Aggregative consequentialism and several other popular moral theories are threatened with paralysis: when coupled with some plausible assumptions, they seem to imply that it is always ethically indifferent what you do. Modern cosmology teaches that the world might well contain an infinite number of happy and sad people and other candidate value-bearing locations. Aggregative ethics implies that such a world contains an infinite amount of positive value and an infinite amount of negative value. You can affect only a (...) finite amount of good or bad. In standard cardinal arithmetic, an infinite quantity is unchanged by the addition or subtraction of any finite quantity. So it appears you cannot change the value of the world. Modifications of aggregationism aimed at resolving the paralysis are only partially effective and cause severe side effects, including problems of “fanaticism”, “distortion”, and erosion of the intuitions that originally motivated the theory. Modern mainstream ethical theories with its overemphasis on autonomy and non-interference have failed to adequately respond to contemporary social problems. A new ethical perspective is very much needed. Thanks to Carol Gilligan's 1982 groundbreaking work, 'In a Different Voice' , we now not only have virtue and communitarian ethicists, but also a group of feminist philosophers, charting a new direction for ethics that tempers modern ethics' obsession with autonomy, contractual rights, and abstract rules. Nel Noddings, in (...) her 'Caring: A Feminine Approach to Ethics and Moral Education', further contributed to this important discussion. In this work, Noddings proposes a new kind of moral ideal. She calls it "caring." Noddings defines "caring," as a direct, felt concern and action from the one-caring toward the well-being of the cared-for. In other words, care is a state of mental engrossment and motivational displacement that impels caring actions for the happiness of the cared-for and it transcends any rule-bound moral judgment. A caring attitude is best manifest in the spontaneous emotive bond of love between a mother and a child. This human relation of unscrutinized maternal love and care should be the model of ethics. Noddings's theory evokes a vigorous debate concerning whether or not the model can withstand rigorous philosophical scrutiny as a stand-alone ethical theory. This paper first discusses the strengths and weaknesses of a pure care ethics. Secondly, it demonstrates why both the Kantian and the Aristotelian attempts are unsatisfactory, and it offers a Confucian solution to the problems of care ethics. It argues that notwithstanding gender-oppressive practices that are at times associated with Confucianism, Confucian ethics of 'ren' (humaneness) is both more compatible with care ethics and is better equipped with conceptual resources than Kantian liberalism or Aristotelian virtue ethics to handle the moral predicament of the postmodern world. The paper demonstrates that care is an inherent element of Confucian 'ren' but that 'ren' is more than Noddings's care. It examines three essential principles that can be extracted from philosophical classical Confucianism: (1) an affectionate and particularistic approach to persons, (2) the mutual conditioning of the two prominent Confucian virtues -- humaneness (ren) and ritual propriety (li), and (3) the inseparability of the familial and the political self. This chapter applies the modified philosophy of Alasdair MacIntyre to mental health law, and in particular to the mental health tribunal. The natural law approach of Thomas Aquinas is used to assist in this. It is argued that, for law to be just in pre-modern terms, it requires that it be assessed as rational together with the care it supports as a single entity. As such, according to a modified version of the Thomistic Aristotelian ethics of MacIntyre, justice (...) would require reconciliation of both doctor and patient narratives regarding care, possibly at the tribunal. It is suggested that psychiatric intensive care, in particular, could benefit from this approach. The approach might be seen as an additional protection to human rights-based considerations. This book argues that an essential part of Hegel's historical-political thinking has escaped the notice of its interpreters. It is well known that Hegel conceives of history as the gradual progress of rational thought and of forms of political life. But he is usually thought to place himself at the end of this process—his philosophical end is to give a rational account of the end of this process, namely, modern ethical life. This overlooks the question of how a new (...) shape of ethical life is founded. Hegel holds that the founding act of a new form of life is the act of an unwitting agent, and it necessarily meets with the violent incomprehension of the society it transforms. The tragedy of Antigone, the French Revolution and its aftermath (the Terror and the Napoleonic Wars), and wars generally are all examples of the tragically violent foundation of a new form of life. Moreover, Hegel does not claim that the foundation of modern ethical life is a fact of the past—it lies in the future. (shrink)

"Being and Freedom is an account of ethics in Europe from the French Revolution: a phase of philosophical ethics whose influence ran far beyond philosophy, eventually dominating politics and religion in the West. Developments came from France, Germany, and Britain. This book is currently the only study that treats them together as a Europe-wide phenomenon. The first chapter covers the philosophical conflict at the heart of the French Revolution, between the individualism of the Enlightenment and two very different (...) forms of holistic ethics: the old regime's ethic of service and the radical-democracy of the Rousseauian left. Hardcover, $130.00.John Skorupski's Being and Freedom traces the development of modern ethics in France, Germany, and England, as set in motion by two great revolutions: the French Revolution and Kant's methodological (...) revolution in the Critique of Pure Reason. I begin this review by offering [End Page 714] a brief summary of the book (which consists of eight lengthy chapters, an introduction, and a brief conclusion). I then raise some interpretive worries and offer an overall assessment.In chapter 1, Skorupski reminds us that the French Revolution, a physical struggle between opposing factions, was also a battleground of ideas. In opposing the ancien régime, revolutionaries took aim at the "Catholic-feudal order" (27). Underlying this order was an ethical view, "holism," according to which a person lives well through excellent performance of community roles assigned by family, state, and church. When individual interests conflict with these social roles, the latter take precedence. Revolutionaries (partially inspired by Rousseau) railed against this. On their view, persons were born for freedom, not the chains of traditional life. To realize such freedom demanded a radical democratic state. Here, too, fidelity to the ethical whole (the Republic) sometimes required sacrifices on the part of individuals. But in a properly constituted republic, these sacrifices would be self-imposed requirements of the general will.As revolution turned to terror and blood became the regular currency of sacrifice, critics like Guizot saw the ancien régime's parochialism as a symptom of a larger problem with its underlying ethics, one it shared with the radicals aligned against it: its commitment to holism. Holism says that some social entities have a good not reducible to the good of their members. Additionally, these social wholes have their own rights that sometimes override individual rights (28, 59). These features make it easy for holist orders to justify sacrificing individuals for collective goods. If this is the disease, individualism of the sort associated with Kantian ethics can seem to be the cure.Chapter 2 argues that the new critical philosophy resulting from Kant's "Copernican" Revolution is a mixed bag. On the one hand, Kant offers no good reason for positing a noumenal world and locating freedom there (77–79). On the other hand, there is lasting promise in the idea that morality follows from each person's individual autonomy. And yet, in the end, Kant's arguments fail here, too. For deriving morality from autonomy requires an explicit commitment to impartiality, which does not follow from autonomy (83–102). And, even when suitably modified, Kant's ethical principles risk emptiness if they fail to take content from our relationships and social roles (112, 148). Unfortunately, Kant suggests that doing so would perpetrate heteronomy, making such emptiness inevitable (102).By chapter 3, the tension between holist and individualist conceptions of ethics has become Skorupski's central leitmotif. On the one hand, individualists are well positioned to resist oppression and terror. On the other hand, individualism risks atomism and alienation from our attachments and feelings. Although Fichte takes a step away from transcendental idealism by making intellectual intuition the hallmark of our subjectivity (173), he agrees with Kant that morality follows from autonomy. Indeed, for Fichte, autonomy commits us to striving for full self-sufficiency, which appears to court a similar atomism. Yet this impression is corrected when Fichte turns to politics. There, Fichte grounds rights (as permissible demands) in mutual recognition (182–83). Nietzsche on the Banishment of Supererogation by Luther and its Influence on Modern Ethical Life and Moral Theorizing. Much attention has been paid to Nietzsche’s refusal of obligation-centred moral theories (such as Kantian deontology and Utilitarian consequentialism), but little or no attention to the historical roots of such conceptions. The aim of this paper is to explore the ways Nietzsche connects the Kantian version of legal moral theory to the Lutheran Reformation, taking as its leitmotif the exclusion by Luther (...) of the so-called supererogation (the ideal of a Christian perfect life of sainthood being the most evident case) from the horizon of our ethical life (see D 88; GS 355; NL 1884, 25[271]). After establishing this historical connection, we are better positioned to understand the motivation behind his rejection of legal moral theories, particularly the Kantian version. In _The Priority of Prudence_, Daniel Mark Nelson proposes a reappropriation of a moral perspective that focuses on the cardinal virtues of courage, temperance, justice, and prudence. The study aims to recover and rehabilitate the virtue of prudence as a way of resuming a moral conversation that has been stalemated for too long. Nelson's main source for reviving the virtue of prudence is St. Thomas Aquinas's account of the cardinal virtues in the _Summa Theologica_. A primary problem with using Aquinas (...) as a source for reviving an ethics of virtue centered on prudence is that he is commonly perceived as the most prominent figure in the conflicting natural-law tradition. According to Nelson's reinterpretation, however, Aquinas teaches that moral understanding depends first and foremost on prudence working in accord with other cardinal virtues and that natural law functions to explain moral reasoning rather than to guide it. This study serves to advance the debate about the contemporary relevance of an ethics of virtue by way of its significantly more detailed explication of prudence. Nelson makes important connections between influential reinterpretations of the ethical theory of Aquinas that have been published during the last thirty years and widespread interest in an ethics of virtue that has been expressed by Alasdair Maclntyre, Stanley Hauerwas, William Sullivan, Robert Bellah, and others. _The Priority of Prudence _represents a significant contribution to the scholarly literature both in the study of Aquinas and in the debate on the ethics of virtue. The self-worth of political communities is often understood to be an expression of their position in a hierarchy of power; if so, then the desire for self-worth is a source of competition and conflict in international relations. In early modern German natural law theories, one finds the alternative view, according to which duties of esteem toward political communities should reflect the degree to which they fulfill the functions of civil government. The present article offers a case study, examining the (...) views concerning confederation rights and the resulting duties of esteem in diplomatic relations developed by Christoph Besold (1577–1638). Besold defends the view that confederations including dependent communities—such as the Hanseatic League—could fulfill a stabilizing political function. He also uses sixteenth-century conceptions concerning the acquisition of sovereignty rights through prescription of immemorial time. Both strands of argument lead to the conclusion that the envoys of dependent communities can have the right to be recognized as ambassadors, with all the duties of esteem that follow from this recognition. Plutarch is virtually unique in surviving classical authors in arguing that animals are rational and sentient, and in concluding that human beings must take notice of their interests. Stephen Newmyer explores Plutarch's three animal-related treatises, as well as passages from his other ethical treatises, which argue that non-human animals are rational and therefore deserve to fall within the sphere of human moral concern. Newmyer shows that some of the arguments Plutarch raises strikingly foreshadow those found in the works of such (...) prominent animal rights philosophers as Peter Singer and Tom Regan in maintaining that non-human animals are the sorts of creatures that have intellectual qualities that cause them to be proper objects of man's concern, and have interests and desires that entitle them to respect from their human counterparts.
