience our lives and preferences in whatever ways they evolve.

This paper develops Bernard Williams’s claim that moral incapacity – i.e., one’s inability to consider an action as one that could be performed intentionally – ‘is proof against reward’. It argues that we should re-construe the notion of moral incapacity in terms of self-identification with a project, commitment, value, etc. in a way that renders this project constitutive of one’s self-identity. This consists in one’s being insensitive to incentives to reconsider or get oneself to change one’s identification with this project. (...) More precisely, self-identification with a project implies that no state-given reason can justify for oneself reconsidering, or getting oneself to revise, or abandon one’s identification with that project. This view ties together integrity and self-identification, and avoids problems common to competing views: it avoids regress problems faced by hierarchical theories of identification; it demonstrates that integrationist views of identification overlook the fact that a deep, well-integrated attitude may fail to be incentive-insensitive; and it helps explain what’s wrong with ‘perverse’ cases, where one values acting in a way that one does not all things consider value. It also improves on Williams’s own view, by construing moral incapacity not merely in terms of one’s incapacity to perform an action (that undermines one’s project and thus violates one’s integrity), but also in terms of one’s incapacity to reconsider one’s commitment (to said project). The task of this chapter is to investigate and assess Grossmann’s view of the ontological status of categories. It has two dimensions. Because Grossmann does not offer a full discussion of the ontology of categories, we first need to present an interpretation of his view. Our point of departure is Grossmann’s claim that a category is a fundamental property of being (which implies that he holds view 3 above). Our second task is to assess the adequacy of his view. We (...) do this by raising some problems with Grossmann’s account, offering as an alternative view a version of 4 above, and defending it against what we construe as Grossmann’s possible counter-arguments. We argue that the best way to view categories themselves is as ontologically neutral insofar as this opens the way for particular categories to be linguistic entities, mental acts, or properties of extra-mental things. This requires, in turn, a qualified defense of two views rejected by Grossmann—common natures and modes of being. (shrink)

This is a collection in translation of essays by Paul Ricoeur which presents a comprehensive view of his philosophical hermeneutics, its relation to the views of his predecessors in the tradition and its consequences for the social sciences. The volume has three parts. The studies in the first part examine the history of hermeneutics, its central themes and the outstanding issues it has to confront. In Part II, Ricoeur's own current, constructive position is developed. A concept of the text (...) is formulated as the implications of the theory are pursued into the domains of sociology, psychoanalysis and history. Many of the essays appear here in English for the first time; the editor's introduction brings out their background in Ricoeur's thought and the continuity of his concerns. In the modern day, it is understood that the role of the teacher comprises aspects of therapy directed towards the child. But to what extent should this relationship be developed, and what are its concomitant responsibilities? This book offers a challenging philosophical approach to the inherent problems and tensions involved with these issues.

This chapter introduces inferential role semantics (IRS) and some of the challenges it faces. It also introduces inferentialism and places it into the wider context of contemporary philosophy of language. The chapter focuses on what is standardly considered both the most important test case for and the most natural application of IRS: logical inferentialism, the view that the meanings of the logical expressions are fully determined by the basic rules for their correct use, and that to understand a logical expression (...) is to use it in accordance with the appropriate rules. It discusses some of the benefits of logical inferentialism, chiefly with regard to the epistemology of logic, and considers a number of objections. The chapter critically examines Robert Brandom's inferentialism about linguistic and conceptual content in general. Finally, it considers a number of general objections to IRS and possible responses on the inferentialist's behalf. (shrink)

I would have preferred that the Special Section on Children as Organ Donors had focused on the donation of a specific organ because morally relevant differences are obscured when the subject is discussed in general terms. The donation of a lobe of liver and peripheral blood or bone marrow stem cells does not result in the permanent loss of vital tissue because these organs regenerate; however, a kidney does not regenerate and its donor loses a vital organ permanently. Liver tissue (...) and peripheral blood or bone marrow stem cells are typically required to save a life, but, because most patients with end-stage renal disease can be kept alive on dialysis, the donation of a kidney is rarely life saving. Also, donor risk is organ specific; for example, it is more dangerous to donate a lobe of liver than it is to donate peripheral blood or bone marrow stem cells. (shrink)
