ABSTRACT The publication of Pope Leo XIII's encyclical Rerum Novarum in 1891 established a tradition of Catholic social teaching concerned with the moral obligations that should exist between capital and labour. In Ireland the encyclical instigated enthusiasm among some clergy for their congregation's welfare. An urgency given to social and economic questions coincided with the co-operative movement's introduction to the Irish countryside. Rural co-operative societies were established as part of a wider programme of economic democracy that placed ownership of production (...) in the hands of farmers. The growth of the co-operative movement benefitted from the participation of members of the clergy at both a national and local level. Co-operative organisers and socially minded priests shared an interest in addressing the iniquities of capitalist modernisation. Co-operators championed a communal form of business organisation that emphasised the moral importance of economic activity as much as its productive importance. The involvement of Catholic priests in the co-operative movement naturalised priest-led social action in the sphere of rural development. This article analyses intersections between the economic objectives of co-operation and Catholic social teaching to understand how attempts to promote a more democratic economy had a profound influence over the country's economic development. (59).Chapter 1 begins with cases of conflict between women's religious congregations and clerical leadership. In the first case, Sisters of the Holy Names of Jesus and Mary protested intolerable living conditions at a parish in Brooklyn, New [End Page 201] York, in 1939. When repeated requests for heat fell on the pastor's deaf ears, the sisters requested to leave the parish and were told that they would then also have to leave another thriving ministry in the diocese. The sisters acquiesced to this decision in a spirit of obedience and did not publicize the real reason for their departure. Fifty years later in Miami, Florida, when another conflict arose, the sisters involved discerned a very different response to injustice, one marked by concern for "justice, honesty, and personal responsibility." The model of a "good sister" had shifted from an emphasis on obedience and institutional loyalty toward shared responsibility for ministry and leadership.Chapter 2 surveys the landscape of women's engagement with the Church and its structures of leadership and adapts H. Richard Niebuhr's Christ and Culture to sketch five "types": women against the Church; women content with the Church; women above the Church; women and Church in paradox; and women transforming Church. Patrick proposes the transformationist model as the approach that most adequately meets the challenges that women face in the Church today; she calls on those who adopt this approach to live in creative tension with the Church and with those who follow the other models, to espouse justice and mutuality in organizational structures, and to be self-critical. Chapter 3 recounts the history of the National Assembly of Religious Women through this transformational lens.Chapter 4 proposes a "framework for love" that builds on Margaret Farley's ethic of commitment to envision an ethic of vocation that elicits "active receptivity," values the contributions of institutions, practices egalitarianism, and keeps justice and love in dialectical relationship. The "myth" of vocation (the notion that vocation is a "thing" to be discovered and pursued, like one's destiny or soul mate) is balanced by the "mystery" of vocation that engages ongoing, lifelong discernment. Background: Moral distress is an important and well-studied phenomenon among nurses and other healthcare providers, yet the conceptualization of parental moral distress remains unclear. Objective: The objective of this dimensional analysis was to describe the nature of family moral distress in serious pediatric illness. Design and methods: A dimensional analysis of articles retrieved from a librarian-assisted systematic review of Scopus, CINAHL, and PsychInfo was conducted, focusing on how children, parents, other family members, and healthcare providers describe parental moral distress, both (...) explicitly through writings on parental moral experience and implicitly through writings on parental involvement in distressing aspects of the child’s serious illness. Ethical considerations: To promote child and family best interest and minimize harm, a nuanced understanding of the moral, existential, emotional, and spiritual impact of serious pediatric illness is needed. The cases used in this dimensional analysis come from the first author’s IRB approved study at the Children’s Hospital of Philadelphia and subsequent published studies; or have been adapted from the literature and the authors’ clinical experiences. Findings: Three dimensions emerged from the literature surrounding parent moral distress: an intrapersonal dimension, an interpersonal dimension, and a spiritual/existential dimension. The overarching theme is that parents experience relational solace and distress because of the impact of their child’s illness on relationships with themselves, their children, family, healthcare providers, their surrounding communities, and society. Discussion: Elucidating this concept can help nurses and other professionals understand, mitigate, or eliminate antecedents to parental moral distress. We discuss how this model can facilitate future empirical and conceptual bioethics research, as well as inform the manner in which healthcare providers engage, collaborate with, and care for families during serious pediatric illness. Conclusion: Parent moral distress is an important and complex phenomenon that requires further theoretical and empirical investigation. Decisions about whether or not to become a parent are significant parts of normative human development. Many studies have shown that married different-sex couples are expected to become parents, and that many social pressures enforce this norm. For same-sex couples, however, much less is known about social norms surrounding parenthood within marriage. This study examined injunctive norms and descriptive norms for the pursuit of parenthood as a function of age, gender, and sexual orientation. Participants in an internet survey included 1020 (...) cisgender people from across the United States Findings showed that norms, especially descriptive norms, for the pursuit of parenthood for heterosexual people were much stronger than those for lesbian women and gay men, and that norms for lesbian women were stronger than those for gay men. These differences were more pronounced for older, heterosexual, and male participants. However, lesbian and gay participants, especially gay men, reported that lesbian and gay people ought to become parents to the same extent as heterosexual people. Overall, the results indicated that, regardless of sexual orientation, adults report that lesbian and gay married people ought to become parents, but that they expect only a minority of these couples will pursue parenthood. This research provided a glimpse into how Americans are envisioning family formation among same-sex couples today. (shrink)

All non-nuclear-weapon states are morally and legally obliged by the Nuclear Nonproliferation Treaty (NPT) to refrain from acquiring nuclear weapons. These obligations cannot be overridden for reasons of mere prudence. Only (i) material breaches of the treaty and/or a corresponding; (ii) ‘fundamental change in circumstances’ (rebus sic stantibus) that undermines the integrity of the NPT may override states parties’ legal nonproliferation duties. More than the violations of the NPT by ‘rogue’ states like North Korea or Iran, I argue that the (...) failure of the de jure nuclear-weapon powers since 2001 to uphold their informal and some formal NPT commitments suggests the possibility of material breach and/or institutional subversion. If NPT subversion were to occur, the non-nuclear-weapon states’ collective responsibility to avoid complicity in that subversion leads them to choose between (a) individually seeking nuclear weapons capability for state security; or, more preferably, (b) a publicly announced and collective withdrawal from the NPT that simultaneously refuses to pursue the nuclear weapons option. Inductively defined structures are ubiquitous in mathematics; their specification is unambiguous and their properties are powerful. All fields of mathematical logic feature these structures prominently: the formula of a language, the set of theorems, the natural numbers, the primitive recursive functions, the constructive number classes and segments of the cumulative hierarchy of sets. -/- This dissertation gives a mathematical characterization of a species of inductively defined structures, called accessible domains, which include all of the above examples except the set of (...) theorems. The concept of an accessible domain comes from Wilfried Sieg's analysis of proof-theoretic practices, starting with his dissertation. In particular, he noticed the special epistemological character of elements of an accessible domain: they can always be uniquely identified with their build-up. Generally, the unique build-up of elements justifies the principles of induction and recursion. -/- I use category theory to give an abstract characterization of accessible domains. I claim that accessible domains are all instances of initial algebras for endofunctors. Grounded in the historical roots of Sieg's discussions, this dissertation shows how the properties of initial algebras for endofunctors and accessible domains coincide in a satisfying and natural way. -/- Filling out this characterization, I show how important examples of accessible domains fit into this broad characterization. I first characterize some accessible domains by relatively simple functors (e.g. finite, polynomial, those that preserve certain colimits) where we can see how iterating the functor can produce the accessible domain. Then I describe accessible domains that result from more involved specifications (e.g. ordinals and segments of the cumulative hierarchies associated with CZF, IZF, and ZF) by relying heavily on algebraic set theory. In a widely cited and controversial speech, UN Secretary-General Kofi Annan highlighted the moral character of the boundaries of political sovereignty when he questioned whether respecting national sovereignty everywhere and always precluded the international protection of human rights. He argued that it did not and highlighted the importance of multilateral authorization. In this article, I explore the difference that multilateral authority, as opposed to unilateral national decision, should make in justifying armed intervention. Should the more salient role of the United (...) Nations lead us to a more expansive tolerance of international intervention? And, if multilateralism does make a difference—and many think its impartiality is key—are good intentions enough? Had the international community also discovered how to intervene more effectively, with a better prospect of self-sustaining self-determination, at an acceptable humanitarian cost? I will conclude that multilateralism should widen our acceptance of intervention, even though the intentions at play are not reliably superior to unilateral intentions. (shrink)

T he Question of punishment and its justification has been a major preoccupation in recent philosophy of law. The reasons for this growing concern are not difficult to discover. Both philosophers and jurists have become increasingly sceptical of traditional theories of legal punishment. Each of these inherited theories was designed to establish criteria for the recognition and appraisal of punishment as a legal institution. However, alternative theories emphasised different and often conflicting criteria. Some theories emphasised moral desert and retribution, while (...) others appealed to the social utilities of punishment. Moral latitude is only ever a matter of coincidence on the most popular decision procedure in the literature on moral uncertainty. In all possible choice situations other than those in which two or more options happen to be tied for maximal expected choiceworthiness, Maximize Expected Choiceworthiness implies that only one possible option is uniquely appropriate. A better theory of appropriateness would be more sensitive to the decision maker’s credence in theories that endorse agent-centred prerogatives. Various philosophers have wanted to move from a (P.F.) “Strawsonian” understanding of the “practices of moral responsibility” to a non-skeptical result. I focus on a strategy moving from a “response-dependent” theory of responsibility. I aim to show that a key analogy associated with this strategy fails to support a compatibilist result. It seems clear that nothing could show that nothing we have been laughing at has really been funny. If “the funny” is similar to “the blameworthy”, then perhaps it would (...) follow that nothing could show that no one we have ever blamed has really been blameworthy. The comparison is interesting, but inconclusive: even if we grant that these properties are normatively similar, the latter has substantive empirical presuppositions, whereas the former does not. One important upshot: even if the standards operative in our practices cannot be mistaken, it could nevertheless be that no one has ever met these standards Ruling out this possibility seemingly requires re-engaging in all of the so-called "metaphysical" debates Strawsonians are keen to avoid. Recent estimates indicate that over 40,000 children die annually in the United States and a majority have life-limiting conditions. Children at end of life require extensive healthcare resources, including multiple hospital readmissions and emergency room visits. Yet, many children still suffer from symptoms at end of life—including fatigue, pain, dyspnea, and anxiety—with less than 10% of these children utilizing hospice care services. A critical barrier to pediatric hospice use was the original federal regulations associated with the hospice care that required (...) a diagnosis of 6 months to live and the discontinuation of all curative treatments. The Concurrent Care Provision of the United States’ Affordable Care Act eliminated the need to forgo curative therapies in order to enroll in hospice for children in Medicaid or Children’s Health Insurance Program. Concurrent care for children can help mitigate the tension families experience in choosing between essential forms of care, as well as contribute to improved end-of-life outcomes for the child and possibly bereavement outcomes for the family. Understanding concurrent care for children from a social justice perspective has important advocacy and research implications for hospice and palliative care clinicians providing care for children and their families. We apply Powers and Faden’s theory of social justice “as the moral foundation of public health and health policy” to the provision of concurrent care to children near end of life and families in the United States. The goals of applying this theory are to explore additional insights and perspectives into concurrent care policy may provide and to assess the usefulness of this theory when applied to end-of-life health policy. We argue that concurrent care policy is socially just since it has potential to promote well-being in vulnerable children and families and can limit the inequity children at end-of-life experience in access to high-quality hospice care. The author uses social epistemology to develop the cognitive authority theory. The fundamental concept of cognitive authority is that people construct knowledge in two different ways: based on their first-hand experience or on what they have learned second-hand from others. What people learn first-hand depends on the stock of ideas they bring to the interpretation and understanding of their encounters with the world. People primarily depend on others for ideas as well as for information outside the range of direct experience. (...) Much of what they think of the world is what they have gained second-hand. All that people know of the world beyond the narrow range of their own lives is what others have told them. However, people do not count all hearsay as equally reliable; only those who are deemed to “know what they are talking about” become cognitive authorities. --. (shrink)

As well as disagreeing about how much one should donate to charity, moral theories also disagree about where one should donate. In light of this disagreement, how should the morally uncertain philanthropist allocate her donations? In many cases, one intuitively attractive option is for the philanthropist to split her donations across all of the charities that are recommended by moral views in which she has positive credence, with each charity’s share being proportional to her credence in the moral theories that (...) recommend that particular charity. Despite the fact that something like this approach is already being used by real-world philanthropists to distribute billions of dollars of donations, it is not supported by any of the approaches to moral uncertainty that have been proposed thus-far in the philosophical literature. In this paper, we will develop a bargaining-based approach to moral uncertainty that honors the proportionality intuition in favor of splitting one’s donations. We also show how this bargaining-based approach has several further advantages over the best alternative proposals. (shrink)
