La arqueología ha revelado recientemente la existencia de una importante revitalización urbana en Córdoba durante el Califato Almohade, apenas tratada hasta ahora por la historiografía, centrada principalmente en su pasado omeya. Por un lado, se ha observado una importante inversión del poder almohade en elementos defensivos y palatinos, acaso por tratarse en estas fechas de un centro fundamental en la conceptualización histórica de al-Andalus y en la lucha contra los reinos cristianos; por otro, se ha documentado un importante crecimiento orgánico (...) y privado extramuros. Todo ello coincidió con su elección como capital andalusí en 557/1162 por ‘Abd al-Mu’min, lo que suponía un hito fundamental para la legitimación de su nuevo califato. Tras su muerte pocos meses después, Abū Ya‘qūb Yūsuf hizo regresar la corte a Sevilla, creando un importante cambio de rumbo en la política almohade que no afectó al resurgir urbano de la antigua sede omeya. En realidad, Córdoba seguiría muy presente en la mentalidad colectiva andalusí durante el gobierno almohade, manteniéndose como referente principal del esplendor pasado y como núcleo esencial de la tradición mālikī. This book addresses the European Court of Human Rights’ fairness standards in criminal appeal, filling a gap in this less researched area of studies. Based on a fair trial immediacy requirement, the Court has found several violations of Article 6 of the European Convention on Human Rights at the appellate level by at least eighteen States of the Council of Europe in a vast array of cases, particularly in contexts of first instance acquittals overturning and of sentences increasing on appeal. (...) -/- On the one hand, the book critically engages this case-law with the law revisions it has recently inspired in European countries, as well as with the critiques and difficulties that it continues to raise. On the other hand, it interweaves insight from criminal procedure theory with new discoveries in the field of cognitive sciences (neuroscience of memory, philosophy of knowledge, AI), shedding an interdisciplinary light on the (in)adequacy and limits of the Strasbourg Court’s jurisprudence. This paper argues that epistemic errors rooted in group- or identity- based biases, especially those pertaining to disability, are undertheorized in the literature on medical error. After sketching dominant taxonomies of medical error, we turn to the field of social epistemology to understand the role that epistemic schemas play in contributing to medical errors that disproportionately affect patients from marginalized social groups. We examine the effects of this unequal distribution through a detailed case study of ableism. There are four primary (...) mechanisms through which the epistemic schema of ableism distorts communication between nondisabled physicians and disabled patients: testimonial injustice, epistemic overconfidence, epistemic erasure, and epistemic derailing. Measures against epistemic injustices in general and against schema-based medical errors in particular are ultimately issues of justice that must be better addressed at all levels of health care practice. Situados en un progresivo traspaso de responsabilidades en la ejecución de los servicios sociales desde el Estado hacia actores no gubernamentales, aparece una demanda hacia el mismo Estado, el cual en lugar de simplemente declinar su labor, debiera de hecho expandir su regulación de modo de asegurar que la oferta social sea eficiente en satisfacer al ciudadano usuario en aquellos servicios prometidos por las políticas y programas sociales. Así mismo, la institucionalidad pública debiera reconocer las demandas del mundo privado para (...) actuar articuladamente hacia fines comunes, que finalmente conduzcan a un horizonte de desarrollo de una sociedad más igualitaria. Este estudio da cuenta de las tensiones, reveladas por autoridades de servicios públicos que atienden personas vulnerables, en su relación de colaboración con OSFL (Organizaciones Sin Fines de Lucro), para alcanzar tal horizonte. Provability, Computability and Reflection.

The European Commission has recently proposed the introduction of legally binding quotas for women on corporate boards of European companies. This proposal has put the spotlight on the question of whether increasing female representation on the board brings economic benefits to the firm. In order to shed light on the issue, this study investigates the direct and indirect effects of women on the board on firm value. We use a simultaneous equation model to estimate the effects of women on the (...) board on firm value, financial performance, and compliance with ethical and social principles adopted by the firm. We find no evidence that a higher female representation on the board directly affects firm’s value. However, we find indirect effects. Women on the board are positively related with financial performance (measured in terms of return on assets and return on sales) and with ethical and social compliance, which in turn are positively related with firm value. The findings in this study suggest that greater female representation on corporate boards of large European firms can increase firm value indirectly. Further, part of the indirect effect comes from stronger compliance with ethical principles, something that is not captured by accounting-based financial performance. (shrink)

Purpose The purpose of this paper is to report on empirical work conducted to open up algorithmic interpretability and transparency. In recent years, significant concerns have arisen regarding the increasing pervasiveness of algorithms and the impact of automated decision-making in our lives. Particularly problematic is the lack of transparency surrounding the development of these algorithmic systems and their use. It is often suggested that to make algorithms more fair, they should be made more transparent, but exactly how this can be (...) achieved remains unclear. Design/methodology/approach An empirical study was conducted to begin unpacking issues around algorithmic interpretability and transparency. The study involved discussion-based experiments centred around a limited resource allocation scenario which required participants to select their most and least preferred algorithms in a particular context. In addition to collecting quantitative data about preferences, qualitative data captured participants’ expressed reasoning behind their selections. Findings Even when provided with the same information about the scenario, participants made different algorithm preference selections and rationalised their selections differently. The study results revealed diversity in participant responses but consistency in the emphasis they placed on normative concerns and the importance of context when accounting for their selections. The issues raised by participants as important to their selections resonate closely with values that have come to the fore in current debates over algorithm prevalence. Originality/value This work developed a novel empirical approach that demonstrates the value in pursuing algorithmic interpretability and transparency while also highlighting the complexities surrounding their accomplishment. Teaching through discussion is perhaps the most fundamental pedagogical technique of philosophy. When done well, discussion can promote long-term, durable learning. It supports an active-learning classroom, sparks higher-order cognition, and helps students construct their own understanding of the material. Yet it is often not done well: it is easily dominated by a few students; it can waste time on tangents and minutiae; it can fail to motivate students to prepare adequately; and it is not easily scalable. In this paper we (...) present a technique, the random discussion leader (RDL), which addresses all of these shortcomings of traditional discussion. Qualitative and quantitative evidence from our quasi-experimental study (n = 279) suggests that RDL leads to better preparation, better engagement with the material, more equitable participation, and higher quality discussions. Additionally, we provide a toolkit for instructors interested in trying RDL, showing how the technique can be adapted to various course settings and materials. (shrink)

This paper investigates the role of a pre-existing body-model that is an enabling constraint for the incorporation of objects into the body. This body-model is also a basis for the distinction between body extensions (e.g., in the case of tool-use) and incorporation (e.g., in the case of successful prosthesis use). La investigación aborda el dilema que implica la relación entre economía y ética, el cual se deriva de la separación entre filosofía moral y economía positiva. Analizarlo a través de la teoría del bienestar permite acercarse a los preceptos de un cognitivismo ético o de psicología moral, mediante una propuesta distinta de individuo representativo. La finalidad es ofrecer algunos elementos para observar a la economía desde otra perspectiva, al estrechar los lazos teóricos con la ética.

En este breve comentario discuto algunos aspectos de la interpretación de la epistemología de Davidson que sugiere Willian Duica en su reciente libro. Luego de una presentación somera del libro me centro en tres asuntos centrales de la interpretación de Duica. En primer lugar, argumento que su lectura de la crítica de Davidson al dualismo esquema/contenido es muy restrictiva y deja abierta la posibilidad de un realismo directo empirista. En segundo lugar, argumento que en su lectura el propio Duica se (...) compromete inadvertidamente con un empirismo de este tipo y, de este modo, su interpretación entra en tensión con el coherentismo de Davidson. Finalmente, discuto algunos aspectos de la interpretación que hace Duica de la tesis davidsoniana de la triangulación. In this short comment I discuss some aspects of William Duica's interpretation of Davidson's epistemology in a recent book. After a brief review of the book, I focus on three central issues of Duica's interpretation. First, I argue that his reading of Davidson's criticism of the scheme/content dualism is too restrictive and leaves open the possibility of an empiricist direct realism. Second, I argue in his reading Duica inadvertently commits himself to an empiricism of this sort and, as a result, his interpretation is in tension with Davidson's own coherentism. Finally, I discuss some aspects of Duica's interpretation of Davidsonian triangulation. (shrink)

Never like today concerns about masculinities and the implications of being-a-man had been so present in diverse public life scenarios. We witness the multiplication and propagation of social agendas, programs and pedagogies around masculinity. Psychological practices and discourses, as well as their means for cultural propagation, have an important presence in current understandings of masculinity and articulate a language for its intervention. In this text we explore this scenario through the notions of psychologization and therapeutic culture. We trace certain inflections (...) in the development of masculinity as an object in the field of psychological dispositives for knowledge production and individual management. Decision-making capacity is the gatekeeping element for a patient’s right to self-determination with regard to medical decisions. A DMC evaluation is not only conducted on descriptive grounds but is an inherently normative task including ethical reasoning. Therefore, it is dependent to a considerable extent on the values held by the clinicians involved in the DMC evaluation. Dealing with the question of how to reasonably support clinicians in arriving at a DMC judgment, a new tool is presented that fundamentally differs from (...) existing ones: the U-Doc. By putting greater emphasis on the judgmental process rather than on the measurement of mental abilities, the clinician as a decision-maker is brought into focus, rendering the tool more of an evaluation guide than a test instrument. In a qualitative study, the perceived benefits of and difficulties with the tool have been explored. The findings show on the one hand that the evaluation aid provides basic orientation, supports a holistic perspective on the patient, sensitizes for ethical considerations and personal biases, and helps to think through the decision, to argue, and to justify one’s judgment. On the other hand, the room for interpretation due to absent operationalisations, related ambiguities, and the confrontation with one’s own subjectivity may be experienced as unsettling. (shrink)

Servant leadership offers a compelling ideal of self-sacrificing individuals who put the needs of others before their own and cultivate a culture of growth in their organisations. Although the theory’s attempts to emphasise the moral, emotional and relational dimensions of leadership are laudable, it has primarily assumed a decontextualised view of leadership untouched by power. This article aims to problematise servant leadership by undertaking an intersectional analysis of an Asian cis-male heterosexual senior manager in Australia. Through in-depth interviews with the (...) manager and his staff, the article shows how his attempts to practice servant leadership were informed by intersecting power dynamics of race, gender, sexuality, age and class that subordinated him to white power. The findings demonstrate the ways servant leadership is necessarily embedded in wider power structures that shape who gets to be a “servant leader” and who remains merely a “servant”. (shrink)

El presente texto versa sobre la reflexión teórica del ser de la mujer latinoamericana desde una perspectiva dusseliana, de manera que el objetivo del artículo radica en la comprensión filosófica de lo que significa ser y estar como mujer latinoamericana, además de concebir los aportes y retos que nutren dicha reflexión. Por tal motivo se encontrará: primero una justificación de la pertinencia de esta reflexión mediante una breve contextualización de la situación actual de la mujer en América Latina; segundo, una (...) síntesis del aporte de Enrique Dussel que, sin duda alguna, es un análisis que nace del método analéctico ; tercero, dado que el reto está en dilucidar la afirmación del ser que ha sido negado para llegar a comprenderlo, propongo tres postulados que retroalimentan el problema de investigación. Se analiza la apuesta ontológica de Arturo Escobar a partir de dos formas en las que esta se expresa, para vislumbrar los alcances y limitaciones de esta concepción ontológica. La primera concepción radica en lo que el autor denomina ontología relacional y la segunda versa en la llamada ontología política. El texto está dividido en cuatro apartados, el primero introduce al lector a lo que representa la pregunta por el ser, haciendo hincapié en Martin Heidegger. El segundo expone brevemente el (...) contexto que se puede evidenciar en la apuesta académica del antropólogo colombiano a través del giro ontológico, desarrollado desde la antropología, en el que se destaca una crítica al paradigma occidental dualista naturaleza/cultura y, a su vez, de la teoría decolonial que denuncia a la Modernidad y la vigencia de la colonialidad de ser, para así poder comprender la propuesta de la ontología relacional de Escobar. El tercer apartado expresa desde las categorías de territorio y pluriverso una premisa fundamental: pensar lo político presupone una ontología, es decir, una visión de mundo sobre lo que es y está, de esta manera se articula el proyecto de la ontología desde la relacionalidad con luchas que reivindican los mundos y los derechos de las comunidades; en el cuarto y último apartado se exponen los alcances y límites de la ontología de Escobar, así como caminos posibles para considerar en investigaciones futuras. Acting for the good of the patient is the most fundamental and universally acknowledged principle of medical ethics. However, given the complexity of modern medicine as well as the moral fragmentation of contemporary society, determining the good is far from simple. In his philosophy of medicine, Edmund Pellegrino develops a conception of the good that is derived from the internal morality of medicine via the physician-patient relationship. It is through this healing relationship that rights, duties, and privileges are defined for (...) both physicians and patients. Moreover, this relationship determines the characteristics or virtues that are necessary to engage in the medical telos. This paper addresses the role of the moral virtues in clinical medicine and the physician-patient relationship. First, it provides a brief background of the Aristotelian foundations of virtue-ethics. Second, it delves into Pellegrino’s philosophy of medicine understood as a practice oriented towards a teleological goal. Third, it relates the telos of medicine to the notion of the medical community as a fundamentally moral community. The aim of this study was to identify the ethical problems that nurse managers encounter in their work and the role of codes of ethics in the solutions to these difficulties. The data were collected using a structured questionnaire and analysed statistically. The target sample included all nurse managers in 21 specialized health care or primary health care organizations in two hospital districts in Finland (N = 501; response rate 41%). The most common ethical problems concerned resource allocation as well (...) as providing and developing high quality care. This was the case in different managerial positions as well as in types of organization. Professional codes of ethics were used more often for problems related to patients’ care compared with issues of resource allocation. Nurse managers at middle or strategic management levels used codes of ethics more often than those in charge of a ward. More research is required to investigate ethical decision making in nursing management, especially with regard to problem solving. In addition, new guidelines and continuing education in ethics are important for management personnel. (shrink)

The aim of this study was to explore ethically problematic situations in the long-term nursing care of elderly people. It was assumed that greater awareness of ethical problems in caring for elderly people helps to ensure ethically high standards of nursing care. To obtain a broad perspective on the current situation, the data for this study were collected among elderly patients, their relatives and nurses in one long-term care institution in Finland. The patients (n=10) were interviewed, while the relatives (n=17) (...) and nurses (n=9) wrote an essay. Interpretation of the data was based on qualitative content analysis. Problematic experiences were divided into three categories concerning patients’ psychological, physical and social integrity. In the case of psychological integrity, the problems were seen as being related to treatment, self-determination and obtaining information; for physical integrity, they were related to physical abuse and lack of individualized care; and for social integrity, to loneliness and social isolation. This study provided no information on the prevalence of ethical problems. However, it is clear from the results that patient integrity warrants more attention in the nursing care of elderly patients.
