In this article, I put forward, as a suspicion only, that Kant never thought Black lives had dignity but only price. I follow Michel-Rolph Trouillot's argument that the Haitian Revolution is unthinkable for Enlightenment philosophers to examine what Kant could have, would have, or should have said about this world-historical event. By making conjectures about Kant's silence on the Haitian Revolution, I also draw from Kant's writings on the American and French Revolutions. If my suspicion is right, (...) then Kantianism cannot accommodate an antiracist program. This ought to change how we talk about racism, slavery, and colonialism in Kant scholarship and in the history of philosophy. (shrink)

Like Hegel, Marx and Engels, Nietzsche has made the Haitian Revolution “unthinkable” (Michel-Rolph Trouillot). He provokes his readers by justifying slavery in the ancient and in the modern world. In order to indicate the problematic dimension of Nietzsche’s cultural legitimation of slavery it is necessary to situate his ideas in the context of the transatlantic slave trade. Furthermore, we need to ask whether his anti-democratic statements regarding the French Revolution could be understood as a “hyper-democratic” commitment to (...) a “coming democracy” (Jacques Derrida) that resists slavery. I raise the question whether Nietzsche, in this context, considers the possibility of overcoming the institution of slavery in modern Europe. (shrink)

This study is concerned with current images of Science Studies travelling to places outside Western Europe and North America. These images focus on the movement of Science Studies’ formative concepts and ideas. They eclipse other formative aspects specific to the context in which this field was established. For example, Science Studies has analysed science within the conceptual architecture of modernity. Michel-Rolph Trouillot has proposed the notion of “Elsewhere” as analytical lens to analyse the constitution of modernity. The (...) paper claims that modern science, too, can be studied through this analytical lens to call attention to characteristics of science that remain systematically eclipsed. Trouillot’s notion of Elsewhere is applied to a paradigmatic case study from the field of Science Studies—Leviathan and the Air-Pump by Steven Shapin and Simon Schaffer—to test and demonstrate its analytical potential. Max Tomba aims to reconstruct how historical actors reconstructed the past to open the future in ways that diverged from the trajectory of the dominant modernity. Insurgent Universality would break open the dead logic of the juridical, political, and economic trajectory of modernity that limits what is given and constrains what is possible. This essay reflects on the practice and the role of the historian. Beyond merely adopting insurgents’ perspectives, the historian must engage in a practice of critical and reflective (...) judgment. The relationship between Albert Einstein’s special theory of relativity and Hendrik A. Lorentz’s ether theory is best understood in terms of competing interpretations of Lorentz invariance. In the 1890s, Lorentz proved and exploited the Lorentz invariance of Maxwell’s equations, the laws governing electromagnetic fields in the ether, with what he called the theorem of corresponding states. To account for the negative results of attempts to detect the earth’s motion through the ether, Lorentz, in effect, had to assume that the laws (...) governing the matter interacting with the fields are Lorentz invariant as well. This additional assumption can be seen as a generalization of the well-known contraction hypothesis. In Lorentz’s theory, it remained an unexplained coincidence that both the laws governing fields and the laws governing matter should be Lorentz invariant. In special relativity, by contrast, the Lorentz invariance of all physical laws directly reflects the Minkowski space-time structure posited by the theory. One can use this observation to produce a common-cause argument to show that the relativistic interpretation of Lorentz invariance is preferable to Lorentz’s interpretation. (shrink)

Readers of this volume will notice that it contains only a few papers on general relativity. This is because most papers documenting the genesis and early development of general relativity were not published in Annalen der Physik . After Einstein took up his new prestigious position at the Prussian Academy of Sciences in the spring of 1914, the Sitzungsberichte of the Berlin academy almost by default became the main outlet for his scientific production. Two of the more important papers on (...) general relativity, however, did find their way into the pages of the Annalen [35,41]. Although I shall discuss both papers in this essay, the main focus will be on [35], the first systematic exposition of general relativity, submitted in March 1916 and published in May of that year. I provide a detailed reconstruction of Einstein's rather sketchy accounts of the twins and the bucket and examine the role of these two relativity principles. Some coping strategies are capable of being achieved through the cultivation of moral resilience.AimThe aim is to identify the strategies of moral resilience in the nursing management of University Hospitals in Brazil.Research designThe research design is the qualitative study with discursive textual analysis.Participants and research context: 44 nurse managers (...) and nurses in leadership positions participated in a total of 30 University Hospitals in Brazil. Data were collected online, using a questionnaire with open questions.Ethical considerationsThe Ethics Committee approved the study. Participants received information about the research, agreed to respond to the questionnaire, and were guaranteed anonymity.FindingsPersonal adaptive strategies (intrapersonal and interpersonal) and organizational collaborative strategies (intrinsic and transformational management) emerged from this process. The intrapersonal strategies involved elements of rationality, flexibility, rebalancing practices, moral courage, and detachment. The interpersonal strategies addressed support networks, team involvement, and dialog. Organizational strategies dealt with actions which reorient ethical infrastructure, ethical education, and psychological protection, as well as fostering dialogical relationships, empowerment, and cooperation.ConclusionFrom the perspective of social historical construction, it is understood that developing personal and organizational strategies is essential to cultivating moral resilience. Foucault's previously unpublished doctoral dissertation on Kant offers the definitive statement of his relationship to Kant and to the critical tradition of philosophy. This introduction and commentary to Kant's least discussed work, Anthropology from a Pragmatic Point of View, is the dissertation that Michel Foucault presented in 1961 as his doctoral thesis. It has remained unpublished, in any language, until now. In his exegesis and critical interpretation of Kant's Anthropology, Foucault raises the question of the relation between psychology and (...) anthropology, and how they are affected by time. Though a Kantian “critique of the anthropological slumber,” Foucault warns against the dangers of treating psychology as a new metaphysics, explores the possibilities of studying man empirically, and reflects on the nature of time, art and technique, self-perception, and language. Extending Kant's suggestion that any empirical knowledge of man is inextricably tied up with language, Foucault asserts that man is a world citizen insofar as he speaks. For both Kant and Foucault, anthropology concerns not the human animal or self-consciousness but, rather, involves the questioning of the limits of human knowledge and concrete existence. This long-unknown text is a valuable contribution not only to a scholarly appreciation of Kant's work but as the first outline of what would later become Foucault's own frame of reference within the history of philosophy. It is thus a definitive statement of Foucault's relation to Kant as well as Foucault's relation to the critical tradition of philosophy. By going to the heart of the debate on structuralist anthropology and the status of the human sciences in relation to finitude, Foucault also creates something of a prologue to his foundational The Order of Things. There is a striking difference between the methodology of the young Einstein and that of the old. I argue that Einstein’s switch in the late 1910s from a moderate empiricism to an extreme rationalism should at least in part be understood against the background of his crushing personal and political experiences during the war years in Berlin. As a result of these experiences, Einstein started to put into practice what, drawing on Schopenhauer, he had preached for years, namely to use (...) science as his means of escaping from “the merely personal.” Whatever the exact sources of Einstein’s about-face, the older man has left us with a highly misleading picture of how the younger man achieved the successes that we still celebrate today. This has had a harmful influence on theoretical physics. If the young Einstein’s successes are any guide as to how successful theoretical physics is done, close adherence to general features of the empirical data is much more and mathematical elegance is much less important than the old Einstein wanted us to believe. In this critical notice we argue against William Craig’s recent attempt to reconcile presentism (roughly, the view that only the present is real) with relativity theory. Craig’s defense of his position boils down to endorsing a ‘neo-Lorentzian interpretation’ of special relativity. We contend that his reconstruction of Lorentz’s theory and its historical development is fatally flawed and that his arguments for reviving this theory fail on many counts.

Auguste Comte (1798–1857) is the founder of positivism, a philosophical and political movement which enjoyed a very wide diffusion in the second half of the nineteenth century. It sank into an almost complete oblivion during the twentieth, when it was eclipsed by neopositivism. However, Comte's decision to develop successively a philosophy of mathematics, a philosophy of physics, a philosophy of chemistry and a philosophy of biology, makes him the first philosopher of science in the modern sense, and his constant attention (...) to the social dimension of science resonates in many respects with current points of view. His political philosophy, on the other hand, is even less known, because it differs substantially from the classical political philosophy we have inherited. -/- Comte's most important works are (1) the Course on Positive Philosophy (1830-1842, six volumes, translated and condensed by Harriet Martineau as The Positive Philosophy of Auguste Comte); (2) the System of Positive Polity, or Treatise on Sociology, Instituting the Religion of Humanity, (1851-1854, four volumes); and (3) the Early Writings (1820-1829), where one can see the influence of Saint-Simon, for whom Comte served as secretary from 1817 to 1824. The Early Writings are still the best introduction to Comte's thought. In the Course, Comte said, science was transformed into philosophy; in the System, philosophy was transformed into religion. The second transformation met with strong opposition; as a result, it has become customary to distinguish, with Mill, between a “good Comte” (the author of the Course) and a “bad Comte” (the author of the System). BackgroundClinical ethics case consultations (CECCs) provide a structured approach in situations of ethical uncertainty or conflicts. There have been increasing calls in recent years to assess the quality of CECCs by means of empirical research. This study provides detailed data of a descriptive quantitative and qualitative evaluation of a CECC service in a department of cardiology and intensive care at a German university hospital.MethodsSemi-structured document analysis of CECCs was conducted in the period of November 1, 2018, to May 31, 2020. All documents were analysed by two researchers independently.ResultsTwenty-four CECCs were requested within the study period, of which most (n = 22; 92%) had been initiated by physicians of the department. The patients were an average of 79 years old (R: 43–96), and 14 (58%) patients were female. The median length of stay prior to request was 12.5 days (R: 1–65 days). The most frequent diagnoses (several diagnoses possible) were cardiology-related (n = 29), followed by sepsis (n = 11) and cancer (n = 6). Twenty patients lacked decisional capacity. The main reason for a CECC request was uncertainty about the balancing of potential benefit and harm related to the medically indicated treatment (n = 18). Further reasons included differing views regarding the best individual treatment option between health professionals and patients (n = 3) or between different team members (n = 3). Consensus between participants could be reached in 18 (75%) consultations. The implementation of a disease specific treatment intervention was recommended in five cases. Palliative care and limitation of further disease specific interventions was recommended in 12 cases.ConclusionsTo the best of our knowledge, this is the first in-depth evaluation of a CECC service set up for an academic department of cardiology and intensive medical care. Patient characteristics and the issues deliberated during CECC provide a starting point for the development and testing of more tailored clinical ethics support services and research on CECC outcomes. In 1980, Michel Foucault began a vast project of research on the relationship between subjectivity and truth, an examination of conscience, confession, and truth-telling that would become a crucial feature of his life-long work on the relationship between knowledge, power, and the self. The lectures published here offer one of the clearest pathways into this project, contrasting Greco-Roman techniques of the self with those of early Christian monastic culture in order to uncover, in the latter, the historical origin of (...) many of the features that still characterize the modern subject. They are accompanied by a public discussion and debate as well as by an interview with Michael Bess, all of which took place at the University of California, Berkeley, where Foucault delivered an earlier and slightly different version of these lectures. Foucault analyzes the practices of self-examination and confession in Greco-Roman antiquity and in the first centuries of Christianity in order to highlight a radical transformation from the ancient Delphic principle of “know thyself” to the monastic precept of “confess all of your thoughts to your spiritual guide.” His aim in doing so is to retrace the genealogy of the modern subject, which is inextricably tied to the emergence of the “hermeneutics of the self”—the necessity to explore one’s own thoughts and feelings and to confess them to a spiritual director—in early Christianity. According to Foucault, since some features of this Christian hermeneutics of the subject still determine our contemporary “gnoseologic” self, then the genealogy of the modern subject is both an ethical and a political enterprise, aiming to show that the “self” is nothing but the historical correlate of a series of technologies built into our history. Thus, from Foucault’s perspective, our main problem today is not to discover what “the self” is, but to try to analyze and change these technologies in order to change its form. (shrink)

Most states are multination states, and most peoples are stateless peoples. Just as collectives can behave as sovereign states only if they are recognized by the international community, liberal multination states must recognize stateless peoples in order to determine their political status within that state. There is, however, no agreement on the kind of principles that should be considered, especially under classical liberalism, which gives individuals preeminence over groups. Liberal theories that attempt to accommodate collective rights are often based on (...) a comprehensive version of liberalism that subscribes to moral individualism. Within such a framework, they develop a watered-down concept of collective rights. In A Liberal Theory of Collective Rights Michel Seymour explores the theoretical resources of John Rawls’s political liberalism and shows that this particular approach can accommodate genuine collective rights. By Rawls’s account, Seymour explains, peoples are moral agents and sources of valid moral claims and are therefore entitled to collective rights. These kinds of rights translate, in the constitution of the multination state, to a true political recognition for stateless peoples. Ultimately, A Liberal Theory of Collective Rights answers three important questions: Who is the subject of collective rights? What is the object of collective rights? An assessment of decision-making capacity is the accepted procedure for determining when a person is not competent. An inferential gap exists between the criteria for capacity specific abilities and the legal requirements to understand relevant information and appreciate the consequences of a decision. This gap extends to causal influences on a person'scapacity to decide. Using a published case of depression, we illustrate that assessors' uses of diagnostic information is frequently not up to the task of bridging this inferential gap in (...) a justifiable way. We then describe cases of faulty judgement which challenge the understanding of diagnostic causal influences. These cases help to clarify the nature of the expertise required for capacity assessments. In practice, the requirements of decision-making capacity are often abandoned to other considerations due to a lack of requisite expertise. The legal policy supporting decision-making capacity as a means to protective intervention is justified only if the requisite expertise is developed. We propose the requisite expertise to be developed in the long term as a distinct multidisciplinary endeavour. (shrink)

After a presentation of some relevant aspects of Chakravartty's semi-realism (A Metaphysics for scientific realism. Knowing the unobservable. Cambridge University Press, Cambridge, 2007), this paper addresses two difficulties that appear to be inherent to important components of his proposed metaphysics for scientific realism. First, if particulars and laws are concrete structures, namely actual groupings of causal properties as the semirealist contends, the relation between particulars and laws becomes also a relation between particulars with some annoying consequences. This worry—and some others—are (...) resolved if laws are taken to be statements and particulars are construed not only as groupings of properties, but things that contain a non-conceptual ingredient which can be given in perceptual awareness. Second, on the semirealist's view of particulars it becomes difficult to defend an epistemological version of scientific realism according to which we have good reasons to believe that the same things are referred to despite the fact that successive theories may attribute different properties to them. This paper investigates a series of normative principles that are used to justify different aspects of executive compensation within business firms, as well as the remuneration of lower-ranking employees. We look at how businesses perform pay benchmarking; employees’ engagement, fidelity and loyalty ; and the acceptability of what we call both-ends-dipping, that is, receiving both ex ante and ex post benefits for the same work. We make two observations. First, either different or incoherent principles are used to justify the pay (...) of executives compared to employees, or the same principles are applied differently. Second, these differences or inconsistencies tend to be to the benefit of executives and/or to the detriment of employees. We conclude by asking whether there is any reason for thinking differently about executive pay than we do about employee pay. Our analysis leads us to question the principles justifying current executive compensation and to wonder if these principles are potentially being instrumentalized to serve other ends. (shrink)
