Debates on the moral status of human embryos have been highly and continuously controversial. For many, these controversies have turned into a fruitless scholastical endeavor. However, recent developments and insights in cellular biology have cast further doubt on one of the core points of dissent: the argument from potentiality. In this article we want to show in a nonscholastical way why this argument cannot possibly survive. Getting once more into the intricacies of status debates is a must in our eyes. (...) ZusammenfassungDie Odysseus-Verfügung ist als besondere Form der Patientenverfügung zumindest in der Literatur hinlänglich bekannt. Die Verwendung des Begriffs und damit sein Gegenstandsbereich sind hingegen noch immer umstritten. Zudem wird oft nicht beachtet, dass es innerhalb dieses Gegenstandsbereichs Varianten von OVs zu differenzieren gilt, die sich auch in ihrer moralischen Rechtfertigung unterscheiden. Nicht zuletzt ist die Grundstrukturstruktur dieser Rechtfertigung umstritten. Vor diesem Hintergrund plädieren wir im Folgenden zunächst für eine Eingrenzung des Begriffs, mit der argumentative und klinisch-praktische Verwirrungen vermieden werden können. (...) Anschließend betrachten wir zwei Varianten von – Zwang legitimierenden – OVs, die sich in der individuellen Kompetenz des Destinatärs unterscheiden. Schließlich zeigen wir, dass deren Rechtfertigung ungeachtet des Umstandes, dass OVs auf Wiedererlangung der Urteils- und Steuerungsfähigkeit des Patienten angelegt sind, weder in einer gemutmaßten noch gar in einer faktischen retrospektiven Billigung von Zwang durch den Patienten liegt. Die primäre Legitimationsgrundlage von OVs besteht vielmehr in der ex ante erfolgenden Autorisierung durch den Betroffenen selbst. Die hier einzuräumende Autorität wiederum basiert auf dem Recht jeder Person auf lebensplanerische Selbstbestimmung. El artículo recorre la obra de Rodolfo Kusch posicionando sus principales propuestas en la construcción de tres enfoques convergentes en su filosofía. El primer enfoque está relacionado con la fenomenología y la cultura. El segundo enfoque se refiere a la influencia de la antropología y el cuestionamiento por el símbolo. El tercer enfoque despliega una aproximación filosófico-política. Estos enfoques permiten introducir tres “horizontes de pregunta” principalmente relacionados con el método, con lo popular y con lo indígena, que son expuestos como (...) asuntos centrales en toda su obra. Estos “horizontes de pregunta” buscan comprender los alcances de la filosofía de Kusch y su contribución al pensamiento filosófico americano. This paper analyses the work of Rodolfo Kusch remarking his main philosophical proposals through three correlated perspectives. The first perspective refers to phenomenology and culture. The second focuses on the influence of anthropology and the problem of symbols. The third posits a political-philosophical approximation. These perspectives operate interdependently as the background for Kusch’s philosophy and allow us to introduce three “questioning horizons” related to the method, the popular and the indigenous as the central issues of his philosophical work. Thus, these “questioning horizons” build a platform to understand Kusch’s philosophy and his contribution to the Latin American philosophy. (shrink)

In everyday situations, and particularly in some sport and working contexts, humans face an inherently unpredictable and uncertain environment. All sorts of unpredictable and unexpected things happen but typically people are able to skillfully adapt. In this paper, we address two key questions in cognitive science. First, how is an agent able to bring its previously learned skill to bear on a novel situation? Second, how can an agent be both sensitive to the particularity of a given situation, while remaining (...) flexibly poised for many other possibilities for action? We will argue that both the sensitivity to novel situations and the sensitivity to a multiplicity of action possibilities are enabled by the property of skilled agency that we will call metastable attunement. We characterize a skilled agent’s flexible interactions with a dynamically changing environment in terms of metastable dynamics in agent-environment systems. What we find in metastability is the realization of two competing tendencies: the tendency of the agent to express their intrinsic dynamics and the tendency to search for new possibilities. Metastably attuned agents are ready to engage with a multiplicity of affordances, allowing for a balance between stability and flexibility. On the one hand, agents are able to exploit affordances they are attuned to, while at the same time being ready to flexibly explore for other affordances. Metastable attunement allows agents to smoothly transition between these possible configurations so as to adapt their behaviour to what the particular situation requires. We go on to describe the role metastability plays in learning of new skills, and in skilful behaviour more generally. Finally, drawing upon work in art, architecture and sports science, we develop a number of perspectives on how to investigate metastable attunement in real life situations. (shrink)

In an enlightening dialogue with Descartes, Kant, Husserl and Gadamer, Professor Seifert argues that the original inspiration of phenomenology was nothing other than the primordial insight of philosophy itself, the foundation of philosophia perennis. His radical rethinking of the phenomenological method results in a universal, objectivist philosophy in direct continuity with Plato, Aristotle and Augustine. In order to validate the classical claim to know autonomous being, the author defends Husserl's methodological principle "Back to things themselves" from empiricist and idealist (...) critics, including the later Husserl, and replies to the arguments of Kant which attempt to discredit the knowability of things in themselves. Originally published in 1982, this book culminates in a phenomenological and critical unfolding of the Augustinian cogito, as giving access to immutable truth about necessary essences and the real existence of personal being. Neste artigo, propõe-se uma leitura das categorias no tratado aristotélico homônimo como um primeiro esboço de uma ontologia regional, centrada nas substâncias sensíveis. Tendo por foco substância, quantidade, qualidade, relativo, agir e sofrer, este trabalho busca expor as duas estratégias principais que Aristóteles parece empregar para chegar a uma lista das categorias: (a) características básicas, cuja satisfação ou não satisfação de cada uma determina a natureza categorial de cada item e (b) a propriedade única que caracteriza cada categoria em contraste (...) com todas as outras. São, então, feitas considerações para vincular esse primeiro esboço ontológico a temas discutidos nos livros Lambda e Zeta da Metafísica, de modo a sugerir as direções principais que a sua ontologia nova (e geral) seguirá ao evoluir para uma teoria unificada da substância. Using an enactive approach to trail runners’ activity, this study sought to identify and characterize runners’ phenomenological gestalts, which are forms of experience that synthesize the heterogeneous sensorimotor, cognitive and emotional information that emerges in race situations. By an in-depth examination of their meaningful experiences, we were able to highlight the different typologies of interactions between bodily processes (e.g., sensations, pains), behaviors (e.g., actions, strategies) and environment (e.g., meteorological conditions, route profile). Ten non-professional runners who ran an ultra-trail running race (...) (330 kilometers, 24,000 meters of elevation gain) volunteered to participate in the study. Data were collected in two steps: (1) collection of past activity traces (i.e., race maps, field notes and self-assessment scales) and (2) enactive interviews using the past activity traces in which the runners were invited to relive their experience and describe their activity. The enactive interviews were coded using the course-of-experience methodology to identify the phenomenological gestalts that emerged from activity and scaffolded the runners’ courses of experience. The results revealed that runners typically enact three phenomenological gestalts: controlling global ease, enduring general fatigue and experiencing difficult situations, and feeling freedom in the running pace. These phenomenological gestalts were made up of specific behaviors, involvements and meaningful situated elements that portrayed various ways of achieving an ultra-endurance performance in the race situation. They also highlighted how runners enact a meaningful world by acting in relation to the fluctuations in physical sensations and environmental conditions during an ultra-trail race. Practical applications for preparation, race management and sports psychology interventions are proposed to enrich the existing recommendations. In conclusion, this approach provides new research perspectives by offering a more holistic grasp of activity in trail running through an in-depth analysis of athletes’ experience. In doing so, we may expect that runners can connect these typical gestalts to their own personal experiences and stories as trail runners in order to sustain a viable approach to their sport. Whether or not quantum physics can account for molecular structure is a matter of considerable controversy. Three of the problems raised in this regard are the problems of molecular structure. We argue that these problems are just special cases of the measurement problem of quantum mechanics: insofar as the measurement problem is solved, the problems of molecular structure are resolved as well. In addition, we explore one consequence of our argument: that claims about the reduction or emergence of molecular structure (...) cannot be settled independently of the choice of a particular resolution to the measurement problem. Specifically, we consider how three standard putative solutions to the measurement problem inform our under- standing of a molecule in isolation, as well as of chemistry’s relation to quantum physics. This study aims to examine the perceptions of Black, Asian and Minority Ethnic staff in English local government on the ethical nature of their treatment at work, and its mediating effect on their Public Service Motivation. This is a particular imperative in a sector which itself delivers social justice within a strong regulatory system designed to ensure workplace equality and therefore is expected to be a model employer for other organisations. Employees place great importance on their fair treatment by their (...) employers and, in particular, the endeavour of managerial authority to implement equality at work based on their discretionary powers. 2580 valid responses were collected from 15,000 questionnaires sent to staff in five local councils in England. Our analyses show that BAME employees have a significantly stronger PSM than their white colleagues; however, this has been eroded by their perception of unfair treatment: being underpaid allied with a lack of effort from management to ensure an equal work environment, to be specific, to prevent discrimination, bullying, and racism at workplace. Most importantly, the perceived exertion made by management to ensure an equal work environment has a significantly strong mediating effect on PSM and a compensational effect on perceived lower pay. Part of this process will be carried out with the discussion of communicative action, as a space for dialogue between people seeking understanding. The process of new forms of understanding and construction of knowledge is possible through the integrative structure of the lifeworld, such as semantic dimension, social space, and historical time. However, there is the other side, the (...) Systems, where the manifestations of crisis and disturbances, the pathologies of society, which in cultural reproduction appear as a loss of meaning of culture, loss of legitimacy of society and in personality, there is a crisis of belonging. The Oscar Wilde trials (1895) have usually been interpreted either as a historical document which gives insight into the regulation of sexuality in the late nineteenth century, or as literary biography explicating the playwright's life and works. Taking its cue from recent scholarship in ‘law and literature’, and also from Wilde's own conception of the relationship between art and life, this article proposes a reading of the trials which blurs the distinction between legal history and literary criticism by considering them (...) as a form of literature. It argues that the trial transcripts enact and reflect Wilde's vision of what literature is and how it should be read, and as such should be given a place amongst his literary works, alongside such aesthetic manifestos as ‘The Decay of Lying’ and ‘The Critic as Artist’. A spatial logic is a formal language interpreted over any class of structures featuring geometrical entities and relations, broadly construed. In the past decade, spatial logics have attracted much attention in response to developments in such diverse fields as Artificial Intelligence, Database Theory, Physics, and Philosophy. The aim of this handbook is to create, for the first time, a systematic account of the field of spatial logic. The book comprises a general introduction, followed by fourteen chapters by invited authors. Each (...) chapter provides a self-contained overview of its topic, describing the principal results obtained to date, explaining the methods used to obtain them, and listing the most important open problems. AbstractDeveloped from meaningful work and business ethics, we investigate the motivational effect of meaningful work on paid staff (not volunteers) with a “shortage” of ethical employment practices situated in the Not-for-Profit sector. We tested the traditional notion of meaningful work by nature and by line manager support (under its business-like practices) to compensate for the “sacrifice” (low pay and job stress caused by poor employment terms) of front line staff working alongside professional managers paid the market rate. Using a mixed-method (...) case study, we employed SEM modelling to analyse a staff survey of 125 valid responses and administrative records of staff resignation, alongside interviews. The results show that meaningful work by nature and by line manager support are positively and significantly associated with job satisfaction but neither has a significant effect on staff resignation action. There is no empirical evidence to support the compensating effect of meaningful work by nature; meaningful work by line manager support has a stronger effect only through reduced job stress, rather than compensating for the low pay, in preventing resignation. The qualitative analysis reveals that continued low pay and using precarious employment contracts have evoked the questioning of ethics of employment practices in this sector. We discuss the implications and suggest further areas of research. (shrink)

This study investigates financial correlates of corporate philanthropy in Fortune 1000 companies using structural equation modeling. The results suggest that cash flow (one of the most discretionary types of organizational slack) has a significant impact on a firm’s cash donations to charitable causes, but monetary donations do not affect firm financial performance. These findings support the accepted view of corporate philanthropy as a discretionary social responsibility and the traditional thinking about firm giving in the business and society literature—that doing well (...) enables doing good. Contrary to some contemporary thinking, the findings imply no significant effect on profits from corporate generosity. (shrink)

This paper discusses how to define logics as deductive limits of sequences of other logics. The case of da Costa's hierarchy of increasingly weaker paraconsistent calculi, known as $ \mathcal {C}$n, 1 $ \leq$ n $ \leq$ $ \omega$, is carefully studied. The calculus $ \mathcal {C}$$\scriptstyle \omega$, in particular, constitutes no more than a lower deductive bound to this hierarchy and differs considerably from its companions. A long standing problem in the literature (open for more than 35 years) is (...) to define the deductive limit to this hierarchy, that is, its greatest lower deductive bound. The calculus $ \mathcal {C}$min, stronger than $ \mathcal {C}$$\scriptstyle \omega$, is first presented as a step toward this limit. As an alternative to the bivaluation semantics of $ \mathcal {C}$min presented thereupon, possible-translations semantics are then introduced and suggested as the standard technique both to give this calculus a more reasonable semantics and to derive some interesting properties about it. Possible-translations semantics are then used to provide both a semantics and a decision procedure for $ \mathcal {C}$Lim, the real deductive limit of da Costa's hierarchy. Possible-translations semantics also make it possible to characterize a precise sense of duality: as an example, $ \mathcal {D}$min is proposed as the dual to $ \mathcal {C}$min. (shrink)

Due to the increasingly heterogeneous trajectories of aging, gerontology requires theoretical models and empirical methods that can meaningfully, reliably, and precisely describe, explain, and predict causes and effects within the aging process, considering particular contexts and situations. Human behavior occurs in contexts; nevertheless, situational changes are often neglected in context-based behavior research. This article follows the tradition of environmental gerontology research based on Lawton’s Person-Environment-Interaction model and the theoretical developments of recent years. The authors discuss that, despite an explicit time (...) component, current P-E models could be strengthened by focusing on detecting P-E interactions in various everyday situations. Enhancing Lawton’s original formula via a situationally based component not only changes the theoretical perspectives on the interplay between person and environment but also demands new data collection approaches in empirical environmental research. Those approaches are discussed through the example of collecting mobile data with smartphones. Future research should include the situational dimension to investigate the complex nature of person environment interactions. (shrink)

We prove that the category of Nachbin’s compact ordered spaces and order-preserving continuous maps between them is dually equivalent to a variety of algebras, with operations of at most countable arity. Furthermore, we observe that the countable bound on the arity is the best possible: the category of compact ordered spaces is not dually equivalent to any variety of finitary algebras. Indeed, the following stronger results hold: the category of compact ordered spaces is not dually equivalent to any finitely accessible (...) category, any first-order definable class of structures, and any class of finitary algebras closed under products and subalgebras. An explicit equational axiomatisation of the dual of the category of compact ordered spaces is obtained; in fact, we provide a finite one, meaning that our description uses only finitely many function symbols and finitely many equational axioms. Heterogeneity of Being goes beyond the standard interpretations of Octavio Paz as a thinker of national identity and proposes a radical rethinking of the relationship between literature and philosophy. Dorfsman analyzes how Paz’s “tradition of rupture” properly displays a continuity between self and other, identity and difference, time and space.

From the early 1840s on, Jeremy Bentham’s utilitarian doctrine aroused the joint interest of Marx and Engels, who saw the English philosopher as one of the forerunners of socialism. Later, however, in the various editions (German, French, English) of Book 1 of Capital (1867/90), Bentham would be sarcastically branded by Marx as a “genius of bourgeois stupidity”. In their youth, both Engels and Marx had independently become interested in Bentham’s ideas, admiring some social-ethical themes, seen as heralding interesting developments for (...) the cause of the proletariat. On Engels’s suggestion, Marx included Bentham’s name, alongside those of the major 18th–19th century English and French exponents of protosocialism, in a planned Library of the most outstanding foreign socialist writers (1845), which however remained only a draft. From his first stay in England (1842/44), the young Engels had embraced in particular the famous utilitarian principle of “the greatest happiness of the greatest number” advocated by Bentham. Marx, on the other hand, after initially praising Bentham’s work, which he had read in a French translation during his exile in Paris (1844), harshly criticized the ambiguous implications of this principle. In fact, he believed thatbehind a misleading progressive façade, it constituted the philosophical equivalent of the later economic theory of labour productivity propounded by D. Ricardo in opposition to the theory of its mere quantitative extension put forward by A. Smith. In the London Manuscripts (1861/63) Marx will reveal the affinity betweenBentham’s principle of the happpiness of the greatest number of people, and Ricardo’s assumption of the ineliminable misery of the minority condemned to productive labour. Based on the collection of Marx’s and Engels’s texts (letters, drafts, notebooks, manuscripts, printed works), made available today thanks to the critical edition by MEGA1, this paper sets out to re-examine, im großen und ganzen, the main moments in their critique of Bentham’s Utilitarianism. Interest in _dream_ and _madness_, conceived as the loss of a world shared with others, and the individual’s entry into a private world governed by a personal logic unrelated to the waking state and to common feeling, recurs in at least three of Kant’s works: _Essay on the Diseases of the Head,_ (1764), _Dreams of a Spirit-Seer_ (1766), and _Anthropology from a Pragmatic Point of View_ (1798). Hegel too, from an early age, showed a strong fascination and a precocious interest (...) in psychopathological matters (states of altered consciousness, prophetic dreams, somnambulism, catalepsy, witchcraft etc.) to which he devoted intriguing reflections in various works from different periods: from the Berne Ms _Philosophy of Subjective Spirit_ (1794/95) to the _Phenomenology _(1807), from the _Philosophical __Propaedeutics_ (1808ff.) to the _Encyclopedia of the Philosophical Sciences_ (1830 3 ). Starting from the remarks of the two philosophers, this paper aims to underline the conceptual links between their thought and that of some renowned psychologists and psychiatrists of the 1800s-1900s (Pinel, Janet, Adler, James, Binswanger, Freud et al.). On the other hand, the paper also seeks to show – within the framework of an idea of _reason_ dating back to Heraclitus (about 544/483 B.C.) – some murky motifs, not always adequately emphasized in the past, found in the figurative and literary works of the late 1700s (e.g. Fuseli’s_ The Nightmare_, Coleridge’s _The Rhyme of the Ancient Mariner_, and, in particular, plate Nr. 43 of the _Caprichos _by Goya, _El sueño de la razón produce monstruos_), where there emerges a «dark side» of psychic activity emblematically described as the cryptic relationship between _dream_ and_ madness._.
