Our understanding of the role and development of alchemy in Poland and Lithuania is still in need of further research. However, it is already possible to present a number of interesting cases, starting with medieval scholars and passing through humanist intellectuals to early modern nobles and burghers. Although Michael Sendivogius was certainly the only Polish alchemist of pan-European stature, there were many others either lured by the dream of the Philosophers’ Stone or motivated by their thirst for knowledge. In some (...) cases that interest seems to be related to the revolution in science, while in some others—to religious reformation. A brief survey of those individuals and circles is presented, along with some initial conclusions about the alternative channels through which alchemy penetrated the Eastern frontiers of Europe. THE EMBRACING MODE OF THINKING Viktorija Daujotytė-Pakerienė Summary The author sets out to reconsider the problem of humanistic methods. It expresses the doubt as to the application of the methods which are detached from theories and a more general mode of thought. The title of the article is taken from the Lithuanian edition of the preface to “Semiotics” written by A. J. Greimas. The mode of thought, embracing the multifarious worlds of meaning, is considered as a humanistic universal, it is also perceived as a bridge of thought to prevailing phenomenology. The concept of embrace encompasses the dimension of the body and the full mental participation of the individual. A brief review of the first translation of Edmund Husserl’s “Cartesian Meditations” into Lithuanian by Tomas Sodeika are presented. Meditation is viewed as the common ground-substratum shared by philosophy and poetry. “Meditations” of Donaldas Kajokas are introduced. Algis Mickūnas and Arūnas Sverdiolas’s dialogues “The All-Embracing Present” are referred to as a personal testimony of the inner participation in the theories. The significance of A. Ðliogeris’s study “Thing and Art“, which discusses the creative work of P. Cezanne and R. M. Rilke, is reflected within the framework of the tradition of phenomenological thought; here the concept of theoretical point of view was first formulated in Lithuanian humanistics. The article suggests that in approaching the problems of method in humanistics, and especially in literary criticism, the participation of creation itself is very important, and particularly the experiences that open up in original texts. It is important to reveal the equivalents, to reflect them, to extract the method from the texts. The article arrives at the conclusion that the recognition of the organizing inner text system is the essential principle of humanistic methodology, which is in close connection with the embracing mode of thought. This study examines the challenges of humanism and education in the 21st century as addressed by the German philosopher Peter Sloterdijk in his Elmau Speech (1999). In this lecture, titled _Rules for the Human Zoo_, Sloterdijk argues that the traditional notion of humanism, specifically “humanism as a literary society,” has reached its conclusion, necessitating the development of a new humanism appropriate for the contemporary era. However, the new concept of humanism emerging from what Sloterdijk terms the “anthropotechnic turn” appears to (...) align with the discourses surrounding human enhancement that have emerged in the 21st century, thereby influencing the realm of education. The first half of this article reports on the significant concerns and criticisms expressed by the media at that time regarding this new humanism, which seems to be associated with eugenicist ideas. Taking a step further, this study critically examines the nature of the challenges around education implied by Sloterdijk, specifically the conflict between “friend of humans and friend of Übermensch”, and explores the potential roles and responsibilities of education in the latter part of the paper. Between the world wars, Lithuanian notary practice was based on the legal acts adopted from Russia, the Kingdom of Poland, and Germany. The most important was the Russian Notary Law of 1866, which was valid in the largest part of the Lithuanian territory. This law established the so-called approval system, in which the most important acts of the notary as indicated by civil law had to be approved by the senior notary, who worked under the supervision of the (...) county court. In 1919, upon transferring this outdated system into the Lithuanian law practice, only a few provisions were corrected. In addition to the right to collect fees from customers, the notaries had a fixed state remuneration established for them. The provisions for material liability of the notaries were abolished. This withdrawal from the so-called Latin model of notary practice was corrected by the changes to the Notary Law of 1932, which declared notaries as “civil servants without wages”. Thus, starting 1932, payments from the state have been discontinued while more regulation was enforced regarding the daily activities of notaries (e.g. notaries were required to work at least six office hours). Vytautas Raudeliūnas is Lithuanian law historian, expert of the history of the Great Duchy of Lithuania, pedagogue and Lithuanian patriot. He spent his youth in exile and finished his studies in Russia and in Vilnius. He worked as a fellow in Lithuanian Science Academy, in the Monument Defence Office, the Institute of Culture, Philosophy and Art. V. Raudeliūnas lectured at Vilnius Pedagogical University. He was one of the establishers and publishers of periodical publications “The monuments of (...) class='Hi'>Lithuanian law”, “The studies of Lithuanian law history”. The article describes biography of V. Raudeliūnas, collects and disputes his bibliography and evaluates his contribution to the history of Lithuanian law. The article analyzes V.Raudeliūnas’ biography and scientific activity, as well as the main directions of his research: publications and transcriptions of Lithuanian Statutes; development of law institutes in the Great Duchy of Lithuania; peculiarities of development of Vilnius University. 'Humanism of the Other' argues that it is not only possible but of the highest exigency to understand one's humanity through the humanity of others.".

This essay explores the relation between two perspectives on the nature of human rights. According to the "political" or "practical" perspective, human rights are claims that individuals have against certain institutional structures, in particular modern states, in virtue of interests they have in contexts that include them. According to the more traditional "humanist" or "naturalistic" perspective, human rights are pre-institutional claims that individuals have against all other individuals in virtue of interests characteristic of their common humanity. This essay argues that (...) once we identify the two perspectives in their best light, we can see that they are complementary and that in fact we need both to make good normative sense of the contemporary practice of human rights. Research on the forced migration of Lithuanians to the east of the former Soviet Union in the 1940s and early 1950s throws up a wide range of issues. Methodologically, most of such studies are similar in terms of the sample chosen, which consists of the former prisoners of gulags and exiles who have returned to Lithuania, but it usually disregards those who stayed. Accordingly, the Lithuanian diasporas that emerged in the east after the forced migration, including in Kazakhstan, have (...) not been studied in detail. In this article, our aim is to answer the questions of how and in what private and public contexts processes of the ethnic identification of the Lithuanian diaspora in Kazakhstan are determined, how ethnic boundaries are drawn, and what cultural and social resources are used for this purpose. As the research revealed, the conceptualisation of ethnicity implied by the Kazakhstan state that has been adopted by our informants eliminates its cultural content, or at most reduces it to forms evident in festive culture, as well as the need and possibilities for its expression. As a result, ethnic identity is constructed on the basis of what is almost the sole criterion: Lithuanian descent in the form of ‘root’ or ‘blood’. For most of our informants, ‘roots’ are just a fact of origin, as shown in the practice of entering Lithuanian ethnicity in personal documents, an officially required practice which does not have and does not presuppose any enactment of ethno-cultural differences. Ethnicity, which is seen as ‘in-rooted’ but also as culture-less and as muted by a doubling of roots among ethnically mixed families of origin, enables a whole spectrum of manipulations of ethnic identity. One such manipulation is attempting to profit from the Lithuanian ethnic identity by turning it into a resource for acquiring benefits. The practice of profiteering from the Lithuanian ethnic identity, and thus its transformation into a resource for gaining benefits in the forms of Lithuanian citizenship and a hope of being repatriated to Lithuania, is probably the most frequent factor in becoming Lithuanian by remembering Lithuanian roots and activating the Lithuanian ethnic identity. Management theory and practice are facing unprecedented challenges. The lack of sustainability, the increasing inequity, and the continuous decline in societal trust pose a threat to ‘business as usual’. Capitalism is at a crossroad and scholars, practitioners, and policy makers are called to rethink business strategy in light of major external changes. In the following, we review an alternative view of human beings that is based on a renewed Darwinian theory developed by Lawrence and Nohria. We label this alternative view (...) ‘humanistic’ and draw distinctions to current ‘economistic’ conceptions. We then develop the consequences that this humanistic view has for business organizations, examining business strategy, governance structures, leadership forms, and organizational culture. Afterward, we outline the influences of humanism on management in the past and the present, and suggest options for humanism to shape the future of management. Humanism and the Death of God is a critical exploration of secular humanism and its discontents. Through close readings of three exemplary nineteenth-century philosophical naturalists or materialists, who perhaps more than anyone set the stage for our contemporary quandaries when it comes to questions of human nature and moral obligation, Ronald E. Osborn argues that "the death of God" ultimately tends toward the death of liberal understandings of the human as well. Any fully persuasive defense of humanistic values--including the core (...) humanistic concepts of inviolable dignity, rights, and equality attaching to each individual--requires an essentially religious vision of personhood. Osborn shows such a vision is found in an especially dramatic and historically consequential way in the scandalous particularity of the Christian narrative of God becoming a human. He does not attempt to provide logical proofs for the central claims of Christian humanism along the lines some philosophers might demand. Instead, this study demonstrates how philosophical naturalism or materialism, and secular humanisms and anti-humanisms, might be persuasively read from the perspective of a classically orthodox Christian faith. In such cases courts shall apply analogy of law, customs and general principals of law. Last but not least, the courts must address international legal practice as regards the domain name disputes, i.e. take into account the famous ICANN Uniform Domain Name Dispute Resolution Policy adopted in 1999 and mostly applied by the panels of WIPO Arbitration and Mediation Centre while (...) dealing with disputes on generic top level domain names <.com>, <.net>, <.org>, also analyse the practice of ADR cases of Czech Arbitration Court which has the jurisdiction over <.eu> domain name disputes. This article deals with the case-law of Lithuanian courts in <.lt> domain name disputes and analysis the trends of Lithuanian internet law as regards the protection of the owners of intellectual property in Lithuania. The article outlines some aspects of the civil law in Lithuania, an Eastern European country, which underwent an essential transformation in the last decades. The author outlines the development of the Lithuanian civil law from the oldest written sources up to the adoption of the new Civil Code of the Republic of Lithuania in 2000. The author is critical about the denomination of Lithuania as a “new” state and draws attention to the history of Lithuanian law, which spans (...) hundreds of years. The article emphasizes the continuity of the legal tradition and the heterogeneity of law – the coexisting of several legal systems in the territory of one state. The article discusses the role of Roman Law in the legal system of Lithuania. Even though Roman Law has never been applied in Lithuania, the author argues that it nevertheless had an indirect influence on Lithuanian private law. Roman Law and Canonical Law were among the main sources while drafting the three codified acts, the Statutes of Lithuania, in 1529, 1566 and 1588. The knowledge of Roman Law acquired by lawyers at universities in other European countries was transmitted through drafting of the laws and the jurisdictional and administrative practices. (shrink)

Humanistic management is a people-oriented management that seeks profits for human ends. It contrasts with other types of management that are essentially oriented toward profits, with people seen as mere resources to serve this goal. This article reviews the historical development of humanistic management and the ever-increasing body of literature on the concept as well as the different meanings that scholars attribute to it. It then explores what form a genuine humanism might have by presenting seven propositions labeled as: 1) (...) wholeness, 2) comprehensive knowledge, 3) human dignity, 4) development, 5) common good, 6) transcendence, and 7) stewardship-sustainability. Next, it looks at four characteristics of a humanistic ethos for managing business: the view of the individual and human work, the role of the individual in the society and in interacting with nature, the business firm, and the purpose of business in society. Upon reinstitution of the Lithuanian state in the beginning of the twentieth century, some people reflected back to the times where Lithuanian law had European significance. However, it was concluded that the latter would not satisfy the needs of a modern state. The change in times made the continuation of the legal tradition impossible. Yet it was also impossible to put faith into fast creation of the essentially new Lithuanian legal system. Therefore, it was decided to accept (...) a foreign system that was in place before the First World War – that of the Russian Empire. The law of the Lithuanian Grand Duchy (LGD) had an impact on the Russian law during the course of history. The most important channel was the reception of the Lithuanian Statute into the Sobor Code of 1679, which later resulted in the codex of the Russian Empire. The latter was also supplemented by the norms from the Lithuanian Statute relating to some exceptions in various regions covered. Some norms were imported purely for the purpose of renewal of the Russian legislation. The reception of the Russian law in the independent Lithuanian state meant that together with it Lithuania had accepted historical norms from the Lithuanian Statute. In that manner, the modern Lithuanian law was related to the historical law of the LGD. (shrink)

Private copying exception is an exception to copyright which is present both in Lithuanian national law and law of the European Union. Recent jurisprudence of Court of Justice of the European Union interpreted legal regulation of private copying exception in the laws of the European Union. The mentioned jurisprudence raised concern whether Lithuanian copyright laws on private copying exception and their interpretation in case law of Supreme Court of Lithuania are compatible with the European Union law. This paper (...) analyses the nature and intention of private copying exception, its reflection in Lithuanian and European copyright law and evaluates Lithuanian laws and case law in the light of recent jurisprudence of the Court of Justice of the European Union. The authors conclude that recent jurisprudence of the Court of Justice of the European Union on private copying exception shall not lead to any dramatic or substantial changes of Lithuanian national copyright laws. Humanism is the view that people treat others inhumanely when we fail to see them as human beings, so that our treatment of them will tend to be more humane when we (fully) see their humanity. Recently, humanist views have been criticized on the grounds that the perpetrators of inhumanity regard their victims as human and treat them inhumanely partly for this reason. I argue that the two most common objections to humanist views (and their relatives) are unpersuasive: not only (...) does the evidence marshalled against these views fail to actually disprove them, it could threaten them only if some questionable assumptions were granted. By providing necessary conceptual ground-clearing and routing common lines of attack, I hope to determine what it would take for a humanist project to succeed, paving the way for a full defense of humanism that fulfills its explanatory ambitions. A form of metaphysical humanism in the field of philosophy of technology can be defined as the claim that besides technologies’ physical aspects, purely human attributes are sufficient to conceptualize technologies. Metaphysical nonhumanism, on the other hand, would be the claim that the meanings of the operative words in any acceptable conception of technologies refer to the states of affairs or events which are in a way or another shaped by technologies. In this paper, I focus on the conception of (...) technologies as problem-solving physical instruments in order to study the debate between the humanist and the nonhumanist ways of understanding technologies. I argue that this conception commits us to a hybrid understanding of technologies, one which is partly humanist and partly nonhumanist. (shrink)

Article 14 Chapter I ‘The State of Lithuania’ of the Constitution of the Republic of Lithuania of 1992 reads as follows: ‘Lithuanian shall be the State language’. This principle is not new in the Lithuanian history of constitutionalization, as Lithuanian was the official language of the State in the interwar period but lost this status during the Soviet occupation. After 1988, when many political, economic and social changes crucial for further development of the State took place in (...) Lithuania, linguistic issues re-emerged. It was recognized back then that language played a vital role in the life of the State and the society, and the Lithuanian language was given back its status of the official language by the Constitution. The principle that Lithuanian is the official language of the State, enshrined in Article 14 of the Constitution of the Republic of Lithuania, was further elaborated by the Constitutional Court of the Republic of Lithuania in its rulings and judgments. According to its official constitutional doctrine, the Lithuanian language should be treated as a very specific constitutional value, as it forms the basis of the ethnic and cultural identity of the Lithuanian nation and is the guarantor of the national identity and survival. The status of Lithuanian as the official language means that the Lithuanian language must be used in all spheres of public life. The Court also holds that having this principle enshrined in Chapter I ‘The State of Lithuania’ of the Constitution implies that the Lithuanian language enjoys particular protection since the provisions of this Chapter may be amended only by a referendum. Cultures and moral expectations differ around the globe, and so the management of corporate responsibilities has become increasingly complex. Is there, however, a humanistic consensus that can bridge cultural and ethnic divides and reconcile the diverse and contrary interests of stakeholders world-wide? This book seeks to answer that question.

This paper considers the moral psychology of interpersonal conduct that is cruel, brutal, humiliating, or degrading. On the view I call “humanism,” such behavior often stems from the perpetrators’ dehumanizing view of their targets. The former may instead see the latter as subhuman creatures, nonhuman animals, supernatural beings, or even mindless objects. If people recognized their common humanity, they would have a hard time mistreating other human beings. The Corporate Social Performance (CSP) model (Wood, Acad Manag Rev 164:691–718, 1991) assesses a firm’s social responsibility at three levels of analysis—institutional, organizational and individual—and measures the resulting social outcomes. In this paper, we focus on the individual level of CSP, manifested in the managerial discretion of a firm’s principles, processes, and policies regarding social responsibilities. Specifically, we address the human resources management of employees as a way of promoting CSR values and producing socially minded outcomes. We show that applying (...) the humanist philosophy to the managerial discretion of a business organization leads to the creation of an “autonomy supportive work environment”—as defined by the self-determination theory—which in turn, facilitates the internalization of social values, citizenship behaviors, and cooperation. The objective of promoting self-determination at work (i.e., the core of a humanist management) fits well with the ontology of social responsibility since autonomy and consideration of individuals as moral actors are central tenets. Furthermore, we show that applying humanistic management philosophy to the discretion of managers can lead to socially responsible outcomes. First, intra-organizational stakeholders (e.g., employees) are treated with respect and focus is put on their well-being, satisfaction, and self-actualization at work. Second, as employees’ need of self-determination is addressed by managers, it is likely that pro-social behaviors toward other stakeholders of the organization will be adopted, leading to socially responsible outcomes for extra-organizational stakeholders (Gagné, Motiv Emot 77:58–75, 2003). Thus, this paper ultimately posits that humanistic management applied to the HRM can be a solution for developing and maintaining socially responsible outcomes as determined at the individual level of the CSP model, through managerial discretion. Vico's earliest extant scholarly works, the six first statement of ideas that Vico would continue to refine throughout his life. Delivered between 1699 and 1707 to usher in the new academic year at the University of Naples, the orations are brought together here for the first time in English in an authoritative translation based on Gian Galeazzo Visconti's 1982 Latin/Italian edition. In the lectures,Vico draws liberally on the classical philosophical and legal traditions as he explores the relationship between the Greek (...) dictum "Know thyself' and liberal education. As he sets forth the values and goals of a humanist curriculum, Vico reveals the beginnings of the anti-Cartesian position he will pursue in On the Study Methods of Our Time. A theory of morality acceptable to humanists must be one that can be accepted independently of religion. In this paper, I argue that while there is such a theory, it is a non-standard one, and its acceptance would have some far-reaching consequences. As one might expect, the theory is similar to others in various ways. But it is not the same as any of them. Indeed, it is a radically new theory. Like Hume’s ethics, it is founded on our (...) natural sociability, and feelings of empathy for others. Like Aristotle’s theory, it incorporates an ethics of virtue. Like Kant’s theory, it regards the set of moral principles as those appropriate for a socially ideal society. But unlike Kant’s theory, it is essentially utilitarian. In this book, Ellis argues that moral and political objectives are not independent of one other, and so must be pursued in tandem. _Social humanism_ is a moral and political philosophy that does just this. As a political philosophy, it justifies the implementation and maintenance of many of the characteristic social policies of welfare states. As a moral philosophy, it provides the foundation required for most human rights legislation.
