Criminal behaviour is but one behavioural tendency for which a genetic influence has been suggested. Whilst this research certainly raises difficult ethical questions and is subject to scientific criticism, one recent research project suggests that for some families, criminal tendency might be predicted by genetics. In this paper, supposing this research is valid, we consider whether intervening in the criminal tendency of future children is ethically justifiable. We argue that, if avoidance of harm is a paramount consideration, such an intervention (...) is acceptable when genetic selection is employed instead of genetic enhancement. Moreover, other moral problems in avoiding having children with a tendency to criminal behaviour, such as the prospect of social discrimination, can also be overcome. (shrink)

Our aim is to expand the regulative ideal governing consent. We argue that consent should not only be informed but also based on rational beliefs. We argue that holding true beliefs promotes autonomy. Information is important insofar as it helps a person to hold the relevant true beliefs. But in order to hold the relevant true beliefs, competent people must also think rationally. Insofar as information is important, rational deliberation is important. Just as physicians should aim to provide relevant information (...) regarding the medical procedures prior to patients consenting to have those procedures, they should also assist patients to think more rationally. We distinguish between rational choice/action and rational belief. While autonomous choice need not necessarily be rational, it should be based on rational belief. The implication for the doctrine of informed consent and the practice of medicine is that, if physicians are to respect patient autonomy and help patients to choose and act more rationally, not only must they provide information, but they should care more about the theoretical rationality of their patients. They should not abandon their patients to irrationality. They should help their patients to deliberate more effectively and to care more about thinking rationally. We illustrate these arguments in the context of Jehovah's Witnesses refusing life-saving blood transfusions. Insofar as Jehovah's Witnesses should be informed of the consequences of their actions, they should also deliberate rationally about these consequences. (shrink)

The transcendental turn of Husserl's phenomenology has challenged philosophers and scholars from the beginning. This volume inquires into the profound meaning of this turn by contrasting its Kantian and its phenomenological versions. Examining controversies surrounding subjectivity, idealism, aesthetics, logic, the foundation of sciences, and practical philosophy, the chapters provide a helpful guide for facing current debates.

Bringing together established researchers and emerging scholars alike to discuss new readings of Husserl and to reignite the much needed discussion of what phenomenology actually is and can possibly be about, this volume sets out to critically re-evaluate the predominant interpretations of Husserl’s philosophy, and to adapt phenomenology to the specific philosophical challenges and context of the 21st century. “What is phenomenology?”, Maurice Merleau-Ponty asks at the beginning of his Phenomenology of Perception – and he continues: “It may seem strange (...) that this question still has to be asked half a century after the first works of Husserl. It is, however, far from being resolved.” Even today, more than half a century after Merleau-Ponty’s magnum opus, the answer is in many ways still up for grasp. While it may seem obvious that the main subject of phenomenological inquiry is, in fact, the subject, it is anything but self evident what this precisely implies: Considering the immense variety of different themes and methodological self-revisions found in Husserl’s philosophy – from its Brentanian beginnings to its transcendental re-interpretation and, last but not least, to its ‘crypto-deconstruction’ in the revisions of his early manuscripts and in his later work –, one cannot but acknowledge the fact that ‘the’ subject of phenomenology marks an irreducible plurality of possible subjects. Paying tribute to this irreducible plurality the volume sets out to develop interpretative takes on the phenomenological tradition which transcend both its naive celebration and its brute rejection, to re-articulate the positions of other philosophers within the framework of Husserl’s thought, and to engage in an investigative dialogue between traditionally opposed camps within phenomenology and beyond. There are 4 main arguments for euthanasia: (1) arguments appealing to consistency (e.g., from passive to active euthanasia); (2) the argument from respect for autonomy; (3) appeals to justice; and (4) the argument from interests (mercy or relief of suffering). I will argue that only the last is directly relevant to active euthanasia as a medical intervention, though arguments together from autonomy and justice can in practice (through the backdoor) provide a ground for voluntary active medical euthanasia (AME).

Theoretical ethics includes both metaethics (the meaning of moral terms) and normative ethics (ethical theories and principles). Practical ethics involves making decisions about every day real ethical problems, like decisions about euthanasia, what we should eat, climate change, treatment of animals, and how we should live. It utilizes ethical theories, like utilitarianism and Kantianism, and principles, but more broadly a process of reflective equilibrium and consistency to decide how to act and be.

Why have some countries been able to implement quarantines and roll-out vaccines effectively quickly, while others have suffered with poor widescale public support and compliance? Part of the reason is because of a lack of fair, well-articulated government policies to deal with the costs of necessary lockdowns and other protocols, along with uneven citizen compliance and behaviour. We argue for a progressive reciprocity framework. We argue that governments have a responsibility to make the costs of mandatory restrictions of liberty reasonable (...) and this provides a reciprocal responsibility to comply and sacrifice freedom and some level of well-being for the common good. We introduce a “Quarantine Bill of Rights”, as both an ethical, economic, and responsible template for governments and citizens responding to pandemics. It provides incentives for greater public quarantine and vaccine compliance which can end future health crises faster, thereby reducing overall societal harm. We ask individuals to take responsibility during a pandemic, but this is a reasonable demand only if states themselves take responsibility for the ongoing welfare of their citizens, including those who bear the costs of government strategy to address pandemic threats, such as lockdowns and vaccination efforts. Our proposal also addresses the long-term economic damage when such crises have not been contained quickly enough. Such an accord should become a universal governing principle, perhaps under the auspices of the World Health Organization or another multilateral organization. Governments have responsibilities to all of their citizens, not merely citizens to each other. (shrink)

The publication of the first study to use gene editing techniques in human embryos (Liang et al., 2015) has drawn outrage from many in the scientific community. The prestigious scientific journals Nature and Science have published commentaries which call for this research to be strongly discouraged or halted all together (Lanphier et al., 2015; Baltimore et al., 2015). We believe this should be questioned. There is a moral imperative to continue this research.

In this contribution we first sketch an outline of the concept of lifeworld (_Lebenswelt_), to introduce the readers to the guest-edited collection of essays _Varieties of the Lifeworld: Phenomenology and Aesthetic Experience_, special issue of the “Continental Philosophy Review.” We trace back the origin of the concept of lifeworld to Husserl’s late phenomenology, although also explaining (on the basis of the careful historical-conceptual reconstructions offered by some distinguished scholars of Husserl and the phenomenological movement) that the development of Husserl’s phenomenology (...) of the _Lebenswelt_ was gradual and was connected, among other things, to the question of the natural world of experience. Then, quickly referring to Gadamer, Landgrebe, Fink and other authors belonging to the phenomenological tradition, we explain that different interpretations of the topic “Lifeworld” in Husserl’s thinking have been provided: In our view, this contributes to the fact that still nowadays this topic is a fascinating and philosophically stimulating one. Finally, making reference to more recent works by such authors as Figal, Gallagher, Zahavi and Shusterman (a pragmatist philosopher, whose somaesthetics is nonetheless very rich in insights that can be connected to phenomenological views of the body and its place in the world), we emphasize how the question concerning the lifeworld is still capable today to open a great variety of perspectives and plurality of paths for thinking, as testified by the essays collected in this guest-edited special issue of the “Continental Philosophy Review.”. Brain organoid research raises ethical challenges not seen in other forms of stem cell research. Given that brain organoids partially recapitulate the development of the human brain, it is plausible that brain organoids could one day attain consciousness and perhaps even higher cognitive abilities. Brain organoid research therefore raises difficult questions about these organoids' moral status – questions that currently fall outside the scope of existing regulations and guidelines. This paper shows how these gaps can be addressed. A new form of skepticism is described, which holds that objectivity and understanding are incompossible ideals of modern science. This is attributed to Weyl, hence its name: Weylean skepticism. Two general defeat strategies are then proposed, one of which is rejected.

This paper considers Weylean invariantism, i.e., the view that objectivity requires categoricity, and argues that if the Stone-von Neumann theorem can be naturally interpreted as a categoricity result, the view is falsified by quantum field theory.

It is unclear whether someone’s responsibility for developing a disease or maintaining his or her health should affect what healthcare he or she receives. While this dispute continues, we suggest that, if responsibility is to play a role in healthcare, the concept must be rethought in order to reflect the sense in which many health-related behaviours occur repeatedly over time and are the product of more than one agent. In this article we discuss the validity of previous preferences and advance directives in cases of severe mental illness.

In late February and early March 2020, Italy became the European epicenter of the COVID-19 pandemic. Despite increasingly stringent containment measures enforced by the government, the health system faced an enormous pressure, and extraordinary efforts were made in order to increase overall hospital beds’ availability and especially ICU capacity. Nevertheless, the hardest-hit hospitals in Northern Italy experienced a shortage of ICU beds and resources that led to hard allocating choices. At the beginning of March 2020, the Italian Society of Anesthesia, (...) Analgesia, Resuscitation, and Intensive Care issued recommendations aimed at supporting physicians in prioritizing patients when the number of critically ill patients overwhelm the capacity of ICUs. One motivating concern for the SIAARTI guidance was that, if no balanced and consistent allocation procedures were applied to prioritize patients, there would be a concrete risk for unfair choices, and that the prevalent “first come, first served” principle would lead to many avoidable deaths. Among the drivers of decision for admission to ICUs, age, comorbidities, and preexisting functional status were included. The recommendations were criticized as ageist and potentially discriminatory against elderly patients. Looking forward to the next steps, the Italian experience can be relevant to other parts of the world that are yet to see a significant surge of COVID-19: the need for transparent triage criteria and commonly shared values give the Italian recommendations even greater legitimacy. Why potential parents should select the best child of possible children, and the necessity of a dialogue about the context of a reproductive decision.The principle of Procreative Beneficence is the principle of selecting the best child of the possible children one could have. This principle is elaborated on and defended against a range of objections. In particular, focus is laid on four objections that Michael Parker raises: that it is underdetermining, that it is insensitive to the complex nature of the (...) good, that it is self-defeating and that it is overly individualistic. Procreative Beneficence is a useful principle in reproductive decision-making. It is necessary to be more active in making selection decisions about what kind of child to have.Parker1 raises four objections to the principle of Procreative Beneficence . I will address these in turn. Procreative Beneficence is underdeterminingParker claims that Procreative Beneficence is underdetermining. By “underdetermining”, he means that the principle will not give clear and determinate answers as to which lives are better or best. Parker argues that “ranking possible lives as “better” or “worse” is “highly problematic”.Ranking lives is a very complex matter. Let us distinguish between: the value of a whole life and the value of an individual feature of a life .We should also distinguish between valuation ex ante and ex post . In Procreative Beneficence, I likened genetic testing to playing the wheel of fortune.2 Just because we have a weak chance of winning, does not mean we should not play the game. Antibiotic resistance is one of the most pressing public health problems humanity faces. Research into new classes of antibiotics and new kinds of treatments – including risky experimental treatments such as phage therapy and vaccines – is an important part of improving our ability to treat infectious diseases. In order to aid this research, we will argue that we should permit researchers to pay people any amount of money to compensate for the risks of participating in clinical trials, including ‘challenge (...) studies’ that involve deliberately infecting patients. We think that standard worries about paying for participation in risky research are reducible to concerns that can be addressed with the right screening mechanisms. (shrink)

Some healthcare systems are said to be grounded in solidarity because healthcare is funded as a form of mutual support. This article argues that health care systems that are grounded in solidarity have the right to penalise some users who are responsible for their poor health. This derives from the fact that solidary systems involve both rights and obligations and, in some cases, those who avoidably incur health burdens violate obligations of solidarity. Penalties warranted include direct patient contribution to costs, (...) and lower priority treatment, but not typically full exclusion from the healthcare system. We also note two important restrictions on this argument. First, failures of solidary obligations can only be assumed under conditions that are conducive to sufficiently autonomous choice, which occur when patients are given ‘Golden Opportunities’ to improve their health. Second, because poor health does not occur in a social vacuum, an insistence on solidarity as part of healthcare is legitimate only if all members of society are held to similar standards of solidarity. We cannot insist upon, and penalise failures of, solidarity only for those who are unwell, and who cannot afford to evade the terms of public health. (shrink)
