My aim in this memorial paper is to recall two essential Ricoeurean themes that underlie his entire philosophical orientation and that respond well to specific challenges today from post-modern deconstruction. At question is whether Ricoeur's account of sign in language and the living present in time can adequately respond to and meet the recent challenge from postmodern deconstruction, which radically challenges the very root of his phenomenological and hermeneutic orientation: the priority of the semantic in language and the priority of (...) the living present. Although Ricoeur and Derrida will be seen to address the same problems of decentering consciousness, their accounts, although agreeing on important issues, quickly become mutually exclusive and deconstruction becomes a challenge to Ricoeurean hermeneutics. I will turn first to the postmodern deconstruction of Jacques Derrida before turning to Ricoeur's response with a more viable view of language, sense, and lived time. (shrink)

This article presents the perspective of Karl Marx and Friedrich Engels on the concept of the State. It is divided into three parts, the first addressing the emergence of the State as a result of the expropriation of the means of production suffered by direct producers, giving rise to private property with the State; the first section also addresses the State in slave and feudal society. The second section explains the functions of the bourgeois state, that is, the attributions (...) of the State which, situated in the capitalist mode of production, represents the wishes of the ruling class; as well as, it points to the illusory form of democracy in the bourgeois State, that limits itself to reforming and does not envisage overcoming it. Finally, the third section treat with the State under the control of the working class, that is, in the period of transition to classless society, and the consequent dissolution of the State after the firmament of this society free from exploiters and exploited. In his essay “La judéité dans la musique,” Richard Wagner’s horrid portrayal of a Jew by way of physical, economical, linguistic and musical description exposed his anti-Semitic convictions. Much of this aspect has either been forgotten or softened, however, when evoking Wagner, it is in fact the relationship between his anti-Semitism and his work that is the most problematic. This paper proposes to consider three symbolic forms through which this reticence is expressed by looking at the the theoretical writings, opera (...) booklets and their music. Using the Beckmesser character in Les Maîtres Chanteurs de Nuremberg, although Beckmesser is not introduced as a Jew but rather a good German bourgeois, one cannot deny the allegory positioning him as a Jew. First element of demonstration: the analogical resemblance between Beckmesser and the Viennese music critic Eduard Hanslick to whom Wagner accused of hiding his Jewishness. Second element: it has already been proven that Beckmesser’s serenade sung during the second act to the Master Singers was a mockery of a Jewish prayer. Third element: in Cosima’s, Wagner’s wife, diary she explains that this particular piece generated at that time a strong reaction by the Jewish community in Vienna, thus supporting the claim that his antisemitism was already known and problematic to his contemporaries. Cloth, $42.50.This important book is an interpretation and defense of Rousseau's theory of moral education, in which the author explains and justifies Rousseau's ideas about what virtue is, why it is important, and how it can be cultivated.Briefly, this is his (...) reading: in advanced societies, people come to possess intense and incoherent passions, enflamed by amour-propre, which set them at odds with themselves and with each other, making bourgeois existence unsatisfying and exploitive. To create a better life, people must learn to restrain their desires in a way that promotes their own happiness; they must be taught virtue, which Reisert defines as, "the strength of character to rule over one's passions, so that one can make oneself do what one knows one ought to do" (8). Finally, the best model for the moral educator is not ruler to ruled, but friend to friend.The book is both a defense of this interpretation of Rousseau, and a defense of Rousseau's social and psychological theory itself, most notably against Aristotle, Locke, and Buffon. While the two lines of argument do not go together seamlessly, Reisert offers a number of contributions to Rousseau scholarship and to social thought, especially as it intersects with liberal political theory. He divides the work into two parts. The first explains Rousseau's theory of human nature and his diagnosis of the ills of society. The second interprets and defends his ideas about how to remedy that condition through the cultivation of virtue by means of friendship. The final chapter discusses the importance of virtue for contemporary liberal politics.The first half of the book, on Rousseau's "physics of the soul," touches on self-love, pity, vanity, and conscience. For some reason, Reisert limits his discussion largely to the meaning of amour-propre in the second Discourse and Emile to the exclusion of other issues and other books. Even so, he gives an interesting interpretation of amour-propre, and how it leads to the restless, banal misery that both authors think is characteristic of modern life.The problems of this section come when Reisert attempts to defend Rousseau. He argues that his theory of human nature is to be preferred because it answers questions that others cannot, such as how essentially asocial beings have come to live in societies. Yet, this question and some others he discusses come into being only because of Rousseau's own assumptions, for example that people are asocial in the first place. So, Rousseau's ability to solve puzzles that exist only on the basis of his own principles cannot be taken as evidence for those principles without begging the question.The second half of the work is more innovative. Reisert makes two basic arguments: that only virtue can alleviate the dissatisfactions of bourgeois existence; and that only the relationship of friendship can bring about this "education to virtue" (141). The first is less controversial given that he defines virtue simply as the power to restrain irrational desires for the sake of happiness; yet he goes on to make an interesting distinction between the virtue of Socrates who does not have irrational desires to begin with, and that of Emile who has them but can control them.The most original part of the book is his argument that only the relationship of friendship can foster virtue. He says that the amour-propre which makes people miserable also makes them resistant to efforts to improve their character. "A friend," on the other hand, "can, through force of personality and the power of example, exert a potent influence on his friend without thereby provoking resistance or inspiring resentment" (171). He gives a fascinating account of how a friend can be a kind of better self through whose eyes one sees the source of one's own dissatisfaction and the need for virtue to make life enjoyable. Jacques Derrida is probably the most famous European philosopher alive today. The University of Nebraska Press makes available for the first English translation of his most important work to date, Glas. Its appearance will assist Derrida's readers pro and con in coming to terms with a complex and controversial book. Glas extensively reworks the problems of reading and writing in philosophy and literature; questions the possibility of linear reading and its consequent notions of theme, author, narrative, and discursive demonstration; (...) and ingeniously disrupts the positions of reader and writer in the text. Glas is extraordinary in many ways, most obviously in its typography. Arranged in two columns, with inserted sections within these, the book simultaneously discusses Hegel’s philosophy and Jean Genet’s fiction, and shows how two such seemingly distinct kinds of criticism can reflect and influence one another. The customary segregation of philosophy, rhetoric, psychoanalysis, linguistics, history, and poetics is systematically subverted. In design and content, the books calls into question “types” of literature (history, philosophy, literary criticism), the ownership of ideas and styles, the glorification of literary heroes, and the limits of literary representation. The question of Spinozist determinism and necessitarianism have been extensively studied by commentators, while the relationship between the notions of divine will and free will still requires elaborate studies. Our article seeks to contribute to such research, by clarifying the analyses of these questions by authors that Spinoza has confronted: Maimonides, as well as other Jewish philosophers, and Leibniz who criticized Spinozist determinism. The aim of this article is to bring to light some of the factors that allowed the emergence of secularization, and to understand to what extent and in what ways these factors contributed to the formation of the main lines of Spinozism. I will first examine the issues of secularization, emphasizing the importance of the transformations in the status of the Hebrew language during the Renaissance. I will then analyze the role that the Tractatus theologico-politicus may have had in European (...) culture. Brigitte Bourgeois and Philippe Jockey Gold and Marble: the Gilded Hellenistic Sculptures of Delos p. 331-349 The investigation we are conducting on the polychromy of the Hellenistic sculptures of Delos has enabled us to add to the corpus of gilded marble works and to refine the typology. A visual examination of the sculptures through a video-microscope, combined with an analysis of the remains isolated by this means under X-fluorescence, has revealed the existence of three large types of gold leaf (...) gilding on marble at Delos in around 100 BC: totally gilded statues, works on which the gilding forms only an added colouring to the general polychromy, and works that we propose to call "chrysochromes", which present a singularity not hitherto recognised of a very bright polychromy on the clothed parts associated with gold on the nude parts. Among the number of important results of this enquiry may be counted the revelation of the overall gilding on the Delian copy in the National Museum at Athens of the Polyclitus Diadumenus, carved and gilded in imitation of a gilt bronze or even a gold statue. Such a use of gold leaf gilding on the Delos marbles calls in any case for a reconsideration of the question of the reception in antiquity of such works, as well as of such a success of gold at Delos and no doubt elsewhere in the Greek world in the same period. These two lectures by Jacques Derrida, 'Foreigner Question: Come from Abroad' and 'Step of Hospitality/No Hospitality', derive from a series of seminars on 'hospitality' conducted by Derrida in Paris, January 1996. The book consists of two texts on facing pages. 'Invitation' by Anne Dufourmantelle appears on the left clarifying and inflecting Derrida's 'response' on the right. The interaction between them not only enacts the 'hospitality' under discussion, but preserves something of the rhythms of teaching. The book also characteristically combines (...) careful readings of canonical texts and philosophical topics with attention to the most salient events in the contemporary world, using 'hospitality' as a means of rethinking a range of political and ethical situations. Analysant les investissements dont notre culture a chargé le signe écrit, Jacques Derrida en démontre aussi les effets les plus actuels et parfois les plus inaperçus. Cela n'est possible que par un déplacement systématique des concepts - on ne saurait en effet répondre à la question 'qu'est-ce que l'écriture?' par un appel de style 'phénoménologique' à quelque expérience sauvage, immédiate, spontanée. This volume collects twenty-three interviews given over the course of the last two decades by Jacques Derrida. It illustrates the extraordinary breadth of his concerns, touching upon such subjects as the teaching of philosophy, sexual difference and feminine identity, the media, AIDS, language and translation, nationalism, politics, and Derrida's early life and the history of his writings.

A coherent practice of mens rea (‘guilty mind’) ascription in criminal law presupposes a concept of mens rea which is insensitive to the moral valence of an action’s outcome. For instance, an assessment of whether an agent harmed another person intentionally should be unaffected by the severity of harm done. Ascriptions of intentionality made by laypeople, however, are subject to a strong outcome bias. As demonstrated by the Knobe effect, a knowingly incurred negative side effect is standardly judged intentional, whereas (...) a positive side effect is not. We report the first empirical investigation into intentionality ascriptions made by professional judges, which finds (i) that professionals are sensitive to the moral valence of outcome type, and (ii) that the worse the outcome, the higher the propensity to ascribe intentionality. The data shows the intentionality ascriptions of professional judges to be inconsistent with the concept of mens rea supposedly at the foundation of criminal law. (shrink)

The book focuses on five main areas: the juridical originality of the Nuremberg trials; the scientific, epistemological, and psychoanalytic backgrounds of racism and anti-Semitism; the biomedical and bioethical issues of the Nuremberg Code; a post-Nuremberg historical, ethical, and philosophical study of the notion of (...) a 'crime against humanity'; and the Jewish perspective on purity, impurity, race, and the universal ethical expectations of mankind.
