This volume, consisting of a collection of papers by an impressive gallery of scholars, offers a plurality of perspectives on Spinoza. Each interpretation conflicts with some other; yet each illuminates some aspect of the subject. All the papers reflect the "tensions" and "conflicts" which make for (...) very exciting and rewarding reading. Context: The need to reinvigorate medical confidentiality protections is recognised as an important objective in building patient trust necessary for successful health outcomes. Little is known about patient understanding and expectations from medical confidentiality.Objective: To identify and describe patient views of medical confidentiality and to assess provisionally the range of these views.Design: Qualitative study using indepth, open ended face-to-face interviews.Setting: Southeastern Pennsylvania and southern New Jersey, USA.Participants: A total of 85 women interviewed at two clinical sites and three community/research centres.Main (...) outcome measures: Subjects’ understanding of medical confidentiality, beliefs about the handling of confidential information and concerns influencing disclosure of information to doctors.Results: The subjects defined medical confidentiality as the expectation that something done or said would be kept “private” but differed on what information was confidential and the basis and methods for protecting information. Some considered all medical information as confidential and thought confidentiality protections functioned to limit its circulation to medical uses and reimbursement needs. Others defined only sensitive or potentially stigmatising information as confidential. Many of these also defined medical confidentiality as a strict limit prohibiting information release, although some noted that specific permission or urgent need could override this limit.Conclusions: Patients share a basic understanding of confidentiality as protection of information, but some might have expectations that are likely not met by current practice nor anticipated by doctors. Doctors should recognise that patients might have their own medical confidentiality models. They should address divergences from current practice and provide support to those who face emotional or practical obstacles to self-revelation. (shrink)

One of the principal challenges to human survival will be for human beings, embedded in a plurality of cultural contexts, to engage with and learn from one another respectfully in the continuing task of creating a more liveable world. I argue here that theoretical psychology can contribute to setting some of the terms for this effort through the kind of conception it advances of the person as agent. I discuss broadly two philosophical perspectives toward human agency which have become prominent (...) in psychology in the last few decades, the humanistic and the hermeneutic. We consider the complex interactions between rape culture and epistemology. A central case study is the consideration of a deferential attitude about the epistemology of sexual assault testimony. According to the deferential attitude, individuals and institutions should decline to act on allegations of sexual assault unless and until they are proven in a formal setting, i.e., a criminal court. We attack this deference from several angles, including the pervasiveness of rape culture in the criminal justice system, the epistemology of testimony (...) and norms connecting knowledge and action, the harms of tacit idealizations away from important contextual factors, and a contextualist semantics for 'knows' ascriptions. In their book ‘Corporate Social Opportunity’, Grayson and Hodges maintain that ‘the driver for business success is entrepreneurialism, a competitive instinct and a willingness to look for innovation from non‐traditional areas such as those increasingly found within the corporate social responsibility agenda’. Such opportunities are described as ‘commercially viable activities which also advance environmental and social sustainability’. There are three dimensions to corporate social opportunity – innovation in products and services, serving unserved markets and building new business models. While small‐ (...) and medium‐sized enterprises have traditionally been presented as non‐entrepreneurial in this area, this paper demonstrates how SMEs can take advantage of the opportunities presented by CSR. Using data from 24 detailed case studies of UK SMEs from a range of sectors, the paper explores the numerous CSR opportunities that present themselves to SMEs, such as developing innovative products and services and exploiting niche markets. There are inevitable challenges for SMEs undertaking CSR, but by their very nature they have many characteristics that can aid the adoption of CSR; the paper explores these characteristics and how the utilisation of positive qualities will help SMEs make the most of CSOs. Integrating CSR into the core of a company is crucial to its success. Using the case studies to illustrate key points, the paper suggests how CSR can be built into a company's systems and become ‘just the way we do things’. There are a number of factors that characterise the CSO ‘mentality’ in an organisation, and Grayson and Hodges's book describes seven steps that will move a company in the direction of a ‘want to do’ CSO mentality. This paper adapts these steps for SMEs, and by transferring and building on knowledge from the 24 detailed case studies, it develops a ‘business opportunity’ model of CSR for SMEs. (shrink)

Norwegian health professionals, elderly people and family members experience ethical problems involving end-of-life decision making for elders in the context of the values of Norwegian society. This study used ethical inquiry and qualitative methodology to conduct and analyze interviews carried out with 25 health professionals, six elderly people and five family members about the ethical problems they encountered in end-of-life decision making in Norway. All three participant groups experienced ethical problems involving the adequacy of health care for elderly Norwegians. Older (...) people were concerned about being a burden to their families at the end of their life. However, health professionals wished to protect families from the burden of difficult decisions regarding health care for elderly parents at the end of life. Strategies are suggested for dialogue about end-of-life decisions and the integration of palliative care approaches into health care services for frail elderly people. (shrink)

Is "living together" in a marriage-like relationship compatible with the feminist ideal of individual self-development? Paradoxically, while the structure and social-historical context of marriage-like relationships seems in fundamental conflict with the goal of autonomous self-development, the development of individuality also seems to be better fostered by living with a significant other in a committed relationship than by living alone. This paradox is resolved through the suggestion of a three-stage account of self-development: inauthenticity, autonomous being oneself, and autonomous being with others. (...) At the third stage, living together in a marriage-like relationship is one social format in which autonomous relating to others is possible. “Talking Back to Frida: Houses of Emotional Mestizaje” is, in part, a historical meditation on the silencing of three women, Frida Kahlo, Maria Enríquez, a Mexican woman who was sexually assaulted in 1924, and me. Written in an innovative historical fashion that joins techniques drawn from fiction, journalism, and history, the article attempts to understand specific assaults on women’s voices by drawing readers into the historical worlds of the protagonists. “Talking Back” also seeks to respond to Hans Kellner’s incisive theoretical (...) challenge: how do historians’ person histories affect their historical choices? The article’s organization depends on my understanding of language, color, and physicality, as the emotional architecture of the Deep Southern and Mexican places tend to both enclose and partially free the protagonists. The essay begins by leading the reader into my own past in the Deep South, a past where German Jewish and Russian Jewish relatives engaged in a cultural battle over form, personal style, and will. Confronting a German Jewish world where only things—never feelings—seemed to matter, I found solace in the friendship of a black servant. That friendship, in turn, helped prompt a particularly empathic historical voice. The southern section is followed by a journey into Frida Kahlo’s Mexican world. In that world, Kahlo’s severe physical pain and solitude construct inner and outer universes. The people who populate these worlds are friends, lovers, husband, and the Mexican poor. Kahlo’s artistic renditions of these people reflect, the article suggests, both the depth of her love for them and a tendency to use them in response to her despair. Finally, “Talking Back” reconstructs the world of María Enríquez, a Michoacán peasant woman assaulted in public by her former boyfriend. Abandoned by friend, sister, and Catholic women on the way to church, Enríquez develops a voice laced with generosity, cultural insight, and a rare self-possession. (shrink)

The United States, unlike most developed countries, continues to use the marital couple as the taxable unit for its income tax. This continued use of the marital unit— like its original establishment —rests on cultural preferences. This Article suggests that the roles of marriage, religion and taxation in America are essential factors in America’s retention of the marital unit. Part I examines the distinctive contribution marriage — especially the traditional single-earner breadwinner marriage — makes to the political life of the (...) country. Part II explores the similar role of religion. Part III describes some congressional efforts over the past two decades to aid, ostensibly, married couples through the income tax. Part IV concludes that although these actions have not been the most effective or efficient means of helping married couples, they nevertheless serve an important expressive purpose. Tax has been the arena for many political issues since the founding of the nation. Consequently, congressional actions and rhetoric regarding the income tax’s "marriage penalty" reinforce the marital unit/joint return and reaffirm — even if only symbolically — a national commitment to marriage as instrumental to American democracy. Further, I argue that other areas of identity theory are ultimately dependent upon this first area. No theory of how, two, a "thing" is individuated ; of how, three, a "thing"; is identically the same as another "thing"; or of how, four, a "thing" is the same thing over time or through change, can possibly be adequate unless it first tackles the question of what the "thing" in question is or may be. ;In this dissertation, I have attempted to exlore (...) the range of theoretical responses to each of the four groups of questions, ; to show the roots of the inadequacies of these responses in Aristotelian essentialism and in Locke's notion of identity as rooted in "beginnings"; and, finally, to present Buchler's concept of identity in order to show both that it is grounded in an adequate metaphysics and that the conception of identity he offers, grounded in the categories he employs, provides a perfectly adequate conceptual tool for the analysis of all four areas which should be covered by an identity theory. In my final chapter I undertake to perform such an analysis and thus to develop a Buchlerian theory of identity. ;I argue throughout the dissertation, that one cannot offer satisfactory theoretical clarification of what I take to be the first and most general sense of identity, involving "picking-out" or "naming," unless one has an adequate notion of the "things" being "picked-out" . Such an adequate notion of "thing" is available only in a general metaphysical theory which must itself be adequate. ;In this dissertation I broadly examine contemporary literature on identity and find considerable difficulty with various attempts to resolve a range of identity problems. I then undertake an exploration of the roots of these difficulties in the classic Aristotelian discussions and in the classic modern formulation of John Locke. Finally, through an analysis of the metaphysics of Justus Buchler, I suggest that the development of a Buchlerian discussion of identity provides both adequate categorial clarification of the concept of identity and directions for the pursuit of fruitful resolutions to specific identity problems. Marsilio Ficino commended his translation of the Phaedrus to his soul mate Iohannes Bessarion because in that dialogue Plato sought from God spiritual beauty. "When this gold was given to Plato by (...) God, it shone in him most brilliantly, because he was so pure in heart." The epithet "pure in heart" is not literally Ficino's diction: he wrote "in his Platonic bosom perfectly clean" (Platonico in sinu utpote mundissimo). 1 Although this philological variant insinuates his full meaning, the modern translation conveys his essential import. Ficino and Bessarion were both scholars and priests, convinced of the compatibility of Platonism with Christianity. The recipient of the letter, Bessarion, had defended the Phaedrusvigorously against protestations that, for promoting the criminal activity of pederasty, it was an obscene work of unchaste philosophy. "Love," he declared, "leads many to beatitude." 2 Ficino emphasized that "no one can attain beatitude, which consists in divine contemplation, unless he loves God ardently." 3 To that end he translated the complete works of Plato into Latin with commentaries. He also composed a speculative Theologia platonica. The pair would have approved of the application to Plato of the gospel promise "Blessed are the pure of heart [hoi katharoi t¯e kardia], for they shall see God" (Matt. 5:8). Was this promise not already fulfilled in Plato, even before Jesus' pronouncement? Did not Socrates in the Phaedrus soar to the vision of God in his myth of the charioteer, where among privileged souls he peered over the rim of intelligible being to behold the divine processional and true being? The [End Page 41] myth figured the recollection of the soul's primordial state of innocence, "when we were pure ourselves," and, beholding "the beatific vision," were initiated into its "most blessed" mystery. 4 Bessarion cited the passage defensively, declaring Socrates' speech "most holy." 5The beatitudes, from which "pure of heart" derived, emphatically comprised the opening discourse of Jesus' Sermon on the Mount. Jesus blessed the poor in spirit, the mourners, the meek, those hungry and thirsty for righteousness, the merciful, the pure of heart, the peacemakers, and those persecuted for righteousness. He pronounced a corresponding good for each type (Matt. 5:1-10). The first four beatitudes promised reversals for the unfortunate; the second four, eschatological rewards for the virtuous. 6 Ficino personalized the beatitudes. He applied them in a letter to an archbishop to his own contrasting status as a priest "of humble fortune." Indicating his slight financial means, he affirmed obedience to his lot, even contentment with his meager possessions. He then wielded the divine reversal of human judgment, so startling in the beatitudes, against his enemies. "I am certainly content with few possessions, even though I am often held in contempt by many; for these many ought to be deemed of little worth. Blessed are the poor in spirit. Blessed are the peacemakers." 7Ficino also philosophized the beatitudes. He argued in Theologia platonica that, although the celestial realm was usually considered fiery, it could be earthy, as poets imagined the Elysian Fields. Jesus' beatitude promising the possession of the earth to the meek was proof. Ficino expounded the nine grades of celestial beatitude as a belief shared by Platonists and Christians. He assigned these grades to varying degrees and combinations of three ends: the fear of divine power, the search for wisdom, and the love of good, which ultimately transformed the soul. This elaborate division Ficino compared to Jesus' beatitudes. "I think that this mystery is signified in the gospel, where the divine oracle nine times calls his disciples blessed, because through nine grades of merit, with God leading, the nine heavens are sought blessedly through nine degrees of contemplation." Reviews the book Time and psychological explanation by Brent D. Slife . In this book Prof. Slife has taken on the task of showing how the Western conception of time is a construct whose use in psychology is in need of just such a review. The object of Slife's critique is the modern Western tradition which takes time to be an objective and linear entity. This perspective, of course, derives from the work and thinking of Sir Isaac Newton, and it (...) is an orientation which has been fundamental to the development of Western science and culture since the period of the Enlightenment. Prof. Slife argues that the Newtonian time paradigm rests on five somewhat overlapping conceptual elements which are basic to traditional scientific explanation. These are the notions of "objectivity," "continuity," "linearity," "universality," and "reductionism." Some of these characteristics can be seen to be features of the way Newton envisioned time itself and some are aspects of events to be accounted for, because they exist in absolute time. In sum Prof. Slife has made a philosophically literate case for the need to analyze the limiting effects of Newtonian notions of time on psychology's theory and practice. 2012 APA, all rights reserved). The partial aim of this paper is to suggest that Merleau-Ponty’s ontology is prefigured in Schelling’s conception of God as presented in Ages of the World. This will specifically be demonstrated by explicating the parallels between Merleau-Ponty’s paradoxical notion of the flesh and Schelling’s equally complex idea of Ungrund. Understanding the significance of Schelling’s influence on Merleau-Ponty becomes pivotal upon the recognition that the contemporary French political philosopher Claude Lefort’s idea of the political instituting politics is directly linked to Merleau-Ponty’s (...) ontology of the invisible and visible. The implication here involves the suggestion that Lefort’s conception of the political parallels Schelling’s conception of God as mediated by Merleau-Ponty. It is then suggested that the political form of modernity should be understood less as the emergence of a novel form and conceived of more as an originary dimension where the theological and the political become indistinguishable. This essay attempts to provide a historical account of Michael Oakeshott’s famous distinction between civil and enterprise association. As such, it demonstrates that Oakeshott’s political skepticism and his concomitant view of civil association can in part be explained by his reliance on Augustinian theology. In a similar vein, Oakeshott’s linkage of enterprise association with the rationalism of Bacon must be considered in terms of Oakeshott’s understanding of Pelagianism and Gnosticism. Unsurprisingly, it will be demonstrated that despite Oakeshott’s disagreements with the (...) political philosopher Eric Voegelin, he was very impressed by Voegelin’s work on the Gnostic origins of modernity. Consequently, a major claim of this essay is that Oakeshott’s speculative understanding of modern political thought constitutes a theological genealogy of political modernity in all but name. We propose that the prevalent moral aversion to AWS is supported by a pair of compelling objections. First, we argue that even a sophisticated robot is not the kind of thing that is capable of replicating human moral judgment. This conclusion follows if human moral judgment is not codifiable, i.e., it cannot be captured by a list of rules. Moral judgment requires either the ability to engage in wide reflective equilibrium, the ability to perceive certain facts as moral considerations, moral (...) imagination, or the ability to have moral experiences with a particular phenomenological character. Robots cannot in principle possess these abilities, so robots cannot in principle replicate human moral judgment. If robots cannot in principle replicate human moral judgment then it is morally problematic to deploy AWS with that aim in mind. Second, we then argue that even if it is possible for a sufficiently sophisticated robot to make ‘moral decisions’ that are extensionally indistinguishable from (or better than) human moral decisions, these ‘decisions’ could not be made for the right reasons. This means that the ‘moral decisions’ made by AWS are bound to be morally deficient in at least one respect even if they are extensionally indistinguishable from human ones. Our objections to AWS support the prevalent aversion to the employment of AWS in war. They also enjoy several significant advantages over the most common objections to AWS in the literature. (shrink)
