Prisoners sometimes die in prison, either due to natural illness, violence, suicide, or a result of imprisonment. The purpose of this study is to understand deaths in custody using qualitative methodology and to argue for a comprehensive definition of death in custody that acknowledges deaths related to the prison environment. Interviews were conducted with 33 experts, who primarily work as lawyers or forensic doctors with national and/or international organisations. Responses were coded and analysed qualitatively. Defining deaths in custody according to (...) the place of death was deemed problematic. Experts favoured a dynamic approach emphasising the link between the detention environment and occurrence of death rather than the actual place of death. Causes of deaths and different patterns of deaths were discussed, indicating that many of these deaths are preventable. Lack of an internationally recognised standard definition of death in custody is a major concern. Key aspects such as place, time, and causes of death as well as relation to the prison environment should be debated and incorporated into the definition. Systematic identification of violence within prison institutions is critical and efforts are needed to prevent unnecessary deaths in prison and to protect vulnerable prisoners. (shrink)

This conference was devoted to the 80 years of the Copenhagen Interpretation, and to the question of the relevance of the Copenhagen interpretation for the present understanding of quantum mechanics. It is in this framework that fundamental questions raised by quantum mechanics, especially in information theory, were discussed throughout the conference. As has become customary in our series of conference in Växjö, we were glad to welcome a fruitful assembly of theoretical physicists, experimentalists, mathematicians and even philosophers interested in the (...) foundations of probability and physics. The nature of quantum fluctuations---in the form of Stochastic Electrodynamics or in other approaches to stochastic quantum mechanics---was also a central topic discussed during the conference, especially during debates. We should also mention talks on the completeness or incompleteness of quantum mechanics; on macroscopic quantum systems; on Bell's inequality, entanglement and experiments on quantum nonlocality (and locality); on Bohmian mechanics; on the connection between quantum mechanics and general relativity; on quantum probability; on quantum computing, quantum teleportation and quantum cryptography technologies; and more generally on the mathematical formalism of quantum mechanics and on the philosophical problems raised by its interpretations. This Växjö conference was devoted to the reconsideration of quantum foundations. Due to increasing research in quantum information theory, especially on quantum computing and cryptography, many questions regarding the foundations of quantum mechanics, which have long been considered to be exclusively of philosophical interest, nowadays play an important role in theoretical and experimental quantum physics.

ABSTRACT Recently, the hypothesis that purely evaluative disputes are metalinguistic negotiations has gained traction. I resist a strong version of that hypothesis, and argue that some of those disputes are not metalinguistic negotiations. To defend that claim, I argue that metalinguistic negotiations have three linguistic properties that some purely evaluative disputes lack. First, in a metalinguistic negotiation it is felicitous to embed the dispute-initial statement under the subjective attitude verb consider; second, a speaker can reply to that initial statement by (...) using a metalinguistic comparative; and, third, such negotiations address metalinguistic questions under discussion. Some purely evaluative disputes lack these properties, which suggests that they are not metalinguistic negotiations. (shrink)

One way social scientists explain phenomena is by building structural models. These models are explanatory insofar as they manage to perform a recursive decomposition on an initial multivariate probability distribution, which can be interpreted as a mechanism. Explanations in social sciences share important aspects that have been highlighted in the mechanisms literature. Notably, spelling out the functioning the mechanism gives it explanatory power. Thus social scientists should choose the variables to include in the model on the basis of their function (...) in the mechanism. This paper examines the notion of ‘function’ within structural modelling. We argue that ‘functions’ ought to be understood as the theoretical underpinnings of the causes, namely as the role that causes play in the functioning of the mechanism. (shrink)

ABSTRACT:Ethical research on consumption has focused mainly on the obligations, principles and values guiding consumers' actions and reasons for action. In doing so, it has concerned itself mostly with such bounded contexts as voluntary simplifiers, anti-consumption movements or so-called ‘ethical consumers,’ thereby fostering an artificial opposition between ethical and non-ethical consumption. This paper proposes virtue ethics as a more apt conceptual framework for the ethical analysis of consumption because it takes into account the developmental dynamic triggered by engagement in consumption (...) practices. We build on MacIntyre's goods-virtues-practices-institutions framework and Beabout's concept of a domain-relative practice and argue that when engaging in consumption activities, agents may pursue goods internal to practices, further their individual life narratives and contribute to the good of their communities, thus developing virtues that perfect themselves both as consumers and as ethical agents. In this paper, we use an experimental design to compare the performance of elicitation rules for subjective beliefs. Contrary to previous works in which elicited beliefs are compared to an objective benchmark, we consider a purely subjective belief framework. The performance of different elicitation rules is assessed according to the accuracy of stated beliefs in predicting success. We measure this accuracy using two main factors: calibration and discrimination. For each of them, we propose two statistical indexes and we compare the (...) rules’ performances for each measurement. The matching probability method provides more accurate beliefs in terms of discrimination, while the quadratic scoring rule reduces overconfidence and the free rule, a simple rule with no incentives, which succeeds in eliciting accurate beliefs. Nevertheless, the matching probability appears to be the best mechanism for eliciting beliefs due to its performances in terms of calibration and discrimination, but also its ability to elicit consistent beliefs across measures and across tasks, as well as its empirical and theoretical properties. I defend a metalinguistic account of Mates's puzzle: sentences where synonymous expressions cannot be substituted salva veritate. If Andrea thinks that attorneys are different from lawyers, and she thinks that Fiona is the former but not the latter, we may hesitate to substitute ‘lawyer’ for ‘attorney’ in ‘Andrea believes that Fiona is an attorney’, even though ‘lawyer’ and ‘attorney’ are synonymous. I argue that these sentences report de re beliefs about linguistic expressions, thereby blocking such substitutions, and I offer a (...) compositional derivation of their meaning. (shrink)

I argue against the view that metalinguistic usage is a form of conversational implicature. That view, suggested by Thomasson (Anal Philos 57(4):1-28, 2016) and Belleri (Philos Stud 174(9):2211–2226, 2017), has been most recently fleshed out by Mankowitz (Synthese 199:5603–5622, 2021). I provide two types of criticism to the implicature view. From an empirical point of view, metalinguistic usage differs in key respects from standard cases of conversational implicature. From a conceptual standpoint, I argue that the calculation algorithm provided by the (...) implicature view makes undesirable predictions. Although my main objective is negative, I end the paper by sketching an alternative neo-Stalnakerian view of metalinguistic usage, that can be gathered from work by Barker (Linguist Philos 25(1):1–36, 2002; Inquiry 56(2–3):240–257, 2013) and others. It has been argued that moral assertions involve the possession, on the part of the speaker, of appropriate non-cognitive attitudes. Thus, uttering ‘murder is wrong’ invites an inference that the speaker disapproves of murder. In this paper, we present the result of 4 empirical studies concerning this phenomenon. We assess the acceptability of constructions in which that inference is explicitly canceled, such as ‘murder is wrong but I don’t disapprove of it’; and we compare them to similar constructions involving ‘think’ (...) instead of ‘disapprove’—that is, Moore paradoxes (‘murder is wrong but I don’t think that it is wrong’). Our results indicate that the former type of constructions are largely infelicitous, although not as infelicitous as their Moorean counterparts. (shrink)

The ethic of care has often been opposed to the ethic of justice as offering a different and even a contradictory approach to moral problems. This article argues that, from the perspective of the discourse ethic, both approaches are complementary in a very fundamental sense, since each one applies to one of two stages of moral reasoning that are as different as they are interconnected. It argues, in particular, that while justice is concerned with the justification and elaboration of norms, (...) care is concerned with finding a solution for specific moral situations. The article then places considerations of care at the centre of ideal discourse and subordinates the importance of rational understanding and moral justification to intuitive communication. (shrink)

Guillaume Collett questions to what extent we can locate Deleuze within the Lacanian School during the late-1960s, prior to Guattari. In so doing, he offers a new, integrated reading of Deleuze's The Logic of Sense by understanding it as a 'psychoanalysis of sense', and gives a new interpretation of Deleuze's conception of philosophy itself. The Psychoanalysis of Sense shows that Deleuze was not merely aware of the debates animating the Lacanian School during the 1960s: he sought to contribute to (...) them. Emphasising his appropriation of the work of post-Lacanian Serge Leclaire, Collett explains how Deleuze constructed a more singular and immanent theory of the linguistic structure of the unconscious - granting the erogenous body a larger structuring role. Representing an epistemic situation involving several agents obviously depends on the modeling point of view one takes. We start by identifying the types of modeling points of view which are logically possible. We call the one traditionally followed by epistemic logic the perfect external approach, because there the modeler is assumed to be an omniscient and external observer of the epistemic situation. In the rest of the paper we focus on what we call the internal approach, where the modeler is (...) one of the agents involved in the situation. For this approach we propose and axiomatize a logical formalism based on epistemic logic. This leads us to formalize some intuitions about the internal approach and about its connections with the external ones. Finally, we show that our internal logic is decidable and PSPACE-complete. Although Wilhelm Dilthey and Franz Brentano apparently were pursuing roughly the same objective—to offer a description of our mental functions and of their relations to objects—and both called their respective research programs ‘descriptive psychology’, they seem to have used the term to refer to two different methods of psychological research. In this article, I compare analyses of these differences. Against the reading of Orth but also against a possible application of recent relativist accounts of the epistemology of peer disagreement to (...) this case, I argue that their apparent shared objective is not enough to support an understanding of their views as two alternatives within a given historical or scientific context, or as a mutual peer disagreement. I show that the impression of a shared objective can be explained away as stemming from the influence of their teacher Adolf Trendelenburg, and I stress that the case of introspection strongly suggests that an account in terms of peer disagreement is not plausible. Finally, I conclude that the opposition between two traditions, Austrian philosophy and historicism, might be better suited to account for the dispute and its apparent common historical context. After observing that the truth conditions of connectives of non–classical logics are generally defined in terms of formulas of first–order logic, we introduce ‘protologics’, a class of logics whose connectives are defined by arbitrary first–order formulas. Then, we introduce atomic and molecular logics, which are two subclasses of protologics that generalize our gaggle logics and which behave particularly well from a theoretical point of view. We also study and introduce a notion of equi-expressivity between two logics based on different classes (...) of models. We prove that, according to that notion, every pure predicate logic with \ variables and constants is as expressive as a predicate atomic logic, some sort of atomic logic. Then, we prove that the class of protologics is equally expressive as the class of molecular logics. That formally supports our claim that atomic and molecular logics are somehow ‘universal’. Finally, we identify a subclass of molecular logics that we call predicate molecular logics and which constitutes its representative core: every molecular logic is as expressive as a predicate molecular logic. El jesuita Francisco Suárez como eminente teólogo, filósofo y jurista de su época juega un papel relevante como precedente en la construcción de las categorías del pensamiento moderno. Una de estas categorías, no contemporánea del doctor eximio, es la de los derechos humanos. Son muchos los autores que anticipan alguno de sus elementos fundamentales ya en el pensamiento en torno al Derecho que desarrolla Francisco Suárez en sus principales tratados de filosofía jurídica y política como el De Legibus y la (...) Defensio fidei. En este trabajo trataremos de conectar la virtualidad del planteamiento suarista en el ámbito de los derechos humanos, explorando en su obra estos antecedentes y la dirección en la que los mismos se dirigen, así como las posibilidades de dialogo que abre en torno a la construcción de la concepción de los derechos humanos en el contexto actual. Using a comprehensive sample of U.S. non-profit hospitals from 2011 to 2015, we examine the effects of state community benefits regulation on the amount of charity care provided by and the operational efficiency of U.S. non-profit hospitals. First, we document that, under such regulations, non-profit hospitals provide more charity care and less compensated care as a proportion of net revenue. We infer from these findings that CBR has the potential to increase both non-profit hospitals’ amount of charity care and their (...) efficiency of operations. Second, by examining variation in CBR types, we find no differences between having provision or having reporting requirements on the amount of charity care offered. Moreover, when we consider CBR with both provision and reporting requirements, the combination of these two requirements does not incrementally enhance charity care offerings, suggesting that the requirements may serve as substitutes with comparable effect. Lastly, we show that several state-level characteristics influence the relationship between CBR and charity care: CBRs in states with a higher gross domestic product and percentage of revenue received in taxes have incrementally lower associations with charity care, while hospitals in states where populations have, on average, higher household incomes have greater associations between CBR and charity care. Our findings highlight the effects that state-enacted regulation can have on socially beneficial behavior by non-profits. (shrink)

O filósofo se afasta da longa tradição alemã dos hinos à melancolia, ao mesmo tempo em que subverteu os poemas filosóficos - os darwinistas em particular - de sua época, para superar seu pessimismo schopenhaueriano.The article aims at describing the poem “An die Melancholie” as an essential and crucial (...) moment within the development of Nietzsche’s philosophy, which refers to the first intuition of the notion of “Will to Power”. The philosopher deviates from the long German tradition of odes to melancholy, whilst subverting the philosophical poems of his own time - specially the Darwinian ones -, in order to overcome his Schopenhauerian pessimism. Dynamic Epistemic Logic (DEL) deals with the representation and the study in a multi-agent setting of knowledge and belief change. It can express in a uniform way epistemic statements about: 1. what is true about an initial situation 2. what is true about an event occurring in this situation 3. what is true about the resulting situation after the event has occurred. We axiomatize within the DEL framework what we can infer about (iii) given (i) and (ii). Given three formulas (...) φ,φ' and φ" describing respectively (i), (ii) and (iii), we also show how to build a formula φ ? φ' which captures all the information which can be inferred about (iii) from φ and φ'. We show how our results extend to other modal logics than K. In our proofs and definitions, we resort to a large extent to the normal form formulas for modal logic originally introduced by Kit Fine. In a companion paper (Aucher, 2012), we axiomatize what we can infer about (ii) given (i) and (iii), and what we can infer about (i) given (ii) and (iii), and show how to build two formulas φ ? φ" and φ' ? φ" which capture respectively all the information which can be inferred about (ii) from φ and φ", and all the information which can be inferred about (i) from φ' and φ". Corporate codes of ethics, which have spread in the last decades, have shown a limited ability to foster ethical behaviors. For instance, they have been criticized for relying too much on formal compliance, rather than taking into account sufficiently agents and their moral development, or promoting self-reflexive behaviors. We aim here at showing that a code of ethics in fact has meaning and enables ethical progress when it is interpreted and appropriated with practical wisdom. We explore a model that represents (...) an uncommon organizational code of ethics: the monastic Rule of St. Benedict, written in the sixth century and still used today. Our empirical study—conducted in several monasteries living under this rule—shows that organization members interpret this rule, both hermeneutically and ethically, to adapt it to situations. They also appropriate this rule as a way of life and treat it as a dynamic framework that helps them to follow their purpose within their organization. This exceptional code actually offers an alternative model for practicing codes of ethics, in a virtue-ethical manner, beyond mere compliance with the text. The way in which reflexive and active agents practice the code, both individually and collectively, shapes their organizational experience and fosters their moral development. (shrink)

El artículo presenta los principales resultados de un estudio realizado entre 1998 y 2000 con hombres jóvenes de la Ciudad de Cali, Colombia, profundizando en sus prácticas de distinción en torno al cuerpo, la vestimenta, los espacios de sociabilidad, las mujeres como objetos de ostentación y sus dinámicas de prestigio. El estudio es desarrollado en base a observación participante y a la implementación de entrevistas con grupos de jóvenes entre 14 y 22 años, tanto de sectores medios bajos, como medios (...) altos, e indaga en sus opiniones sobre la moda, el prestigio, la distinción social y los comportamientos que otorgan o quitan el estatus. Objectives—To assess the relationship between the approval of trials by a research ethics committee and the fact that informed consent from participants was obtained, with the quality of study design and methods.Design—Systematic review using a standardised checklist.Main measures—Methodological and ethical issues of all trials published between 1993 and 1995 in the New England Journal of Medicine, the Lancet, the Journal of the American Medical Association and the British Medical Journal were studied. In addition, clinical trials conducted in Spain and published (...) by at least one Spanish author during the same period in any other journal were also included.Results—We studied the published articles of 767 trials and found the following indicators of lower methodological quality to be independent predictors for failure to disclose REC approval or ICP: absence of concealment of allocation, lack of justification for unblinded trials, not using a treatment for the patients in the control group, absent information on statistical methods, not including sample size estimation, not establishing the rules to stop the trial, and omitting the presentation of a baseline comparison of groupsConclusion—Trials of higher methodological and scientific quality were more likely to provide information about their ethical aspects. El presente artículo desarrolla una reflexión acerca de los ideales de belleza femenina promovidos por el mercado y los mass-media, dando cuenta de datos estadísticos e informes periodísticos de los trastornos que generan, en términos de mortalidad y morbilidad en la población femeninaLa primera parte del análisis responde, desde una perspectiva psicológica, a la pregunta ¿cómo se constituye como sujeto una mujer? La segunda parte aborda desde una perspectiva sociocultural la pregunta ¿cómo debe ser una mujer?, desde la premisa de (...) que las prácticas de educación y moldeamiento del cuerpo tienen sentido en la modernidad como una forma de control social. Finalmente se busca, desde una perspectiva política, señalar cómo el “boom” de la estética corporal es un mecanismo de dominación principalmente dirigido a la mujer, al cual las políticas públicas y la legislación no logran dar respuesta, manteniendo a éstas en un lugar pasivo como sujeto y actor político. In a posthumous text entitled A Scientific Theory of Culture, he offered a minimal definition of ‘science’ for the humanistic scholar, which would thus be differentiated simultaneously from abstract thought and from common sense.
