In the current debate on human rights, the political conception is attractive in its ability to try to find solutions to the central questions and problems, which the orthodox conception has difficulties in solving, because of its own nature it does not need a moral foundation that is independent of the recognition established by international law and practice. On the one hand, it is necessary to recognize that the current practice and the international doctrine consider human rights as tools addressed, (...) mainly, to establish the limits of the legitimate sovereignty of the state, thus, recognizing the plausibility of the political conception. On the other hand, the article intends to show that this specific function, while important, should not exhaust all that human rights perform. Therefore, the political conception runs the serious risk of weakening the normative force of human rights and conflating two different agendas, that of human rights and that of global justice. To go through this argument, first of all, the article presents the contemporary genesis of the political conception of human rights based on the work of John Rawls. Secondly, it focuses on the reformulation given by Raz and Beitz’s approaches. Finally, in the third section, I criticize three main assumptions which ground the current paradigm of political conception of human rights. (shrink)

Some scholars believe that only governments or those who uphold governmental policies can be human rights violators. Others argue that private individuals are also able to violate human rights. The two positions have come to be known in the literature as the institutional interpretation and the interactional interpretation of human rights respectively. This paper critically analyzes an exemplary case: Thomas Pogge’s institutional conception of human rights as presented in World Poverty and Human Rights: Second Edition. This paper focuses on some (...) of the negative consequences implicit in his approach. First of all, it shows that Pogge does not provide an adequate explanation of the reason why human rights should be conceived as claims on coercive social institutions and on those who uphold such institutions but not on single individuals, independently of their commitment to institutions. Secondly, it shows that official disrespect rather than violation as a criterion to evaluate the respecting of human rights is unsuccessful or at least insufficient. It sees in Pogge the same perspective mistake that infects Rawls’ conception of human rights, namely that of expanding unduly one of the functions human rights perform - establishing the limits of legitimate sovereignty - into their very essence. Therefore, this paper puts in question the way in which Pogge’s institutionalism mix the conception of human rights with the conception of distributive justice. The conclusion to which the whole paper comes to is that proponents of the institutional interpretation misconstrue human rights because they conflate two philosophical agendas, that of human rights and that of global justice. This article argues about John Rawls' paradigm shift in contemporary political philosophy. In the article, this paradigm is defined as democratic insofar it claims, among other things, to leave enough room for democratic deliberations and citizens’ political autonomy. On this specific issue, Rawls and Habermas dialogue is still particularly fruitful. Both authors believe that contemporary political philosophy must be modest in some relevant theoretical and methodological aspects but they disagree on which of these aspects should be more or less modest. (...) This article argues that when we look for the legitimate boundaries of the contemporary political philosophy, Rawls and Habermas projects should be seen as closely complementary to one another. On the one hand, the article partially agrees with Habermas’ objections to Rawls that political philosophy should not be too modest in providing orientations for the normative grounds of the political justification. On the other hand, against Habermas, the article remains on Rawls's side on the idea that political philosophy cannot be agnostic regarding the substantive and distributive issues of social justice. In the anapaestic sequences of Eur. Alc. 93–7 and 105–11, a fast-paced exchange takes place between two choreuts eager to learn about Alcestis’ fate. The two passages pose several metrical and textual problems. The most serious is the presence at lines 94 and 106 of the ᴗ ᴗ – – sequence, which finds no parallel in anapaestic poetry from any age or literary genre. The same sequence occurs at the beginning of the short anapaestic coda of lines 132–5, which, whether (...) authentic or not, from a metrical point of view presents certain affinities with the two previous sequences. How rich should the 1% be? And, most importantly, when does the distance in economic resources between the richest citizens and ‘us’, the average citizenry, become a concern for justice? This volume explores how excessive economic inequality gives the best-off considerably more political influence than average citizens, thereby violating political equality. It argues that the gap between the best-off and the worst-off should not be reduced because it is good, but rather as an inescapable instrument to protect citizens from the (...) risk of material domination. For this reason, it defends the ‘principle of proportionality’: economic inequality should not exceed a certain range or proportion to enable both the best-off and the worst-off to be co-authors of the legal, political, and socioeconomic rules that govern the ‘social’ relations in which they are involved. Further, the book discusses material domination and explains how money influences politics and what are the remedies for this phenomenon; how social justice should face and harmonise power, poverty, efficiency, individual merit, and economic liberties; and, most importantly, how to determine income and wealth limit ratios in a liberal democracy. A thoughtful investigation on the interdependencies of money and justice and their influence our socio-political systems, this volume will be of great interest to students and researchers of political theory, political philosophy, economics and development, economics theory and philosophy, and social policy. This paper argues that the future of capabilities approach lies on the theoretical development of the democratic political structure. For this purpose, we take into account Martha Nussbaum’s late theoretical works. Firstly, we argue that the capability approach can be divided into two main models: the top down and the bottom up. Nussbaum, for example, endorses a top-down model, which it begins from an abstractive theory of partial justice and then draws the issue of institutional implementation. On the other hand, (...) Amartya Sem advocates the bottom-up model, which starts from the immanent demands of justice from public sphere and then up to normative and abstract questions (like his “idea of justice”). In the second part of this paper, we present Nussbaum’s partial theory of justice, arguing that it is mainly composed by four issues: (a) the elaboration of the list of capabilities, (b) the process of normative evaluation, (c) arguments for stability, (d) the implementation of the model. About this last topic, we argue in the third part that the current theoretical advance of the capabilities approach lies on the issue of the democratic political structure. In other words, the future of capabilities approach depends on the interaction between its own theory and a theory of democracy. Finally, in the last section we provide a re-elaboration of Nussbaum’s threshold level of capabilities (the list) in order to make it more adherent with the democratic political structure. (shrink)

Number 13 of Dei verbum, by means of the analogy of the incarnation and the perspective of the συγκαταβασιζ, invites us to look at the vast theological and historical-salvific background against which the Word of God, expressed in human language, is outlined. The present article, first, attends to the text of Dei Verbum 13 and its treatment in various commentaries on the dogmatic constitution as well as in official texts . Next, it focuses on the συγκαταβασιζ, in its relation to (...) oικoνoμíα and θεωρια, that is, to the modality of the divine salvific intervention in history and the contemplation of God which is granted to those who receive the manifestation of the condescension of the Saviour, attested to by Scripture. Third, the article develops the theme of συγκαταβασιζ in its profound relation to God's coming to men, from a Trinitarian point of view, in the light of the Verbum abbreviatum and the verbum scriptum, in the perspective of the action of the Holy Spirit in the hearts of the faithful. The conclusions draw attention to the light that a person sees when, in the experience of his finitude, he listens to the Verbum abbreviatum which, in its συγκαταβασιζ, has become one with humanity. A soteriological perspective is not altogether absent in the christological hymn of Phil 2:6-11, even though the salvific value of the death and resurrection of Jesus does not receive in it special emphasis. In fact, W. Kasper and J. Moltmann - who are considered critically in the article as examples of contemporary christological/soteriological reflection - find in the hymn some hints for a soteriological reflection, which sometimes stresses a paschal perspective, sometimes an incarnational one. Both Kasper and Moltmann, however, show (...) more interest in what they must make the hymn say than in the meaning which they may discover in the hymn or receive from it. While adopting either a paschal or an incarnational perspective, this article intends to take its starting point from the meaning offered by the scriptural text, following for this the «consensus exegeticus». Two elements are brought to light in view of an implicit soteriological reflection: 1. the salvific aspect of the mystery of Christ in its entirety, from the kenosis in the incarnation to the self-emptying of the death on the cross , in Phil 2:6-8; 2. the universal salvific Lordship of Christ in Phil 2: 9-11, understood in the sense of the Lordship of Yahweh, explicitly qualified as salvific in Is 45:20-25, which is the background of the second part of the christological hymn. Among the studies on the history of philosophy recently published in Italy, one that may be of some interest to the English reader is by D R . Abbagnano , a young pupil of Aliotta , and is devoted to the new English idealism. 1 Truthfully speaking, the term ‘ new ’ is inappropriate, or partly so, because Abbagnano dedicates the greater part of his study to what we might call the ‘ old ’ idealism in England, represented by Stirling, (...) the two Cairds, Wallace, Green, and Bradley. However, he does also pass in review the more recent doctrines, particularly those of J. H. Muirhead, G. H. Howison, D. G. Richtie, J. E. Creighton, J. B. Baillie, J. S. Mackenzie, H. Jones, W. E. Hocking, A. S. Pringle Pattison, and G. P. Adams. Abbagnano regards as a distinctive trait of English idealism inspired by Hegel as opposed to Hegel himself, this, that “for Hegel the absolute is essentially process, change and becoming; it is thought which differentiates itself and becomes articulate in a life of its own, in the threefold rhythm of thesis, antithesis, and synthesis, in which each moment passes into the next. For Green, Bradley, and Royce, the absolute is on the other hand immutability, completeness, static perfection, in which each process and becoming is overcome and resolved.” At any rate, Abbagnano is equally unsympathetic towards Hegel and towards his followers, against whom he opposes, not without scholastic ingenuity, his own irrationalistic views, set out in another book whose contents are sufficiently expressed in the title. 1. In 1920 Bignone published an Italian translation of the writings and fragments of Epicurus in Laterza's library of Ancient and Mediaeval Philosophers which in many respects added to and improved upon Usener's classic collection, of Epicurea. He has since then zealously prosecuted these studies, and arrived at some very interesting conclusions which he has given out in two volumes published lately.1 His starting-point is the observation that the writings of Epicurus often have a polemical tone, and not only rebut the (...) accusations of adversaries who misinterpret the new doctrine, but are often directed also against those preceding philosophers who denied to pleasure a stable and certain nature on which a system of ethics could be based. Bignone has set himself the task of particularizing these anonymous predecessors, and thereby bringing the Epicurean polemic into more striking relief. I t was easy and safe to start from the standpoint that Epicurus in his rehabilitation of pleasure had to oppose Plato and the Platonists, but at what Platonists in particular did he take aim? In answering this question Bignone has been able to make use of recent Aristotelian studies, especially those of Jaeger, which have thrown much light on the first phase of the Stagirite's philosophy, of a purely Platonic inspiration. As is well known, some exoteric dialogues belong to this phase, such as the Eudemos, the Protrepticon, and On Philosophy, which have to a large extent disappeared, though it has been found possible to reconstruct a few scattered fragments of them. The great scholastic works which reveal the full independence and maturity of Aristotle's genius have eclipsed them in the memory of posterity. But originally there were only these dialogues, the only ones published, to make Aristotle's thought known to the public outside the peripatetic school. The scholastic writings on the other hand remained unknown until the time of Sulla. What wonder, then, if Epicurus, in combating Platonism, had in mind these dialogues, which give out the fundamental conceptions of Platonism in a more decisive and dogmatic form than that of the Platonic dialogues? Contacts between Italian and English thought of late years have been both frequent and effective.

Recently there has been a spate of interest in Max Scheler’s social phenomenology (Schloßberger, 2016; Szanto & Moran, 2016; Cusinato, 2018). In this paper I aim to show that his philosophical contribution on Europe and Europeanism has its focal point on the concepts of rebuilding (Wiederaufbau) and rebirth (Wiedergeburt). My idea is that, for Scheler, the essential condition of any attitude towards socio-cultural change (Umkehr) have its center in the idea of the formation and the development of the personal singularity (...) (Personbildung) (Scheler, 2009a; Scheler, 2010a; Scheler, 2013). And this means the growth and the expression, in a solidaristic perspective, of one’s own ethical singularity (An-sich-Gutes für mich) and of one’s own vocations. The idea of solidarity declined in terms of Bildung is therefore strictly interdependent on the testimony coming from Otherness-exemplar (Vorbild) (Scheler, 2009f). (shrink)

An interesting connection between special relativity and quantum mechanics was put forward by Louis de Broglie, about 60 years ago, who focused on the link between synchronization in a rotating frame and the quantization of the angular momentum. Here we generalise his approach to curved spacetime, using the gravitoelectromagnetic analogy, which can be applied to describe the weak gravitational field around rotating sources, and give a new interpretation of the results.

This article aims to explain and clarify the controversial textual issue over which manuscripts should be preferred in an edition of Sulpicius Severus’ Martinellus. In particular, Ruggiero examines the case of the Letters. Firstly, he shows that there is only one contaminated textual tradition, as proven by the numerous adiaphoristic variants. Secondly, he shows that the manuscripts from the French-German area are superior to those from the Italic peninsula and some insular areas, as they provide a much more elegant (...) and correct text. This is consistent with our knowledge of Sulpicius Severus’ higher literary education. In publishing the Martinellus, it is therefore advisable to follow the variants of the French-German manuscripts, whereas the ones of the Italian manuscripts are to be taken into account only in the case of obvious errors. Consequently, Ruggiero maintains that the editions that predate Halm’s should be rated much more highly than they are. (shrink)

This short article is intended to contribute to the solution of a known locus desperatus of the Augustinian Confessions. The Author proposes that 8, 2, 3 should be read spirabat paululum iam instead of spirabat † popilios iam †. The conjecture is reminiscent of Catil. 61, 4 paululum etian spirans concerning Catilina’s death. Catilina’s death is a metaphor for the fall of Roman paganism, and for Marius Victorinus’s and Augustine's personal lives as well as their conversions. Ruggiero adds further (...) evidence to Manlio Simonetti’s arguments as shown in the «Nota al Testo» preceding his edition of Confessiones for the Italian collection “Lorenzo Valla”: common mistakes such as popilios iam were already in the edition’s manuscript. This exploratory study investigated the ramifications of e-mail and listservs as modes of journalistic ethical discussion. Results of the e-mail questionnaire to online newspaper journalists indicated that, although American online journalists overwhelmingly use e-mail to conduct both professional and personal business, it is unlikely that many are logging on to electronic discussion groups to discuss ethical issues. Moreover, this study suggests that the "informality" of listservs may reflect their perceived ineffectiveness and consequent underutilization by journalists. Journalists who do participate in (...) listservs may view the "ethical" component as a minor element of their overall Web activities. (shrink)

Este relato cuenta la experiencia de una escuela del conurbano bonaerense (Argentina) que sostuvo durante cinco años un proyecto de lo que solemos llamar Filosofía con niños. Mostramos aquí los logros y las limitaciones de un trabajo colectivo que despierta amplias expectativas, pero que todavía debe pensar algunos supuestos. Sostendremos como hipótesis que las dificultades para pensar las prácticas y rutinas escolares, terminan reabsorbiendo bajo el signo de la repetición aquello que los proyectos de filosofía con niños tienen de novedoso.

The author of this article discusses several passages from Πρὸς Διόγνητον and in particular he suggests a new reading of five problematical loci of the work. In 2, 3, the addition of καί before the words ἔτι καὶ νῦν makes the reading καὶ ἔτι καὶ νῦν more suitable for the style of the entire clause. In 3, 5, a very economical change – τὸ δὲ δοκεῖ[ν] τινά παρέχειν τῷ μηδενὸς προσδεομένῳ – gives the correct meaning to a widely discussed sentence. (...) In 7, 4, the clause ὡς βασιλεὺς πέμπων υἱὸν βασιλέα ἔπεμψεν, ὡς ϑεὸς πέμπων πρὸς ἀνϑρώπους ἔπεμψεν, ὡς σώζων ἔπεμψεν is probably the correct reading, taking into account both the author’s theology and the rhythm of the three anaphoric sentences. In 8, 11, the words of the manuscript tradition ἰδεῖν καὶ ποιῆσαι are out of context; ; ἰδιοποιῆσαι, a conjectural emendation, plausibly restores to the revised clause καὶ μετασχεῖν τῶν εὐεργεσιῶν αὐτοῦ καὶ ἰδιοποιῆσαι its correct sense. In 10, 1, the very economical conjectural emendation καταλάβῃς for the καὶ λάβῃς of the manuscript tradition offers both a correct reading for the revised passage ταύτην καὶ σὺ τὴν πίστιν ἐὰν ποϑήσῃς, καταλάβῃς πρῶτον μὲν ἐπίγνωσιν πατρός and a good connection to the following clause.
