We analyzed a sample of 356 forms containing information that Colorado law legally requires both licensed and unlicensed therapists to disclose to clients. The majority of forms contained the legally mandated information; fewer forms contained ethically desirable information. The average readability grade level was 15.74, corresponding to upper-level college, and 63.9% of the forms reached the highest (most difficult) readability grade of 17 +. Therapists are obeying the law, but do not appear to be taking advantage of the opportunity to (...) provide their clients useful information in an accessible way. (shrink)

Leslie Tharp proves three theorems concerning epistemic and metaphysical modality for conventional modal predicate logic: every truth is a priori equivalent to a necessary truth, every truth is necessarily equivalent to an a priori truth, and every truth is a priori equivalent to a contingent truth. Lloyd Humberstone has shown that these theorems also hold in the modal system Actuality Modal Logic, the logic that results from the addition of the actuality operator to conventional modal logic. We show that (...) Tharp’s theorems fail for the expressively equivalent Subjunctive Modal Logic, the logic that was developed by Kai Wehmeier as an alternative to AML. We then argue that the existence of Tharp’s theorems for AML is due to a faulty interpretation of the notion of necessary truth, a feature that is not shared by SML. The paper concludes with an argument for the thesis that the existence of the distinction between truth at all worlds w and truth at all worlds w from the point of view of w as the actual world is an artifact owing to the interaction of the necessity and actuality operator. Jeff Jordan has put together nine essays which give those who want to gamble on God something to think about. Though only three of them are really about Pascalk wager, all of them are worth reading. The most entertaining paper is Roy A. Sorensen's "Infinite Decision Theory." Sorensen confronts the St. Petersburg Paradox, which stems from the fact that there are available wagers with a potentially infinite payoff on which no one would bet $ao. Suppose you are offered $2n for each throw of a standard balanced coin until a head turns up. N = the number of tosses. It could be a long time--forever--before heads turns up. By the time n = loo you would have a bag of gold bigger than the sun. But Sorensen says the right bet is at least $23,but not much more. It is also true that since we don't know which actions God will reward, any human action has a possible infinite payoff and since all such actions have the same potential payoff none is better than the others. (Some god was moved to save Coleridge's Ancient Mariner, who had kindly thoughts about water-snakes.) Sorensen also notes that it is often said (Pascal would have agreed) that persons can be of infinite worth. If so, is rescuing one drowning person as good as rescuing five? The total worth seems to be the same. (Luckily, if Cantor is to be believed, there are larger and smaller infinities.) Sorensen ends inconclusively, but he is right that decision theory needs to address the infinite. Pascal would have had something to say. He thought that his bet was morally good. To bet on God is to act as if God exists. One who treats everyone as saved behaves as if God exists. (You don't know who is saved, but if you treat the saved as damned God will be annoyed whereas if you treat the damned as saved you won't detract from their ultimate penalty.) You don't have to bet $3, you only have to do what you ought to do anyway. The incremental cost of the bet appears to be zero. Anyhow, Pascal thought that it was not the infinite payoff (in the sense of a life of bliss) which provided the main motive for the bet but the fact that the required action was one's moral duty. Moreover, nook REVIEWS 689 if everyone behaves as if everyone is saved the result is a world in which God could appear and not be crucified. To be sure, there is a chance of an infinite life. Pascal believed human beings are potentially infinite--as is shown by our capacity for extending our knowledge to the infinite--but we are also potentially nothing, as is shown by the fact that the person never really appears in our scientific accounts. It is through God that our infinity is to be achieved, and so betting on God is also betting on ourselves in a perfectly intelligible way. One of the first books to address what has come to be known as the philosophy of cosmology, Universes asks, "Why does the universe exist?", arguing that the universe is "fine tuned for producing life." For example, if the universe's early expansion speed had been smaller by one part in a million, then it would have recollapsed rapidly; with an equivalently tiny speed increase, no galaxies would have formed. Either way, this universe would have been lifeless.

The ‘black box problem’ is a long-standing talking point in debates about artificial intelligence. This is a significant point of tension between ethicists, programmers, clinicians and anyone else working on developing AI for healthcare applications. However, the precise definition of these systems are often left undefined, vague, unclear or are assumed to be standardised within AI circles. This leads to situations where individuals working on AI talk over each other and has been invoked in numerous debates between opaque and explainable (...) systems. This paper proposes a coherent and clear definition for the black box problem to assist in future discussions about AI in healthcare. This is accomplished by synthesising various definitions in the literature and examining several criteria that can be extrapolated from these definitions. There are no data in this work. (shrink)

Excellence in sport performance is normally taken to be a matter of superior performance of physical movements or quantitative outcomes of movements. This paper considers whether a wider conception can be afforded by certain kinds of nature based sport. The interplay between technical skill and aesthetic experience in nature based sports is explored, and the extent to which it contributes to a distinction between different sport-based approaches to natural environments. The potential for aesthetic appreciation of environmental engagement is found to (...) be strongly dependent on whether or not environmental engagement is exploited for the end of producing a quantifiable result or enhancing technical skill. It is also argued that an existential rather than spectatorial attitude to aesthetic experience is offered by specifically nature oriented sport. Aesthetic experience achieved in this way is therefore neither passive nor detached, but extends Berleant's concept of participatory environmental aesthetics and underpins both an alternate (wide) conception of excellence in sport activity and a richer experience of aesthetic engagement than more objectivised standpoints. Are demands for equality motivated by envy? Nietzsche, Freud, Hayek, and Nozick all thought so. Call this the Envy Objection. For egalitarians, the Envy Objection is meant to sting. Many egalitarians have tried to evade the Envy Objection.. But should egalitarians be worried about envy? In this paper, I argue that egalitarians should stop worrying and learn to love envy. I argue that the persistent unwillingness to embrace the Envy Objection is rooted in a common misunderstanding of the nature of (...) the charge, what it reveals, and what can be said in response to it. I develop what Bernard Williams might call a vindicatory genealogy of envy, thereby allowing us to see that envy, rather than undermining egalitarian intuitions, can in fact play a distinct justificatory role (when it is fitting), which undermines the Envy Objection. Ducks lay eggs' is a true sentence, and `ducks are female' is a false one. Similarly, `mosquitoes carry the West Nile virus' is obviously true, whereas `mosquitoes don't carry the West Nile virus' is patently false. This is so despite the egg-laying ducks' being a subset of the female ones and despite the number of mosquitoes that don't carry the virus being ninety-nine times the number that do. Puzzling facts such as these have made generic sentences defy adequate semantic treatment. (...) However complex the truth conditions of generics appear to be, though, young children grasp generics more quickly and readily than seemingly simpler quantifiers such as `all' and `some'. I present an account of generics that not only illuminates the strange truth conditions of generics, but also explains how young children find them so comparatively easy to acquire. I then argue that generics give voice to our most cognitively primitive generalizations and that this hypothesis accounts for a variety of facts ranging from acquisition patterns to cross-linguistic data concerning the phonological articulation of operators. I go on to develop an account of the nature of these cognitively fundamental generalizations and argue that this account explains the strange truth-conditional behavior of generics. (shrink)

Volume 2 focuses on eighteenth-century moral philosophy, political philosophy and literature, and on the literary and religious reactions to the revolution in thought. This book is not aimed at exhuming Kant, but resurrecting him. It is inspired by the Critique of Pure Reason , yet is not about it: perhaps over-ambitiously, it tries to delineate not Kant's metaphysics of experience but the truth of the matter. The author shows rather than says where he agrees and disagrees with the first Critique , in so far as he understood that profound but obscure, over-systematic yet carelessly written, inspiring and infuriating, magnificent but flawed masterpiece. The (...) book attempts a highly systematic presentation, in which the very form of the work reflects the content of the arguments. Kant is often derided for the extent to which he allows his penchant for architectonic structure to distort his insights, but it is argued that he had the right instinct in assuming that there must be some systematic way in which the necessary conditions for experience fit together. The contemporary trend in analytical philosophy seems to be towards ever more specialized, jargon-infested work, and there is a need to draw things together into a wider view that can be more generally appreciated. Philip Reed argues that laws that grant people access to euthanasia on the basis of terminal illness are discriminatory. In support of this claim, he offers an argument by analogy: it would be discriminatory to offer a person access to euthanasia because they are women or because they are disabled, as such restricted access would send the message ‘that life as a woman or as a disabled person is (very often) not worth living’.1 And so it must also be discriminatory (...) to offer people access to euthanasia because they are terminally ill. Arguments by analogies are only as good as the analogies on which they are built. Having a terminal illness, I’m going to suggest, is not relevantly similar enough to either being disabled or being a member of an oppressed social group to make Reed’s claim compelling. Let’s explore each branch of the analogy in turn. Why think that terminal illness is relevantly unlike disability, in a way that makes offering access to euthanasia in the latter case discriminatory, but not the former? We often feel survivor guilt when the very circumstances that harm others leave us unscathed. Although survivor guilt is both commonplace and intelligible, it raises a puzzle for the standard philosophical account of guilt, according to which people feel guilt only when they take themselves to be morally blameworthy. The standard account implies that survivor guilt is uniformly unfitting, as people are not blameworthy simply for having fared better than others. In this paper, we offer a rival account of guilt, (...) the relational account of guilt, which makes sense of survivor guilt and other forms of guilt without self-blame while preserving the intelligibility of guilt about culpable wrongdoing. According to this account, guilt involves the feeling of being unable to justify ourselves to others, and we lack self-justification when we (however blamelessly) stand on the positive side of an undesirable asymmetry with them. When someone survives something that those around her do not, the disparity in outcome constitutes an asymmetry that is often undesirable, because it arises from luck or violates a requirement of solidarity. Sir Leslie Stephen (1832–1904), the founding editor of the Dictionary of National Biography, and a writer on philosophy, ethics, and literature, was educated at Eton, King's College London and Trinity College, Cambridge, where he remained as a fellow and a tutor for a number of years. Though a sickly child, he later became a keen and successful mountaineer, taking part in first ascents of nine peaks in the Alps. In 1871 he became editor of the Cornhill Magazine. During his (...) eleven-year tenure, he wrote two successful books on ethics, including The Science of Ethics in 1892, which was widely adopted as a standard textbook. This two-volume work, which was first published in 1896, brings together the lectures he gave to various ethical societies, mostly in London. Rooted in the field of cathedral studies, this paper draws into dialogue three bodies of knowledge: Edward Bailey’s notion of implicit religion that, among other things, highlights the continuing traction of the Christian tradition and Christian practice within secular societies; David Walker’s notion of the multiple ways through which in secular societies people may relate to the Christian tradition as embodied within the Anglican Church and John Fisher’s notion of spiritual wellbeing as conceptualised in relational terms. Against this conceptual background, (...) this paper draws on data provided by 1234 participants attending one of the Christmas Eve carol services in Liverpool Cathedral to explore the perceived impact of attendance on the spiritual health of people who do not believe in God and yet feel that Liverpool Cathedral is their cathedral, and it is this sense of belonging that brings them back at Christmas time.Contribution: Situated within the science of cathedral studies, this paper links in an original way three fields of discourse: Edward Bailey’s notion of implicit religion, David Walker’s notion of the four ways of belonging to God facilitated by the Anglican Church and John Fisher’s conceptualisation and operationalisation of the notion of spiritual wellbeing. In ‘Discrimination Against the Dying’, Phillip Reed argues that terminally ill patients are subjected to a distinct form of discrimination called ‘terminalism’. One of Reed’s primary examples of terminalism is right to try laws, which offer terminally ill patients the option to request medications that are not FDA-approved and without IRB involvement. In this analysis, we consider additional contextual factors about right to try, suggesting that it may not neatly count as an exemplar of terminalism. When pursued with appropriate protocols (...) and oversight, right to try has the potential to broaden treatment opportunities for the terminally ill by bypassing FDA and IRB restrictions, functioning as a less stringent alternative to expanded access for patients with limited time and dwindling options. Reed acknowledges that differential treatment of patients is not inherently unjust. For instance, Reed praises expanded access laws that grant patients with severe or life-threatening diseases access to treatment options otherwise unavailable. Patients not afflicted by severe illness or who have found success with standard treatment options are unlikely to face discrimination for inability to access nonessential treatment. The #MeToo movement generated a feminist insistence that we “believe women.” But the men accused of assault, harassment, and other violations frequently defended themselves with the insistence that they had always “respected women” – sometimes, going so far as to get numerous women to sign letters swearing that these men had always respected them. This common MeToo defense reveals the core inconsistency – and the core entitlement – at the heart of misogyny and sexual injustice: some women deserve respect. But (...) the duty to respect those women relies on an invisible entitlement to disrespect – indeed, to assault, harass, dominate, or exploit – others. This chapter explores consent’s role within the superstructure of misogyny and sexual injustice, arguing what consent is a key apparatus of white supremacy. It argues that consent has been constructed through dynamics of colonial and racist sexual entitlement, mapping some (white) women as deserving of respect and the right to consent, while marking other women as expendable or disposable within the sexual economy. This means not only that consent is historically constructed as white, but also that whiteness, and in particular, white womanhood, is constructed through consent. Thus, white women’s right to consent – or to refuse – is premised upon the inability of other women to do so. In this way, the right to sexual consent does not disrupt the norm of male sexual entitlement. Consent has always been premised on non-consent, from coloniality and slavery to contemporary porn, which offers a vision of the world without proper consent, so that granting consent to actual women is an exceptional practice, an “act of respect.” By including race and class alongside gender in my analysis of consent, I argue that contemporary feminist visions of sexual justice must do more than defend or ameliorate consent, but develop intersectional interrogations of sexual justice that reckon with the complicities of consent. When our nearest and dearest experience medical crises, we may need to step into caregiving roles. But in doing so, we may find that our new caregiving relationship is actually in tension with the loving relationship that motivated us towards care. What we owe and are entitled to as friends, spouses, and family members, can be different from what we owe and are entitled to as caregivers. For this reason, caregiving carries with it the risk of a type of moral (...) distress that I call “role conflict distress.” Rather than view role conflict distress as a sign that we are falling short, I suggest that it actually speaks to the commitment that we have to the loving relationship that grounds our duty of care. This book has a wonderful introduction and afterword by Marjorie Hewitt Suchocki. From beginning to end, this tri-authored work offers an integrated treatment of process theology, pneumology, and ecclesiology for the benefit of local Christian congregations.Among the three voices at work in this book, John Cobb provides an important primer on Whitehead's views of possibilities, experience, and relationships. Opening each of the book's three parts, Cobb both lays the groundwork and provides a strong framing for pneumology on the basis of (...) Whiteheadian thought. The frame for the Spirit is a broad one, calling for diversity and spontaneity. Lest the spiritual become too ethereal, Cobb reminds us of Whitehead's emphasis on experience and responsiveness to the world around us. Our freedom involves a self-determination that actualizes our own happiness and our contribution to others (111). Cobb's sections build a frame for the sections written by Epperly and Nancarrow, and they also encourage continued reading of Whitehead. (However, the book's lack of an index or a resource page for this kind of growth is a shortcoming.)Epperly offers in each of the book's three sections efforts at honing the concept of spirituality. As a concept, spirituality is in danger of a vacuousness that has no leverage in the life experience of the practitioner. Epperly does not succumb. He explicates important conduits of the spirit: embodiment, imagination, affirmative awareness, and compassion. Epperly provides a definition of spirituality as an adventurous journey of compassion. Spirituality is less a state of being and more of an exploration or a becoming as one relates to the surrounding world. He works the definition of spirituality with a prism-like beauty over the course of the three sections, integrating important persons from various cultures and inviting the reader to imagine their own spiritual past and potential future contributions.In each of the three sections, Nancarrow brings ecclesiology into the mix, thus making the book an essential for pastors who care about the pragmatics of process in the community of a local congregation. Nancarrow's chapters might be best characterized as how-to chapters helping church folk revisit the routines of liturgy, small groups, and the sacrament of communion. He encourages specific practices to engage liturgy, freshen perception, and potentially awaken hearts that can grow dull in rote practices of worship. Discernment and group work receives step-by-step attention. It is not lost on the reader that Nancarrow means to connect the care of facilitation in groups to the group's experience of the Spirit's call. Quite deftly, he closes the book with attention to the sacrament of communion in which “imagination, intellect, will, memory, emotion, sensation, and physicality are all engaged” (137).In short, The Call of the Spirit does more than talk about the Spirit. The book provides a philosophy and theology for practicing into the Spirit and helping others do the same. The authors believe in the readers’ intellect, deep-seated compassion, and commitment to the communities from which the adventure might play out in the most profound ways. (shrink)

Are workers dominated? A recent suite of neo-republican and relational egalitarian philosophers think they are. Suppose they are right; that is, suppose that some workers are governed by an unjust and arbitrary power existing in labour relations, which persists even in the presence of the actual ability to exit. My question is this: does that give us reason to impose restrictions on firms? According to the so-called Efficiency Objection there are relevant trade-offs that need to be considered between the efficiency (...) of firms and the freedom of workers, and upon considering these trade-offs, we should reject workplace democracy. In this paper, I present a dilemma for the Efficiency Objection. I argue that either the Efficiency Objection is justified on moral grounds or non-moral grounds; if the Efficiency Objection is justified on moral grounds, then it fails because efficiency cannot be valued for its own sake (it is only instrumentally good); if the Efficiency Objection is justified on non-moral grounds, then it fails because of the respect that we owe to persons as persons; therefore, the Efficiency Objection fails. Pragmatic arguments seek to justify the performance of an action by appealing to the benefits that may follow from that action. Pascal’s wager, for instance, argues that one should inculcate belief in God because there is everything to gain and little to lose by doing do. In this chapter I critically examine Pascal’s wager and William James’s famous “Will-to-Believe” argument by first explaining the logic of each argument and then by surveying the objections commonly arrayed against them. Finally, I suggest (...) that among the various versions of the wager found in Pascal’s Pensées is a neglected version that anticipates the Jamesian argument and that avoids the many-gods objection. By demonstrating that Kant's analysis of slavery, citizenship, and sex developed in inter-linked ways over several decades, culminating in his development of a 'trichotomy' of Right, the author shows that Kant's normative account of independence is configured through his theory of labour, and is continuous with his anthropological accounts of race and gender, providing a systemic justification for the dependency of women (...) and non-whites embedded in his philosophy of right. By examining Kant's arguments about slavery as intertwined with his account of domestic labour, the author argues that his ultimate rejection of slavery may owe more to his changing conceptualization of labour than to his theory of race, and that his final arguments against slavery rehearse strategies for embedding intersectional patterns of domestic dependence in his account of the rightful state.
