Herbert Lionel Adolphus Hart was born in Yorkshire in 1907 to second generation Jewish immigrants. Having won a scholarship to Oxford University, he went on to become the most famous legal philosopher of the twentieth century. From 1932-40 H.L.A Hart practised as a barrister in London. He was pronounced physically unfit for military service in 1940, and was recruited by MI5, where he worked until 1945. During his time at the Bar he had continued to study philosophy and at M15 (...) his interest was further stimulated by his philosopher colleagues in M16, Stuart Hampshire and Gilbert Ryle. After the war, Hart returned to Oxford to take up a philosophy fellowship, later to become Professor of Jurisprudence. H.L.A Hart single-handedly reinvented the philosophy of law and influenced the nation's thinking in the 1960s on abortion, the legalization of homosexuality, and on capital punishment. Hart's approach to legal philosophy was at once disarmingly simple and breathtakingly ambitious, combining as it did the insights of Austin and Bentham and the new linguistic philosophy of J.L. Austin and Ludwig Wittgenstein. He sought to elucidate a concept of law which would be of relevance to all forms of law, wherever or whenever they arose: his bestselling book, The Concept of Law, has sold tens of thousands of copies worldwide. In 1941, he married Jenifer Williams (a high-ranking civil servant, later an Oxford academic) with whom he had four children. Their relationship was an enduring if unconventional one. In the early 1950s, Jenifer was rumoured to be having a long-standing affair with Isaiah Berlin, one of Hart's closest friends. She was also, falsely, accused by the Sunday Times of having been a Russian spy, an allegation which was all the more scandalous given Hart's position at MI5 during the War. Nicola Lacey draws on Hart's previously unpublished diaries and letters to reveal a complex inner life. Outwardly successful, Hart was in fact tormented by doubts about his intellectual abilities, his sexual identity and his capacity to form close relationships. Her biography also sheds fascinating light on the origins of his ideas, and assesses his overall contribution. Above all, it chronicles of a life which had a depth ands impact far greater than many of Hart's readers have realized. (shrink)

We argue that work on norms provides a way to move beyond debates between proponents of individualist and structuralist approaches to bias, oppression, and injustice. We briefly map out the geography of that debate before presenting Charlotte Witt’s view, showing how her position, and the normative ascriptivism at its heart, seamlessly connects individuals to the social reality they inhabit. We then describe recent empirical work on the psychology of norms and locate the notions of informal institutions and soft structures with (...) respect to it. Finally, we argue that the empirical resources enrich Witt’s ascriptivism, and that the resulting picture shows theorists need not, indeed should not, choose between either the individualist or structuralist camp. IVF as lottery or investment: contesting metaphors in discourses of infertilityThis paper reports an aspect of a poststructural feminist study in which I explored the discursive formations within which women for whom in vitro fertilisation (IVF) was unsuccessful constitute themselves. In my exploration I draw on data from interviews with women who discontinued infertility treatment, print media material and infertility self‐help books. Specifically, I highlight a metaphor of lottery in discourses of infertility, arguing that it is hegemonic and showing how (...) when women are situated as gamblers, the metaphor is instrumental in polarising them into ‘winners’ or ‘losers’ in relation to the subjectivity of motherhood. I further deconstruct these subjectivities, showing how ‘winners’ are valorised and ‘losers’ are pathologised. But importantly, I show how infertile women who are not mothers resisted locating themselves as ‘losers’ in a metaphor of lottery and instead situated themselves in a contesting metaphor of investment as diligent ‘workers’ and as active agents in choosing the best employment of their bodily and monetary resources. This paper therefore amplifies the marginalised perspective of infertile women who are not mothers. (shrink)

We investigate the relation between intermediate predicate logics based on countable linear Kripke frames with constant domains and Gödel logics. We show that for any such Kripke frame there is a Gödel logic which coincides with the logic defined by this Kripke frame on constant domains and vice versa. This allows us to transfer several recent results on Gödel logics to logics based on countable linear Kripke frames with constant domains: We obtain a complete characterisation of axiomatisability of logics based (...) on countable linear Kripke frames with constant domains. Furthermore, we obtain that the total number of logics defined by countable linear Kripke frames on constant domains is countable. (shrink)

Seit fast 200 Jahren wird Clausewitz gelesen und interpretiert. Rasmus Beckmann erschließt seine Kriegstheorie den modernen Sozialwissenschaften. Dabei wird deutlich, dass sich Clausewitz keineswegs auf zwischenstaatliche Kriege beschränkt hat. Auch die asymmetrischen Kriege kann man durch seine Theorie besser analysieren und verstehen. Dies zeigt der Autor am Beispiel des Afghanistankrieges.

Individuals shift their language to converge with interlocutors. Recent work has suggested that convergence can target not only observed but also expected linguistic behavior, cued by social information. However, it remains uncertain how expectations and observed behavior interact, particularly when they contradict each other. We investigated this using a cooperative map task experiment, in which pairs of participants communicated online by typing messages to each other in a miniature “alien” language that exhibited variation between alien species. The overall task comprised (...) three phases, in each of which participants were told that they would be paired with a different partner. One member of the pair was given explicit linguistic expectations in each phase, while the software controlled whether or not observed behavior from their partner would be consistent or inconsistent with these expectations. The other participant was given no such expectations, allowing us to control for the role of expectation. Participants converged to both observed and expected linguistic behavior, and convergence was boosted when observation and expectation were aligned. When expected and observed behavior were misaligned, participants updated their expectations, though convergence levels did not drop. Furthermore, participants generalized what they learned about one partner to apparent novel partners of the same alien species. We also discuss individual variation in convergence patterns and the lack of a relationship between linguistic convergence and success at the map task. Findings are consistent with observations outside the laboratory that language users converge toward expected linguistic behavior. They also have broader implications for understanding linguistic accommodation and the influence of social information on linguistic processing and production. (shrink)

In this chapter, the authors aim to review what they take to be the primary philosophical claims or concerns of fat activism and introduce a framework for understanding a primary strategy of fat activism as public philosophy. Fat activism is a robust and important example of public philosophy. The authors also review the limited work done within mainstream philosophy on fat oppression. They use the theoretical apparatus of master narratives and counter‐stories to explore a primary strategy of fat activism as (...) public philosophy. Master narratives are pervasive and interlocking; the beliefs within the master narrative are knitted together to keep some people in power while others are subjugated under this power. The authors present the counter‐storytelling that seeks to undermine and disrupt the dominant narrative about fatness and fat people and highlight the organizations and public philosophers who both theorize and take action toward a fat‐liberated future. As forms of private self-regulation, multi-stakeholder initiatives have emerged as an important empirical phenomenon in global governance processes. At the same time, MSIs are also theoretically intriguing because of their inherent double nature. On the one hand, MSIs spell out CSR standards that define norms for corporate behavior. On the other hand, MSIs are also the result of corporate and stakeholder behavior. We combine the perspectives of institutional theory and club theory to conceptualize this double nature of MSIs. Based on (...) a stage model that looks at the interplay of actor and institutional dynamics, we generate insights into why actors join a voluntary MSI, how the various motivations and intentions of the actors influence the standard development, and how these as well as the MSI design are subsequently influenced by both external and internal dynamics. This article introduces an “ordonomic” approach to corporate citizenship. We believe that ordonomics offers a conceptual framework for analyzing both the social structure and the semantics of moral commitments. We claim that such an analysis can provide theoretical guidance for the changing role of business in society, especially in regard to the expectation and trend that businesses take a political role and act as corporate citizens. The systematicraison d'êtreof corporate citizenship is that business firms can and—judged by the criterion of (...) prudent self-interest—“should” take on an active role in rule-finding discourses and rule-setting processes with the intent of realizing a win-win outcome of the economic game. Background: Recent research demonstrates that people sometimes make different medical decisions for others than they would make for themselves. This finding is particularly relevant to end-of-life decisions, which are often made by surrogates and require a trade-off between prolonging life and maintaining quality of life. We examine the impact of decision role, patient age, decision maker age and multiple individual differences on these treatment decisions. Methods: Participants read a scenario about a terminally ill cancer patient faced with a choice between (...) an aggressive chemotherapy regimen that will extend life by two years and palliative treatments to control discomfort for one remaining month. Participants were randomly assigned to one of three decision roles (patient, physician, or an abstract other) and the scenario randomly varied whether the patient was described as 25 or 65-years old. Results: When deciding for a 65-year old patient, approximately 60% of participants selected aggressive chemotherapy regardless of decision role. When deciding for a 25-year old patient, however, participants were more likely to select chemotherapy for a patient (physician role) or another person (abstract other) than for themselves (70%, 67%, and 59%, respectively). In addition, confidence that powerful others (eg, physicians) control one’s health, as well as respondents’ age and race, consistently predicted treatment choices. Conclusions: Patient age appears to influence medical decisions made for others but not those that we make for ourselves. These findings may help to explain the discord that often occurs when younger cancer patients refuse life-extending treatments. (shrink)

Utilitarianism has been attacked many times and from many points of view. Among other objections has been the charge that it cannot account for the moral phenomena connected with justice; we are interested, it is said, not only in producing as much good as possible, but also in distributing it in a certain way. The Utilitarian usually replies that these phenomena either can be deduced from Utilitarianism or are illusory, but a natural reluctance to go against the data of our (...) moral experience usually inclines him to the first alternative. One of the most interesting of the Utilitarians from this point of view is Sidgwick, because he makes Utilitarianism his philosophical basis, but at the same time he has a set of maxims 2 part of whose purpose is to cover the common-sense views on justice. In this article I shall consider the relations between these maxims and Utilitarianism, and shall try to show by means of an example that some of them do go beyond Utilitarianism, and that in so far, at any rate, as these maxims do represent the common-sense view, it and Utilitarianism are not in all cases strictly reconcilable. ABSTRACT:The notion of “democracy” has become a much-debated concept in scholarship on business ethics, management, and organization studies. The strategy of this paper is to distinguish between a principle of organization that fosters participation and a principle of legitimation that draws on consent. Based on this distinction, we highlight conceptual shortcomings of the literature on stakeholder democracy. We demonstrate that parts of the literature tend to confound ends with means. Many approaches employ type I democracy notions of participation and often (...) take for granted that this also improves type II democratic legitimation. We hold this to be a mistake. We provide examples of the ambiguity of organizational procedures and show that under some circumstances a decrease in the degree of participation may actually increase legitimation because a governance structure that results in higher productivity can provide higher benefits for all parties involved, serve their interests and therefore meet their agreement. Less type I democracy may mean more type II democracy. We believe this to be an important insight for judging the legitimacy of both capitalistic firms and competitive markets. (shrink)

Researchers rely on psychometric principles when trying to gain understanding of unobservable psychological phenomena disconfounded from the methods used. Psychometric models provide us with tools to support this endeavour, but they are agnostic to the meaning researchers intend to attribute to the data. We define method effects as resulting from actions which weaken the psychometric structure of measurement, and argue that solution to this confounding will ultimately rest on testing whether data collected fit a psychometric model based on a substantive (...) theory, rather than a search for a model that best fits the data. We highlight the importance of taking the notions of fundamental measurement seriously by reviewing distinctions between the Rasch measurement model and more generalised 2PL and 3PL IRT models. We then present two lines of research that highlight considerations of making method effects explicit in experimental designs. First, we contrast the use of experimental manipulations to study measurement reactivity during the assessment of metacognitive processes with factor-analytic research of the same. The former suggests differential performance-facilitating and -inhibiting reactivity as a function of other individual differences, whereas factor-analytic research suggests a ubiquitous monotonically predictive confidence factor. Second, we evaluate differential effects of context and source on within-individual variability indices of personality derived from multiple observations, highlighting again the importance of a structured and theoretically grounded observational framework. We conclude by arguing that substantive variables can act as method effects and should be considered at the time of design rather than after the fact, and without compromising measurement ideals.
