O presente artigo tem por objetivo apontar a relação entre a III Conferência Geral do Episcopado Latino Americano celebrada no final de janeiro e início de fevereiro de 1979 em Puebla de Los Angeles e os Bispos do Brasil. Apontando quem foram os Bispos do Brasil que de Puebla tomaram parte e em quais aspectos eles contribuíram. Tal colaboração será externada em duas vertentes. De um lado, a contribuição dos Bispos do Brasil enquanto Conferência Episcopal Nacional; De outro, a colaboração (...) pessoal de prelados especialmente Aloísio Lorscheider e Luciano Mendes de Almeida que ou por sua liderança natural no episcopado Latino Americano ou por suas opções e testemunhos eclesiológicas, influíram profundamente em posições assumidas no Documento Final. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

Our goal is to investigate the notion of self-agency in William James and Donald Winnicott. With James, we examine the descriptive element of what constitutes a self. With Winnicott, we explore his explanatory theory on self-emergence. Winnicott's perspective is presented here as the prehistory of the Jamesian self. James's conception of self is similar to the Winnicottian notion of an "integrated self", an embodied position that emerges from the organism's actions in the experiential field. The combination of the two approaches (...) leads to the idea that the self is a flux of identities emerging in interaction with others in the "transitional space" (an intermediate area of experience). Conscious experiences in infants remain poorly understood. In this NeuroView, Passos-Ferreira discusses recent evidence for and against consciousness in newborn babies. She argues that the weight of evidence from neuroimaging and behavioral studies supports the thesis that newborn infants are conscious.

Is the dream of EU endangered? This book reviews classic and modern values and virtues, and uses them in order to rethink Europe's present politics and its future. The idea of the Republic was born with the political ethics of ancient Greece. The current international crisis obliges Europe to face the mirror of truth: What has become of the European Idea and how fares the European Constitution? It has been a long road from the Greek Politeia to the present lack (...) of values and financial monomania in Europe, who seems to have lost any harmony between the spirit, the soul and the body of her Constitution: the will and values of the people (material constitution), the text of the Lisbon Treaty (formal constitution) and its current political interpretation and action (real constitution), making Europe a two-tier or three-tier club, far from the dream of the founding fathers. Without republican values and virtues, and failing to uphold the European social model, the European Union would devolve into moral, social and democratic bankruptcy. (shrink)

The present paper draws a contrast between the notions of τὸ παρ’ ἡμᾶς and τὸ ἐφ’ ἡμῖν to the effect that, according to Chrysippus, each has a different role to play and different requirements to meet, the former being especially tailored to suit the exigencies of praise and blame taken as exhortations, the latter those of desert and justice in praising and blaming as well as honoring and punishing.

The formation of the education professional has been a top subject of studies during the history of education in Brazil and must be a human formation directly related to his or her emancipation as a social, individual person. This is his or her truth citizenship and sine qua non to the formation of a new man for the construction of a human culture. In this sense, the concept of man is the fundamental axis of formation of the education professional. Theoretical (...) matrices that have given rise to individualism and its powerful concepts are analyzed, as well as the new dominant ideas that, in an explicit or implicit way, construct in our society by different forms of social consciousness. There is a firm conviction that the understanding of man as alive, active, and conscious in material existence, according to concrete life, looks as the formation of consensus, organic emancipating scientific fundamental of radial change in social relations on a global society and with the possibility of human culture. I suggest here ecologies of the nascent state, posing the following general questions: what is this state and what is it to live, to fabricate modes of life, in its immanence? I believe populating this state is, by right, ‘ecological’, even if what I offer here is only a sketch or glimpse, playful as it is, of the possibility of such modes of life, of dwelling. As I develop it here, the nascent is in flight of being. It is populated (...) by lesser, minoritarian existences. If it is ‘ecological’, it is because these existences, or modes of becoming, are themselves, in their own right, ‘ecologies’, that is, modes of dwelling, of life, on the ‘other side of existence’, as Antonin Artaud put it once, in exile from Being. The power to return eternally to the nascent state is the power to live, to dwell, in the absolute forgetfulness of Being, in the interstice where philosophy supposedly ends, but where it nevertheless begins again, in oblivion itself, where being is never already the verticality of Being, its difference with beings, but always nascent, in the beginning, eternally so. Based on the readings of the philosophers Gilles Deleuze, Félix Guattari and Michel Onfray, the present article aims to carry out a critical assessment based on what is meant by “control society” and then, inspired by the Nietzschean philosophy of “Super human” [Übermensch], verify the feasibility of flourishing a human type whose creative and courageous posture surpasses the most adverse hypotheses of postmodernity. That said, the research adopts the following method: first, succinctly, to present the development of the different record (...) productions, as presented in The Anti-Oedipus; second, after the Deleuzian work opens up the scope for thinking about the “schizo”, that is, the individual below the social impositions, we complement with the hypothesis of the onfraryan typology of the “condottiere”, making it a model of resistance and insubmission, inspiring, therefore, the possible appearance of a fourth record production analyzed by Deleuze and Guattari. Palace of the End is a dense triptych of monologues exploring alternative narratives - albeit based in real facts - behind the events and the headlines surrounding the war in Iraq. Borrowing its title from the former royal palace where Saddam Hussein’s torture chamber was located, Thompson’s docudrama is structured as a chain of monologues telling three real-life stories set in the context of the war in Iraq. The play conveys three unconventional interpretations of the realities of war: that of (...) a young American soldier convicted for her misconduct at Abu Ghraib, the prison that stands as one of the most controversial symbols of the American-led Iraq invasion; a British scientist and weapons inspector who denounces what he understands as the false arguments given by his country’s leaders for engaging in a distant war; and an Iraqi mother whose life was shattered firstly by Saddam Hussein’s authoritarian regime, and later by the American first Gulf War. Each story is an enthralling and gut-wrenching reflection of one of the contemporary world’s most studied and controversial conflicts. The play gives voice to three different kinds of war victims, insofar as their political subjectivities and their moral conundrums are concerned. (shrink)

This book examines the significantly similar, yet finally different, thinking of two nineteenth-century existentialist thinkers, Soren Kierkegaard and Friedrich Nietzsche. Its focus is on the different ways each envisioned a joyful acceptance of life - a concern they shared. Each strove to give a place to this acceptance in his picture of life, but their conceptions of it are far apart.

The principal aim of the thesis is to develop a developmental account of conscious experience. In this account, the objective is to understand and explain the phenomenal experience of newborns and pre-linguistic infants. The question that guides the investigation concerns the phenomenality of babies' experiences: what is it like to be a baby? There are some crucial philosophical issues that any account of the nature of infant consciousness must face: the ontology of early conscious states; the epistemic status of infants' (...) experiences; the content of infants' experiences. The thesis addresses how we evolve as conscious beings from early states of life until we become full self-conscious beings who are morally responsible for our actions. The thesis involves four chapters. The first chapter explores phenomenal consciousness in newborns, first addressing the epistemological and methodological problems, and then arguing that newborns are phenomenally conscious and have a variety of phenomenal experiences. The second chapter addresses representation in newborns, claiming that their conscious experiences represent the world and discussing the consequences for representationalism. The third chapter focuses on the sense of agency, arguing that infants have a sense of agency and a sort of self-consciousness. The fourth chapter discusses moral agency, focusing mainly on the role of empathy. (shrink)

In view of Alexander of Aphrodisias’s and Porphyry’s respective positions on the issue, I discuss whether logos apophantikos is to be defined, as DI 4 seems to imply, by its being true or false or rather, as DI 5 seems to imply, by its representing the ontological combination/separation of substrate and attribute through the logical combination/separation of subject and predicate.

A prevailing view in moral psychology holds that empathy and sympathy play key roles in morality and in prosocial and altruistic actions. Recently, Jesse Prinz (2011a, 2011b) has challenged this view and has argued that empathy does not play a foundational or causal role in morality. He suggests that in fact the presence of empathetic emotions is harmful to morality. Prinz rejects all theories that connect empathy and morality as a constitutional, epistemological, developmental, motivational, or normative necessity. I consider two (...) of Prinz’s theses: the thesis that empathy is not necessary for moral development, and the thesis that empathy should be avoided as a guide for morality. Based on recent research in moral psychology, I argue that empathy plays a crucial role in development of moral agency. I also argue that empathy is desirable as a moral emotion. (shrink)

This book highlights some of the most pressing safety, ethical, legal and societal issues related to the diverse contexts in which robotic technologies apply. Focusing on the essential concept of well-being, it addresses topics that are fundamental not only for research, but also for industry and end-users, discussing the challenges in a wide variety of applications, including domestic robots, autonomous manufacturing, personal care robots and drones.

The article analyzes the possibility of reconciling skepticism with moral theories and the idea that moral philosophy is the supreme arbiter of all moral justification. We cannot take universally valid maxims as descriptive rules nor can we fall into an individualistic relativism. H. Putnam seeks to deconstruct Habermas' separation of values and norms, and, in doing so, he shows the need for such a reconciliation.

The epistemic position of an agent often depends on their position in a larger network of other agents who provide them with information. In general, agents are better off if they have diverse and independent sources. Sullivan et al. [19] developed a method for quantitatively characterizing the epistemic position of individuals in a network that takes into account both diversity and independence; and presented a proof-of-concept, closed-source implementation on a small graph derived from Twitter data [19]. This paper reports on (...) an open-source reimplementation of their algorithm in Python, optimized to be usable on much larger networks. In addition to the algorithm and package, we also show the ability to scale up our package to large synthetic social network graph profiling, and finally demonstrate its utility in analyzing real-world empirical evidence of ‘echo chambers’ on online social media, as well as evidence of interdisciplinary diversity in an academic communications network. The course delivered by Heidegger during the Summer semester of 1923, and published later under the title of Ontology – The hermeneutics of facticity, is one of the most important loci in which we can have a glimpse of Kierkegaard’s influence on and importance to Heidegger, as well as of some of his interpretations about the thought of the Dane philosopher. One of them, notwithstanding puts forward a very interesting assessment of the relation between Kierkegaard and Hegel – through F. (...) A. Trendelenburg –, one of hottest topics in the Kierkegaardian scholarship, is not usually analyzed by that scholarship. Hence, this paper aims to show and analyze Heidegger’s theses on the relation between Kierkegaard-Hegel in that work in order to evaluate their correctness. As final remarks, this paper presents some metaphilosophical reflections on the very notions of relation and dependence between philosophers. (shrink)

O percurso construído pelo pensamento de Albert Camus (1913-1960) perfaz uma unidade profunda entre Ética e Estética. Par- tindo de uma preocupação explicitamente ética, o autor acaba por ter de desenvolver uma antropologia filosófica, ou seja, um discurso sobre o homem que tem como núcleo um conceito que o reenvia àquilo que podemos chamar de dimensão estética para então, a partir daí, oferecer uma resposta àquele problema ético. Desse modo, pretendemos neste trabalho explicitar o caminho ao qual aludimos em três (...) momentos: (a) a existência humana como problema ético; (b) o discurso camusiano sobre o homem que tem como núcleo a noção de Passion e, por fim, (c) a elaboração de um novo éthos, partindo da noção de Paixão, como res- posta necessária ao problema existencial configurada como uma re-cri- ação ou correção permanente, à semelhança do ofício do Artista. Neste artigo, pretendemos defender a tese segundo a qual julgamentos sociais se iniciam com a percepção emocional e com o processamento de informações emocionais no reconhecimento de expressões faciais. Para tanto, revisaremos modelos que discutem (i) os mecanismos pelos quais as expressões faciais são codificadas para transmitir informações e ser percebidas pelos outros, (ii) os mecanismos perceptivos de decodificação e categorização de expressões faciais e, por fim, (iii) os mecanismos pelos quais o reconhecimento de expressões faciais geram respostas emocionais e (...) ajustes comportamentais e, por fim, (iv) a eficiência de nosso sistema perceptual na decodificação desses processos. Com essa discussão, nossa intenção é a de (i) explicitar em que sentido nossa percepção emocional de expressões faciais é u m dos principais mecanismos evolutivos de regulação da vida e que (ii) o processamento de informações emocionais é um poderoso instrumento para assegurar a sobrevivência e sustentar razoáveis interações sociais. Levinas's ethics of other-centered service has been criticized at the theoretical level for failing to offer a conception of moral agency adequate to ground its imperative and at the practical level for encouraging self-hatred. Levinas's explicit resistance to the incorporation of the phrase "as yourself" in the Judaeo-Christian love command might seem to validate the critics' complaints. The author argues, on the contrary, that Levinas does offer a strong and compelling conception of moral agency and that his ethics, properly understood, (...) does not entail self-abnegation. Levinas's attempt to counter excessive and manipulative self-concern and self-inflation by insisting on the dependent and situational position of the self has been wrongly overinterpreted as an abandonment of the self and its just claims. The author seeks to establish a more balanced understanding by focusing attention on the "ethics of welcome," on Levinas's distinctive conception of passivity, and on the role of "the third" in all human relations. The present article argues that Chrysippus' reply to the objection that Fate does away with that which is up to us (and therefore with justice in honor and punishments) consists in shifting the notion of that which is up to us from one in terms of ultimate origination to one in terms of self-sufficient causation—and thus in shifting the very notion of justice in honor and punishments from one in retributive terms to one in rehabilitative terms.
