Remembering seems, to philosophers and scientists, one of the most mystifying of human activities. Yet natural language users have no problem understanding what is meant by ‘memory’. Memory is simply the ability to recall personally experienced events and certain kinds of information such as facts, names, or faces; or how to perform certain actions, like riding a bike or playing chess. It is on this basis that people sometimes make claims about themselves or others having a good or bad memory, (...) especially for things like names, numbers, or faces. Why then is memory such a mystery? Because, firstly, of its diversity: memory enables us to perform a plethora of different tasks, including the continuous interpretation of every moment of consciousness. Recent discussions of how axioms are extrinsically justified have appealed to abductive considerations: on such accounts, axioms are adopted on the basis that they constitute the best explanation of some mathematical data, or phenomena. In the first part of this paper, I set out a potential problem caused by the appeal made to the notion of mathematical explanation and suggest that it can be remedied once it is noted that all the justificatory work is done by appeal to the theoretical (...) virtues. In the second part of the paper, I appeal to the theoretical virtues account of axiom justification to provide an argument that judgements of theoretical virtuousness, and therefore of extrinsic justification, are subjective in a substantive sense. This tells against a recent claim by Penelope Maddy that such justification is “wholly objective”. (shrink)

A theory of the person which considers feeling. The book distinguishes feeling from emotion, and defines it as resonance with being, the capacity to be unified with what is present. It relates this to the theory and practice of a transpersonal psychology and philosophy.

Two studies investigated the development of infants' visual preferences for the human body shape. In Study 1, infants of 12,15 and 18 months were tested in a standard preferential looking experiment, in which they were shown paired line drawings of typical and scrambled bodies. Results indicated that the 18-month-olds had a reliable preference for the scrambled body shapes over typical body shapes, while the younger infants did not show differential responding. In Study 2, 12- and 18-month-olds were tested with the (...) same procedure, except that the typical and scrambled body stimuli were photographic images. The results of Study 2 again indicated that only the 18-month-olds had a reliable preference for the scrambled body shapes. This finding contrasts sharply with infants' precocious preferences for human faces, suggesting that infants' learning about human faces and human bodies follow different developmental trajectories. Contemporary economists are silent regarding economic rights because modern economic theory does not adequately account for reciprocity and risk in human relationships. The immigration question in the US serves as our test case for both the reality of reciprocity and risk in the realm of economic rights, and the need for economic analysis that more honestly contends with this reality. We examine reciprocity and risk in immigration through an economic lens and then complement that examination with resources from the Catholic (...) social teaching tradition. We show how Catholic social teaching can enhance economic analysis of immigration and other social phenomena by helping economics make sense of reciprocity and risk in economic relations. (shrink)

Do free markets teach us how to construct humane social relations or do they impede us from doing so? We discuss social scientific evidence on the nature of commercialization and its consequences for moral formation. From a virtue ethics perspective, people face a need to learn and practice the good. When interactions transition into the market sphere, we argue commercialization can fundamentally alter the nature of relationships, particularly for those relations formerly based on gift, sacrifice, and obligation. While modern social (...) scientists accurately identify problems resulting from commercialization, we argue for the importance of theological social ethics, which can offer a penetrating analysis of the habits of gift and communal responsibility. Catholic social teaching in particular outlines the set of principles and institutions which foster sacrificial gift‐giving among individuals and organizations within society, providing a bulwark against the threat commercialization poses to many social relations. This article seeks to deepen Giorgio Agamben’s brief investigation of the Foucauldian technical term dispositif, by locating it (and the triple structure which articulates it) in the larger context of his own contribution to the genealogy of “governmentality.” Following Agamben’s reconstruction of the Christian paradigm for the divine government of the world, it explores the singular relation between governmental dispositifs and concurrent modes of subjectivation. This paper examines the effects of a decrease in auditor litigation risk in a setting that isolates a change in auditor litigation risk from changes in auditor reputation. _StoneRidge Investment Partners v. Scientific Atlanta_ is a 2008 U.S. Supreme Court ruling that restricted secondary actor liability in class action suits, resulting in a decrease in class actions that listed auditors as defendants. We document that the _StoneRidge_ decision is associated with a negative CAR for clients of Big 4 auditors and (...) industry specialist auditors, in particular those associated with high-litigation risk, low cash, and past incidences of modified going concern opinions. These findings are consistent with investor perception of lower potential payoffs from secondary defendants in class action suits, in particular auditors, following the _StoneRidge_ decision. We also document that auditors are more (less) likely to accept (reject) risky clients and charge lower audit fees to risky clients after _StoneRidge_, consistent with a decrease in auditor litigation risk that increases auditor risk tolerance. Finally, we provide evidence that audit firms issue fewer going concern opinions following _StoneRidge_, consistent with a decrease in litigation risk leading to lower audit quality_._ Our results are relevant to policy makers as they consider the disciplinary role of litigation on audit markets. Carl Schmitt (1888–1985), Professor für Staats- und Völkerrecht, bewegt nach wie vor die Gemüter. Die Reaktion auf seine Schriften, Handlungen und Ausstrahlungen ist vielfältig; die Spanne reicht von entrüsteten, für die er der Teufel in Person bleibt, über viele Zwischenstufen bis zu jenen Lesern, die ihn für einen der subtilsten, noch keineswegs ausgeloteten Geistern dieses Jahrhunderts halten. Sein Leben lang war Carl Schmitt ein passionierter Schreiber von Briefen. Meist handelte es sich um handschriftlich verfasste, die für den Schreibenden (...) die Fortsetzung eines konkreten Gespräches mit anderen Mitteln war. Das macht das authentische und die Spontanität der Schmitt-Briefe aus. Als erste Edition einer umfangreichen Korrespondenz wird in dem Buch die Korrespondenz zwischen Carl Schmitt und Armin Mohler veröffentlicht. Der Briefwechsel umfasst die Zeit von 1947 bis 1980 und enthält 280 Briefe und Karten von Carl Schmitt an Armin Mohler. Von dem Briefpartner und Herausgeber wird in der Regel aus den eigenen Briefen nur auszugsweise zitiert, sofern es für das von Carl Schmitt Geschriebene notwendig ist. Armin Mohler (1920 bis 2003), ist einer der bekanntesten rechtskonservativen Schriftsteller, Kritiker und Historiker in Deutschland. Sein Handbuch zur Konservativen Revolution ist ein Standardwerk. In der Zeit des Briefwechsels war Mohler von 1949 bis 1953 Sekretär Ernst Jüngers, danach Korrespondent großer Zeitungen in Paris und von 1964 an Geschäftsführer der Carl Friedrich von Siemens Stiftung, in der er sehr beachtete Symposien zu aktuellen wissenschaftlichen Themen organisierte. Der Briefwechsel ist für die Deutung Carl Schmitts in der Nachkriegszeit in seinem Sauerländer "Exil" grundlegend, gleichzeitig enthält er pointierte Schlaglichter auf das politische und kulturelle Geschehen der frühen und mittleren Bundesrepublik sowie auf Werk und Leben von Ernst Jünger. Recent debates about mathematical ontology are guided by the view that Platonism's prospects depend on mathematics' explanatory role in science. If mathematics plays an explanatory role, and in the right kind of way, this carries ontological commitment to mathematical objects. Conversely, the assumption goes, if mathematics merely plays a representational role then our world-oriented uses of mathematics fail to commit us to mathematical objects. I argue that it is a mistake to think that mathematical representation is necessarily ontologically innocent and (...) that there is an argument from mathematics' representational capacity to Platonism. Given that it is common ground between the Platonist and nominalist that mathematics plays a representational role in science, this representationalist argument is to be preferred over the explanatory, or enhanced, indispensability argument. This study investigated the attitudinal responses of 403 undergraduate students with respect to nine hypothetical marketing moral dilemmas. Participants varied by gender, major, and age.It was found that undergraduate women responded more ethically on the hypothetical marketing moral dilemmas, as hypothesized. Secondly, chosen major did not make a difference on cognitive, affective, or behavioral responses. Further, the overall means for each scenario were in the morally correct direction in every case. Also, all intercorrelations for each story were significant. Finally, whenever (...) there was a nonchance finding for age, the oldest participants answered more morally than the youngest subjects. A co-authored collaboration between a theatre practitioner and a clinical psychiatrist, this paper will examine Rough for Theatre II and Beckett’s demonstration of the way records are used to understand the human subject. Using Beckett’s play to explore interdisciplinary issues of embodiment and diagnosis, the authors will present a dialogue that makes use of the ‘best sources’ in precisely the same manner as the play’s protagonists. One of those sources will be Beckett himself, as Heron will locate the play (...) in its theatrical context through reflections upon his own practice as well as recent studies such as Beckett, Technology and the Body and Performing Embodiment in Samuel Beckett’s Drama ; another source will be the philosopher Wilhelm Windleband, whose 1901 History of Philosophy was read and noted upon by Beckett in the 1930s, as Broome will introduce a philosophical and psychiatric context to the exchange. Windelband is now a neglected figure in philosophy; but as one of the key figures of Neo-Kantianism in the late 19th century, his work was an important impetus to that of Rickert, Weber and Heidegger. Specifically, Windelband gives us the distinction between idiographic and nomothetic understanding of individuals, an approach that is of relevance to the psychiatric encounter. This academic dialogue will consider tensions between subjectivity and objectivity in clinical and performance practice, while examining Beckett’s analysis of the use of case notes and relating them back to Windelband’s ideas on the understanding of others. This article proposes that Deleuze’s psychoanalytically inspired theory of humour and irony provides an underappreciated way to theorize acts of resistance that adopt a structurally perverse position towards a law or authority. In his books Coldness and Cruelty and Difference and Repetition, Deleuze explains that the law is susceptible to two kinds of subversive procedure. The first, which he calls irony and which he aligns with sadism, reveals a gap between the law and its principles. The second, which he calls (...) humour and which he aligns with masochism, exposes a gap between the law’s interdictions and their consequences. For Deleuze, humour and irony harbour the potential to overturn or overthrow the law. Drawing on Lacanian psychoanalytic theory and contemporary examples – alt-right ‘free speech’ demonstrations in the United States and protests surrounding Russia’ s 2012 parliamentary elections – the article argues that Deleuze overstates the transformative potential of perversion. Nevertheless, his account remains useful for showing the circuitous routes that some subjects take to enjoy their position within the law. Given the global rise in right-wing authoritarianism in recent years, this may prove to be an important insight. (shrink)

The Proliferation of Rights explores how the assertion of rights has expanded dramatically since World War II. Carl Wellman illuminates for the reader the historical developments in each of the major categories of rights, including human rights, civil rights, women’s rights, patient rights, and animal rights. He concludes by assessing where this proliferation has been legitimate and helpful, cases where it has been illusory and unproductive, and alternatives to the appeal to rights.
