Abstract:During recent years, the principle and practice of employment-at-will have been under attack. While progress has been made in eroding the practice, the principle still governs the philosophical assumptions underlying employment practices in the United States, and, indeed, EAW has been promulgated as one of the ways to address economic ills in other countries. This paper will briefly review the major critiques of EAW. Given the failure of these arguments to erode the underpinnings of EAW, we shall suggest new avenues (...) for approaching employment issues to achieve the desirable goal of employee dignity and respect. This article presents a response to Richard Rorty's paper "Is Philosophy Relevant to Business Ethics?" The author questions Rorty's views on the depreciation of the role of philosophy in applied ethics, and outlines four reasons why philosophy retains its relevance. The author addresses the role of moral reasoning in the development of the moral imagination. The author also concludes that humans have the means necessary to make moral progress and are capable of moral reasoning, and need only to develop a (...) strong moral imagination. (shrink)

En esta línea, se concentra en las innovaciones que ha implicado el establecimiento del Consejo de Derechos Humanos, en lugar de la antigua Comisión de Derechos Humanos. ResumenLa exigencia metodológica de claridad se ha transformado muchas veces en una exigencia teórico-empírica sobre el objeto analizado: que la realidad que se puede analizar debe ser, a su vez, clara. Sin embargo, ello es inadecuado para analizar la vida social. Una de las características básicas de la acción es que ella no es clara, sino que opera en un mundo que es confuso. La exigencia entonces ha de transformarse de forma tal que la exigencia metodológica no se traduzca en (...) una exigencia sobre la realidad. Resumen:En los textos de los clásicos de la sociología, la historia tiene una fuerte presencia y el llamado teórico a una sociología con consciencia histórica ha sido común, en particular en América Latina. Sin embargo, esos llamados han sido infructuosos. En este artículo abordamos algunas hipótesis en torno al este hecho y concluimos defendiendo esta necesidad de una sociología que conozca en profundidad la historia. Lo que es inaceptable -tanto como juicio de hecho como juicio de valor- es la pretensión de derivar recomendaciones neutrales (...) solo desde los hechos, la idea tecnocrática de una intervención que no requiere compromiso. En el Santiago del siglo XVIII, los ajustes urbanísticos y sociales emanados de las autoridades se tradujeron en prácticas y representaciones, institucionales y de las otras, que involucraron a todos los habitantes de la ciudad. La actuación decidida de algunos alcaldes, como los de Aguas y los de Barrio, implicó el acomodo de voluntades e intereses, y también el enfrentamiento violento de cuerpos y de subjetividades, los que han quedado registrados en los pleitos por injuria seguidos en tribunales de primera (...) y de última instancia. El análisis comparado de dos casos puntuales, con el auxilio de preguntas y miradas propias de las ciencias sociales, enriquece el conocimiento de la dinámica vida cotidiana en la capital del reino durante el último siglo colonial. The ways in which knowledge relates to power have been much discussed in radical education theory. New emphasis on the role of gender and the growing debate about subjectivity have deepened the discussion, while making it more complex. In Getting Smart , Patti Lather makes use of her unique integration of feminism and postmodernism into critical education theory to address some of the most vital questions facing education researchers and teachers.

This analysis tests the influence of personal, job, and family status characteristics on maternal employment. We use the Merged Child/mother File from the National Longitudinal Survey of Youth to examine employment patterns of mothers who gave birth between 1979 and 1986. Logistic regression is used to estimate the probabilities; proportional hazards techniques are used to estimate rates of leaving and return to employment after childbirth. We find that family status factors and the proportion of the family income the mother earns (...) are consistently important in predicting maternal employment. Human capital factors are more significant in predicting employment exits and the rate of exit than the rate of return or employment status one year after a birth. (shrink)

This paper examines the relationship between organizational ethical culture in two large international CPA firms, auditors'' personal values and the ethical orientation that those values dictate, and judgments in ethical dilemmas typical of those that accountants face. Using an experimental task consisting of multiple judgments designed to vary in "moral intensity" (Jones, 1991), and unique as well as tried-and-true approaches to variable measurements, this study examined the judgments of more than three hundred participants in our study. ANCOVA and path analysis (...) results indicate that: (1) Ethical judgments in situations of high moral intensity are affected by personal values and by environmental variables, such as the professional code of conduct (direct and indirect effects) and previous ethics instruction (direct effect only). (2) Corporate ethical culture, and a relatively strong firm rules-orientation, affect auditors'' idealism but not relativism, and therefore indirectly affect ethical judgments. Jones'' (1991) moral intensity argument is supported: differences in the characteristics of specific judgment tasks apparently result in different decision processes. (shrink)

Habit and Embodiment in Merleau-PontyIntroductionMerleau-Ponty (French phenomenological philosopher, born in 1908 and deceased in 1961) refers to habit in various passages of his Phenomenology of Perception as a relevant issue in his philosophical and phenomenological position. Through his exploration of this issue he explains both the pre-reflexive character that our original linkage with the world has, as well as the kind of “understanding” that our body develops with regard to the world. These two characteristics of human existence bear a close (...) relation with the vision of an embodied mind sustained by Gallagher and Zahavi in their work The Phenomenological Mind: An Introduction to Philosophy of Mind and Cognitive Science. Merleau-Ponty uses concepts like those of the lived or own body and of lived space in order to emphasize, from a first-person perspective, the co-penetration that exists between subject and world.Gallagher and Zahavi have regained the experience of phenomenology, especially that of Merleau-Ponty and Sartre, to contribute to the development of the cognitive sciences. Via the phenomenological approach to the reality of habit, a new understanding of the body becomes possible for us, such that it becomes characterized “as subject, as experiencer, as agent”, and at the same time we can understand “the way the body structures our experience” (Gallagher and Zahavi, 2008). In Emotions and Reasons, Patricia Greenspan offers an evaluative theory of emotion that assigns emotion a role of its own in the justification of action. She analyzes emotions as states of object-directed affect with evaluative propositional content possibly falling short of belief and held in mind by generalized comfort or discomfort.

Husserl’s writings on sociality have received increasing attention in recent years. Despite this growing interest, Husserl’s reflections on the specific role of communication remain underexplored. In this paper, we aim to fill this gap by reconstructing the various ways in which Husserl draws systematic connections between communication and communalization. As will become clear, Husserl’s analysis converges with much more recent ideas defended by Margaret Gilbert and Naomi Eilan.

The study of the subjectivity and the subject appears today as a disputed field by different perspectives. In this article, we expose a framework to understand the subjectivity in a cultural historical approach and we propose theoretical, methodological and axiological issues for the study of subjectivity. We discuss the place of discourse in the study of social subjectivity through structuralism’s positions and proposals of social constructionism. Finally, we defend that the Critical Discourse Analysis proposed by Norman Fairclough as a solid (...) theoretical-methodological perspective for the study of the complex links between subjectivity, discourse and social reality. We propose that this approach, based on categories such as discursive practice, social practice hegemony, discursive order, intertextuality and discursive shift, can address the theoretical, methodological and axiological challenges regarding the study of subjectivity. El estudio de la subjetividad y del sujeto aparece en la actualidad como un campo en disputa por distintas corrientes y posiciones. Las propuestas para el estudio del campo de la subjetividad variarán de acuerdo a las concepciones teóricas y supuestos que sobre ella se tengan. En el presente artículo se plantean una serie de desafíos teóricos, metodológicos y axiológicos necesarios de afrontar para el estudio de la subjetividad. Asimismo, se discute el lugar del discurso en el estudio de la subjetividad social, debatiendo con las posiciones estructuralistas y con las propuestas del construccionismo social. Por otra parte, se expone una forma de comprender la subjetividad desde el enfoque histórico cultural y, en consistencia con lo anterior, se plantea una perspectiva teórica-metodológica pertinente para abordar las complejas relaciones entre subjetividad, discurso y realidad social: el Análisis Crítico del Discurso propuesto por Norman Fairclough. Proponemos que este enfoque, a partir de categorías como práctica discursiva, práctica social, hegemonía, orden discursivo, intertextualidad y cambio discursivo, permite abordar los desafíos teóricos, metodológicos y axiológicos antes planteados respecto del estudio de la subjetividad. A dialogue between virtue and care ethics is formed as a step towards meeting Pellegrino's challenge to create a more comprehensive moral philosophy. It is also a dialogue between nursing and medicine since each practice draws on the Greek Virtue Tradition and the Judeo-Christian Tradition of care differently. In the Greek Virtue Tradition, the point of scrutiny lies in the inner character of the actor, whereas in the Judeo-Christian Tradition the focus is relational, i.e. how virtues are lived out in (...) specific relationships, particularly unequal relationships where vulnerability of one of the members is an issue. In a care ethic relational qualities such as attunement rather than inner qualities are the point of scrutiny. A dialogue between these two traditions makes it possible to consider the relational virtues and skills of openness and responsiveness that are required for a respectful meeting of the other. He rejected as impossible the scientific inquiry practiced by the earlier Presocratic philosophers and held that generation, destruction, and change are unreal and that only one thing exists. Neurophenomenological (NP) methods integrate objective and subjective data in ways that retain the statistical power of established disciplines (like cognitive science) while embracing the value of first-person reports of experience. The present paper positions neurophenomenology as an approach that pulls from traditions of cognitive science but includes techniques that are challenging for cognitive science in some ways. A baseline study is reviewed for “lessons learned,” that is, the potential methodological improvements that will support advancements in understanding consciousness and cognition using (...) neurophenomenology. These improvements, we suggest, include (1) addressing issues of interdisciplinarity by purposefully and systematically creating and maintaining shared mental models among research team members; (2) making sure that NP experiments include high standards of experimental design and execution to achieve variable control, reliability, generalizability, and replication of results; and (3) conceiving of phenomenological interview techniques as placing the impetus on the interviewer in interaction with the experimental subject. In a range of peace process scenarios, the expert’s knowledge has become a fundamental tool for generating information systems as a mechanism for the storage and circulation of data. These information artifacts are supposed to faithfully document situations of human rights violations and contribute to the design of public policy and the construction of collective memory. Following Latour’s (1993) original coinage of the term coproduction, this paper analyzes how the Inter-Institutional System of Information for Justice and Peace (SIIJYP)1 was designed (...) to define victims of war and means of reparation from the State in Colombia. From an actor network theory perspective, we explain how victimizers become the main beneficiaries of the application of the SIIJYP. To comprehend this unintended social impact of the technological artifact and how it becomes an artifact that functions as an aseptic mediator of the historical-judicial truth, and the policy of transitional justice, we examine the relations between human and nonhuman actors, how information is collected, organized, hierarchized, and negotiated, as well as the consequences of the technical and legal construction of the notion of victims of war. Taking the lead from Susan Wolf's and Linda Emanuel's work on systems thinking, and developing ideas from Moberg's, Seabright's and my work on mental models and moral imagination, in this paper I shall argue that what is often missing in management decision-making is a systems approach. Systems thinking requires conceiving of management dilemmas as arising from within a system with interdependent elements, subsystems, and networks of relationships and patterns of interaction. Taking a systems approach and coupling it with moral imagination, (...) now engaged on the organizational and systemic as well as individual levels of decision-making, I shall conclude, is a methodology that encourages managers and companies to think more imaginatively and to engage in integrating moral decision-making into ordinary business decisions. More importantly this sort of thinking is a means to circumvent what often appear to be intractable problems created by systemic constraints for which no individual appears to be responsible. This book explores Gilles Deleuze's contribution to film theory. According to Deleuze, we have come to live in a universe that could be described as metacinematic. His conception of images implies a new kind of camera consciousness, one that determines our perceptions and sense of selves: aspects of our subjectivities are formed in, for instance, action-images, affection-images and time-images. We live in a matrix of visual culture that is always moving and changing. Each image is always connected to an assemblage (...) of affects and forces. This book presents a model, as well as many concrete examples, of how to work with Deleuze in film theory. It asks questions about the universe as metacinema, subjectivity, violence, feminism, monstrosity, and music.
