It is hard to imagine a threat to international security or a tension within U.S. foreign policy that does not involve the imposition of economic sanctions. Australia, Canada, the European Union, Japan, South Korea, and others also have autonomous sanctions regimes, spanning a broad range of contexts and purpose. Most well-known are those concerning weapons proliferation, terrorism, and human rights violations; but sanctions are also imposed in such contexts as money laundering, corruption, and drug trafficking. States may also impose sanctions as a means to achieve foreign policy goals: to pressure a foreign state to bend to the sanctioner's will, to punish those who represent a threat to the sanctioner's economic or political interests, or to seek the end of a political regime toward which the sanctioner is hostile, to give but a few examples. United Nations Security Council resolutions raise distinctive problems of interpretation, particularly in the context of Chapter VII measures. In disputes of interpretation, the stakes are very high, since Chapter VII measures may explicitly or implicitly authorize military action; may override the target nation’s sovereignty; and may put lives at risk. However, there is no direct, binding judicial review of Security Council measures where questions of interpretation can be resolved. Consequently, interpretive disputes are resolved in a highly politicized process. This article (...) considers three situations where the language of the resolutions was ambiguous. In this chapter, we identify and present predominant debates at the intersection of ethics and imagination. We begin by examining issues on whether our imagination can be constrained by ethical considerations, such as the moral evaluation of imagination, the potential for morality’s constraining our imaginative abilities, and the possibility of moral norms’ governing our imaginings. Then, we present accounts that posit imagination’s integral role in cultivating ethical lives, both through engagements with narrative artworks and in reality. Filial obligation and its implications have been little-debated in ethics. The basis of informed consent in libertarian positions may be challenged by inclusion of others beyond the immediate doctorpatient relationship. Some of the literature arguing for and against filial duty, including feminist literature, is presented as a backdrop to the argument that a patient’s family, and further, his or her community, contains the source of a broader perspective regarding decisions concerning his or her medical treatment. Communitarian models allow for a (...) medical decision to be owned by some or all stakeholders in patient outcomes. Although such a position undoubtedly confronts traditional notions of autonomy, it offers an alternative that may positively impact the practice of medicine by providing a more holistic treatment context. New models premised on shared decision-making will be presented as frameworks that may provide a theoretical basis for greater physician input into medical decisions that impact a patient’s family members and in more global terms, his or her community. The Roman thinker and politician Cicero may seem worlds away from us and our twenty-first-century problems. As long as he lived, Cicero's practical aims were to strengthen the power of the senatorial class and his own personal influence over others. He did not view the republic as a means toward collective betterment, and never questioned his rich and aristocratic peers' militaristic values and commitment to an empire secured by violence and economic exploitation. One of the central issues in political philosophy is the problem of perspective: if there is a dispute as to how justice is to be defined, or a dispute as to whether a particular situation is unjust, how do we determine who is right? I reject the claim that an idealized speech situation or a transcendental perspective can legitimately be invoked to resolve such disputes. In their place, I discuss critical theory's commitment to the position that all perspectives are (...) ideo logical, partial, and rooted in interests. I then discuss Lukács's notion that, given that ideology and interests are ineluctable, certain per spectives are epistemologically privileged (though not transcenden tal). I discuss the notion of the preferential option for the poor in liberation theology, as an instance of such a claim of epistemological privilege. I argue that this has implications for the concept of alterity, and specifically for the role of the Other in a community of discourse. Finally, I discuss Lyotard's notion of incommensurable phrase regi mens, and the particular kind of harm which is done by exclusion from a discursive community. Ulrich Beck asserts that global risks, such as climate change, generate a form of ‘compulsory cosmopolitanism’, which ‘glues’ various actors into collective action. Through an analysis of emerging ‘cosmopolitan risk communities’ in Chinese climate governance, this article points out a ‘blind spot’ in the theorization of cosmopolitan belonging and an associated inadequacy in explaining shifting power relations. The article addresses this problem by engaging with the intersectionality of the cosmopolitan space. It is argued that cosmopolitan belonging is a form of (...) performative identity. Its key characteristic lies in a ‘liberating prerogative’, which enables individuals to participate in the solution of common problems creatively. Civics and Moral Educationwas implemented as a new moral education programme in Singapore schools in 1992. This paper argues that the underlying theme is that of citizenship training and that new measures are under way to strengthen the capacity of the school system to transmit national values for economic and political socialisation. The motives and motivation for retaining a formal moral education programme have remained strong. A discussion of the structure and content of key modules in Civics and Moral (...) Education shows how curriculum writers have attempted to integrate separate strands of civics and moral education from earlier programmes and present them in a less divisive manner. This essay on the life and work of Pamela Sue Anderson traces aspects of her scholarly work that I was very fortunate to share with her over twenty-six years. What brought us together was our commitment to feminism but also our strong interest in the work of Paul Ricoeur – which seemed to many people an odd combination, given Ricoeur’s silence on the topic of women and gender issues. Over the years, we met at conferences, read each other’s books, (...) and published articles in each other’s publications. My principal aim is to chart her own journey and her relation to the work of Paul Ricoeur. What was remarkable in Pamela’s work was her passionate commitment, which was especially contagious. Her early work on the philosopher Kant was rigorous in ways that helped to initiate a wealth of new scholarship and increased an awareness of Ricoeur’s Kantian influence. In relation to Ricoeur’s work, Pamela was intrigued by his silence on women, but she realized that, given his dialogical approach, she could attempt not only to introduce feminist insights but also to expand his ideas so as to incorporate philosophy of religion. First, she integrated Ricoeur’s approach of the hermeneutics of suspicion to assist in this task. Then she adapted his writings on hospitality. But it was only when Ricoeur turned his attention to human suffering and vulnerability in his later years – a topic that resonated deeply with Pamela – that she was moved to write specifically in ways that helped incorporate her insights with Ricoeur’s in constructive ways. I trace Ricoeur’s development, starting from Fallible Man and Freedom and Nature, by way of The Symbolism of Evil, Oneself as Another, and The Course of Recognition, as he delineates his project. In this journey, (...) Ricoeur emerges from the strict Protestant training of his youth to a more pluralist and inclusive ideal. During his elaboration of the ethical, as well as political and social conditions where human beings can flourish, Ricoeur does not appeal directly to religious terminology. This book introduces the special dynamics of women and their close relationships with the gift in both past and contemporary religious settings. This essay reads Godwin's second novel, St. Leon (1799), as an attempt to counter the asperity he expresses towards the domestic affections in his political philosophy of the 1790s. In St. Leon, Godwin seeks to square his newfound interest in the affections as a topic for fiction with his commitment to an anti-establishment political agenda. Though it is presented as a ‘eulogium’ to ‘the affections and charities of private life’, the narrative persistently undercuts the potential for the affections (...) to stimulate readerly curiosity. The focus of the novel constantly shies away from the domestic scene, and instead propels the momentum forwards to the alchemical adventures that precipitate the disintegration of the very affections the novel purports to eulogise. The novel thus plays out Godwin's complicated desire to embrace, and yet simultaneously to deny, the importance of private emotions in the pursuit of political justice. (shrink)

This article provides a critical rereading of Andrea Dworkin’s infamous text Intercourse. I use Judith Butler’s post-structural theory to contest the common view that Dworkin forwards an immutable position on heterosexual intercourse. Instead, I argue that she identifies a particularly pernicious discourse used to represent vaginal penetration – the discourse of intercourse-as-violation. This discourse is important for feminists to consider because the codification of sex acts affects the codification of gendered social actors. The article continues to explore how Dworkin’s text (...) positions readers as gendered subjects in order to better understand why her work is seldom given careful contemplation. When read as positing an essentialist position on heterosex, heterosexed male readers are brought into social being as perpetrators of sexual violation while female readers are positioned as morally superior victims. This distasteful position is quickly rejected as readers form affective attachments to her work based in disindentification. (shrink)

People with disabilities face inequalities in mental wellbeing, for which social exclusion is a contributing factor. Musical activities offer a promising but complex intervention, making impacts on a population with highly varied characteristics and needs challenging to capture. This paper reports on a mixed methods, person-centered study investigating a community music intervention for such a population. Three groups of adult service users with varied disabilities, took part in weekly music workshops in different locations. Music staff, housing and resource center staff, (...) as well as participants and members of their families, took part in semi-structured interviews. A quantitative measure administered by service staff was used to rate service users’ social development. Two lay researchers, both individuals with a disability contributed to all aspects of the study. Interviews were analyzed through thematic analysis. Improvements in individuals’ self-expression, confidence, mood, and social skills were consistent with previous findings. Differences in effect between centers included: Group 1, some of whom had previous experience of workshops, showed an improvement in musical skills; Group 2 showed a mixed response, some participated with enthusiasm but others chose art activities over music workshops; Group 3 had lasting positive impact, this group had very limited opportunities for music due to their rural location. Quantitative analysis showed significant increase over all groups in communication, interaction with others, and joint attention. The intervention was beneficial for participants in separate locations in similar ways, but also highlighted that context and prior experience mediated effects in distinct ways. The lay researchers enhanced the qualitative analysis by emphasizing the importance of recognizing participants’ self-expression in non-verbal modes of communication and the importance of having music staff with a disability to provide a positive role model. This paper proposes that mixed methods person-centered research is the most suitable approach to capture and understand the multiple and varied effects of this complex intervention for a diverse group of participants. Background Informed consent procedures for large population-based cohort studies should be comprehensive and easy-to-use. This is particularly challenging when participants from different socio-economic groups and multicultural ethnic backgrounds are involved. Recently, more and more studies have tried to use multimedia in informed consent procedures. We describe the development and testing of a digital informed consent app and elaborate on whether this may contribute to a comprehensive and practical procedure to obtain informed consent for public health research. Methods In a sample (...) of parents with young children, we used a mixed method approach to study the user experience of an informed consent app and evaluate whether it can be used to adequately inform people and register their consent. Through semi-structured interviews we investigated participants’ experiences with and opinions about the app, with a special focus on comprehensibility of the content and the usability of the app. Information retention questions were asked to evaluate to what extent participants could recall key aspects of the provided study information. Results The 30 participants in this study used the app between 4 and 15 min to give their consent. Overall, they found the app well-designed, informative and easy to use. To learn more about the study for which informed consent is asked, most of the participants chose to watch the animated film, which was generally found to convey information in a clear manner. The identification process was met with mixed reactions, with some feeling it as a secure way to give consent, while for others it contradicted their view of using data anonymously. Information retention questions showed that while all participants remembered various aspects of the study, fewer than half answered all four questions satisfactorily. Conclusion Our study shows that a well-designed informed consent app can be an effective tool to inform eligible participants and to record consents. Still, some issues remain, including trust barriers towards the identification procedure and lack of information retention in some participants. When implementing consent procedures that incorporate digital formats, it may be beneficial to also invest in a complementary face-to-face recruitment approach. (shrink)

Edited by Karma Lekshe Tsomo. Albany: State University of New York Press, 1999. Pp. viii + 326. This collection of essays on women in Buddhism largely succeeds in fulfilling Tsomo's goal of documenting "Buddhist women's actual involvement" in the Buddhist tradition (p. 1). Her introduction provides a very (...) informative and well-supported description of the history and current status of Buddhist women around the world, focusing on Asia but including the West as well. In the introduction and in her essays on women in the Tibetan and Himalayan region and in Buddhist and Christian traditions, she provides a feminist critique of gender discrimination in the Buddhist tradition as well as prescriptions for transforming the existing tradition in ways that would make it more egalitarian. These include "consciously validating women's accomplishments," reinterpreting religious texts with gender sensitive lenses, and the ordination of women (pp. 256-257). The essays in the volume as a whole carry forward Tsomo's examination of both sides of the equation of women and Buddhism--that is, how the Buddhist tradition has treated women overall as well as how women have responded to and are working to alter Buddhism, what Tsomo characterizes as "the ongoing process of women transforming and being transformed by, the tradition" (p. 1). The essays highlight a number of dichotomies in the experiences of Buddhist women, the primary one being that of gender disparities in the status and experience of women. Several essays in the collection detail the hardships that Buddhist women encounter because of gender inequalities that persist to the present day, even in Western cultures. Tsomo's essay comparing the experiences of Buddhist and Christian women in particular illustrates that in most areas, gender-based inequalities are more pronounced in Buddhist contexts than in Christian ones. Tsomo observes that [End Page 278] both traditions have fallen short of their egalitarian ideals, expressed within Christianity as the imago dei (creation in the image of God) and in Buddhism as tathagathagarbha (the seed or essence of Enlightenment present in all sentient beings). While noting that both traditions in general permit women to participate in religious practices on an equal basis with men, that neither legally mandates an inferior status for women, and that the highest stage of religious attainment is the same for both genders, Tsomo finds gender discrimination still functioning in both religions: both Buddhism and Christianity traditionally have assigned subordinate roles to women (especially with respect to monastic life), depict females negatively in scriptures, and generally ignore women's contributions to religious life.Despite these similarities, Tsomo thinks that in most respects Christian women have made more progress in securing equal rights to participate in the religious life of their faith than have Buddhist women. The only reason she provides for the greater extent of change in Christianity is that "Christian women have been far more active than Buddhists" (p. 253). Yet she fails to probe the possible reasons for this disparity in respect to the broader cultural, social, and economic differences in Christian and Buddhist contexts that have fostered a more activist and socially acceptable feminism in the former. The greater gender discrimination in Buddhist cultures has less to do with differences between Christianity and Buddhism per se than it does with other aspects of culture. Unfortunately, Tsomo does not develop the thesis she presents in the introduction to this essay that "Christian women have much to learn from the Buddhist tradition with respect to meditation and that Buddhist women have much to learn from Christian women with respect to service to society" (p. 241). Indeed, it is difficult to understand the basis for the latter claim, given Buddhist women's primary roles as service providers in most Buddhist cultures, unless she is speaking of the so-called socially engaged religious movement. If so, then as other scholars have noted, there are impediments to social action within certain interpretations of the Buddhist teachings themselves that would need to be resolved first. A... This thesis challenges prevailing approaches to religiously-based or influenced laws , and proposes an alternative model that makes religious pluralism, gender, and moral identity central considerations. I focus my analysis around abortion as a case study in order to analyze the gendered dimensions of the issue in addition to other, more well-recognized problems with religious lawmaking. ;My overarching thesis is that the prevalent approaches to religious lawmaking in the Supreme Court's jurisprudence, as well as in liberal and communitarian moral and (...) legal theory, are inadequate. Liberal approaches tend to protect religious pluralism at the expense of the religious identity of lawmakers, whereas communitarian proposals protect the religious morality of lawmakers at the expense of respect for religious pluralism. Both approaches are also inadequate, I contend, because they are premised upon faulty conceptions of moral identity, and fail to adequately consider the potential of religious lawmaking to perpetuate inequalities based on gender as well as religion. My arguments regarding deficiencies in these approaches are reinforced with empirical evidence regarding abortion views held by American religious groups, as well as the self-descriptions of a number of lawmakers regarding the influence of religion in their decision making. ;In developing alternative ethical and legal frameworks for addressing religious lawmaking, my analysis proceeds along both theoretical and practical lines. On the theoretical level, I propose that the conceptions of the social self and role-based morality developed by the twentieth century pragmatist philosopher George Herbert Mead, as supplemented by feminist and poststructuralist perspectives, provide the basis for a preferable ethical approach to religious lawmaking. ;On the practical level, I develop a legal framework that requires government in qualified challenges to religious lawmaking to show that the law can be fully supported on the basis of publicly accessible reasons and, in some instances, also by a compelling state interest. I explain how this proposal can accommodate the interests of religious lawmakers in relying on their religious convictions in their political and legal decision making, while insuring that the citizenship rights of their constituents are not thereby harmed. Scholars have recently suggested the desirability of moving the migrant female subject to the center of the analysis of sex trafficking and other forms of women’s cross-border migration. At first glance, this seems to be a progressive move forward in empowering women and protecting their human rights, especially those who have been trafficked for the sex trade or have otherwise migrated for work in the sex industry. However, putting the victim of trafficking into the center of trafficking analysis also creates (...) new problems, especially for the formulation and implementation of law and public policy. In this paper, I will first discuss some of the factors that favor putting the female migrant subject at the center of anti-trafficking, such as recognition and respect for the autonomy of the person that is at the center of trafficking. Chemicals have penetrated everyday lives of men who have sex with men as never before, along with new online and mobile technologies used to seek pleasures and connections. Poststructuralist (including queer) explorations of these new intensities show how bodies exist in the form of (political) surfaces able to connect with other bodies and with other objects where they may find/create a function (e.g., reproduce or disrupt hegemonies). This federally funded netnographic study explored how a variety of chemicals such as (...) recreational drugs, pharmaceuticals and steroids are contributing to the construction of gay, bisexual and other men having sex with men (GBMSM) communities and their interactions with idealized masculinities in the age of increasing technology. Five major thematic categories emerged from our analysis: (1) assembling bodies and technologies, (2) becoming orgiastic, (3) experiencing stigma, (4) becoming machinic and (5) negotiating practices. Our analysis explores how and why GBMSM pursue excesses of pleasure and connection through the assemblages they make with sexualized drug use, online platforms and other men. (shrink)

Spinoza’s Ethics makes reference to three kinds of knowledge that humans are capable of winning: imagination, reason and intuitive knowledge of God. Of these, imagination is necessarily inadequate while the latter two are necessarily adequate. In other words, we remain passive in the first type of knowledge, but come into our power of acting in the latter two. The passage from the first to the second and third types of knowledge, however, remains, in Spinoza’s text, rather obscure. This paper seeks (...) to come to terms with how exactly the passage from passion to action is made in the Ethics while locating this particular problematic as a site at which various interpretations of Spinoza diverge with considerable stakes. I thus focus on Gilles Deleuze’s proposed answer to this problem as well as Pierre Macherey’s critique of Deleuze’s reading. I argue that the disagreement between Macherey and Deleuze is not merely interpretive, but rather indicates some of the stakes involved in assessing Spinoza’s theory of the passions and the imagination. An ‘optimistic’ appraisal of these features might lead one to Deleuze’s affirmationist project, while Macherey’s pessimism concerning the two might take a Spinozist politics in quite the opposite direction. I appreciate and assess multiple aspects of Macherey’s critique while nonetheless arguing that they do not prove damning for Deleuze’s affirmationist picture. I conclude with an analysis of vacillation of mind in Deleuze’s Spinoza, and place Deleuze’s thoughts on this note in conversation with his earlier reading of Nietzsche. (shrink)

A theological treatment of the role of affections such as joy, compassion, and shame in contemporary politics. Hordern discusses what affections are and how they play a role in parts of political life such as representation and law. He shows that affections have an intelligent role to play in fostering loyalty, trust and public moral reasoning.

While the value of early detection of dementia is largely agreed upon, population-based screening as a means of early detection is controversial. This controversial status means that such screening is not recommended in most national dementia plans. Some current practices, however, resemble screening but are labelled “case-finding” or “detection of cognitive impairment”. Labelled as such, they may avoid the ethical scrutiny that population-based screening may be subject to. This article examines conceptualizations of screening and case-finding. It shows how the definitions (...) and delimitations of the concepts (the _what_ of screening) are drawn into the ethical, political, and practical dimensions that screening assessment criteria or principles are intended to clarify and control (the _how_ of screening, how it is and how it should be performed). As a result, different conceptualizations of screening provide the opportunity to rethink what ethical assessments should take place: the conceptualizations have different ethico-political implications. The article argues that population-based systematic screening, population-based opportunistic screening, and case-finding should be clearly distinguished. (shrink)

This article examines a population-based opportunistic screening practice for cognitive impairment that takes place at a hospital in Sweden. At the hospital, there is a routine in place that stipulates that all patients over the age of 65 who are admitted to the ward will be offered testing for cognitive impairment, unless they have been tested within the last six months or have been diagnosed with any form of cognitive impairment. However, our analysis shows that this routine is not universally (...) and mechanically applied. Rather, the health care professionals have developed and use an ethico-political judgment, concerning, for example,whomto test,whento offer the tests, andhowto explain and perform them. This article explores the role and practice of this form of judgment, emphasising its political and ethical nature. The analysis is based on qualitative interviews with professionals and patients, and draws on the theories of Aristotle and Hannah Arendt. (shrink)
