Intuition is frequently used in medicine. Along with the use of existing medical rules, there is a separate channel that physicians rely on when making decisions: their intuition. To cope with the epistemic problem of using intuition, I use some clues from Wittgenstein's philosophy to illuminate the decision-making process in medicine. First, I point to a connection between intuition as functioning in medicine and Wittgenstein's notions of "seeing as" or noticing "aspects". Secondly, I use Wittgenstein notion of empirical regularities hardened (...) into rules to suggest that there are two stages that should be addressed in the analysis of medical practice: the first concerns the accumulation of cases and the second pertains to the setting a rule based on these cases. I argue further that the medical context is exceptional in that the two stages are intertwined and, and explain the consequences of this fact for the physician's work. Finally, inspired by Wittgenstein's rule-following conundrum, I argue that medicine is particularly prone to difficulties in applying a general rule to a specific case represented by an individual patient. Recourse to intuition is reflects the physicians' efforts to bridge this gap. (shrink)

Asymmetrical convergence is the increasing overlap between academic and industrial sectors, but with academia moving closer toward for-profit industrial norms than vice versa. Although this concept, developed by Kleinman and Vallas, is useful, processes of asymmetrical convergence in daily laboratory life are largely unexplored. Here, observations of three lab groups of chemical scientists in academic and industry contexts illustrate variation in interactions with ethics-related policies. Findings show more tension for academic science with business-based practices, such as the move toward greater (...) accountability, than for industrial science with academic practices. This asymmetry is evident in the process of purposive decoupling: for example, where academic scientists use humor to distance themselves from the performance of compliance in required reporting and top-down ethics training requirements. This distancing from meaningless requirements contrasts with mentoring around practices of professional behavior that are thought to matter. Convergence is evident in how safety policies seem more engaging than other kinds of policies. Yet, power structures shape engagement. Academic engagement often means rule following, and flows vertically from professor’s authority to student apprenticeship. Industry engagement includes collaborative problem solving and flows along a more horizontal peer structure where informal power is less visible. (shrink)

Grammatical theories of Scalar Implicatures make use of an exhaustivity operator exh, which asserts the conjunction of the prejacent with the negation of excludable alternatives. We present a new Grammatical theory of Scalar Implicatures according to which exh is replaced with pex, an operator that contributes its prejacent as asserted content, but the negation of scalar alternatives at a non-at-issue level of meaning. We show that by treating this non-at-issue level as a presupposition, this theory resolves a number of empirical (...) challenges faced by the old formulation of exh (as well as by standard neo-Gricean theories). The empirical challenges include projection of scalar implicatures from certain embedded environments (‘some under some’ sentences, some under negative factives), their restricted distribution under negation, and the existence of common ground-mismatching and oddness-inducing implicatures. We argue that these puzzles have a uniform solution given a pex-based Grammatical theory of implicatures and some independently motivated principles concerning presupposition projection, cancellation and accommodation. It is not clear, however, how the weights of reasons combine, especially given the logical and substantive relations among different reasons. Nor is it clear how the weighing of reasons relates to decision theoretic maximization of expected value. In Legends of the Samurai, Sato confronts both the history and the legend of the samurai, untangling the two to present an authentic picture of these legendary warriors. Through his masterful translations of original samurai tales, laws, dicta, reports, and arguments accompanied by insightful commentary, Hiroaki Sato chronicles the changing ethos of the Japanese warrior from the samurai's historical origins to his rise to political power. For this purpose, Sato has chosen to translate, wherever possible, writings closest in time (...) to the actual event. His translations are a testament to his mastery of the language for they flow with lively ease that one might not expect from accounts, many of which are ancient. Legends of the Samurai covers legends from mythological times to the early eighteenth century. Through this book Sato describes men accomplished in martial arts, warrior-commanders in battle, and samurai's own views of themselves. Objective: The purpose of this study was to demonstrate how educators involved in the teaching of bioethics to healthcare university students in Japan would cope with ethical disagreement in the classroom, and to identify factors influencing them.Methods: A cross sectional survey was conducted using self administered questionnaires mailed to a sample of university faculty in charge of bioethics curriculum for university healthcare students.Results: A total of 107 usable questionnaires were returned: a response rate of 61.5%. When facing ethical disagreement in (...) the classroom, coping behaviour differed depending on the topic of discussion, was influenced by educators’ individual clear ethical attitudes regarding the topic of discussion, and was independent of many respondents’ individual and social backgrounds. Among educators, it was commonly recognised that the purpose of bioethics education was to raise the level of awareness of ethical problems, to provide information about and knowledge of those issues, to raise students’ sensitivity to ethical problems, and to teach students methods of reasoning and logical argument. Yet, despite this, several respondents considered the purpose of bioethics education to be to influence students about normative ethical judgments. There was no clear relationship, however, between ways of coping with ethical disagreement and educators’ sense of the purpose of bioethics education.Conclusions: This descriptive study suggests that educators involved in bioethics education for healthcare university students in Japan coped in various ways with ethical disagreement. Further research concerning ethical disagreement in educational settings is needed to provide better bioethics education for healthcare students. (shrink)

This paper presents the first dataset for Japanese Legal Judgment Prediction (LJP), the Japanese Tort-case Dataset (JTD), which features two tasks: tort prediction and its rationale extraction. The rationale extraction task identifies the court’s accepting arguments from alleged arguments by plaintiffs and defendants, which is a novel task in the field. JTD is constructed based on annotated 3477 Japanese Civil Code judgments by 41 legal experts, resulting in 7978 instances with 59,697 of their alleged arguments from the involved parties. Our (...) baseline experiments show the feasibility of the proposed two tasks, and our error analysis by legal experts identifies sources of errors and suggests future directions of the LJP research. Communication on the Internet is often described as “anonymous”, yet the usage of the term is often confusing, even in academia. Three levels of anonymity, visual anonymity, dissociation of real and online identities, and lack of identifiability, are thought to have different effects on various components of interpersonal motivation. Specifically, we propose that cross-cultural differences in interpersonal motivation (autonomy vs. affiliation) are illustrated by choices individuals make when deciding whether or not to remain anonymous while communicating online. Autonomy is often (...) valued in Western societies, whereas Eastern societies tend to emphasize affiliation, suggesting that individuals in Western societies will gravitate toward online communities that allow lower levels of anonymity, while individuals in Eastern societies will be more likely to seek out online communities that promote higher levels of anonymity. The research presented in this article supports this notion, suggesting that we need to consider cultural differences when designing online communication systems and other communications technologies. We present an annotation scheme describing the argument structure of judgement documents, a central construct in Japanese law. To support the final goal of this work, namely summarisation aimed at the legal professions, we have designed blueprint models of summaries of various granularities, and our annotation model in turn is fitted around the information needed for the summaries. In this paper we report results of a manual annotation study, showing that the annotation is stable. The annotated corpus we created contains (...) 89 documents. We also designed and implemented the first two stages of an algorithm for the automatic extraction of argument structure, and present evaluation results. (shrink)

We develop several aspects of local and global stability in continuous first order logic. In particular, we study type-definable groups and genericity.

We prove that for every simple theory $T$ (or even simple thick compact abstract theory) there is a (unique) compact abstract theory $T^fP$ whose saturated models are the lovely pairs of $T$. Independence-theoretic results that were proved in [Ben Yaacov, Pillay, Vassiliev - Lovely pairs of models] when $T^fP$ is a first order theory are proved for the general case: in particular $T^fP$ is simple and we characterise independence.

We prove that the definition of supersimplicity in metric structures from [Ben Yaacov, Uncountable dense categoricity in cats] is equivalent to an textit{a priori} stronger variant. This stronger variant is then used to prove that if $T$ is a supersimple Hausdorff cat then so is its theory of lovely pairs.

Robustness is a fundamental property of biological systems, observed ubiquitously across species and at different levels of organization from gene regulation to ecosystem. The theory of biological robustness argues that robustness fosters evolv-ability and that together they entail various tradeoffs as well as characteristic architectures and mechanisms. We argue that classes of biological systems have evolved to enhance their robustness by extending their system boundary through a series of symbioses with foreign biological entities . A series of major biological innovations (...) has been achieved by events consistent with this framework: horizontal gene transfer, serial endosymbiosis, oocytes-mediated vertical infection, and host-symbiont mutualism for bacterial flora. Self-extending symbiosis contributes to robustness because symbiotic foreign biological entities can enhance the adaptative capacity of the system against environmental perturbations as well as contribute novel functions. In addition, evolutionary history indicates that the degree of symbiosis achieved has substantially changed from tight integration into the genome to loose integration as bacterial flora . The most dramatic example can be seen in the symbiosis of host immune system and bacterial flora in which substantial function of host defense depends on the proper maintenance of bacterial flora and its adaptive capability. Biological systems following this type of evolutionary path might have attained high levels of functionality, robustness, and evolvability. Thus, robustness, evolution, and self-extending symbiosis may form essential system principles for biology. (shrink)

Using Harvey Sacks’s concept of membership categorization devices, this article examines the help-search sequences in which Japanese rehabilitation team members use a set of categories to locate the availability of stroke family caregivers. Specifically, based on an analysis of audiovisual data from rehabilitation team conferences in Japan, the article illustrates the ways in which participants at the meetings: evaluate the expectable behaviors of various category incumbents; classify which category of person is proper to turn to for help; and arrive at (...) the conclusion that no one is available, and so the patient must be institutionalized. Analysis shows that participants routinely choose co-resident family members to fulfill the caregiver position. However, the position is not guaranteed unless the selected incumbent can satisfy additional criteria, especially physical strength and time availability. By exploring the ways in which participants use categories to negotiate discharge destinations, the article adds to Sacks’s analysis by illustrating methodical activities for deciding whether someone is unavailable to help. Moreover, it considers the applicability of Sacks’s notion of MCDs to Japanese data. (shrink)

Indigenous ecologies in industrial societies need immediate attention in light of the ongoing debate on indigenous resource rights and decreasing biodiversity. This paper examines the functions and meanings of hunting, fishing, and gathering activities among contemporary Nez Perce Indians in Idaho, USA. The collected data were analyzed with Pierre Bourdieu's concepts of “symbolic capital” and “practice” within the framework of political ecology. The results clearly demonstrate that hunting, fishing, and gathering practices play significant roles not only in social and religious (...) but also economic and political senses within the contemporary Nez Perce society. This study suggests that investigation of indigenous ecologies in industrial societies take a synthesized approach between idealist and materialist perspectives. (shrink)

Recent research suggests that individuals from East Asian and Western cultures differ in the degree to which they hold a folk world view known as naïve dialecticism, which is characterized by tolerance for contradiction, expectation of change, and cognitive holism. The current research utilizes the Mouse Paradigm to investigate the dynamic nature of naïve dialecticism in real time by measuring individuals’ fluctuations in judgment during the process of contemplation. The results showed cultural differences in dynamic measures of evaluation process: Japanese (...) participants took more time to stabilize their thought and showed more fluctuations in their judgment than American participants. These cultural differences were fully mediated by individual differences in levels of naïve dialecticism as measured by the level of dialectical self-views. Implications for cultural psychology and the psychology of dialectical thinking are discussed. (shrink)

The role of research ethics consultants in biomedical research has increased to the point that they have an advisory capacity at all research institutes. For such professionals, we have established an educational system, which includes teaching materials, training methods, and nationwide educational workshops. These workshops have served to examine the developed system’s usefulness and to provide realistic training for consultant candidates. In addition, we have used the current workshop to encourage clinical research investigators to participate. Subsequently, we examined its usefulness (...) as an opportunity to provide exposure to research ethics. In October 2019, we held a 1-day pilot workshop in Tokushima, Japan, which included a basic lecture in research ethics. During the lecture, two sets of materials were used for case discussion: case 1, covering issues related to a clinical trial, and case 2, covering issues related to human biological specimens. At the end of the workshop, a 30-item self-reporting anonymous questionnaire was provided. Of the 13 total participants, 9 were clinical research investigators and related personnel, while 6 had no direct intention to act as consultants. Respondents indicated that case 2 was more difficult than case 1. However, both cases were generally accepted as educational materials; thus, satisfaction was expressed in relation to both. As the evaluations of the cases were generally positive, we will further examine the usefulness of participation in the workshop in the cultivation of research ethics in the investigator community. This study investigates rehabilitation team members’ interactive accomplishments of their domains of work and responsibility in rehabilitation team conferences in Japan. A combination of membership categorization analysis and sequential analysis is adopted to systematically illustrate the situated productions of professional sense-making practices. Analysis focuses on the segment in which a physician asks a series of questions regarding a patient’s functional status and disability coded in the functional assessment record (FAR). A close examination of data shows that a physician does not (...) always choose a respondent with his or her gaze when asking a question because s/he is continuously reading the FAR displayed on a computer screen. Despite this, a physician’s mention of a topic generates a professional’s domain of work and responsibility in a local division of labor which is used by members to assume who the relevant categorial respondent is. Further, members demonstrate these assumptions by shifting their gazes toward the computer screen, back to the document on the desk, and turning toward co-participants, thus embodying professional roles and responsibilities in situ. This study utilizes the analyst’s ethnographic understanding of the routines and division of labor at the rehabilitation ward as a resource to explicate professional sense-making practices, thus utilizing Garfinkel’s ethnomethodological studies of work. Together with sequential and categorial resources offered by Sacks, this study elucidates inferences and normative expectations which rehabilitation team members bring together to reproduce the endogenous logic of rehabilitation culture in actual occasions of the institutional life. The functional independence measure is a clinical scale which is used to evaluate the amount of assistance disabled persons need to conduct their daily living activities. Drawing on 65 video-recorded rehabilitation team meetings and medical records collected from a Japanese hospital, this article utilizes ethnomethodology and conversation analysis to uncover how Japanese rehabilitation team members use the FIM to track changes in the functional status of patients and decide the length of stay in ongoing interactional sequences. Analysis shows that a (...) series of the FIM scores assembled and arranged in situ provide a sequential framework for members to understand the progress of rehabilitation and predict the plateau phase. Moreover, a particular expert is asked about patients’ capacity for further improvements and his or her opinions are treated as a basis for clinical decisions. In this way, diagnostic and clinical decision-making is produced through the ongoing collaborative work of various specialists. (shrink)

We present several models which satisfy CH and some ♦-like principles while others fail, answering a question of Moore, Hrušák and Džamonja.

Clinical ethics support, including ethics consultation, has become established in the field of medical practice throughout the world. This practice has been regarded as useful, most notably in the UK and the USA, in solving ethical problems encountered by both medical practitioners and those who receive medical treatment. In Japan, however, few services are available to respond to everyday clinical ethical issues, although a variety of difficult ethical problems arise daily in the medical field: termination of life support, euthanasia and (...) questions about patient autonomy. In light of these conditions, a group of 17 volunteer educators and researchers from the area of biomedical ethics, including the authors, have formed the Clinical Ethics Support and Education Project, and began providing Japan’s first small team clinical ethics consultation service in October, 2006. Members include scholars of biomedical ethics, scholars of philosophy and ethics, legal professionals and legal scholars, nurses and doctors, consisting of five women and 12 men. Consultation teams, made up of a small number of members, were organised each time a request for consultation was received. Over approximately 15 months (October 2006–December 2007), the programme received 22 consultation requests from medical practitioners and medical institutions, and three from the families of patients. In this paper, we will discuss the status of our consultation service and examples of consultation cases we have handled. In addition, we will examine the process of evaluating small team clinical ethics consultation services, as well as the strengths and weakness of such programmes. (shrink)

ObjectiveProcessing Speed, the ability to perceive and react fast to stimuli in the environment, has been shown to be impaired in children with attention deficit hyperactivity disorder. However, it is unclear whether PS can be improved following targeted treatments for ADHD. Here we examined potential changes in PS following application of transcranial electric stimulation combined with cognitive training in children with ADHD. Specifically, we examined changes in PS in the presence of different conditions of mental fatigue.MethodsWe used a randomized double-blind (...) active-controlled crossover study of 19 unmedicated children with ADHD. Participants received either anodal transcranial direct current stimulation over the left dorsolateral prefrontal cortex or transcranial random noise stimulation, while completing CT, and the administration order was counterbalanced. PS was assessed before and after treatment using the MOXO-CPT, which measures PS in the presence of various conditions of mental fatigue and cognitive load.ResultstRNS combined with CT yielded larger improvements in PS compared to tDCS combined with CT, mainly under condition of increased mental fatigue. Further improvements in PS were also seen in a 1-week follow up testing.ConclusionThis study provides initial support for the efficacy of tRNS combined with CT in improving PS in the presence of mental fatigue in pediatric ADHD. Artificial intelligence (AI) technologies in medicine are gradually changing biomedical research and patient care. High expectations and promises from novel AI applications aiming to positively impact society raise new ethical considerations for patients and caregivers who use these technologies. Based on a qualitative content analysis of semi-structured interviews and focus groups with healthcare professionals (HCPs), patients, and family members of patients with Parkinson’s Disease (PD), the present study investigates participant views on the comparative benefits and problems of using human versus (...) AI predictive computer vision health monitoring, as well as participants’ ethical concerns regarding these technologies. Participants presumed that AI monitoring would enhance information sharing and treatment, but voiced concerns about data ownership, data protection, commercialization of patient data, and privacy at home. They highlighted that privacy issues at home and data security issues are often linked and should be investigated together. Findings may help technologists, HCPs, and policymakers determine how to incorporate stakeholders’ intersecting but divergent concerns into developing and implementing AI PD monitoring tools. With research in continuous first-order logic preoccupied with studying the model theory of this framework, we find a natural question calls for attention. Is there an interesting set of axioms yielding a completeness result?The primary purpose of this article is to show that a certain, interesting set of axioms does indeed yield a completeness (...) result for continuous first-order logic. In particular, we show that in continuous first-order logic a set of formulae is satisfiable if it is consistent. From this result it follows that continuous first-order logic also satisfies an approximated form of strong completeness, whereby Σ⊨φ only if Σ⊢φ∸ 2-n for all n < ω. This approximated form of strong completeness asserts that if Σ⊨φ, then proofs from Σ, being finite, can provide arbitrarily better approximations of the truth of φ.Additionally, we consider a different kind of question traditionally arising in model theory—that of decidability. When is the set of all consequences of a theory recursive? Say that a complete theory T is decidable if for every sentence φ, the value φT is a recursive real, and moreover, uniformly computable from φ. If T is incomplete, we say it is decidable if for every sentence φ the real number φT∘ is uniformly recursive from φ, where φT∘is the maximal value of φ consistent with T. Sentences such as Olivia can take Logic or Algebra (‘♢∨-sentences’) are typically interpreted as entailing that Olivia can take Logic and can take Algebra. Given a standard semantics for modals and disjunction, those ‘Free choice’ (FC) readings are not predicted from the surface form of ♢∨-sentences. Yet the standard semantics is appropriate for the ‘double prohibition’ reading typically assigned to ¬♢∨-sentences like Olivia can’t take Logic or Algebra. Several extant approaches to FC can account for those two cases, but face (...) challenges when ♢∨, ¬♢∨ and related sentences appear embedded in certain environments. In this paper, we present a novel account of FC that builds on a ‘grammatical’ theory of scalar implicatures — proposed by Bassi et al. (2021) and Del Pinal (2021) — according to which covert exhaustification is a presupposition trigger such that the prejacent forms the assertive content while any excludable or includable alternatives are incorporated at the non-at issue, presuppositional level. Applied to ♢∨, ¬♢∨, and similar sentences, ‘presuppositional exhaustification’ predicts that their default interpretations have an assertive component (roughly, the classical interpretation of the prejacent) and a homogeneity presupposition which projects in standard ways. Those predictions, we then show, support a uniform account of the puzzling behavior of ♢∨, ¬♢∨, and related sentences when embedded under (negative) factives (Marty & Romoli 2020), disjunctions (Romoli & Santorio 2019), and in the scope of universal, existential (Bar-Lev & Fox 2020) and non-monotonic quantifiers (Gotzner et al. 2020). Using conversation analysis, this study investigates how Japanese rehabilitation team members use their geographic knowledge to search for long-term care facilities for stroke survivors in multidisciplinary team interactions. The study uncovers the orderly use of decision rules during discharge planning activities by exploring the following two questions: What decision criteria are discursively used? In what order are the criteria handled through sequential operations? The data comprise 65 video-recorded rehabilitation team meetings and ethnographic information regarding local care facilities and patients’ residential (...) addresses. The analysis shows that the participants deal with decision criteria in an orderly manner. They identify the type of facility and location preferred by the patient’s family and search for a facility accordingly. Moreover, they routinely select facilities closer to the patients’ and their families’ homes. However, these rules are modified if the family’s choice is inappropriate, or when a facility in a different location is preferred by the family. The study contributes to the conversation analytic understanding of interprofessional decision making and prioritization through the analysis of orderly methods of search procedures interactively accomplished by participants in ongoing medical team interactions. We prove that separable, elementarily equivalent structures which are approximately $aleph_0$-saturated up to arbitrarily small perturbations are isomorphic up to arbitrarily small perturbations. As a corollary, we obtain a Ryll-Nardzewski style characterisation of complete theories all of whose separable models are isomorphic up to arbitrarily small perturbations.

The argument from inductive risk claims that judgments about the moral severity of errors are relevant to decisions about what should count as sufficient evidence for accepting claims. While this idea has been explored in connection with evidence required for the approval of pharmaceuticals, the role of inductive risk in the post-approval process has been largely neglected. In this article, we examine the ethics of inductive risk in connection with revisions to the product monograph for OxyContin in Canada, which understates (...) the risks of addiction and abuse associated with this drug. Using the concept of inductive risk, we consider what evidence should have been sufficient for Health Canada to revise the product monograph for OxyContin. Given the stakes involved, we argue that a less strict standard of evidence would have been appropriate, yet HC in fact took the opposite course, insisting upon a higher standard of evidence than it normally requires. In addition to providing a novel perspective on the opioid crisis in Canada, this article contributes to existing philosophical work by demonstrating that inductive risks in the post-approval stage are important and linked to pre-approval inductive risks. We present an adaptation of continuous first order logic to unbounded metric structures. This has the advantage of being closer in spirit to C. Ward Henson's logic for Banach space structures than the unit ball approach, as well as of applying in situations where the unit ball approach does not apply. We also introduce the process of single point emph{emboundment}, allowing to bring unbounded structures back into the setting of bounded continuous first order logic. Together with results from cite{BenYaacov:Perturbations} regarding (...) perturbations of bounded metric structures, we prove a Ryll-Nardzewski style characterisation of theories of Banach spaces which are separably categorical up to small perturbation of the norm. It has been suggested that luminance edges in retinal images are potential cues for glossiness perception, particularly when the perception relies on low-luminance specular regions. However, a previous study has shown only statistical correlations between luminance edges and perceived glossiness, not their causal relations. Additionally, although specular components should be embedded at various spatial frequencies depending on the micro-roughness on the object surface, it is not well understood what spatial frequencies are essential for glossiness perception on objects with different micro-roughness. To address these issues, we examined the impact of a sub-band contrast enhancement on the perceived glossiness in the two conditions of stimuli: the Full condition where the stimulus had natural specular components and the Dark condition where it had specular components only in dark regions. Object images with various degrees of surface roughness were generated as stimuli, and their contrast was increased in various spatial-frequency sub-bands. The results indicate that the enhancement of the sub-band contrast can significantly increase perceived glossiness as expected. Furthermore, the effectiveness of each spatial frequency band depends on the surface roughness in the Full condition. However, effective spatial frequencies are constant at a middle spatial frequency regardless of the stimulus surface roughness in the Dark condition. These results suggest that, for glossiness perception, our visual system depends on specular-related information embedded in high spatial frequency components but may change the dependency on spatial frequency based on the surface luminance to be judged.
