Laurent Henninger intervenant sur les « révolutions militaires » (notion située au carrefour du débat historique lancé dans les années 1980 par Geoffrey Parker – en polémique avec Jeremy Black – et du débat stratégique américain dans les années 1990) souligne que les avancées dans l’art de la guerre ont été depuis cinq siècles une des composantes majeures de la barbarisation et du totalitarisme. La notion de « révolution militaire » est aujourd’hui contestée par ceux qui y voient (...) un outil interprétatif de trop longue durée et lui préfèrent l’idée de « mutations militaires » (selon laquelle l’accumulation de changements millimétriques sur la longue durée débouche sur des ruptures). Après avoir passé en revue la première révolution militaire – XVe-XVIIe siècles – fondée sur la mise à distance de la cavalerie grâce à l’infanterie nouvelle, à l’artillerie du champ de bataille, Henninger s’interroge sur le critère discriminant pour qualifier les nouvelles guerres de la Renaissance (l’hyperviolence n’en est pas un à ses yeux) et voit dans les armes à feu la vraie rupture car elles influent de façon radicale sur la peur et le courage des combattants et sont source d’une véritable « inhumanité » dans la mesure où leur feu est « imparable ». Il insiste sur l’émergence d’un nouveau type de courage guerrier non archaïque et plus « stoïcien » marqué par l’acceptation de la mort. Dans cette perspective, l’« inhumanisation » technique porterait en elle la possibilité de la barbarisation. L. Henninger développe ensuite cette thèse à partir de l’examen des guerres mécanisées de la période 1860-1950 en s’attardant sur la guerre de Sécession puis sur la Grande Guerre. Il relie aussi la question du totalitarisme à la réflexion sur les « bombardements stratégiques massifs » et les débuts de la dissuasion nucléaire (terme qui ne s’impose que vers 1960). Il conclut en insistant sur le fait que, selon lui, la brutalisation des conflits naît toujours d’un retard de la pensée de la guerre et sur le paradoxe d’une culture occidentale qui produit en même temps barbarie de la guerre et codes qui tentent de l’enrayer. This study investigates whether the host personality and the primary alterpersonality of a woman with multiple personality disorder are controlled by the left and right hemispheres, respectively. Results support the hypothesis. Behavioral and preference measures indicate that Pe is strongly right handed and Pa is left handed. Verbal and musical dichotic tests show significantly greater accuracy for stimuli presented to the left ear for Pa and to the right ear for Pe. It is concluded that shifts in hemisphericity involve redistribution (...) of attentional resources and callosal suppression. “Conditional handedness” is proposed as a handedness subtype, characterizing persons who alternate personalities and consistently display alternate hand preferences linked to specific personality characteristics. On interprète assez souvent le succès actuel des médecines parallèles comme une réaction à une double insatisfaction que la médecine scientifique laisse au patient dans nos sociétés occidentales. D'une part, la difficulté d'être entendu comme sujet dans sa maladie, comme une personne globale affectée dans la totalité de son être, dans le sens qu'elle donne à sa vie, à ses relations, etc. Et d'autre part, la difficulté d'être appréhendé d'une manière unitaire par le médecin, corps et esprit réunis. Les différents (...) auteurs de cet ouvrage, qu'ils soient théologiens, philosophes, médecins ou historiens de la médecine, ont tous pris au sérieux ces appels à dépasser ce que l'on peut appeler les impasses de la biomédecine en proposant, selon différentes inspirations, une anthropologie renouvelée du corps humain. En particulier, s'il s'agit de faire droit aux convictions du patient et du professionnel de santé, à quelles conditions - épistémologiques mais aussi politiques - un dialogue entre l'Eglise et la science peut-il s'avérer légitime et fécond? Henninger-Voss [Figures]Approximately halfway through the "Second Day" of Galileo's Dialogue Concerning the Two Chief World Systems Galileo's mouthpiece, the mathematician Salviati, scoffs at his Aristotelian colleague Simplicio: "I see that you have hitherto been of that herd who, in order to learn (...) how matters such as this [motion] take place, and in order to acquire a knowledge of natural effects, do not betake themselves to ships or crossbows or cannons, but retire to their studies... to see whether Aristotle has said anything about them."1 Silly, simple Simplicio! He has been searching for natural philosophical wisdom in the books of natural philosophers rather than in the world of docks and arsenals. Indeed this quotation appears near the outset of Day Two wherein Salviati offers cannonshot as proof for the opposing Aristotelian position that the experience of projectiles proves the motionless state of the earth. Obviously, if the earth rotates toward the east, cannonballs shot point-blank to the west ought to travel much further than to the east. And clearly this is not so. Simplicio agrees that the new arguments offered by the cannon are excellent, "and now I see with how many elegant experiments nature graciously wishes to aid us in coming to the recognition of the truth," Simplicio enthusiastically enjoins. "What a shame there were no cannons in Aristotle's time!" exclaims the third interlocutor, Sagredo. "With them he would indeed have battered down ignorance, and spoken without [End Page 371] [Begin Page 373] the least hesitation concerning the universe."2 The irony here is not only that Aristotle might have used cannons in order to explain the workings of the universe but also that Galileo does so in the following pages. His demonstrations with reference to artillery demolish the Aristotelian position, but he has had Simplicio open the door for him by recognizing this most violent of artifices as an elegant experiment provided by nature.3The cannon provides a primary referent for Galileo's new mathematical physics of motion from his very first dialogue to his very last. The early De Motu culminated in a series of questions about the shot of cannons, while the conversation in his final masterwork, Discourses Concerning Two New Sciences, was set in the Venetian arsenal, and to it Galileo appended a table of the parabolic paths that could be expected from cannons shot at various elevations.4 In some sense Galileo turned inside-out a much older problem, one that had haunted military engineers of sixteenth-century Italy—and Galileo had been trained, and trained others, in military engineering.5 State organizers of war and captain generals were less interested in the implications the arts of fortifications and artillery held for the existing science of natural motion than in the necessity to reduce to a science, that is, a coherent body of knowledge, the rules for manufacturing cannons, planting artillery battery, aiming guns, and fortifying camps, cities, and castles.What Galileo gives us is recognizable as early physics, as a sophisticated mechanical science, a neat triumph of mathematical method in natural philosophy. But the ways and means by which mathematics came together with natural philosophy to address problems of both technology and nature are by no means neat. My claim is that attention to the military sphere will help us sort out some of those ways and means. What role does “discursive consciousness” play in decision-making? How does it interact with “practical consciousness?” These two questions constitute two important gaps in strong practice theory that extend from Pierre Bourdieu's habitus to Stephen Vaisey's sociological dual-process model and beyond. The goal of this paper is to provide an empirical framework that expands the sociological dual-process model in order to fill these gaps using models from cognitive neuroscience. In particular, I use models of memory and moral judgment that highlight the (...) importance of executive functions and semantic memory. I outline each model as it pertains to the aforementioned gaps in strong practice theory. I then use the models from cognitive neuroscience to create an expanded dual-process model that addresses how and when conscious mental systems override and interact with subconscious mental systems in the use of cultural ends for decision-making. Finally, using this expanded model I address the sociological debate over the use of interview and survey data. My analysis reveals that surveys and interviews both elicit information encoded in declarative memory and differ primarily in the process of information retrieval that is required of respondents. This is the first volume of a two-volume project whose aim is to publish all the known Middle English manuscript translations of the French Somme le mi, a thirteenth-century manual of religious instruction offering teaching on the Decalogue, the seven deadly sins and their remedies, compiled by the Dominican friar Laurent of Orleans. The project extends and deepens our knowledge of the influence of this popular French text, known today only from the versions entitled The Ayen bite of Inwit (...) and The Book of Vices and Virtues, published in 1866 and 1942, respectively. This volume presents the versions extant in BL MSS Royal 18. A. x and Add. 37677; the second will cover the versions in Cambridge, Corpus Christi College, MS 494, Oxford, Bodleian Library, MS Ashmole 1286, and Oxford, Bodleian Library, MS e Musaeo 23. The texts of both volumes have been prepared with the help of the recently-published edition of the French text, a circumstance from which the earlier English editions were unable to benefit. It is likely that the versions edited here for the first time will make a considerable contribution to our understanding of the processes of textual transmission and to that of translation itself in English literary circles of the fifteenth century. L'ordre juridique qui se met en place, en France, aux derniers siècles du Moyen Âge a encore tout récemment été l'objet de riches débats : l'auto-développement des coutumes, l'autorité des droits savants et l'interventionnisme du roi de France ont notamment été au cœur de vives controverses historiographiques. La lecture des sources est à l'origine de querelles interprétatives, auxquelles s'ajoutent des difficultés méthodologiques que rencontrent les historiens du droit. Tandis que l'historien n'a accès qu'à une proportion infime du concret, celui-ci s'efforce (...) de combler ces lacunes, parfois même à l'aide d'une projection des catégories juridiques contemporaines. Cet anachronisme des concepts – parfois couplé à un anachronisme des faits – ne constitue-t-il pas l'un des vices rédhibitoires de la discipline? Cette méthode ne présente-t-elle pas, à l'inverse, une indéniable vertu heuristique et disciplinaire? Certains estiment alors que la théorie du droit est anhistorique, quand d'autres critiquent l'emploi par les historiens des concepts contemporains, comme la hiérarchie des normes, la souveraineté ou encore l'État. Outre de telles projections, c'est le sens donné à certains signifiants médiévaux ou modernes qui peut être relativisé, comme c'est le cas notamment pour les notions de droit positif, de droit commun ou encore de loi. Ces difficultés révèlent aussi à certains égards l'ambivalence de l'histoire du droit, écartelée entre science historique et dogmatique juridique. In the wake of the Scientific Revolution initiated in physics, numerous scientists have regularly attempted to introduce experimentation and the quantification of phenomena into the life sciences. These attempts have been difficult and have systematically come up against the fact that living organisms are individuals, i.e. both totalities that are difficult to decompose and transient results of (...) an evolutionary process that gives them specific characteristics. Deliaison n'est pas rupture. L'enfance, la sexuation, le sommeil, les reves, la mort et la parole, ici interroges, montrent que l'anthropologie de Platon ne condamne ni le plaisir, ni le corps. Toutes les democraties egalitaires, detribalisees et secularisees d'Occident sont confrontees aux memes defis du communautarisme et de la reislamisation d'une partie de l'immigration - accrus par un continuel afflux de clandestins : le probleme de l'integration se pose donc moins en termes franco-francais de Republique que plus globalement de societe ouverte. Dans la perspective de Karl Popper et en usant de la liberte d'esprit et de parole chere a Jean-Francois Revel, il s'agit ici, a partir des faits, de montrer que (...) cette situation critique resulte d'abord de la forfaiture morale et parfois juridique de politiques qui n'ont pas voulu faire respecter ledroit commun democratique. Mais, surtout et en amont, de l'emprise d'une ideologie pretendument antiraciste, sans-frontieriste et acquise au relativisme multiculturel qui a perverti les valeurs de tolerance et d'ouverture: en elle se retrouvent les veritables et paradoxaux nouveaux ennemis de la societe ouverte. Faisant grand cas de l'emergence d'une resistance intellectuelle de tradition anti-totalitaire a cette bien-pensance et du combat emancipateur des musulmans libres, cette reflexion pointe le pathos masochiste qui fait oeuvrer les societes ouvertes contre elles-memes. This book addresses current practices in customary law. It includes contributions by scholars from various legal systems (the USA, France, Israel, Canada et cetera), who examine the current impacts of customary law on various aspects of private law, constitutional law, business law, international law and criminal law. In addition, the book expands the traditional concept of the rule of law, and argues that lawyers should not narrowly focus on statutory law, but should instead pay more attention to the impact of (...) practices on "real legal life." It states that the observation of practices calls for a stronger focus on usage, customs and traditions in our legal systems - the idea being not to replace statutory law, but to complement it with customary observations. An argument for an updated definition of 'human being'.

This article argues that many situations in social life can be analyzed by their requirement for the justification of action. It is in particular in situations of dispute that a need arises to explicate the grounds on which responsibility for errors is distributed and on which new agreement can be reached. Since a plurality of mutually incompatible modes of justification exists, disputes can be understood as disagreements either about whether the accepted rule of justification has not been violated or about (...) which mode of justification to apply at all. The article develops a grammar of such modes of justification, called orders of worth (grandeur), and argues that the human capacity for criticism becomes visible in the daily occurrence of disputes over criteria for justification. At the same time, it is underlined that not all social situations can be interpreted with the help of such a sense of justice, which resides on a notion of equivalence. Regimes of love, of violence or of familiarity are systematically distinct from regimes of justification. (shrink)

A expressão não é somente o objetivo de uma obra de arte, mas também a maneira segundo a qual ela funciona. (...) Este artigo mostra como as reflexões de Shaftesbury em A Notion of the Historical Draught or Tablature of the Judgement of Hercules abrem a via para uma nova maneira de considerar cada obra de arte individual como uma solução para um problema da expressão que não depende do meio empregado. Dans cet article sont commentées trois tentatives de résolution de la Belle au bois dormant, la célèbre énigme d'auto-localisation qui engendre un paradoxe probabiliste troublant : l'arbitrage fréquentiste propose une lecture ontologique des probabilités lorsque l'approche bayésienne atteint une limite ; l'analogie avec le Monty Hall s'efforce de penser de nouvelles règles de révision doxastique communes aux deux problèmes ; enfin, la leçon des compagnons encourage le partage et l'harmonisation d'estimations probabilistes entre agents rationnels. Chacun des trois arguments est rappelé (...) brièvement, puis certaines parties sont examinées plus attentivement, critiquées ou au contraire appuyées par des idées neuves, telles que la variante des Quatre Belles. Alors que La volonté de savoir s’annonce comme une archéologie de la psychanalyse et que certains voient en Foucault un « penseur de la psychanalyse », les références précises aux grands textes de la psychanalyse sont rares chez Foucault. Ses années de formation l’ont pourtant familiarisé avec les textes de Freud notamment, ainsi que le montrent les fiches de lecture conservées dans les archives Foucault. Force est de constater que cet intense effort de lecture laisse peu de traces dans son (...) œuvre. Et lorsqu’il l’évoque aussi bien dans ses écrits que ses dits, Foucault est le plus souvent approximatif. Contrairement à l’interprétation commune, en lecteur de Politzer, il est en réalité très tôt embarrassé par l’hypothèse de l’inconscient. Et quand il se met à articuler ses recherches autour de la notion de savoir-pouvoir, son usage de la psychanalyse devient stratégique et de plus en plus éloigné des textes. « Être juste » avec la psychanalyse ne fait dès lors pas partie des préoccupations de Foucault. Quitte à alimenter bien avant l’heure le « livre noir » de la psychanalyse. (shrink)

L’article s’intéresse à la manière dont Michel Foucault fait usage de la psychanalyse, dont il est un grand lecteur dans les années 1950, essentiellement de Freud. Si elle est parfois enrôlée au sein d’une « fonction-Psy » et ne fait pas l’objet d’un cours spécifique au Collège de France comme la psychiatrie, elle apparaît toutefois comme un problème de longue date, une référence qui persiste tout au long de l’œuvre de Foucault, même si elle est abordée de façon tout à (...) fait pointilliste. En ce sens, elle a un statut à part au sein de cette fonction, parfois contradictoire, assez souvent obscur, tantôt matrice de toutes les institutions disciplinaires, tantôt forme de dépsychiatrisation hors de l’asile. À côté d’un usage « instrumental » asservi à la problématique du savoir-pouvoir pointent des usages tout à fait singuliers. Foucault triture ainsi le concept d’inconscient au point de le rendre tout à fait hétérogène au savoir élaboré par Freud et révisé par Lacan. (shrink)

Que le sage ou le poète intervienne dans les affaires politiques est une vieille histoire qui débute bien avant l’invention du mot « intellectuel ». Apparu à la fin du xixe siècle dans le contexte de l’Affaire Dreyfus, il ne cessera d’être l’enjeu de luttes de classement en France : organique ou universel, chien de garde ou démocratique, médiatique ou expert. L’élaboration par Michel Foucault de la notion d’intellectuel spécifique entre bien sûr dans ce jeu, mais, à condition de ne (...) pas la prendre trop au sérieux, il convient de la reprendre à une époque de forte démonétisation de la posture. En la liant à une politique de la subjectivité, Foucault invite en effet à ne pas renoncer à l’exercice d’une fonction critique qui établit un rapport au vrai nécessaire à la vie démocratique. Cognitive forms vary considerably as a human being detaches herself from what is closest and most personal and moves to communicate — in the broad sense of taking part in a common matter — across increasing relational distances. The article proposes to deal with the variety of cognitive formats which cannot `commonize' cognition to an equal degree, relating them to a set of regimes of engagement with the world that are identified in terms of the dependency between the human agent (...) and her environment. The good that engagement aims to guarantee orients how reality is grasped and specifies the format of what constitutes relevant information. This analysis offers new insight into the composition of communities as well as persons who have to cope with the plurality of cognitive formats and engagements from the very familiar to the most public. Why is contempt seen as potentially lacking in the respect for persons and therefore prima facie subject to negative moral evaluation? This paper starts by looking at a distinctive feature of contempt in the context of thick relationships, such as those of friendship, close professional collaboration, or romantic love: there is an irreversibility effect attached to the experience of contempt. Once contempt occurs in a thick relationship, it seems very difficult to return to non-contemptuous reactive attitudes. The second part argues (...) that the irreversibility effect is due to the fact that contempt is an affective attitude which tends to invisibilize the person who is the object of contempt. The tendency to invisibilize is inscribed in the intentional structure of contempt as well as in its motivational dimension. The final part explores some consequences of this hypothesis, and in particular argues that it also explains why contempt motivated by abject wrongdoing, as opposed to resentment, anger, or hatred, tends to block any process of forgiveness. Nous comparons les notions d’usage et de signification chez Ludwig Wittgenstein et Martin Heidegger. Contrairement à Jocelyn Benoist, nous pensons que l’analogie entre Wittgenstein et Heidegger n’est pas superficielle. La métaphysique de Heidegger explicite certaines présuppositions implicites de la seconde philosophie de Wittgenstein. Le pragmatisme naturaliste de Wittgenstein peut être théorisé. Notamment la notion wittgensteinienne d’usage, ou de jeu de langage, peut être comprise comme une pratique à la fois naturelle et normative régie par des règles. -/- Wittgenstein’s notions of (...) use and meaning are compared with the corresponding Heidegger’s ones. Unlike Jocelyn Benoist, we suggest that the analogy between Wittgenstein and Heidegger is not superficial. Heidegger’s metaphysics makes explicit some of the implicit presuppositions of Wittgenstein’s philosophy. Wittgenstein’s naturalistic pragmatism can be theorized. In particular, Wittgenstein’s notion of use, or language game, can be understood as both natural and normative rule- governing practice. (shrink)
