With regard to organ donation, Germany is an ‘opt-in’ country, which requires explicit consent from donors. The relatives are either asked to decide on behalf of the donors’ preferences, if these are unknown or if the potential donor has explicitly transferred the decision to them. At the core of this policy lies the sociocultural and moral premise of a rational, autonomous individual, whose rights require legal protection in order to guarantee a voluntary decision. In concrete transplantation practices, the family plays (...) an even more important role. Potential donors and their families decide while being embedded in relations, a point which does still not gain full recognition. This particular discrepancy between policy and practice creates conflicts, which remain taboos of academic inquiry and public discourse. Our analysis shows a plurality of the family’s role in the transplantation process, which reveals an inner tension of the organ donation system. This tension provokes epistemic opacity on the one hand and different collective strategies as responses to discursive exclusion on the other. In future deliberations about organ donation, it is important to create spaces for open discussion, but also practices of communicative engagement, which take care of the needs and emotions attached to taboos. In the last few decades, the democratic credentials of global governance institutions have been extensively debated in the fields of international relations and political philosophy. However, despite their prominent role in the architecture of global governance, club governance institutions like the Group of Seven (G7) or the Group of Twenty (G20) have rarely been considered from the perspective of democratic theory. Focussing on the G20, this paper analyses its functions in international political practice and discusses whether, in exercising these functions, (...) the G20 exhibits a democratic deficit. As a standard of democracy, the analysis uses the all-affected principle, according to which all those who are affected by a policy decision should be given the opportunity to participate in decision-making. This paper identifies several democratic shortcomings of the G20, for instance related to the exclusion of citizens of non-member states and a lack of parliamentary and public control. By describing realisable reforms that could to some degree alleviate these shortcomings, it is shown that more democratic institutional alternatives are feasible. Thus, the ascription of a democratic deficit to the G20 is warranted. (shrink)

Global governance has a major impact on the lives of people around the world. However, traditional theories of legitimacy were usually developed for states and are not suitable for the diversity of global governance institutions that exist today. This book first develops a normative concept of legitimacy that is applicable to all political institutions. According to this concept, to regard an institution as legitimate means ascribing it the right to exercise its function in political practice. Secondly, the book discusses how (...) the use of this concept opens up new perspectives in the debate on legitimacy criteria for global governance institutions. In this context, the book analyses the relationship of legitimacy to the values of justice and democracy and discusses the role of feasibility constraints and the all-affected principle in legitimacy judgements. The concept of legitimacy as the right to function opens up the conceptual space to accommodate the insight that legitimacy criteria are not the same for all global governance institutions, but depend on their function and context. Eine Möglichkeit hierfür besteht darin, an einer engen Verbindung von Normativität (...) und Moral festzuhalten. In diesem Fall muss die Wahrheit moralischer Sätze jedoch auf eine ähnliche Art als akteursrelativ verstanden werden, wie Street die Wahrheit normativer Sätze versteht. Eine zweite Möglichkeit besteht darin, an einem absolutistischen Verständnis moralischer Sätze festzuhalten. Dann wären nach Streets Konzeption von Normativität jedoch Fälle denkbar, in denen eine Akteurin keinen normativen Grund hat, moralisch zu handeln. Myth, Utopia, and Political Action Starting from the premise that some form of "reality transcendence", i.e. the ability to imagine a different reality and reach out for the (un)thinkable, is necessary for political action, the aim of this paper is to analyse the concepts of myth and utopia elaborated by Georges Sorel and Karl Mannheim and to examine their possible contributions to a theory of political action and social change. By comparing the role the authors assign to rationality and irrationality (...) in human affairs, methodological and conceptual differences between Sorel's and Mannheim's approaches to the political are illustrated. It turns out that due to its immunity to critique Sorel's concept of the social myth is highly problematic. Mannheim's concept of utopia, on the other hand, culminates in a technocratic understanding of the political. Though both approaches emphasise the collective dimension of political action, they ultimately exhibit elitist understandings of the political. (shrink)

The proposition that digital innovations can put people in charge of their health has been accompanied by prolific talk of empowerment. In this paper we consider ethical challenges and opportunities of trying to achieve justice and empowerment using digital health initiatives. The language of empowerment can misleadingly suggest that by using technology, people can control their health and take responsibility for health outcomes to a greater degree than is realistic or fair. Also, digital health empowerment often primarily reaches people who (...) already have high technological and health literacy, leaving others behind. We critically investigate whether the concept of health empowerment could be re-engineered to mean something different, namely the process of improving the health literacy and access of those who least possess it, in line with recent proposals for conceptual engineering in the service of justice. We settle on the weaker conclusion that underlying ethical values including justice should be used to interpret the existing concept of empowerment. To conclude, we take a high-level view of various strategies for achieving the ethical value associated with digital health empowerment. (shrink)

The essay theorizes the responsibilities moral agents may be said to have in relation to global structural social processes that have unjust consequences. How ought moral agents, whether individual or institutional, conceptualize their responsibilities in relation to global injustice? I propose a model of responsibility from social connection as an interpretation of obligations of justice arising from structural social processes. I use the example of justice in transnational processes of production, distribution and marketing of clothing to illustrate operations of structural (...) social processes that extend widely across regions of the world. The social connection model of responsibility says that all agents who contribute by their actions to the structural processes that produce injustice have responsibilities to work to remedy these injustices. I distinguish this model from a more standard model of responsibility, which I call a liability model. I specify five features of the social connection model of responsibility that distinguish it from the liability model: it does not isolate perpetrators; it judges background conditions of action; it is more forward looking than backward looking; its responsibility is essentially shared; and it can be discharged only through collective action. The place of play in the education of young children has been the focus of much interest in the past. But the findings from this research project demonstrate that there remains a significant amount of confusion about the role that play has in young children's education. In particular we found that there is a clear distinction between the rhetoric and reality of play in the reception class. Further, there was evidence of real anguish for some early years workers who were (...) failing to offer the play activities that they knew should be provided. These findings are particularly interesting at present, since the debate on the role of play has once again emerged as fundamental in the attempt to define a curriculum appropriate to the needs of the 3-6 year olds who, from the year 2000, will be required to work within the highly contentious Foundation Stage of the National Curriculum. Some philosophical positions maintain that some aspect of reality depends on human practices, cognitive attitudes or sentiments. This paper presents a framework for understanding such positions in a way that renders them immune to a number of natural but allegedly devastating objections.

Many cognitive scientists, having discovered that some computational-level characterization f of a cognitive capacity φ is intractable, invoke heuristics as algorithmic-level explanations of how cognizers compute f. We argue that such explanations are actually dysfunctional, and rebut five possible objections. We then propose computational-level theory revision as a principled and workable alternative.

In this essay I follow one argument strand from Linda Singer's Erotic Welfare. How can we have a forward-looking and affirmative ideal of sexual freedom when the AIDS panic has altered the sexual landscape and instigated new justifications for oppressive sexual disciplines? How can we be sexual subjects when processes of commodification and disciplinary practices have constrained sexual expression while proliferating sexual fetishes? These are some of the questions this book formulates, without answering.

This paper calls attention to a philosophical presupposition, coined here the continuity thesis which underlies and unites the different, often conflicting, hypotheses in the origin of life field. This presupposition, a necessary condition for any scientific investigation of the origin of life problem, has two components. First, it contends that there is no unbridgeable gap between inorganic matter and life. Second, it regards the emergence of life as a highly probable process. Examining several current origin-of-life theories. I indicate the implicit (...) or explicit role played by the continuity thesis in each of them. In addition, I identify the rivals of the thesis within the scientific community — the almost miracle camp. Though adopting the anti-vitalistic aspect of the continuity thesis, this camp regards the emergence of life as involving highly improbable events. Since it seems that the chemistry of the prebiotic stages and of molecular self-organization processes rules out the possibility that life is the result of a happy accident, I claim that the almost miracle view implies in fact, a creationist position.
