ABSTRACT Since World War II, American presidents have consistently advanced a world free‐trade agenda, despite the fierce opposition of domestic interests threatened by free trade, and despite these interests’ ability to mobilize local pressure and nationalist sentiment against free trade in Congress. A theoretical resolution of these paradoxes would consider both the countervailing pressure of domestic interests that benefit from free trade and an international factor: namely, America’s dominance of world trade. This global dominance gives the United States “superpower” status (...) not only economically, but politically, enabling American presidents to get most of what they want in international trade negotiations. Consequently, they can afford to make tactical concessions to American mercantilist interests—defanging congressional opposition to free trade—because in international negotiations, these concessions can be turned into powerful levers against the barriers to free trade that are erected by countries desiring access to the immense American market. In this paper I assume that syntactic structures contain items that function as variables over possible worlds (or things like possible worlds). I show that in certain syntactic positions we can use some variables but not other. I accordingly motivate a "binding theory" for the items that occupy these positions, and I discuss some consequences of this binding theory.

The concept of the analyst's presence gained attention almost 60 years ago through the writings of the French analyst Sacha Nacht and the Hungarian-British Michael Balint. Anna Freud earlier spoke of the related, but rather ambiguous term "real person of the analyst," which has been widely discussed by many authors since. Both terms- presence and real person- appear frequently in the psychoanalytic literature, usually without much definition or conceptual clarity. Authors have used them in different ways, but in general their (...) intention has been to contrast the analyst's reality as a person with his function as a transference and fantasy object, perhaps as a corrective to the perceived austerity of the classical « one-person » model. Lacan's work represents an exception in attempting to escape the dialectic between intra and inter-psychic, but at the cost of eliminating the influence of the analyst as another subject. In contrast to metapsychologic theories of the mind, the author argues that "real presence" can be better understood as part of the phenomenologic experience of intersubjectivity, The co-presence of the analyst is fundamental to the encounter, rather than an accidental or intentional disruption. Empirical research has transformed our understanding of autocratic institutions. Yet democratic theorists remain laser-focused on ideal democracies, often contending that political equality is necessary to generate democratic authority. Those analyses neglect most nonideal democracies and autocracies – regimes featuring inequality and practices like gerrymandering. This essay fills that fundamental gap, outlining the difficulties of applying theories of democratic authority to nonideal regimes and challenging long-standing views about democratic authority. Focusing on autocrats that lose elections, I outline the democratic authority of (...) nonideal, flawed procedures. Flawed elections are unjustifiably biased toward incumbents. But under certain conditions, ignoring an incumbent’s loss would require not treating one’s fellow citizens as equals. Under those conditions, therefore, citizens are bound to obey those electoral outcomes – that is, flawed procedures can possess democratic authority. (shrink)

This paper introduces some of the major themes of An Unwritten Future: Realism and Uncertainty in World Politics, and provides a short illustration of how the analytical apparatus elaborated there can offer fruitful insights into understanding enduring puzzles in international relations. An Unwritten Future explores, illuminates and interrogates Classical Realism, an approach to the study of world politics that is contrasted with Structural Realism and with the ‘hyper-rationalist’ perspective associated with the ‘Rationalist Explanations for War’ school of thought. It elucidates (...) the fundamental flaws of those two highly influential paradigms, and explains why Classical Realism, with its emphasis on what Structural Realism and Hyper-rationalism forbid—content, purpose, history, and irreducible uncertainty—provides a more promising and productive point of departure for students of international relations. Political representation lies at the core of modern politics. Democracies, with their vast numbers of citizens, could not operate without representative institutions. Yet relations between the democratic ideal and the everyday practice of political representation have never been well defined and remain the subject of vigorous debate among historians, political theorists, lawyers, and citizens. Current strategies to address global inequities in access to life-saving vaccines use averaged national income data to determine eligibility. While largely successful in the lowest income countries, we argue that this approach could lead to significant inefficiencies from the standpoint of justice if applied to middle-income countries, where income inequalities are large and lead to national averages that obscure truly needy populations. Instead, we suggest alternative indicators more sensitive to social justice concerns that merit consideration by policy-makers developing new initiatives (...) to redress health inequities in middle-income countries. Informed consent to medical intervention is fundamental in both ethics and law. But in practice it is often not taken seriously in developing countries. This paper provides an appraisal of informed consent practices in Bangladesh. Following a review of the ethical and legal principles of informed consent, it assesses the degree to which doctors adhere to it in Bangladesh. Based on findings of non-compliance, it then investigates the reasons for such non-compliance through an appraisal of informed consent practices in Bangladesh (...) and provides recommendations aimed at improving such practices. The significance of this paper lies in unveiling the interdependence between the ethical and legal traits of informed consent and their ramifications on strengthening the patient-oriented approach of duty to care. An informal theory is set forth of relations between abstract entities, includingcolors, physical quantities, times, andplaces in space, and the concrete things thathave them, or areat orin them, based on the assumption that there are close analogies between these relations and relations between abstractsets and the concrete things that aremembers of them. It is suggested that even standard scientific usage of these abstractions presupposes principles that are analogous to postulates of abstraction, identity, and other fundamental principles of set theory. * This work has been evolving for a while now. Some parts trace back to the few pages on the context-dependency of quantifiers in my dissertation. Reading Recanati’s paper on domains of discourse made me rethink some of my earlier conclusions without in the end actually changing them much. Other parts formed the material for several discussions in my seminar on context-dependency at MIT in the fall of 1995, which included several sessions exploring the issues raised in an early version (...) of Kratzer. Connecting the choice function approach to indefinites with a general analysis of contextual domain restriction was an idea that I considered then without however working out any details. Conversations with Lisa Matthewson and studying her paper inspired me to tackle the problem again. Connections to questions about the context-dependency of conditional sentences also tickled my fancy, since I have been working on conditionals for a while now. Having the opportunity to present this material at the Vilem Mathesius Series provided the impetus to flesh out some of my vague thoughts. Major influences come from the work done in recent years at MIT by Lisa Matthewson, Philippe Schlenker, Julie Legate, and Uli Sauerland. I thank Irene Heim, Lisa Matthewson, Orin Percus, Philippe Schlenker, and Jason Stanley for illuminating discussions about this material. At this point, I see this talk as a report on the state of the art, exploring an intriguing possible connection, but I do not claim substantial intellectual property rights. This article critically reconstructs militant democracy’s ‘institutional conservatism’, a theoretical preference for institutions that restrain transformation. It offers two arguments, one historical and one normative. Firstly, it traces a historical development from a substantive to a procedural version of institutional conservatism from the traditional militant democratic thought of Schmitt, Loewenstein and Popper to the contemporary militant democratic theories of Kirshner and Rijpkema. Substantive institutional conservatisms theorize institutions that hinder transformation of the existing order; procedural conservatisms encourage transformation but contain (...) and limit it within the boundaries of existing institutions. Secondly, the article uses resources internal to this historical reconstruction to make the normative case that even the procedural version of institutional conservatism, which characterizes contemporary theories of militant democracy, is problematic from a democratic perspective. The reason for this is that it unjustifiably restricts fundamental democratic change to existing institutions. In conclusion, the article calls for further engagement with modes of democratic defence that do not limit the possibility of radical democratic change but nevertheless enable the protection of democratic institutions against authoritarian regression. This Festschrift in Professor Kristeller’s honor consists of contributions by scholars who have had some connection with Columbia University, his "intellectual home in the United States for three decades." It also includes a Tabula Gratulatoria listing many other friends from the United States and Europe. The editor’s opening essay provides an interesting and informative account of this scholar’s academic career, and should be read together with the complete annotated bibliography of his publications through 1974. The latter lists 149 "major publications" (...) and 220 "minor publications." Kristeller’s contributions to the history of Renaissance philosophy are well known to historians of philosophy, and deservedly so. Here reference should be made to his groundbreaking studies on Marsilio Ficino and Pomponazzi, and on others such as Pico della Mirandola and Petrarch, as well as on Renaissance Platonism, Aristotelianism in the Renaissance, Thomism in the Renaissance, Paduan Averroism, and Alexandrism. But he has also contributed greatly to the fields of medieval and Renaissance history, and especially to our understanding of Renaissance humanism, Renaissance music, and Renaissance art. He is universally recognized as one of the world’s foremost authorities on manuscript research, as is witnessed, for example, by the cooperative project, Catalogus Translationum et Commentariorum, which he founded, and by his Iter ltalicum. In all of these enterprises he has set an enviable example for other scholars by the exacting standards and the breadth of his expertise. It is only fitting, then, that the many essays in this Festschrift should reflect the breadth and depth of the scholarship so evident in the man to whom they are dedicated. If the question ``What is a gene?'' proves to be worth asking it must be able to elicit an answer which both recognizes and address the reasons why the concept of the gene ever seemed to be something worth getting excited about in the first place as well analyzing and evaluating the latest develops in the molecular biology of DNA. Each of the preceding papers fails to do one of these and sufferrs the consequences. Where Rolston responds to the apparent (...) failure of molecular biology to make good on the desideratum of the classical gene by veering off into fanciful talk about ``cybernetic genes,'' Griffiths and Stotz lose themselves in the molecular fine print and forget to ask themselves why ``genes'' should be of any special interst anyway.
