“Myth theorists” have recently called the normative requirement of means-end rationality into question. I show that we can accept certain lessons from the Myth Theorists and also salvage our intuition that there is a normative requirement of means-end rationality. I argue that any appeal to a requirement to make our attitudes coherent as such is superfluous and unnecessary in order to vindicate the requirement of means-end rationality and also avoid the problematic conclusion that persons ought to take the means to (...) whatever ends they happen to intend. Those who argue that corporations can be morally responsible for what they do help us to understand how autonomous corporate agency is possible, and those who argue that they cannot be help us maintain distinctive value in human life. Each offers something valuable, but without securing the other's important contribution. I offer an account that secures both. I explain how corporations can be autonomous agents that we can continue to be justified in blaming as responsible agents, but without it also (...) being the case that corporations are morally responsible for anything that they do. The upshot is that we can make sense of the reality of corporate agency and the value that we derive from our sophisticated interactions with them as autonomous agents, while vindicating the idea that they are not members of the moral community. This paper investigates the complicated relations between various versions of naturalism, behaviorism, and mentalism within the framework of W. V. O. Quine's thinking. It begins with Roger Gibson's reconstruction of Quine's behaviorisms and argues that it lacks a crucial ontological element and misconstrues the relation between philosophy and science. After getting clear of Quine's naturalism, the paper distinguishes between evidential, methodological, and ontological behaviorisms. The evidential and methodological versions are often conflated, but they need to be clearly distinguished in order (...) to see whether Quine's argument against mentalism is cogent. The paper argues that Quine's naturalism supports only the weakest version of behaviorism, that is, the evidential one, but this version is compatible with mentalistic semantics. Quine's opposition to mentalism is an overreaction from the behaviorist camp. By contrast, Jerry Fodor's objection to Jose Luis Bermudez is an overreaction from the opposite direction. (shrink)

La epistemología bayesiana tiene como concepto capital la condicionalización simple. Para comprender de buena forma cómo opera esta regla, se debe dar cuenta de la concepción subjetiva de la probabilidad. Sobre la base de lo anterior es posible esclarecer alcances y límites de la condicionalización simple. En general, cuando esta regla enfrenta una dificultad se hacen esfuerzos por resolver dicha particular cuestión, pero no es usual encontrar propuestas unificadas con la intención de resolver varias de las complicaciones subyacentes al bayesianismo (...) ortodoxo. Por lo mismo, el propósito de esta investigación es justamente proponer aquello: un marco bayesiano ampliado que tendrá por objeto solucionar más de una cuestión particular. Más específicamente, el problema de la incorregibilidad, el problema del surgimiento del cero, el problema de la evidencia antigua y el problema de las teorías nuevas. Lo anterior se logrará adicionando al bayesianismo ortodoxo dos cuestiones, a saber, la condicionalización épsilon y una reconstrucción racional. One of the problems religious men and philosophers often face is how to convey enlightenment or wisdom to others so that sentient beings can be enlightened or awakened from dogmatic views. This problem is also the question of how truth is made known to men. The purpose of this paper is to investigate the problem of communicating truth in Ch'an Buddhism.

Although legal terms are conventionally considered to have self-referential, self-closed meaning independent of context, a legal term only acquires its meaning within a given context. As long as the context varies, the meaning of the same legal term as a signifier may change correspondingly. Based on case studies by applying semiotics, we argue that a legal term is just a sign within its sign system; a legal term as an individual sign does not have any inherent meaning, and its meaning (...) can only exist in the relationship with other signs or sign systems. In other words, a legal term only denotes in a particular temporal and spatial context. Through this study, we conclude four propositions about a legal term as a sign: first, the connection of a legal term with a legal concept is relatively arbitrary; second, the meaning of a legal term exists in a sign system; third, a legal term can be subject to multiple interpretations; fourth, the defining of a legal term may be affected by other sign systems. By exploring the cultural discrepancies in Chinese legal texts and their English versions and to what extent legal and cultural discrepancies influence and constrain legal translation, the study argues that it is useful to consider cultural discrepancies within a semiotic framework. Language is a phenomenon and factor that links different cultures; the use of language is crucial to any legal system. Law, as a cultural product, is attended by cultural discrepancies when switched into other languages for the purpose of achieving (...) equivalence. After a brief overview of cultural differences in translation, legal translation in particular, the study is set to examine the role of translation in crossing through different legal cultures and backgrounds and investigate barriers in the process of translation. Investigating cultural discrepancies in legal translation within a semiotic framework allows us to focus on certain interpretations by acknowledging that legal texts are composed with systems of systems and interacting with other cultural aspects in a wider context. Genre has been a critical issue in discourse analysis as well as in other disciplines. Based on a literature review of the concept of genre and taking judgments as one type of genre in legal settings, the present study provides a corpus-based insight into the nature of genre. The literature review per se reveals that genre has one typical feature of a sign, that is, being subject to multiple and alternative interpretations; in other words, genre as a sign may have (...) various interpretants. The present study unravels the actual generic structures, distinguishes different types of generic structures within the given genre, and then defines the dominant generic structure of judgments in Hong Kong, Taiwan, and Mainland China. This study also examines and contrasts the generic structure potential of judgments in each jurisdiction. In addition, the variation of Mainland China's judgments over time is briefly discussed. Comparing the generic structures of judgments among the three jurisdictions, as well as the structures of judgments in Mainland China over time, the paper argues that genre also has the essential features of a sign, that is, the characteristics of temporality and spatiality. According to the universality thesis, the epistemic properties referred to by the English epistemic verb “know” contained in the expressions of the form “S knows that p” or “S knows how to φ‎” are shared by the translations of the epistemic verb in all other languages such as Chinese, Japanese, Korean, Russian, and so on. Some doubt that there is reason to think the universality thesis is true because little or nothing is shown about the meanings and uses of the (...) epistemic terms in languages other than English. Critics of the universality thesis find counterevidence to the thesis; that is, the evidence demonstrates that translations of the epistemic verb “know” are used differently in some languages from the way “know” is used in English. In this chapter, the authors examine the effectiveness of such counterevidence. (shrink)

In this paper, I propose a virtue-theoretic approach to semantics, according to which the study of linguistic competence in particular, and the study of meaning and language in general, should focus on a speaker's interpretative virtues, such as charity and interpretability, rather than the speaker's knowledge of rules. The first part of the paper proffers an argument for shifting to virtue semantics, and the second part outlines the nature of such virtue semantics.

The skill model of wisdom argues that practical wisdom can be best understood in terms of practical skill or expertise, and the model is thought to have the characteristic of focusing on how wise people think rather than how wise people feel. However, from the perspective of Kunzmann and Glück, “it is time for an ‘emotional revolution’ in wisdom research, which will contribute to a more balanced view on wisdom that considers emotional factors and processes as equally typical of wisdom (...) as are cognitive and reflective factors” (Kunzmann U, Gluck J [2019] Wisdom and emotion. In: Sternberg R, Gluck J (eds) The cambridge handbook of wisdom. Cambridge University Press, Cambridge, pp 575–601). Kunzmann and Glück’s appeal for this emotional revolution is significant and intriguing because the inclusion of an explanation of the role of emotion in wisdom can contribute to developing the skill model of wisdom into a more comprehensive framework that recognizes the intricate relation between wisdom and emotions. In this paper, I shall propose and develop a skill account of the emotions of the wise to serve as a supplement to the skill model of wisdom. According to this account, first, at the critical level, having emotions and emotional competence as elements is not essential to wisdom; second, at the theoretical level, a wise person feels an emotion E if and only if E is strategically rational for the wise person; and third, at the metatheoretical level, the primary aim of the skill account is to explain why wise people feel in a particular way rather than to describe how wise people feel. There is a considerable scholarly discussion regarding how Islamic values influence CSR, but prior studies remain fragmented and scattered across several fields. This paper, therefore, aims to offer a more comprehensive understanding of the impacts of Islamic values on CSR by conducting a systematic literature review of 84 relevant publications from 1995 through 2020. The results of a thematic analysis show that there are four underlying themes to consider when explaining the influence of Islamic values on CSR: (1) Islamic narratives (...) promoting CSR, (2) Islam-based CSR, (3) Islamic financial institutions as enablers of CSR, and (4) stakeholders’ perspectives on how Islamic values influence CSR. This study contributes to the CSR literature by providing a systematic understanding of how Islamic values influence CSR and by identifying current challenges and promising directions for future exploration along this line of inquiry. Abstract:In this paper I focus on parasitic cases of exploitation in the case of UBI. I start by arguing that existing concepts of parasitic exploitation in the literature are over inclusive, since they label as cases of parasitic exploitation some cases that are not. Then I offer my own narrower framework of parasitic exploitation, which includes three conditions: built-in mechanisms, structural vulnerability and non-proportionality. I suggest that exploitation happens when agents misuse a system to obtain additional profit at the potential (...) expense of the weak party. This profit is additional compared to a counterfactual scenario in which the systemic vulnerability was not present. I argue that while some cases of parasitic exploitation may arise in the case of UBI, these cases are likely to be weak, and hence, absence of regulation of this system can be justified on the grounds that this would prevent stronger types of exploitation and domination.Key words: Universal Basic Income; parasitic exploitation; transactional exploitation; domination; misusing a system; free-rider. The representational epistemic approach to the design of visual displays and notation systems advocates encoding the fundamental conceptual structure of a knowledge domain directly in the structure of a representational system. It is claimed that representations so designed will benefit from greater semantic transparency, which enhances comprehension and ease of learning, and plastic generativity, which makes the meaningful manipulation of the representation easier and less error prone. Epistemic principles for encoding fundamental conceptual structures directly in representational schemes are described. The (...) diagrammatic recodification of probability theory is undertaken to demonstrate how the fundamental conceptual structure of a knowledge domain can be analyzed, how the identified conceptual structure may be encoded in a representational system, and the cognitive benefits that follow. An experiment shows the new probability space diagrams are superior to the conventional approach for learning this conceptually challenging topic. (shrink)

Some philosophers have recently argued that luck at the time of decision is a problem for compatibilists and libertarians alike. But conceptual ambiguity regarding deterministic luck at the time of decision – henceforth C-luck – has obscured recognition of the problem C-luck poses to compatibilism. This paper clarifies C-luck and distinguishes it from present luck, showing that the former arises from contingent factors at the time of decision instead of presupposed free will requirements. We then argue that empirical findings confirm (...) the existence of C-luck thereby raising a fundamental challenge to compatibilist accounts of moral responsibility. (shrink)

Does being green facilitate product innovation? This study examines whether green management in firms operating in China fosters radical product innovation to a greater extent than it does incremental product innovation and investigates the underlying institutional mechanisms involved in the relationship between green management and product innovation. The findings show that green management is more likely to lead to radical product innovation than to incremental product innovation. Moreover, government support as a formal institutional benefit more strongly mediates the effect of (...) green management on radical product innovation than its effect on incremental product innovation; whereas social legitimacy as an informal institutional benefit more strongly mediates the effect of green management on incremental product innovation than its effect on radical product innovation. What is wisdom? What does a wise person know? Can a wise person know how to act and live well without knowing the whys and wherefores of his own action? How is wisdom acquired? This Element addresses questions regarding the nature and acquisition of wisdom by developing and defending a skill theory of wisdom. Specifically, this theory argues that if a person S is wise, then (i) S knows that overall attitude success contributes to or constitutes well-being; (ii) S knows (...) what the best means to achieve well-being are; (iii) S is reliably successful at acting and living well (in light of what S knows); and (iv) S knows why she is successful at acting and living well. The first three sections of this Element develop this theory, and the final two sections defend this theory against two objections to the effect that there are asymmetries between wisdom and skill. Contemporary philosophers have contributed to the development of the skill model of wisdom, according to which practical wisdom is practical skill. However, the model appears to be limited in its explanatory power, since there are asymmetries between wisdom and skill: A person with practical wisdom can and should deliberate about the end being pursued; by contrast, a person with a particular practical skill cannot deliberate about the end of the skill, and even if she can, she is not required to (...) do so. ABSTRACT In this paper we explore how a public national media outlet, the British BBC, represents an international legal case which has a highly political nature. The case is US versus Huawei/meng Wanzhou, which took place between 2018 and 2021. Accusations were that the Chinese technology company committed fraud, leading the global HSBC bank to breach US sanctions against Iran. The charges were made by the US using what is called an ‘extraterritorial law’, which, while rejected as law by governments (...) around the world, is policed by US economic powers and control over international finance. Using Critical Discourse Analysis we show that, while the BBC presents much detail of legal process, the actual nature of the law the US uses to bring criminal charges against international companies and banks, is neither considered nor questioned. Our interest is how such a law, which has a huge influence over global trade and politics, is presented to the public in this particular case. We contribute to the position that the nature of laws, how they are used and known, must always be understood within the prevailing discourses of the moment. (shrink)
