This volume concerns the status and ambitions of metaphysics as a discipline.

The notion of harm has been a recurring and a significant notion in the characterization of mental disorder. It is present in eminent diagnostic manuals such as DSM and ICD, as well as in the discussion on mental disorders in philosophy of psychiatry. Recent demotion of harm in the definition of mental disorders in DSM-5 shows a general trend towards reducing the significance of harm when thinking about the nature of mental disorders. In this paper, we defend the relevance of (...) the notion of harm in the characterization of mental disorder against some of these attacks. We approach this issue by using the method of conceptual explication pioneered by Rudolf Carnap. Within this framework, we argue that keeping the notion of harm not only helps to discriminate what is pathological from the nonpathological but also prevents potential misuses of psychiatric authority. This paper provides frameworks for understanding how ethics might be expressed in gameplay situations, and how we can study the ethical frameworks that games offer to players. There are many ways to delve into such topics, and this paper considers only a few approaches. It briefly surveys some of the important ques-tions and critiques arising from audience studies, theories of play and games, and work on cheating, and begins to build a framework for considering ethics in relation to games and (...) players that transcends the “place apart” that games are often constructed as. The aim of this study was to evaluate agreement between nurses’ and physicians’ opinions regarding aggressiveness of treatment and to investigate and compare the rationales on which their opinions were based. Structured interviews regarding 714 patients were performed on seven general wards of a university hospital. The data gathered were then subjected to qualitative and quantitative analyses. There was 86% agreement between nurses’ and physicians’ opinions regarding full or limited treatment when the answers given as ‘uncertain’ were excluded. Agreement was (...) less (77%) for patients with a life expectancy of less than one year. Disagreements were not associated with professional status because the physicians considered limiting life-sustaining treatment as often as the nurses. A broad spectrum of rationales was given but the results focus mostly on those for full treatment. The nurses and the physicians had similar bases for their opinions. For the majority of the patients, medical rationales were used, but age and quality of life were also expressed as important determinants. When considering full treatment, nurses used quality-of-life rationales for significantly more patients than the physicians. Respect for patients’ wishes had a minor influence. (shrink)

Clinical ethics support, in particular Moral Case Deliberation, aims to support health care providers to manage ethically difficult situations. However, there is a lack of evaluation instruments regarding outcomes of clinical ethics support in general and regarding Moral Case Deliberation (MCD) in particular. There also is a lack of clarity and consensuses regarding which MCD outcomes are beneficial. In addition, MCD outcomes might be context-sensitive. Against this background, there is a need for a standardised but flexible outcome evaluation instrument. In inclusive dance settings, where people with different abilities and talents come together, the role of facilitators is essential in guiding the process of inclusion. Their behavior gives sensitive information to the individual about one’s status within the own-group affiliation. Even today, very little research on the motivation for facilitating inclusivity in dance contexts exists. This case study will examine the facilitator’s motivation by juxtaposing current theory next to experiences of seven experts of contemporary dance facilitation in Europe. Good opportunities (...) for meaningful interactions can be created in a dance setting: it promotes a deeper sense of community, gives us the feeling of belonging, generates respect and inclusion, and helps to prevent the feeling of loneliness. This research report sheds light on the motivation of being the facilitator of dance for heterogeneous groups and reveals three factors from the data. First, to be led by an artistic motivation, second, to have a vision in terms of changing the society, and third, to have another personal motivation. The motivation of the facilitator is regarded as highly important for inclusive work, as the person who facilitates plays a key role in these successful processes of inclusion. (shrink)

The Metaphysical Club, a gathering of intellectuals in the 1870s associated with Harvard, is widely recognized as the crucible where pragmatism, America's distinctively original philosophy, was refined and proclaimed. Louis Menand's bestseller about the group was a dramatic publishing success. However, only three actual members - Oliver Wendell Holmes Jr., Charles S. Peirce, and William James - appear in this book, alongside other thinkers such as John Dewey who were never in the Club. The Real Metaphysical Club tells the full (...) story of how this influential group shifted the course of philosophy in America. In addition to pioneering pragmatism, the group explored radical empiricism and idealism, and formulated personalism and process philosophy, equally important developments. This volume contains thirty-seven important writings dating from 1870 to 1885 by the real members of the Metaphysical Club. The first section centers on pragmatism and science; the second part collects writings of the lawyers; and the third part covers idealist and personalist philosophers. Many of these writings have never been reprinted before, and nothing like this impressive collection has ever been attempted. A general introduction provides a narrative history, and the editors' three introductions to the volume's sections vividly bring to life the intense meetings, sustained debates, and pioneering thought from the Metaphysical Club. In this paper we apply the popular Best System Account of laws to typical eternal worlds – both classical eternal worlds and eternal worlds of the kind posited by popular contemporary cosmological theories. We show that, according to the Best System Account, such worlds will have no laws that meaningfully constrain boundary conditions. It’s generally thought that lawful constraints on boundary conditions are required to avoid skeptical arguments. Thus the lack of such laws given the Best System Account may seem (...) like a severe problem for the view. We show, however, that at eternal worlds, lawful constraints on boundary conditions do little to help fend off skeptical worries. So with respect to handling these skeptical worries, the proponent of the Best System Account is no worse off than their competitors. (shrink)

The convergence of corporate social responsibility (CSR) and corporate governance (CG) has changed the corporate accountability mechanism. This has developed a socially responsible ‘corporate self-regulation’, a synthesis of governance and responsibility in the companies of strong economies. However, unlike in the strong economies, this convergence has not been visible in the companies of weak economies, where the civil society groups are unorganised, regulatory agencies are either ineffective or corrupt and the media and non-governmental organisations do not mirror the corporate conscience. Much work on intellectual humility has focused on its epistemic benefits. We suggest that displaying (or failing to display) intellectual humility also has effects on how others perceive us and that, as a result, intellectual humility can serve reputation management purposes, in at least four ways: (i) Intellectual humility can be used to signal we are a good source of information; (ii) Intellectual humility can be used to signal we are competent through countersignaling; (iii) Intellectual humility can be used to (...) make sure others do not believe we are overclaiming superiority; (iv) lack of intellectual humility (or intellectual arrogance) can be used to signal dominance. The evidence suggests that intellectual humility (or lack thereof) can have each of these effects. Seeing intellectual humility as (inter alia) a reputation management tool predicts that people will be more or less likely to display intellectual humility in some contexts. For instance, people in a position of power might stand to lose less if they fail to be intellectual humble; accordingly, evidence suggests that they tend to display less intellectual humility. In conclusion, we speculate that understanding intellectual humility as reputation management could help construct environments more conducive to displays of intellectual humility. (shrink)

BackgroundThere is a lack of empirical research regarding the outcomes of such clinical ethics support methods as moral case deliberation. Empirical research in how healthcare professionals perceive potential outcomes is needed in order to evaluate the value and effectiveness of ethics support; and help to design future outcomes research. The aim was to use the European Moral Case Deliberation Outcome Instrument instrument to examine the importance of various MCD outcomes, according to healthcare professionals, prior to participation.MethodsA North European field survey (...) among healthcare professionals drawn from 73 workplaces in a variety of healthcare settings in the Netherlands, Norway and Sweden. The Euro-MCD instrument was used.ResultsAll outcomes regarding the domains of moral reflexivity, moral attitude, emotional support, collaboration, impact at organisational level and concrete results, were perceived as very or quite important by 76%–97% of the 703 respondents. Outcomes regarding collaboration and concrete results were perceived as most important. Outcomes assessed as least important were mostly about moral attitude. ‘Better interactions with patient/family’ emerged as a new domain from the qualitative analysis. Dutch respondents perceived most of the outcomes as significantly less important than the Scandinavians, especially regarding emotional support. Furthermore, men, those who were younger, and physician-respondents scored most of the outcomes as statistically significantly less important compared with the other respondents.ConclusionsThe findings indicate a need for a broad instrument such as the Euro-MCD. Outcomes related to better interactions between professionals and patients must also be included in the future. The empirical findings raise the normative question of whether outcomes that were perceived as less important, such as moral reflexivity and moral attitude outcomes, should still be included. In the future, a combination of empirical findings and normative reflection will contribute to the revision of the instrument. (shrink)

Some authors argue that it is permissible for clinicians to conscientiously provide abortion services because clinicians are already allowed to conscientiously refuse to provide certain services. Call this the symmetry thesis. We argue that on either of the two main understandings of the aim of the medical profession—what we will call “pathocentric” and “interest‐centric” views—conscientious refusal and conscientious provision are mutually exclusive. On pathocentric views, refusing to provide a service that takes away from a patient's health is professionally justified because (...) there are compelling reasons, based on professional standards, to refuse to provide that service (e.g., it does not heal, and it is contrary to the goals of medicine). However, providing that same service is not professionally justified when providing that service would be contrary to the goals of medicine. Likewise, the thesis turns out false on interest‐centric views. Refusing to provide a service is not professionally justified when that service helps the patient fulfill her autonomous preferences because there are compelling reasons, based on professional standards, to provide that service (e.g., it helps her achieve her autonomous preferences, and it would be contrary to the goals of medicine to deny her that service). However, refusing to provide that same service is not professionally justified when refusing to provide that service would be contrary to the goals of medicine. As a result, on either of the two most plausible views on the goals of medicine, the symmetry thesis turns out false. (shrink)

Based on a case study of a large multinational group, this paper addresses the way in which social and environmental reporting systems were changed and the consequences and controversies associated with this change. Drawing on Power’s work on the processes by which things are made auditable via underlying systems, we focus on how and why a specific programme with auditability as its ultimate aim changed the basis on which the external social and environmental report was prepared. Our analysis demonstrates that (...) the perceived alignment with the financial report preparation and the explicit pursuit of auditability legitimized SER and paved the way for data systems to be changed. The programme borrowed authority from financial accounting technologies not only to make a system change but also to push SER internally, as we suggest that an intraorganizational group used the programme to ensure the existence and organizational status of SER. However, we also illustrate some of the practical challenges associated with this change, which include issues related to internal control and the establishment of organizational boundaries. How should you evaluate your choices when you’re unsure what their outcomes will be? One popular answer is to rank your options in terms of their expected utilities. But what should you do when you think that the value of their respective outcomes might be incommensurable? In the face of incommensurable values, it no longer makes sense to speak of ranking your options according to expected utility. Are there any general principles to guide us when facing decisions of this kind? (...) If only! This chapter develops an impossibility result: it holds that there are a handful of independently plausible constraints that no such decision theory can jointly satisfy. The result, while depressing, can be used to helpfully classify extant approaches based on which of the constraints they violate. (shrink)

This paper develops a novel problem for representationalism (also known as "intentionalism"), a popular contemporary account of perception. We argue that representationalism is incompatible with supervaluationism, the leading contemporary account of vagueness. The problem generalizes to naive realism and related views, which are also incompatible with supervaluationism.

That a standard of medical care must outline services that benefit the patient is relatively uncontroversial. However, one must determine how the practices outlined in a medical standard of care should benefit the patient. I will argue that practices outlined in a standard of medical care must not detract from the patient’s well-functioning and that clinicians can refuse to provide services that do. This paper, therefore, will advance the following two claims: (1) a standard of medical care must not cause (...) dysfunction, and (2) if a physician is medically rational to not provide some service which fails to meet the above condition (i.e. fails to be a standard of medical care), then she may refuse to do so. I then apply my thesis to the prescription of puberty blockers to children with gender dysphoria. (shrink)

AI and people do not compete on a level-playing field. Self-driving vehicles may be safer than human drivers, but laws often penalize such technology. People may provide superior customer service, but businesses are automating to reduce their taxes. AI may innovate more effectively, but an antiquated legal framework constrains inventive AI. In The Reasonable Robot, Ryan Abbott argues that the law should not discriminate between AI and human behavior and proposes a new legal principle that will ultimately improve human (...) well-being. In his postapocalyptic novel, Those Who Remain, G. Michael Hopf (2016) makes an important observation about the effect crises can have on human psychology by noting that "hard times create strong [humans]" (loc. 200). While the catastrophic effects of the recent COVID-19 outbreak are incontestable, there are arguments to be made that the situation itself could be materia prima of a more grounded, and authentic generation of humanity, at least in theory. In this article I draw on Heidegger's early, implicit (...) ethic of finitude as well as his later work surrounding the nature of technology, and place them into dialogue with a global milieu contextualized by worldwide pandemic. I approach this discussion from two different angles: in the first part, I explicate the ethic of finitude, and use it as a framework to describe the observable behavior of communities worldwide in order to better understand how global crises impact the psychical welfare of individual human beings. In the second part, I apply lessons given to us by the later Heidegger, specifically those oriented around the movement away from calculative thinking, in an effort to define a loose, albeit fundamentally ennobling prescriptive aimed at easing the existential strain of the situation we have found ourselves in. *This is a pre-print of an article published in Human Arenas. Ethical, Legal and Social Aspects (ELSA) originated in the 4thEuropean Research Framework Programme (1994) andresponsible research and innovation (RRI) from the EC researchagenda in 2010. ELSA has received renewed attention inEuropean funding schemes and research. This raises the questionof how these two approaches to social responsibility relate toone another and if there is the possibility to align. There is aneed to evaluate the relationship/overlap between ELSA and RRIbecause there is a possibility that new ELSA research will reinventthe wheel if it (...) does not engage with the body of literaturealready present in RRI research. This provides unneeded extrabureaucracy, reformulations of research agendas, extrainvestment, and an overabundance of frameworks to implement,and ELSA research does not take advantage of the body ofresearch developed in RRI. Can our beloved cats and dogs love us back? This chapter aims to find a satisfactory theory of love that substantiates the claim that they can. It begins by reconstructing and critically evaluating recent attempts by scientists to show that dogs can love humans back. Although these attempts are argued to be unsuccessful, it is further argued that they illuminate the need for an adequate theory of love and offer us some plausible ideas about love that direct us to two (...) recent philosophical theories of love that support the idea that dogs can love humans back. These two theories are discussed in detail before it is argued that dogs, but not cats, seem capable of loving humans under these theories. These theory-based defenses of the belief that dogs can love humans back are then criticized on the grounds that the theories they use are unsatisfactory because they fail to capture three central truths about love. This leads to a third theory of love that, after some friendly amendments, is argued to be a tentatively adequate theory that provisionally vindicates the claim that dogs, but not cats, can love humans back. This paper, through a discussion of the IRA's proxy bomb campaigns, challenges the way martyrdom is and has been constructed and forces us to examine terrorist events without preconceived notions. It is important to note that when we witness an event that on the surface appears to be an instance of martyrdom, the reality might be far more complex. Part of the problem has been the current inductive logic associated with the study of terrorism in which attacks are a given (...) and experts will engage in a psychological autopsy to trace perpetrators' intentions and motives after the fact. If they are religious, we assume that this act was one of self-sacrifice for a religious cause. However, this is not always the case. We argue that we need to question the intent of the action rather than assume that the event is automatically an act of martyrdom. While attacks in Kabul or Baghdad may appear as deliberate jihadi operations by the Taliban or by Al Qaeda in Iraq, our investigation has determined that a portion of such attacks are the product of coercion and not martyrdom in the traditional sense although observers may understand them to be martyrdom operations. In this article, we offer a perspective into howCanadian doctoral nursing students’ writing capacity is mentored and, as a result, we argue is disciplined. We do this by sharing our own disciplinary and interdisciplinary experiences of writing with, for and about nurses. We locate our experiences within a broader discourse that suggests doctoral (nursing) students be prepared as stewards of the (nursing) discipline. We draw attention to tensions and effects of writing within (nursing) disciplinary boundaries. We argue that traditional approaches (...) to developing nurses’ writing capacity in doctoral programs both shepherds and excludes emerging scholarly voices, and we present some examples to illustrate this dual role. We ask our nurse colleagues to consider for whom nurses write, offering an argument that nurses’ writing must ultimately improve patient care and thus would benefit from multiple voices in writing. Despite societal concerns about the welfare of commercial laying hens, little attention has been paid to the welfare implications of the choices made by the genetics companies involved with their breeding. These choices regarding trait selection and other aspects of breeding significantly affect living conditions for the more than 7 billion laying hens in the world. However, these companies must consider a number of different commercial and societal interests, beyond animal welfare concerns. In this article we map some of the (...) relevant dilemmas faced by genetics companies in order to outline the scope of opportunities to improve welfare under current market conditions. This includes identifying cases where different animal welfare concerns conflict. We discuss the moral responsibility of laying hen genetics companies and the welfare implications that derive from the choices they make and the policies they follow. In addition to evaluating a selection of predominant current practices and breeding goals, we outline different angles from where to assess the moral legitimacy of various industry practices and policies. We discuss specific issues such as injurious pecking, bone health, induced moulting, chick culling and the circumstances of breeding stock. (shrink)

Even though Corporate Social Responsibility (CSR) has become a widely accepted concept promoted by different stakeholders, business corporations' internal strategies, known as corporate self-regulation in most of the weak economies, respond poorly to this responsibility. Major laws relating to corporate regulation and responsibilities of these economies do not possess adequate ongoing influence to insist on corporate self-regulation to create a socially responsible corporate culture. This book describes how the laws relating to CSR could contribute to the inclusion of CSR principles (...) at the core of the corporate self-regulation of these economies in general, without being intrusive in normal business practice. It formulates a meta-regulation approach to law, particularly by converging patterns of private ordering and state control in contemporary corporate law from the perspective of a weak economy. It proposes that this approach is suitable for alleviating regulators' limited access to information and expertise, inherent limitations of prescriptive rules, ensuring corporate commitment, and enhance the self-regulatory capacity of companies. This book describes various meta-regulation strategies for laws to link social values to economic incentives and disincentives, and to indirectly influence companies to incorporate CSR principles at the core of their self-regulation strategies. The focus of this chapter is on some of the ethical and philosophical issues at the intersection of robotics and artificial intelligence (AI) applications in the health care sector and medical assistance in dying (e.g. physician-assisted suicide and euthanasia), including: (1) Is there a role for robotic systems/AI to play in the orchestration or delivery of assisted dying?; (2) Can the use of robotic systems/AI make the orchestration of assisted dying more ethical?; and (3) What insights can be generated in (...) the ethical debate on physician assisted suicide and euthanasia from considering the prospect of robotic systems/AI assisting with the provision of or providing assistance in dying? The prospect of including robotic systems/AI in the context of assisted dying provides opportunity to revisit longstanding philosophical and ethical issues under new light. Indeed, reflecting on these questions may invigorate debate, for example in reconsidering the de-medicalization of assisted dying, reconsidering whether assisted dying is within the proper scope of medicine, and reconsidering which normative approach to the ethics of assisted dying is the most appropriate. Scientific research is almost always conducted by communities of scientists of varying size and complexity. Such communities are effective, in part, because they divide their cognitive labor: not every scientist works on the same project. Philip Kitcher and Michael Strevens have pioneered efforts to understand this division of cognitive labor by proposing models of how scientists make decisions about which project to work on. For such models to be useful, they must be simple enough for us to understand their dynamics, (...) but faithful enough to reality that we can use them to analyze real scientific communities. To satisfy the first requirement, we must employ idealizations to simplify the model. The second requirement demands that these idealizations not be so extreme that we lose the ability to describe real-world phenomena. This paper investigates the status of the assumptions that Kitcher and Strevens make in their models, by first inquiring whether they are reasonable representations of reality, and then by checking the models' robustness against weakenings of these assumptions. To do this, we first argue against the reality of the assumptions, and then develop a series of agent-based simulations to systematically test their effects on model outcomes. We find that the models are not robust against weakenings of these idealizations. In fact we find that under certain conditions, this can lead to the model predicting outcomes that are qualitatively opposite of the original model outcomes. (shrink)

This article examines the dog-like aspects and associations of two marine monsters of Graeco-Roman antiquity: Scylla and the κῆτος. Both harbour recognizably canine features in their depictions in ancient art, as well as being referenced as dogs or possessing dog-like attributes in ancient texts. The article argues that such distinctly canine elements are related to, and probably an extension of, the conceptualization of certain marine animals, most prominently sharks, as ‘sea dogs’. Accordingly, we should understand these two sea monsters and (...) the sea dogs as being interrelated in the ancient imagination. Such a canine resonance to certain sea creatures offers a valuable insight into the Graeco-Roman imagination of the marine element as being the abode of creatures reminiscent of terrestrial dogs. This essay seeks to understand Gorgias’ reflections upon language and perception in the Encomium of Helen through the threefold vocabularies of medicine, enchantment, and oratory that were often taken together in the fifth century. I demonstrate that the two modes of sorcery to which Gorgias refers have to do with language and its effect on opinion, on the one hand, and perception and its effect upon one’s affective bearing, on the other. Both effects, I claim, are grasped through their forceful (...) means of physically impressing and deforming the soul such that its reliance upon memory and habitual forms of dwelling in the world are subject to oblivion. Further, such conceptual and practical unmooring can be understood as forms of disease that rob an individual of her agency, either temporarily or permanently, and therefore reflect the problematic status of language in early democratic Greece. Amie Thomasson challenges advocates of layered conceptions of reality to explain “how layers are distinguished” and “what holds them together” by “examining the world” (2014). One strategy for answering such questions is mereological, treating inter-layer relations as parthood relations, where layers exist whenever composition does, and the number of layers will be equivalent to the number of answers to Peter Van Inwagen’s Special Composition Question, while answers to his General Composition Question explain what holds the layers together (1987). Various answers (...) have been proffered for these questions, from the physicalist atomism of Richard Feynman (2015), Hilary Putnam (1958), and Kit Fine (1992) to the holism of Jonathan Schaffer (2010), the two-layer emergentism of Van Inwagen himself (1995), Tim Maudlin’s three-layered “flash ontology” (2011), and Rob Koons two-layered “thermal substances” (2019). In this PhD project, I seek to meet Thomasson’s challenge by identifying which of these proposals are compatible with plausible interpretations of quantum physics. Atomist answers may have difficulty with relativity, while holistic and emergentist models have trouble giving an account of experimental conditions. Maudlin and Koons’ views, meanwhile, may make testable predictions about the scope of entanglement. Examining the world can lead us to sharply winnow our theories about how layers are distinguished and what holds them together. (shrink)

The Philosophy of John Stuart Mill demonstrates that Mill both saw his views as part of a systematic defense of empiricist epistemology and utilitarian ethics, and was to a large extent successful in offering a coherent and connected defense of this system. At the time Alan Ryan's highly acclaimed study was first published, it was unusual in insisting on the systematic character of Mill's philosophy. Since 1970, however, many writers have contributed to a more systematic understanding of Mill's program (...) for philosophy, ethics and social science, and Alan Ryan's new preface to the second edition assesses the way Mill appears in this new climate of opinion. When thinking of Plato’s discussions of virtue, many dialogues come to mind, but, assuredly, the Phaedrus does not. The word ἀρετή is used only six times in the dialogue. Unlike other dialogues, the Phaedrus thematizes neither the general concept of virtue nor any of the particular virtues. Given the centrality of virtue to Plato’s ethics and politics, it is surprising to see little reference to virtue in a dialogue devoted to love and to rhetoric, topics that have deep ethical and (...) political significance. -/- I argue that the Phaedrus makes important contributions to our understanding of virtue in Plato despite the infrequency of references. First, the dialogue juxtaposes competing conceptions of virtue: the “urbane” (cf. 227d) capacity to make things conform to one’s happenstance desires, championed by Lysias, and the “manic” capacity to conform oneself to reality, championed by Socrates. After clarifying that enslavement to pleasure-lust is the underlying condition of soul for Lysianic virtue, Socrates reveals that the non-lover’s “virtue” is, in truth, virtue in name only. Rather, true virtue emerges only when the soul becomes harmoniously ordered under reason’s guidance, a condition which is achieved through the soul’s encounter with beauty. Second, in the process of articulating how true virtue comes to be in the soul, Socrates gives grounds for distinguishing it from “self-restraint” (ἐγκράτεια), a condition of soul whose outward aspect may be indistinguishable from that of virtue. While a soul in which reason does not take the reins may act from self-restraint, it does not yet act from virtue. Third, the dialogue gives us resources for seeing how other people, such as artful rhetoricians, can influence one’s cultivation of virtue. At first glance, Socrates’s claim that artful rhetoricians can “hand over” virtue (270b) seems incompatible with his claim that virtue is unteachable (cf. Meno 86d-99e). However, the dialogue offers some resources for seeing that the unteachability of virtue and the capacity for rhetoricians to “hand over” virtue are not, in fact, incompatible. From these three points, we will see that the Phaedrus offers an intellectualist account of virtue reminiscent of what we see in other dialogues. The intellectualist vision here, however, is one that includes a positive role for the subrational elements of the soul rather than one that excludes them from relevance or actively seeks to suppress them. Kopec and Titelbaum collect five alleged counterexamples to Uniqueness, the thesis that it is impossible for agents who have the same total evidence to be ideally rational in having different doxastic attitudes toward the same proposition. I argue that four of the alleged counterexamples fail, and that Uniqueness should be slightly modified to accommodate the fifth example.
