C'est bien le sens donné à cet hommage à André-Jean Arnaud. Repenser le droit, c'était pou r cet auteur érudit : repenser les lieux, les conditions et les façons de l'étudier en dépassant les frontières géographiques en même temps que les frontières disciplinaires. This article investigates account episodes in Italian family dinner conversations and illustrates how sequential patterns and participation are organized in terms of preferences indexical of moral ideology and moral order. Accounts have been mostly examined as speech acts abstracted from embedding sequential environment; this article shows that different design features of the priming move in account episodes retrospectively define different aspects of a situation as problematic and prospectively activate the relevance for distinctive remedial moves. On an ideological level, narrative elicitations (...) as priming moves and accounts as remedial moves index a moral perspective that promotes moral reasoning and thus the negotiation of norms. In addition, such moves realize a practice of morality that tends to be inquisitory vs condemnatory, offering the benefit of the doubt prior to guilt allocation. In conclusion, the discursive mechanics of accountability constitutes a medium for reproduction of, and innovation in, the moral order. (shrink)

Recent attempts to undermine his argument rely either on the claim that diminishing certain capacities always harms an animal's welfare or on the claim that it always violates an animal's integrity. I argue that these fail. However, respect for animal dignity provides a defeasible reason not to engineer an animal in a way that inhibits the development of those (...) functions that a member of its species can normally perform, even if the modification would improve the animal's welfare. Extracting the regularities of our environment is one of our core cognitive abilities. To study the fine-grained dynamics of the extraction of embedded regularities, a method combining the advantages of the artificial language paradigm and the serial response time task was used with a group of Guinea baboons in a new automatic experimental device. After a series of random trials, monkeys were exposed to language-like patterns. We found that the extraction of embedded patterns positioned at the end of larger patterns (...) was faster than the extraction of initial embedded patterns. This result suggests that there is a learning advantage for the final element of a sequence that benefits from the contextual information provided by previous elements. (shrink)

The literature on the natural-resource-based view of firms has mostly focused on the positive relationship between financial performance and environmental innovation. The present study extends this research by addressing recent calls to identify the specific managerial approaches that affect a firm’s ability to financially benefit from an innovative environmental strategy. In particular, the focus is on how the selected international scope of patented environmental innovations affects a firms’ financial performance. The sample used included a 5-year data panel of 3,087 environmental (...) patent applications by the 79 Information and Communication Technology firms in the Financial Times Global 500 firms list. The findings indicate that the geographical scope of the exploitation of environmental patents increases the positive relationship between patented environmental innovation and financial performance whereas the geographical scope of knowledge sourcing of environmental patents does reduce this performance. La présente étude propose de faire le point, à travers une sélection d’occurrences extraites d’un document commun, sur la manière dont la classe des pronoms est décrite dans une perspective cognitive. Il s’agit notamment de comprendre comment le traitement des pronoms s’insère dans une modélisation plus large du langage, et à l’inverse, comment celle-ci influence les perspectives sur la classe. Plus spécifiquement, hormis certaines modélisations de l’accès à la référence, c’est la Grammaire Cognitive de Langacker qui est considérée ici. Après (...) une définition du terme même de perspective « cognitive », l’étude met en avant les caractéristiques partagées des pronoms dans ce modèle. Elle propose ensuite un panorama des différentes sous-classes de pronoms. Elle fait apparaître notamment la centralité du pronom personnel et du démonstratif ; le rejet du principe de réagencement au profit de constructions ; le rejet du principe de pronoms « vides de sens » ; enfin, une extension de la notion d’impersonnel à we ou they. Le concept de « clivée en there », emprunté à Davidse et Reeve plutôt qu’à la Grammaire Cognitive, est également proposé. (shrink)

En este trabajo realizamos una revisión historiográfica sobre la fabricación de anatomías artificiales que fueron ampliamente demandadas como herramientas didácticas en la enseñanza de la naturaleza, entre finales del siglo XVIII y principios del XX. Se analizan los contextos educativos y sociales que favorecieron la amplia difusión de este tipo de artefactos en el comercio de la cultura científica, y se describen las técnicas de manufactura. Se concluye que estos artefactos, fruto del ingenio humano, son fuentes materiales de extraordinario valor (...) para comprender la construcción y evolución de la ciencia, los avances en los recursos pedagógicos y las innovaciones tecnológicas. Dans le cadre d’une approche pragmatique, centrée sur l’usage en contexte des formes linguistiques, nous opérons une disjonction fondamentale entre fonction d’exclamation et formes d’exclamation. Le corpus choisi illustre la grande diversité des formes d’exclamation en anglais, qui ne se réduisent pas aux exclamatives en what et how. En nous appuyant sur divers travaux pragmatiques, nous montrons que la fonction d’exclamation est éminemment complexe, liée à l’expression de la subjectivité du locuteur mais également à des paramètres intersubjectifs : elle exprime (...) prototypiquement un décalage cognitif entre un état de fait et des représentations, ou entre deux états de fait, mais elle peut aussi être motivée par des conventions sociales, ou participer d’un positionnement expressif particulier d’un locuteur vis-à-vis de son interlocuteur. À partir d’une réflexion sur le « tout parfait » (Aristote) et le « tout de puissances » (Boèce), Alexandre forge un concept de totalité compatible avec la présence d’immensité divine et même, dans le cas de Bonaventure, avec (...) l’infinité et la simplicité de Dieu. For different reasons, Husserl's original, thought-provoking ideas on the philosophy of logic and mathematics have been ignored, misunderstood, even despised, by analytic philosophers and phenomenologists alike, who have been content to barricade themselves behind walls of ideological prejudices. Yet, for several decades, Husserl was almost continuously in close professional and personal contact with those who created, reshaped and revolutionized 20th century philosophy of mathematics, logic, science and language in both the analytic and phenomenological schools, people whom those other makers of (...) 20th century philosophy, Russell, Frege, Wittgenstein and their followers, rarely, if ever, met. Independently of them, Husserl offered alternatives to the well-trodden paths of logicism, nominalism, formalism and intuitionism. He presented a well-articulated, thoroughly argued case for logic as an objective science, but was not philosophically naive to the point of not seeing the role of subjectivity in shaping the sense of the reality facing objective science. Given the preeminent role that philosophy of logic and philosophy of mathematics have played in transforming the way philosophy has been done since Husserl's time, and given the depth of his insights and his obvious expertise in those fields, his ideas need to be integrated into present-day, mainstream philosophy. Here, philosopher Claire Ortiz Hill and mathematician-philosopher Jairo da Silva offer a wealth of interesting insights intended to subvert the many mistaken idees recues about the development of Husserl's thought and reestablish broken ties between it and philosophy now. This article proposes to retrace the path of trust that Paul Ricœur has drawn across his works. If the concept of trust is never themed as such, nevertheless it unfolds in subtle ways in fields as diverse as ethics, morality, politics, and religion. We will argue that trust is a solid but fragile foundation for Ricœur’s recognition theory. Rooted in man’s structural disproportion, trust is a perpetual tension between the finitude of existence and the infinitude of mutual recognition, between the (...) ability and fallibility of the human being -it is thus a continuous search, always disappointing but always renewed, of a mediation between the self and the other, the hope of happiness and the reality of evil. The analysis of various forms of trust, including interpersonal and institutional forms, will then be coupled with a study of trust in practical terms, based on Ricœur’s approach to healthcare relationships, or the perception of foreigners. El súbito consenso que se ha producido en nuestros días alrededor de la importancia de la noción democracia no se ha acompañado de una reflexión filosófica sobre su sentido moderno. La obra filosófica de Claude Lefort ha contribuido a llenar este vacío teórico. Para Lefort, el sentido de la democracia moderna no puede revelarse, como ha supuesto la ciencia política, a través de la descripción del funcionamiento de sus instituciones, sino puede estudiarse mediante la exploración de su dimensión simbólica. En (...) efecto, la fundación y el destino de la democracia son inseparables de la indeterminación de sus fundamentos y de la infigurabilidad del poder, de la ley y del saber. Origen y destino que bien pueden ser rastreados a la luz del contraste entre la sociedad democrática y la sociedad totalitaria. El presente ensayo se ocupa de contrastar la dimensión simbólica de ambas formas de sociedad. Claude Lefort’s philosophical work has helped to fill this theoretical vacuum. According to Lefort, the sense of modern democracy cannot be disclosed, as political science has assumed, just by describing the operation of its institutions. Rather, it may be studied by exploring its symbolic dimension. In fact, democracy’s origin and fate are inseparable from the indeterminacy of its foundation and the non-figurable nature of power, law and knowledge. Such an origin and fate may indeed be tracked in light of the contrast between the democratic society and the totalitarian one. The ABO histo‐blood group, first discovered over a century ago, is found not only in humans but also in many other primate species, with the same genetic variants maintained for at least 20 million years. Polymorphisms in ABO have been associated with susceptibility to a large number of human diseases, from gastric cancers to immune or artery diseases, but the adaptive phenotypes to which the polymorphism contributes remain unclear. We suggest that variation in ABO has been maintained by frequency‐dependent or (...) fluctuating selection pressures, potentially arising from co‐evolution with gut pathogens. We further hypothesize that the histo‐blood group labels A, B, AB, and O do not offer a full description of variants maintained by natural selection, implying that there are unrecognized, functionally important, antigens beyond the ABO group in humans and other primates. When a new piece of information contradicts a currently held belief, one has to modify the set of beliefs in order to restore its consistency. In the case where it is necessary to give up a belief, some of them are less likely to be abandoned than others. The concept of epistemic entrenchment is used by some AI approaches to explain this fact based on formal properties of the belief set (e.g., transitivity). Two experiments were designed to test the hypothesis (...) that contrary to such views, (i) belief is naturally represented by degrees rather than in an all-or-nothing manner, (ii) entrenchment is primarily a matter of content and not only a matter of form, and (iii) consequently prior degree of belief is a powerful factor of change. The two experiments used Elio and Pelletier's (1997) paradigm in which participants were presented with full simple deductive arguments whose conclusion was denied, following which they were asked to decide which premise to revise. Concernant l’éducation à la vie affective et sexuelle, depuis septembre 2018, la circulaire de Jean-Michel Blanquer remplace celle de 2003. Si, comme la précédente, elle préconise trois séances annuelles, elle innove avec une articulation entre trois champs de compétences : biologique, psycho-émotionnel et juridico-social. L’auteure, qui exerce en centre de planification et d’éducation familiale et anime des interventions auprès d’adolescents au collège, présente ce dispositif, vignette à l’appui. Henri Bergson, Vladimir Jankélévitch, Emmanuel Levinas ont en commun d'avoir marqué la philosophie européenne du XXe siècle. En plus de leurs oeuvres respectives, ils ont tous les trois entretenu des liens manifestes à la fois dans leurs textes et dans leurs biographies. De ce trio, on ne peut pas dire que Bergson, philosophe pourtant déjà installé dans le paysage intellectuel français, prenne la place privilégiée du maître. Ni Jankélévitch, ni Levinas n'ont été, à proprement parler, ses élèves, cependant une relation (...) étroite s'est instaurée entre eux, marquée non pas par une posture de déférence, mais par des préoccupations conceptuelles partagées ainsi qu'un travail engagé sur des questions communes. Les pensées de Jankélévitch et Levinas sont liées par un même franc retrait vis-à-vis de la majorité des courants philosophiques dominants à leur époque, notamment la vogue existentialiste. N'adhérant pas à cette tendance, Jankélévitch et Levinas se tournent vers Bergson pour saisir l'inactualité des questions posées par sa pensée ; plutôt que la restitution de ses thèses, leurs interactions reposent sur un véritable dialogue dans lequel chacun apporte une variation nouvelle. Ces trois philosophes seront finalement réunis par le partage de questions fondamentales, qui résistent à la compréhension et qui s'ouvrent au souci de l'expérience proprement humaine : métaphysique, morale, temps. Bergson, Jankélévitch et Levinas, trois philosophes français marqués par une même inquiétude face à la dégradation de l'humain ; trois moments qui forment une ligne de pensée discrète mais irradiant la philosophie contemporaine, révélée après-coup par les suites qu'elle a autorisées. RESUMEN Con un enfoque cualitativo y alcance descriptivo, el presente artículo tiene como objetivo sintetizar aspectos de materiales publicados en diversas fuentes relacionados con el estrés para lo cual se emplea el método de revisión bibliográfica. Durante el estudio se encontraron aspectos teóricos que permiten entender la evolución del concepto, acceder a modelos, evaluar la repercusión del fenónemo y constatar instrumentos para su evaluación, así como obtener sugerencias para controlarlo. Se concluye que el estrés puede ser percibido como positivo o (...) negativo según el manejo que hace cada individuo y su estilo de afrontarlo, es una manifestación relacionada con el proceso salud enfermedad en el que, para algunos, contribuye al crecimiento personal y en otros, a su malestar o enfermedad. ABSTRACT With a qualitative approach and descriptive scope, the present article takes as an objective to synthesize aspects of materials published in diverse sources related to the stress for which uses the method of bibliographical review. During the study there were theoretical aspects that allow understanding the evolution of the concept, gaining access to models, evaluating the aftereffect of the phenomenon and state instruments for their evaluation, as well as obtaining suggestions to control it. It was concluded that the stress can be perceived as positive or negative according to the handling that there does every individual and its style of confronting it, a declaration related to the process is a health illness in the one that, for some, contributes to the personal growth and in others, to its discomfort or illness. This paper is part of an ongoing research project and builds upon a previous one in which we explain the failure of the Agency Theory through the Shell case. In that, we analysed the behaviour of Shell managers, who reclassified oil reserves, playing with the share price because they owned share options. This previous paper established an important literature framework that is continued and organized to go deeper into our analysis in this paper. The goal here is to show that (...) the way that is supposed to be the right tool to inform stakeholders – disclosure – is not enough, and even in the Shell case, no one would have noticed the problems with the oil reserves through the mere analysis of the company disclosure during the ‘strange period’ . The methodology used in this paper is lexical analysis, which seems to be an innovative and effective approach to the analysis of Corporate Social Disclosure, given the un‐codified nature of the latter. The conclusions obtained highlight the problem of lack of transparency in the contents of corporate social disclosure: some firms avoid communicating crucial contents, some others twist the results in order to camouflage advantages to shareholders or managers. If it is like this for disclosing firms, what is happening in the case of non‐disclosing firms? (shrink)

Introducción. En la actualidad la relación de los niños con las tecnologías de la información y las comunicaciones se inicia desde muy temprano, mediado por la figura de sus padres y contrario a los criterios de gran parte de la comunidad científica por sus potenciales efectos adversos. Objetivo. El estudio tuvo como objetivo identificar los criterios de los padres de la ciudad de Santa Clara sobre la utilidad y el riesgo del consumo de las tecnologías de la información y las (...) comunicaciones en niños menores de 3 años. Métodos. Se llevó a cabo un estudio descriptivo y transversal durante el período de junio de 2013 a julio de 2014. En el mismo fueron encuestados y entrevistados 167 padres de niños menores de 3 años de la ciudad de Santa Clara. La selección de la muestra se efectuó por el muestreo estratificado por racimos. El procesamiento de los datos se realizó mediante el SPSS versión 18.0. Resultados. Los principales resultados demostraron que los padres de niños menores de 3 años tienen una baja percepción de riesgo sobre las afectaciones que el consumo de estas tecnologías puede producir. Consideran, además, que dicho consumo facilita el cuidado del menor; en tanto permite atender otras labores domésticas, ofrece un tiempo libre y constituye una actividad segura. Conclusiones. Estos criterios de los padres favorecen el consumo excesivo de estas tecnologías y son el resultado de la escasa información recibida al respecto. Introduction. Currently, the relation of children with information and communication technologies starts at an early age, mediated by their parents and contrary to the criteria of great part of the scientific community, by its potential adverse effects. Objetive. The objective of this study was to identify the criteria of parents on the usefulness and risk of consumption of information and communication technologies in children under 3 years in the city of Santa Clara. Methods. A descriptive and transversal study was carried out from June 2013 to July 2014. A total of 167 parents of children under 3 years were surveyed and interviewed in Santa Clara city. A stratified cluster sampling was performed. Results. It was demonstrated that parents of children under 3 years had a low risk perception on the harm that can be produced by consuming these technologies. Also, they considered that this consumption facilitates the caring of the child, since it permits to fulfill other domestic duties, provides a free time and it is a safe activity. Conclusions. The criteria of parents favor the excessive consumption of these technologies and they are consequence of the scarce information received on this subject respecto. (shrink)
