Bank customers are not financial experts, and yet they make high-stakes decisions that can substantively affect personal wealth. Sooner or later, every individual has to take relevant investment decisions. Using data collected from financial advisors, bank customers and university students in Italy, this paper aims to reveal new insights about the decision processes of average non-expert investors: their investment goals, the information sets they consider, and the factors that ultimately influence decisions about investment products. Using four portfolio choice tasks based (...) on data collected directly from financial advisors and their clients, we find that most subjects used a limited set of information, ignoring factors that conventional economic models usually assume drive investor behavior. Furthermore, we suggest that non-compensatory decision-tree models, which make no trade-offs among investment features, are parsimonious descriptions of investor behavior useful for improving the organization of financial institutions and in policy contexts alike. Recent crises in Europe and beyond have renewed a longstanding debate on the status and treatment of refugees. Hannah Arendt famously questioned the limits of universalistic human rights discourse based on the widespread phenomena of statelessness and displacement that emerged during and after World War II. In this paper, we analyze recent patterns of inclusion and exclusion of refugees in Italy through the lens of Arendtian narrative and theorizing. We consider three cases of interaction between families, schools, and other public (...) institutions in light of the shifting normative framework before and during the war in Ukraine. Two major insights emerge from this analysis. From a pedagogical point of view, the most promising educational practices with refugees are those centered on enabling their agency and corresponding experiences of "natality". From an ethical-political perspective, these practices highlight a latent tension between the universalistic scope of human rights enshrined in the human rights declarations and their structural dependence on the particular norms and procedures enacted by nation states. The understanding and teaching of human rights within our political communities is inseparable from the practices that engage with refugees. In this sense, our practices of inclusion and exclusion affect the understanding of national borders as a barrier or threshold with other political communities, but also the interpretation of our own ethical-political principles. Workplace spirituality research has sidestepped religion by focusing on the function of belief rather than its substance. Although establishing a unified foundation for research, the functional approach cannot shed light on issues of workplace pluralism, individual or institutional faith-work integration, or the institutional roles of religion in economic activity. To remedy this, we revisit definitions of spirituality and argue for the place of a belief-based approach to workplace religion. Additionally, we describe the construction of a 15-item measure of workplace religion (...) informed by Judaism and Christianity – the Faith at Work Scale (FWS). A stratified random sample (n = 234) of managers and professionals assisted in refining the FWS which exhibits a single factor structure (Eigenvalue = 8.88; variance accounted for = 59.22%) that is internally consistent (Cronbach’s α = 0.77) and demonstrates convergent validity with the Faith Maturity Scale (r = 0.81, p > 0.0001). The scale shows lower skew and kurtosis with Mainline and Catholic adherents than with Mormons and Evangelicals. Validation of the scale among Jewish and diverse Christian adherants would extend research in workplace religion. (shrink)

Large Language Models (LLMs) are generative AI systems capable of producing original texts based on inputs about topic and style provided in the form of prompts or questions. The introduction of the outputs of these systems into human discursive practices poses unprecedented moral and political questions. The article articulates an analysis of the moral status of these systems and their interactions with human interlocutors based on the Habermasian theory of communicative action. The analysis explores, among other things, Habermas's inquiries into (...) the analogy between human minds and computers, and into the status of atypical participants in the linguistic community such as genetically modified subjects and animals. Major conclusions are the LLMs seem to qualify as authors that originally participate in discursive practices but do display only a structurally derivative form of communicative competence and fail to meet the status of communicative agents. In this sense, while the contribution of AI writing systems in public discourse and deliberation can support the process of mutual understanding within the community of speakers, the human actors involved in the development, use, and diffusion of these systems share a collective responsibility for the disclosure of AI authorship and verification and adjudication of validity claims. This book discusses and provides insight on the legal and ethical dilemmas of managing those with Fetal Alcohol Spectrum Disorder (FASD). This book provides a clear perspective for those clinicians and legal professionals who are working with those with this disorder, and correspondingly increases their understanding when arranging effective supports for this population. Historically, the primary focus on FASD has been on children. However, this is a lifelong disorder, and the implications of this disorder become even more prominent and complex (...) in adulthood. Those with this condition can struggle with impulsiveness, and a host of cognitive difficulties. This correspondingly impacts their independence and employability, and produces an elevated risk for homelessness and other residential issues, involvement in substance use, being exploited, development of behavioural issues, and subsequent legal difficulties. Their cognitive difficulties result in challenges for legal systems around the world to understand their issues, and to design appropriate remedial strategies, recommendations for treatments and supports, and even for understanding the failure of many of these individuals to be able to change their behaviours effectively. This produces various legal and ethical dilemmas, which are discussed in detail in this volume by 28 authors from Europe, New Zealand, and North America. These include discussions regarding the rights of the unborn child, the alcohol industry's duty to warn, whether small amounts of alcohol during pregnancy can be condoned, and even the current use of involuntary hospitalization for addicted mothers. Other chapters discuss the need for training on FASD for front line officers, use of lies during interrogation of those with FASD, medical and legal interventions for offenders with FASD, access to diagnostic services and follow-up supports, and whether FASD can be considered a mitigating factor for sentencing. Furthermore, caregivers also provide their stories regarding the daily dilemmas that are faced in raising those with FASD. (shrink)

From Physical World to Transcendent God(s): Mediatory Functions of Beauty in Plato, Dante and Rupa Gosvami -/- Dragana Jagušić -/- In various philosophical, religious and mystical traditions, beauty is often related to intellectual upliftment and spiritual ascent, which suggests that besides its common aesthetic value it may also acquire an epistemic, metaphysical and spiritual meaning or value. I will examine in detail three accounts in which beauty, at times inseparable from desire and love, mediates between physical, intellectual and spiritual levels (...) of existence. Since beauty, in all three accounts, takes on a mediatory role or function,1 I will name these mediations as follows: ancient Greek Eros-mediation or Beauty-mediation (Plato: ca. 429-347 BCE), late medieval Italian Beauty and Love-mediation (Dante Alighieri: 1265-1321) and pre-modern Indian Beauty and Love-mediation (Rūpa Gosvāmi: 1470/90-1564 CE).2 In the first section, I will analyse the stages of Eros or Beauty mediation in Plato; in the second section, I will turn to Dante’s Beauty and Love-mediation and compare it with Plato’s account. In the third section, I will analyse Rūpa’s account of Beauty and Love-mediation in comparison with both Plato and Dante. I will argue that there are certain patterns of mediation mutually shared if not between all three accounts, then at least between two of them. While Plato’s account clearly influenced Dante and was well integrated into Dante’s account, there is no mention or evidence of a pre-modern Bengali theologian influenced by ancient Greek and medieval Italian philosophy and mysticism. However, a strong convergence of elements of Beauty-mediations in Plato and Dante, as well as Beauty and Love-mediations in Dante and Rūpa Gosvāmi, confirms the universality of certain features of Beauty and Love-mediation and speaks in support of an all-inclusive account of them.3 -/- 1 By Beauty-mediation I mean an aesthetic, intellectual or spiritual reconciliation between opposites, such as human and divine, mortal and immortal, particular and universal, sexual and sacred and so on. 2 Rūpa Gosvāmi was an Indian theologian. How do actors cope when their repeated efforts to bring change seem futile? In this qualitative study, we consider sustainable development initiatives within a U.S. higher education institution where repeated efforts by actors led to nominal change. We focus on understanding how actors sought to enact sustainable development initiatives in the face of an unresponsive context, that is, in a context characterized by pressures to maintain the status quo. We show how actors’ attempts to embed sustainable development practices into the (...) university represent a dynamic process, characterized by periods of persistence and suspension. Our theorizing reveals that actors used three coping mechanisms to maintain focus on their sustainability goals: community building, resourcefulness, and vision. By emphasizing these dimensions of their initiatives, actors’ emotional response is focused on encouragement and hope to persist in a context that is largely unresponsive to sustainable development. Our study contributes to the sustainability literature by explicating how actors develop resilience in their efforts to pursue sustainable development in unresponsive contexts. (shrink)

The classical theory of preference among monetary bets represents people as expected utility maximizers with concave utility functions. Critics of this account often rely on assumptions about preferences over wide ranges of total wealth. We derive a prediction of the theory that bears on bets at any fixed level of wealth, and test the prediction behaviorally. Our results are discrepant with the classical account. Competing theories are also examined in light of our data.

The Internet of Things (IoT) is a fast-growing technology that connects everyday devices to the Internet, enabling wireless, low-consumption and low-cost communication and data exchange. IoT has revolutionized the way devices interact with each other and the internet. The more devices become connected, the greater the risk of security breaches. There is currently a need for new approaches to algorithms that can detect malware regardless of the size of the network and that can adapt to dynamic changes in the network. (...) Through the use of a multi-agent reinforcement learning algorithm, this paper proposes a novel algorithm for malware detection in IoT devices. The proposed algorithm is not strongly dependent on the size of the IoT network due to the that its training is adapted using time differences if the IoT network size is small or Monte Carlo otherwise. To validate the proposed algorithm in an environment as close to reality as possible, we proposed a scenario based on a real IoT network, where we tested different malware propagation models. Different simulations varying the number of agents and nodes in the IoT network have been developed. The result of these simulations proves the efficiency and adaptability of the proposed algorithm in detecting malware, regardless of the malware propagation model. (shrink)

This article aims to introduce some features of the literary output of Gling-ras-pa Padma rdo-rje, who was the teacher of the ‘Brug-pa bKa’-brgyud-pa school’s founder, gTsan-pa rGya-ras Ye-shes rdo-rje in Tibet. The work that I draw upon here is titled A Torch of Crucial Points. A Condensation and Presentation of all Dharmas that are to be Practiced, a presentation of the entire outline of Buddhist practice that resembles the doctrinal stages literary genre. Based on an edition and translation of the (...) fifth chapter of the 17 that comprise the work, here I focus on several concepts, such as the three natures and the allground consciousness, that pertain to the system of Yogācāra and the terminology related to it. These are shown as they appear in the framework of the work, which is heavily influenced by the tradition of Mahāmudrā and the background of its author’s life as a wandering yogin in the lineage of Mi-la ras-pa. The Oscar Wilde trials (1895) have usually been interpreted either as a historical document which gives insight into the regulation of sexuality in the late nineteenth century, or as literary biography explicating the playwright's life and works. Taking its cue from recent scholarship in ‘law and literature’, and also from Wilde's own conception of the relationship between art and life, this article proposes a reading of the trials which blurs the distinction between legal history and literary criticism by considering them (...) as a form of literature. It argues that the trial transcripts enact and reflect Wilde's vision of what literature is and how it should be read, and as such should be given a place amongst his literary works, alongside such aesthetic manifestos as ‘The Decay of Lying’ and ‘The Critic as Artist’. This article brings together feminist literary theory and law by approaching a number of U.S. Federal cases on sex equality in light of the work of the renowned feminist literary critic Naomi Schor, and shows that literary theory constitutes an under-explored resource for feminist legal critique. Schor’s writings constitute a sustained rumination on the relationship between reading and feminism. Drawing on writings on language and the body by key French feminist theorists, Schor advances a method of interpretation which she terms, (...) provocatively, ‘clitoral reading’, and which focuses on the place of details relating to women’s bodies and desires within literary and cultural discourses. In the course of her career, she analysed texts from domains as diverse as literature, philosophy, visual art, the history of fashion, and photography. I will demonstrate that her work can make a valuable contribution to legal studies by using it as an interpretative lens to re-examine U.S. Federal court judgments. (shrink)

This article offers the results of emergy analysis used to evaluate four different soybean production systems in Brazil that were divided into two main categories: biological models (organic and ecological farms) and industrial models (green-revolution chemical farms and herbicide with no-tillage farms). The biological models show better environmental, economical, and social performance indicators; however, at the national level, discussion of transgenic soybean seed release considers only industrial models without any mention of biological models. Classic emergy analysis shows biological options are (...) the better alternatives but does not explain why decisions taken by farmers and government in Brazil were in opposition to these options. New research is proposed to identify and quantify the external forces that strongly interfere in the definition of public policy for soybean production. New parameters are proposed to enrich emergy methodology: Renewability of each input was considered in emergy calculations and negative externalities were included as additional services. (shrink)

The impression, from the vantage point of a psychotherapist, is that too many details are lacking from the account that is provided and that the case is hurriedly explained away invoking a naturalistic evolutionary model.The psychotherapeutic, as well as the clinical (Stanghellini 2007) and the research (Stanghellini and Ballerini 2008) interview is a quest for meaning. Its first concern is an accurate unfolding of subjective experiences and the organization of these experiences according to a pattern of sense that is immanent to the experiences themselves; the interpretation or the explanation of these experiences according to a model that is not immanent in the clinical material itself may come as a later step.The first step may be called the explication of case material. It consists in bringing out the raw feelings of the patient's experiences and the personal meanings that the patient attributes to his experiences. Helpless feeling caused by low self-confidence could turn an athlete using aggressive behavior as alternate behavior in the interaction with the opponent during a game. The level of the aggression can be seen in the injury rate in that particular sport. This research objective is to find out the relation between self-confidence and the appearance of the aggressive behavior in basketball player. It involves 64 athletes in West (...) Jakarta between 17 to 28 years old. Data that was measured by questionnaires has shown there is a negative association between self-confidence and aggressive behavior in basketball athlete.  . By promising, requesting and commanding we can give ourselves and each other reasons for acting as promised, requested, and commanded. Call this our capacity to give reasons robustly. According to the triggering account, we give reasons robustly simply by manipulating the factual circumstances in a way that triggers pre-existing reasons. Here I claim that we ought to reject the triggering account. By focusing on David Enoch’s sophisticated articulation of it, I argue that it is overinclusive; it cannot adequately distinguish between (...) threats and robust reason-giving; and it cannot adequately explain why epistemic reasons cannot be robustly given. In a recent paper, Daniel Whiting has argued that there are no exclusionary reasons (i.e., second-order reasons not to act for a reason). The premise of the argument is what he calls the motivation constraint, according to which for the fact that p to be a reason for you to ϕ, it must be possible for you to ϕ for the reason that p. However, the argument goes, it is not possible to act (or not to act) for a reason (...) for a reason. Therefore, he concludes, there are no second-order reasons. In this paper, I shall argue that Whiting's argument ought to be rejected. Thus, I will argue that we should not accept the motivation constraint on which it is based. It is true that for the fact that p to be a reason for you to ϕ, it must be possible for you to ϕ guided in the right way by the consideration that p favours you ϕing. However, I shall argue that it is possible for exclusionary reasons to guide us in the right way, even if it not possible for us to not to ϕ for a reason for a reason. (shrink)

Mark Greenberg argues that legal obligations are those moral obligations created by the actions of legal institutions in the legally proper way. Here I defend three main claims. First, I argue that, although very often misunderstood, Joseph Raz is also a defender of MITL. Secondly, I argue that while both Greenberg and Raz are committed to MITL, they disagree about the conditions under which a moral obligation can be said to be created in the legally proper way. Finally, I argue (...) that Raz’s variant of MITL is better than Greenberg’s. It rests on a more plausible account of authority and it avoids one of the crucial defects threatening Greenberg’s view, namely, its overinclusiveness. (shrink)

Terms of service of on-line platforms too often contain clauses that are potentially unfair to the consumer. We present an experimental study where machine learning is employed to automatically detect such potentially unfair clauses. Results show that the proposed system could provide a valuable tool for lawyers and consumers alike.

Business Ethics: A European Review, EarlyView.

According to the extended cognition thesis, an agent’s cognitive system can sometimes include extracerebral components amongst its physical constituents. Here, we show that such a view of cognition has an unjustifiably anthropocentric focus, for it tends to depict cognitive extensions as a human-only affair. In contrast, we will argue that if human cognition extends, then the cognition of many non-human animals extends too, for many non-human animals rely on the same cognition-extending strategies humans rely on. To substantiate this claim, we (...) will proceed as follows. First (Sect. 1), we will introduce the extended cognition thesis, exposing its anthropocentric bias. Then, we will show that humans and many non-human animals rely on the same cognition-extending strategies. To do so, we will discuss a variety of case studies, including “intrabodily” cognitive extensions such as the spinal cord (Sect. 2), the widespread reliance on epistemic actions to solve cognitive tasks (Sect. 3) and cases of animal cognitive offloading (Sect. 4). That article consists primarily of a lecture that Sartre had presented to La Société Française de Philosophie on 2 June 1947 in which he provided an overview of some of his main points in Being and Nothingness, with particular emphasis on its Introduction (especially its third section, ‘The Pre-Reflective Cogito and the Being of the Percipere’) as (...) well as on the first chapter of its second part, that is, “The Immediate Structures of the For-Itself” (covering content in three of its five sub-sections: I, III and IV). The title of the lecture thus does not wholly encompass the subjects that are discussed in it, although it may well be said to reflect its central theme (even in a literal sense, as the positioning of the hypothetically demarcated ‘Section III’ in the Table of Contents above shows). In addition to the presentation, the article in the Bulletin is preceded by a brief introductory statement – seemingly written by Sartre himself1 – which functions largely as a sort of ‘extended abstract’ for the talk (although not all the points in the introduction are covered in the presentation), and is followed by a transcript of the discussion that took place after the presentation between Sartre and some of the reputable scholars who were in attendance (i.e. a ‘question and answer’ session). A spatial logic is a formal language interpreted over any class of structures featuring geometrical entities and relations, broadly construed. In the past decade, spatial logics have attracted much attention in response to developments in such diverse fields as Artificial Intelligence, Database Theory, Physics, and Philosophy. The aim of this handbook is to create, for the first time, a systematic account of the field of spatial logic. The book comprises a general introduction, followed by fourteen chapters by invited authors. Each (...) chapter provides a self-contained overview of its topic, describing the principal results obtained to date, explaining the methods used to obtain them, and listing the most important open problems. This paper discusses how to define logics as deductive limits of sequences of other logics. The case of da Costa's hierarchy of increasingly weaker paraconsistent calculi, known as $ \mathcal {C}$n, 1 $ \leq$ n $ \leq$ $ \omega$, is carefully studied. The calculus $ \mathcal {C}$$\scriptstyle \omega$, in particular, constitutes no more than a lower deductive bound to this hierarchy and differs considerably from its companions. A long standing problem in the literature (open for more than 35 years) is (...) to define the deductive limit to this hierarchy, that is, its greatest lower deductive bound. The calculus $ \mathcal {C}$min, stronger than $ \mathcal {C}$$\scriptstyle \omega$, is first presented as a step toward this limit. As an alternative to the bivaluation semantics of $ \mathcal {C}$min presented thereupon, possible-translations semantics are then introduced and suggested as the standard technique both to give this calculus a more reasonable semantics and to derive some interesting properties about it. Possible-translations semantics are then used to provide both a semantics and a decision procedure for $ \mathcal {C}$Lim, the real deductive limit of da Costa's hierarchy. Possible-translations semantics also make it possible to characterize a precise sense of duality: as an example, $ \mathcal {D}$min is proposed as the dual to $ \mathcal {C}$min. (shrink)

. This paper investigates the mechanisms of knowledge production of twenty-first century robotics-inspired morphology. How robotics influences investigations into the structure, development, and change of organic forms? Which definition of form is presupposed by this new approach to the study of form? I answer these questions by investigating how robots are used to understand and generate new questions about the locomotion of extinct animals in the first case study and in high-performance fishes in the second case study. After having illustrated (...) the landscape of twentieth-century morphology, I will reflect on the definition of form adopted in twenty-first century robotics-inspired morphology as well as on the differences between this approach to the study of form and the so-called nature-inspired disciplines, such as bionics or biomimetics. In the conclusion, I suggest that we are now in a material turn in morphology, characterized by the coexistence of the robotic, the virtual, and the real, which enables an understanding of how the structures and dynamics of shapes change over time. The aim of my paper is to compare three alternative formal reconstructions of van Inwagen’s famous argument for incompatibilism. In the first part of my paper, I examine van Inwagen’s own reconstruction within a propositional modal logic. I point out that, due to the expressive limitations of his propositional modal logic, van Inwagen is unable to argue directly (that is, within his formal framework) for incompatibilism. In the second part of my paper, I suggest to reconstruct van Inwagen’s argument within (...) a first-order predicate logic. I show, however, that even though this reconstruction is not susceptible to the same objection, this reconstruction can be shown to be inconsistent (given van Inwagen’s own assumptions). At the end of my paper, I suggest to reconstruct van Inwagen’s argument within a quantified counterfactual logic with propositional quantifiers. I show that within this formal framework van Inwagen would not only be able to argue directly for incompatibilism, he would also be able to argue for crucial assumptions of his argument. (shrink)

This essay pushes the history of a scientific discipline, morphology, toward a broader philosophically informed and cross-disciplinarily engaged history of knowledge. It shows that by looking at how knowledge and practices circulated between scientific disciplines (such as biology) and technoscientific ones (like architecture and design) we can better understand how (morphological) knowledge was produced. By doing so, the analysis contributes to the study of the mechanisms of knowledge exchange between the organic and the technical worlds and, more broadly, to the (...) study of the dynamics of knowledge circulation. First, the essay analyzes the engineering studies of organic form conducted by the Austro-Hungarian botanist Raoul Heinrich Francé (1874–1943) and the Scottish polymath D’Arcy Wentworth Thompson (1860–1948). Subsequently, the essay moves to twenty-first-century morphogenesis. It examines the transfer of the notion of morphospace, a paleontological practice of data visualization, into biology-inspired architectural design. The conclusion deals with the broader features of knowledge transfer and circulation. Twentieth- and twenty-first-century morphologists successfully translate and transfer morphogenetic processes from nature into technical artifacts to achieve technical solutions to given problems. In the translation of organic morphogenesis into a technical process, evolution’s intrinsic historical contingency was deliberately left behind. (shrink)

Sartre maintains that “all consciousness is consciousness of something.” Idiosyncratically, he also understands this “intentionality principle” to entail that what consciousness is “of” is necessarily distinct from it (or “outside of” it, or “transcendent to” it). Nonetheless, he also maintains that all consciousness is necessarily conscious of—or rather, “(of)”—itself in a non‐intentional (in his terms: “non‐positional/non‐thetic”) manner. Given that this non‐positional/thetic self‐consciousness is not intentional, it is evidently immune to the “difference” principle, but this is less clear with respect to (...) self‐reflection (which Sartre simply calls “reflection”). It seems impossible for reflection to be “intentional” because intentionality entails difference—yet it also seems problematic to consider reflection “non‐intentional” because it then becomes difficult to distinguish reflection from non‐positional/thetic self‐consciousness as such (which is inherently “unreflective”). This can be called Sartre's “dilemma of reflection.” While Sartre seems to alternate between portraying reflection as intentional and as non‐intentional (it generally appears like the former), this paper argues that it should be conceived as both according to different respects. By piecing together various passages of Sartre's texts and drawing out their implications, Sartre can be shown to have the resources for an answer to his own dilemma. (shrink)
