Given our own group's efforts to develop national guidelines, we have rethought the issue of palliative sedation therapy several times over the past year.The use of clear and concise definitions is fundamental to the development of any consensus guidelines on this topic. Most questions commonly asked about international politics are ethical ones. Should the international community intervene in Bosnia? What do we owe the starving in Somalia? What should be done about the genocide in Rwanda? Yet, Mervyn Frost argues, ethics is accorded a marginal position within the academic study of international relations. In this book he examines the reasons given for this, and finds that they do not stand up to scrutiny. He goes on to evaluate those ethical theories which (...) do exist within the discipline - order based theories, utilitarian theories, and rights based theories - and finds them unconvincing. This article explores the ways in which we hold participants in dispersed practices to ethical account for the accumulated consequences of their individual actions over time. This ‘holding to account’ is quite different to that found within centralised practices such as a state or a corporation. In the case of a state, for example, we hold presidents, prime ministers (and others) to account in terms of well understood norms of ethical behaviour internal to the practice. For example, we might accuse (...) them of corruption. In such cases an actor is criticised for failing to adhere to a well understood ethical norm. In dispersed practices, the holding to account is different. Here the allegation is that the participants, through adhering to the ethical norms inherent in the practice, are collectively bringing about an unethical result. Through their doing the ethically right thing, they are bringing about a wrong. Marx's analysis of capitalism can be understood in this way. In the normal day to day activity in a capitalist system, individual buyers and sellers are not doing anything ethically wrong, but the accumulated outcome of their individual actions is ethically (on Marx's analysis) unacceptable. The wrongdoing arises from a failure to understand the structural consequences of the operation of the practice over time. It also arises from a failure to understand and act on the political possibilities of transformation that exist within the practices in question. (shrink)

This article explores the uses of tragedy as a mode of analysis in international relations. In tragic analyses, actors are portrayed as acting ethically, but through their deeds they bring about consequences that are contrary to the values in the name of which the deeds were undertaken. The good deeds bring about ethically obnoxious consequences. The article demonstrates how tragic analyses can be made of the actions of collective actors such as states and nations. Examples from Rhodesia, South Africa and (...) the Balkans are used to demonstrate this. Tragic stories elicit sympathy for the protagonists. Such accounts are compared with rival accounts of the same acts, in terms of `just war theory', for example, which accounts do not generate sympathy but call forth emotions of outrage and condemnation. Finally, a case is made for the use of the tragic form of analysis in international affairs. Such analyses highlight the tensions and contradictions between rival social practices and point the way towards political transformations that will make a repetition of those cases of tragedy less likely in future. Conviction Narrative Theory is an interesting and plausible way to think about how individuals make decisions when quantitative assessments are not open to them. The question I pose is the following. Is there any general result about how decisions should be taken independent of the particular circumstances of that decision?

During the past four years, the International Institute for Indigenous Resource Management has sponsored and co-sponsored a series of discursive roundtables on the ethical, legal, social, and cultural implications of genetic research on Indian tribes and Indian people. The deliberations of the tribal leaders, legal scholars, researchers, representatives of non-governmental organizations, and others who participated in these roundtables laid out a range of barriers to informed tribal participation in genetic research and proposed a policy, legal, and scientific research agenda to (...) fill gaps in knowledge and to otherwise support indigenous peoples' decision-making on genetic research issues.An understanding of Native American attitudes toward genetic research on their community cannot be fully understood absent an appreciation of the interrelationship among native peoples, genetic research, and the landscape, contaminated as it is by governmental and other factors. The deliberations described herein present invaluable insights into tribal attitudes toward genetic research that have application to ethical, legal and social aspects of forensic DNA databanks, sample collection and retention, and, in particular, issues of secondary non-forensic uses of such DNA. Property dualism is enjoying a slight resurgence in popularity, these days; substance dualism, not so much. But it is not as easy as one might think to be a property dualist and a substance materialist. The reasons for being a property dualist support the idea that some phenomenal properties (or qualia) are as fundamental as the most basic physical properties; but what material objects could be the bearers of the qualia? If even some qualia require an adverbial construal (if they (...) are modifications of the thing that is conscious because of them, not properties of something else to which the subject of consciousness is related), then the property dualist can be driven to speculative forms of materialism none of which, at this point, looks more likely to be true than the more modest versions of emergent dualism defended by contemporary substance dualists. Ethical decision making in medicine has recently seen calls to move towards less prescriptive- based approaches that consider the particularities of each case. The main alternative call from the literature is for better understanding of phronesis concepts applied to decision making. A well-cited phronesis-based approach is Kaldjian’s five-stage theoretical framework: goals, concrete circumstances, virtues, deliberation and motivation to act. We build on Kaldjian’s theory after using his framework to analyse data collected from a three-year empirical study of phronesis and the (...) medical community. The data are a set of narratives collected in response to asking a medical community what making ethically wise decisions means to them. We found that Kaldjian’s five concepts are present in the accounts to some extent but that one of the elements, motivation, is constructed as playing a different, though still crucial role. Rather than being an end-stage of the process as Kaldjian’s framework suggests, motivation was constructed as initiating the process and maintaining the momentum of taking a phronesis-based approach. The implications for medical ethics decision-making education are significant as motivation itself is a highly complex concept. We therefore theorise that motivation is required for leading in, continuing and completing the actions of the ethical decision taken. Appreciating the central importance of motivation through the whole of Kaldjian’s framework has implications for cultivating the virtues of phronesis and courage to take the right course of action. In considering what it means to lead organizations effectively and ethically, the literature comprising spirituality at work and spiritual leadership theory has become highly influential, especially in the USA. It has also attracted significant criticism. While in this paper, we endorse this critique, we argue that the strand of literature which purportedly takes a Christian standpoint within the wider SAW school of thought, largely misconstrues and misapplies the teaching of its founder, Jesus. As a result, in dismissing the claims and (...) application of SAW and SLT, there is a real risk that we lose the vital contribution of Christian thought, not least some of the timeless counter-cultural wisdom of Jesus which, we contend, offers a vital foundation to the practice of ethical leadership and business ethics in organizations. In proposing a way forward, two thorny issues which face all leaders are addressed: dealing with ego and closing the gap between what we say and what we do. The more we understand about the dynamics of human nature, the more we learn about the profundity of Jesus’ teachings. We then propose a number of ways in which Jesus-centred ethical leadership can be practised. Each is radical and each implies risk: both the personal risk of inner renewal arising from repentance as a doorway to personal integrity, as well as the risk of opposing unethical practices and promoting the excellence of core practices in the workplace. The Magic of Unknowing is a unique philosophical and literary work. Cast in the dialogue form, it unfolds in the mood of soliloquy. Mervyn Sprung has created an imaginative meeting of the minds of great western philosophers: Aristotle, Descartes, Kant, Hume, Nietzsche, Wittgenstein and Pyrrho. Selective scientific realists disagree on which theoretical posits should be regarded as essential to the empirical success of a scientific theory. A satisfactory account of essentialness will show that the (approximate) truth of the selected posits adequately explains the success of the theory. Therefore, (a) the essential elements must be discernible prospectively; (b) there cannot be a priori criteria regarding which type of posit is essential; and (c) the overall success of a theory, or ‘cluster’ of propositions, not only individual (...) derivations, should be explicable. Given these desiderata, I propose a “unification criterion” for identifying essential elements. (shrink)

Shows that the very same asymmetries that arise for intentionally also arise from deciding, desiring, in favor of, opposed to, and advocating. It seems that the phenomenon is not due to anything about the concept of intentional action in particular. Rather, the effects observed for the concept of intentional action should be regarded as just one manifestation of the pervasive impact of moral judgment.

To understand the impacts of development on native peoples requires an understanding of how their genetic make-up is implicated in their relationship with their landscapes. This is an area ripe for more research. The ASLME project on DNA Fingerprinting and Civil Liberties proposed improvements to the ethical and legal safeguards for the collection and storage of DNA-derived genetic information. Native peoples have proposed a similar examination of the ethical and legal issues related to the collection and storage of their genetic (...) information obtained via family histories and genealogies. The present study of the manuscripts of the Knights arose out of the preparation of a text of the scholia for a forthcoming edition. The completion of a collation of all the manuscripts for the scholia seemed a suitable occasion for extending the inquiry and re-examining our manuscript tradition in both text and scholia, especially as the scholia in a manuscript, provided they come from the same source as the text, can often reveal facts that might escape an investigator who (...) confined himself to the text. The scholia are far greater in bulk than the text, and scribes are often less careful and so more self-revealing in scholia; so that both from the quantitative and qualitative points of view scholia are important for the student of the tradition. It is a natural thought that understanding language consists in possessing knowledge—to understand a word is to know what it means. It is also natural to suppose that this knowledge is propositional knowledge—to know what a word means is to know that it means such-and-such. Thus it is prima facie plausible to suppose that understanding a bit of language consists in possessing propositional knowledge of its meaning. I refer to this as the epistemic view of understanding language. The theoretical appeal (...) of this view for the philosophy of language is that it provides for an attractive account of the project of the theory of meaning. If understanding language consists in possessing propositional knowledge of the meanings of expressions, then a meaning theory amounts to a theory of what speakers know in virtue of understanding language. In this paper I argue that, despite its intuitive and theoretical appeal, the epistemic view is false. Propositional knowledge is not necessary for understanding language, not even tacit knowledge. Unlike knowledge, I argue, linguistic understanding does not fail in Gettier cases, does not require epistemic warrant and does not even require belief. The intuitions about knowledge that have been central to epistemology do not seem to hold for linguistic understanding. So unless epistemologists have been radically mistaken about what knowledge requires, knowledge is unnecessary for understanding language. (shrink)

We focus here on some familiar kinds of cases of conflict between friendship and morality, and, on the basis of our account of the nature of friendship, argue for the following two claims: first, that in some cases where we are led morally astray by virtue of a relationship that makes its own demands on us, the relationship in question is properly called a friendship; second, that relationships of this kind are valuable in their own right.

Distinguishing between ‘analytical’ or ‘orthodox’ and ‘dialectical’ readings of first-wave critical realism, this review essay engages critically with the former as exemplified in Critical Realism and the Social Sciences: Heterodox Elaborations, edited by Jon Frauley and Frank Pearce. It argues that the ‘orthodox’ reading is fixist and endist and that this is conducive to an ill-informed and unconstructive attitude of hostility to dialectical critical realism and the philosophy of meta-Reality that is at odds with the critical realist embrace and that (...) in turn helps to reproduce the stasis of the reading. If the dynamism that goes hand in hand with the method of immanent critique is embraced, however, the possibility of flourishing two-way constructive critical engagements among the moments of the system is opened up, leading to the invigoration of each and the whole. Notwithstanding limitations - indeed, partly in virtue of them -, Critical Realism and the Social Sciences provides a promising basis for the unfolding of that possibility. (shrink)
