Recent theories on cognitive science have stressed the significance of moral intuition as a counter to and complementary part of moral reasoning in decision making. Thus, the aim of this paper is to create an integrated framework that can account for both intuitive and reflective cognitive processes, in order to explore the antecedents of ethical decision making. To do that, we build on Scholasticism, an important medieval school of thought from which descends the main pillars of the modern Catholic social (...) doctrine. Particularly, the focus will be on the scholastic concept of synderesis, which is an innate human faculty that constantly inclines decision makers toward universal moral principles. Managerial implications are discussed, stressing how a rediscovery of decision makers’ intuitive moral judgments could be relevant in the reflective thinking practice of managers’ ethical reasoning, thus saving them from rational insensitivity to ethical dilemmas. This chapter proposes a dialectical approach to legal interpretation, consisting of three dimensions: a formalization of the canons of interpretation in terms of argumentation schemes; a dialectical classification of interpretive schemes; and a logical and computational model for comparing the arguments pro and contra an interpretation. The traditional interpretive maxims or canons used in both common and civil law are translated into defeasible patterns of arguments, which can be evaluated through sets of corresponding critical questions. These interpretive argumentation schemes are (...) classified in general categories and a distinction is drawn between schemes supporting and rebutting an interpretation. This framework allows conceiving statutory interpretation as a dialectical procedure consisting in weighing arguments pro and contra an interpretation. We propose a synthetic description of Merleau-Ponty’s phenomenology with the aim of providing physicists and philosophers with an alternative linguistic and conceptual framework to address the logical and ontological problematics emerged in quantum mechanics. Phenomenology’s cognitive devices such as the dynamical relationship between object and horizon, the presumptive synthesis and the constitution of an ontology based on the indivisibility of object and subject, not only show hermeneutic efficacy when applied to the study of human perception, but may prove to be (...) sufficiently innovative to lead to novel insights towards the understanding of the quantum mechanical theoretical structure: the traditional tenet of quantum physics being in discontinuity with the major characteristics of classical physics is shaken at its fundaments and a new perspective of continuity between the two worlds is opened. Business Ethics: A European Review, EarlyView.

In this article, we deal with the evaluation of the losses suffered by persons living in urban areas as a result of energy services. In the first part, we analyse how by adopting different informational foci we obtain contrasting interpersonal evaluations regarding the same loss. In the second part, we distinguish between a diachronic and a hypothetical/moralised threshold for harm in order to assess whether individuals are benefiting from or being harmed by a given energy service. Our argument is that (...) the most accurate evaluation of an individual damage caused by an energy service can be obtained by using capabilities as informational focus, instead of realised wellbeing or means to wellbeing, and by interpreting the loss in relation to a hypothetical/moralised threshold that corresponds to a list of central capabilities. In the last part, we address monetary and non-monetary compensations for a loss that is evaluated in terms of capabilities. Accordingly, we expound how compensation policies can either restore the capabilities lost due to energy services or monetarily compensate the individual for the fact that a given capability (or set of capabilities) has been irremediably lost. Definition of the problem Medical ethics is increasingly faced with issues that result from power asymmetries and epistemic injustice. However, medical ethics lacks the epistemic lenses for analyzing these social context factors of clinical practice. A theoretical and conceptual reconfiguration is necessary in order to be able to address these issues. Arguments This paper discusses the foundations of critical medical ethics, which takes perspectives and epistemic categories from critical theories. This includes the Critical Theory of the Frankfurt School as well (...) as those approaches from social sciences and cultural studies that reflect on power asymmetries. By drawing on these theories, the epistemic spectrum of medical ethics could be broadened in order to better include real power relations into normative analyses. The paper starts by outlining the contribution of social sciences to empirical medical ethics. This shows that an empirical approach as such cannot bridge the epistemic gap. In a further step, epistemic lenses and concepts from critical theories are discussed, such as Critical Theory of the Frankfurt School, feminist approaches, postcolonial approaches, queer theory, gender studies, and science and technology studies (STS). The conclusion sums up the foundations of critical medical ethics and discusses its limitations. Conclusion Critical medical ethics possesses the epistemic categories and broader social perspective needed to address issues in medicine that result from power asymmetries and epistemic injustice in society. In the present manuscript, we comment upon a paper that strongly criticized an expert report written by the consultants of the defense in a case of pedophilia, in which clinical and neuro-scientific data were used to establish the causal link between brain alterations and onset of criminal behavior. These critiques appear to be based mainly on wrong pieces of information and on a misinterpretation of the logical reasoning adopted by defense consultants. Here we provide a point-by-point reply to the issues (...) raised in the above paper and also discuss the potential role that neuroscience may contribute in the forensic context. Did the forensic neuroscience defense consultants claim the existence of a deterministic relationship between brain structure or function and behavior? How did the neuroscientific logic work in this specific case? How may the classic psychiatric/neurologic examination and neuroscientific evidence work side by side? Does the rarity of a disease impact on the causal relationship between the disease and the crime? Do neuroscientific data need to be interpreted? We address the above questions and conclude that neuroscience may strengthen the results of psychiatric evaluations, thus reducing uncertainty in the forensic settings. (shrink)

Argumentation schemes are forms of reasoning that are fallible but correctable within a self-correcting framework. Their use provides a basis for taking rational action or for reasonably accepting a conclusion as a tentative hypothesis, but they are not deductively valid. We argue that teleological reasoning can provide the basis for justifying the use of argument schemes both in monological and dialogical reasoning. We consider how such a teleological justification, besides being inspired by the aim of directing a bounded cognizer to (...) true belief and correct choices, needs to take into account the attitudes of dialogue partners as well as normative models of dialogue and communicative activity types, in particular social and cultural settings. Obsessive–compulsive disorder is a debilitating mental health disorder that can easily become a treatment-resistant condition. Although effective therapies exist, only about half of the patients seem to benefit from them when we consider treatment refusal, dropout rates, and residual symptoms. Thus, providing effective augmentation to standard therapies could improve existing treatments. Group compassion-focused interventions have shown promise for reducing depression, anxiety, and avoidance related to various clinical problems, but this approach has never been evaluated for OCD individuals. However, cultivating compassion (...) for self and others seems crucial for OCD patients, given the accumulating research suggesting that fear of guilt, along with isolation and self-criticism, can strongly contribute to the development and maintenance of OCD. The primary aim of this pilot study was to evaluate the acceptability, tolerability, and effectiveness of an 8-week group compassion-focused intervention for reducing OCD symptoms, depression, fear of guilt and self-criticism, and increasing common humanity and compassionate self-reassuring skills in treatment-resistant OCD patients. Using a multiple baseline experimental design, the intervention was evaluated in a sample of OCD patients who had completed at least 6 months of CBT treatment for OCD, but who continued to suffer from significant symptoms. Participants were randomized to different baseline assessment lengths; they then received 8 weekly, 120-min group sessions of compassion-focused therapy for OCD, and then were tested again at post-treatment and at 1 month follow up. Despite the adverse external circumstances, by the end of treatment, all participants demonstrated reliable decreases in OCD symptoms, and these improvements were maintained at 4-week follow-up for seven of eight participants. The intervention was also associated with improvements in fear of guilt, self-criticism, and self-reassurance, but less consistent improvements in depression and common humanity. Participants reported high levels of acceptability of and satisfaction with the intervention. Results suggest that the intervention may be beneficial as either a stand-alone treatment or as an augmentation to other treatments. (shrink)

The continental drift controversy has been deeply analysed in terms of rationalist notions, which seem to find there a unique topic to describe the weight of evidence for reaching consensus. In that sense, many authors suggest that Alfred Wegener’s theory of the original supercontinent Pangea and the subsequent continental displacements finally reached a consensus when irrefutable evidence became available. Therefore, rationalist approaches suggest that evidence can be enough by itself to close scientific controversies. In this article I analyse continental drift (...) debates from a different perspective which is based on styles of thought. I’ll argue that continental drift debate took much longer than it was usually recognized with two styles of thought coexisting for hundreds of years. These were fixism and mobilism and they were always confronting their own evidence and interpretations and functioning as general frameworks for the acceptability of a specific theory. Therefore, this text aims to bring much broader sociological elements than usually involved in the analysis of the continental drift theory. (shrink)

This study examines the implications of practical reason for entrepreneurial activities. Our study is based on Thomas Aquinas’ interpretation of such virtue, with a particular focus on the partition of practical reason in potential parts such as synesis, or common sense, and gnome, or perspicacity. Since entrepreneurial acts and actions deal with extremely uncertain situations, we argue that only this perspicacity, as the ability of correctly judging in exceptional cases, has the power to find wisdom under such blurred conditions. Perspicacity (...) frees entrepreneurs from their cognitive schemata rendering them able to be truly entrepreneurial. Based on this vision and thanks to a semantic analysis of the meaning of the Greek word gnome, we construct an interpretative model for entrepreneurial judgment composed of three dimensions, specifically, knowledge-cognitive, external-affective and personal-reflective. The model highlights how a ‘successful’ entrepreneurial judgment is also such from a holistic point of view. (shrink)

Currently, anomalous lived temporality is not included in the main diagnostic criteria or standard symptom checklists. In this article, we present the Transdiagnostic Assessment of Temporal Experience, a structured interview that can be used by researchers and clinicians without a comprehensive phenomenological background to explore abnormal time experiences in persons with abnormal mental conditions regardless of their diagnosis. When extensive data gathered by this scale are available, it will be possible to delineate well-defined anomalous lived temporality profiles for each psychopathological (...) disorder. This instrument may also prove useful for clinicians by providing a more refined assessment of relevant psychopathological symptoms and an in-depth understanding of the patient’s abnormal behaviour as related to specific types of time experience. In the first part of the article, we provide a brief overview of the phenomenological concept of temporality, including pre-phenomenal and phenomenal time, synthesis, conation and synchronization, and of abnormal time experiences in persons affected by psychopathological conditions. In the following part, we describe the basic structure of the interview that comprises seven categories corresponding to the abnormal features of lived temporality: anomalies of synchrony, of time structure, of implicit time flow, of explicit time flow, and anomalous experiences of the past, the present and the future. The paper also includes a section on administration and scoring of the TATE scale, the complete interview and a Likert table for quantifying the frequency, intensity and interference with daily life of the phenomena explored. The article appearing previously in this journal entitled “Styles of Thought on the Continental Drift Debate” (Pellegrini 2019) prompted a response from Weber and Šešelja (2020) which they termed as “a defence of rationalist accounts”. They argue that their self-designated “sophisticated rationalism” explains the closure of the continental-drift debate without being affected by my critiques to rationalist approaches. While ignoring the empirical evidence that shows the complexity of the debate and the necessity to include broader social elements in the (...) analysis (such as scientists denying continental drift even after the plate tectonics theory, others supporting it without being familiarized with the literature), they proclaim to be unconvinced about the analysis of the styles of thought. In order to clarify differences in the approach to the continental-drift historical controversy, I respond here to the criticism my paper drew while discussing the place of rationalism when explaining the acceptance of a theory. I will argue that their distinction between “crude” and “sophisticated” rationalism does not solve the problem of social aspects being left aside by rationalists in view of the acceptance of a theory. I will also argue that in order to understand what leads people to embrace a belief (namely scientists in accepting a theory), the analysis of mere cognitive or epistemic arguments is not enough and it leads to a reductionist explanation as to social behaviour. Leibnizian-Newtonian calculus was a theory that dealt with geometrical objects; the figure continued to play one of the fundamental roles it had played in Greek geometry: it susbstituted a part of reasoning. During the eighteenth century a process of de-geometrization of calculus took place, which consisted in the rejection of the use of diagrams and in considering calculus as an 'intellectual' system where deduction was merely linguistic and mediated. This was achieved by interpreting variables as universal quantities and introducing the (...) notion of function, which replaced the study of curves. However, the emancipation of calculus from its basis in geometry was not comprehensive. In fact, the geometrical properties of curves were attributed de facto to functions and thus eighteenth-century calculus continued implicitly to use principles borrowed from geometry. There was therefore no transition to a purely syntactical theory based on axiomatically introduced terms, a shift which only took place subsequently in modern times. (shrink)

Risk and crisis communication (RCC) is a current ethical issue subject to controversy, mainly due to the tension between individual liberty (a core component of fairness) and effectiveness. In this paper we propose a consistent definition of the RCC process in public health emergencies (PHERCC), which comprises six key elements: evidence, initiator, channel, publics, message, and feedback. Based on these elements and on a detailed analysis of their role in PHERCC, we present an ethical framework to help design, govern and (...) evaluate PHERCC strategies. The framework aims to facilitate RCC, incorporating effectiveness, autonomy, and fairness. It comprises five operational ethical principles: openness, transparency, inclusivity, understandability, and privacy. The resulting matrix helps understanding the interplay between the PHERCC process and the principles of the framework. The paper includes suggestions and recommendations for the implementation of the PHERCC matrix. (shrink)

The "religious and secular divide" cannot be understood unless we think about the way sex gets mobilized on both sides of this supposed divide. In our joint writing, we have resisted thinking of the religious and the secular as a divide; we have rather been interested to think them relationally—as relations. Thus, the larger suggestion of this paper is that we cannot truly imagine and practice democratic politics—to name some keywords for this discussion—unless we rethink the relations between sex, secularism, (...) and religion. A radical reform of the agri-food biotech regulation in the EU is considered in many quarters as a pressing necessity. Indeed, two important decisions on the legal status of the so-called New Breeding Techniques are expected shortly. In order to clarify some basic aspects of the complex scenario, after a brief introduction regarding the “GMO” fallacy, we offer our point of view on the following facets: A faulty approach is frequent in the discussion of the agri-food regulation; NBTs, genome editing (...) may lead to the disappearance of the “GMO” meme; Beyond health and safety issues: socio-economic considerations; Sustainability: the comprehensive, meaningful starting point of a positive reform; The theoretical and legal basis for the reform are already contained in the EU’s general guidelines to legislation. A recent Supreme Court decision, Kumho Tire Co., Ltd. v. Carmichael, may have substantial impact on psychological expert testimony. Previous criteria for admissibility of scientific expert testimony now apply broadly to expert testimony, not just testimony narrowly grounded in scientific evidence. Judges will determine the relevance and reliability of all expert testimony, including that based on clinical experience or training. Admissible testimony will either satisfy the criteria established in Daubert v. Merrell Dow Pharmaceuticals, Inc. or meet similarly rigorous standards judged (...) appropriate to the particular field involved. Because psychological testimony has varied in its evidentiary basis, sometimes relying on science and otherwise on clinical training or experience, court decisions will gradually determine the precedent for its admissibility. We also discuss long-term consequences for the credibility of psychological expert testimony and the relation between psychology and law. (shrink)

In this work, we discuss how both contractualism, in the Western tradition, and communitarianism, in the African interpretation based on the idea of Ubuntu, conceptualise intergenerational justice. Even though both philosophical theories, taking into account differences and shortcomings, provide theoretical answers to intergenerational justice dilemmas, the implementation of actual policies in the interest of future individuals does not follow straightforwardly. Accordingly, in the second part of the chapter, we analyse what policy tools have been implemented or conceived to deliver intergenerational (...) justice and we advocate a pragmatic approach pointing towards a mix of different policy tools. This paper proposes an argumentation-based procedure for legal interpretation, by reinterpreting the traditional canons of textual interpretation in terms of argumentation schemes, which are then classified, formalized, and represented through argument visualization and evaluation tools. The problem of statutory interpretation is framed as one of weighing contested interpretations as pro and con arguments. The paper builds an interpretation procedure by formulating a set of argumentation schemes that can be used to comparatively evaluate the types of arguments used in cases of (...) contested statutory interpretation in law. A simplified version of the Carneades Argumentation System is applied in a case analysis showing how the procedure works. A logical model for statutory interpretation is finally presented, covering pro-tanto and all-things-considered interpretive conclusions. (shrink)

Practices related to research misconduct seem to have been multiplied in recent years. Many cases of scientific fraud have been exposed publicly, and journals and academic institutions have deployed different measures worldwide in this regard. However, the influence of specific social and cultural environments on scientific fraud may vary from society to society. This article analyzes how scientists in Japan deal with accusations of scientific fraud. For such a purpose, a series of scientific fraud cases that took place in Japan (...) has been reconstructed through diverse sources. Thus, by analyzing those cases, the social basis of scientific fraud and the most relevant aspects of Japanese cultural values and traditions, as well as the concept of honour which is deeply involved in the way Japanese scientists react when they are accused of and publicly exposed in scientific fraud situations is examined. Our objective in this paper is twofold: first, we intend to address the tenability of the enactivist middle way between realism and idealism, as it is proposed in The Embodied Mind. We do so by taking the enactivist conception of bringing forth a world literally in three conceptual levels: enaction, niche construction and social construction. Based on this proposal, we claim that enactivism is compatible with the idea of an independent reality without committing to the claim that organisms have cognitive (...) access to a world composed of properties specified prior to any cognitive activity. Our second goal is to show that our literal interpretation of bringing forth a world not only sustains the legitimacy of the middle way, but it also allows us to revive the conception of evolution as natural drift—which is perhaps the least examined aspect of the original enactivist theory and is central to the understanding of cognition in an enactive way. Natural drift focuses on how structural couplings between organism and environment trigger viable pathways of maintenance and reproduction, instead of selecting the most adapted trait to a pregiven environment. Thus, although enactivists typically do not explore the consequences of their views regarding evolutionary dynamics, we show how natural drift provides a suitable starting point. (shrink)

Epistemic reliabilism holds that a belief is justified if and only if it is produced by a reliable or truth-conducive process. I argue that reliabilism offers an epistemology for bounded rationality. This latter concept refers to normative and descriptive accounts of real-world reasoning instead of some ideal reasoning. However, as initially formulated, reliabilism involves an absolute, context-independent assessment of rationality that does not do justice to the fact that several processes are reliable in some reasoning environments but not in others, (...) as is widely reported in the cognitive sciences literature. I consider possible solutions to this problem. Resorting to ‘normality reliabilism’, a variant of the theory, is one; but I find it insufficient. Therefore, in addition, I propose to relativise the reliability assessment to reasoning environments. This novel version of reliabilism fits bounded rationality better than the original one does. In everyday reasoning - just as in science and art - knowledge is acquired more by "doing" than with long analyses. What do we "do" when we discover something new? How can we define and explore the pattern of this reasoning, traditionally called "synthetic"? Following in the steps of classic pragmatists, especially C.S. Pierce, Giovanni Maddalena's Philosophy of Gesture revolutionizes the pattern of synthesis through the ideas of change and continuity and proposes "gesture" as a new tool for synthesis. (...) Defining gesture as an action with a beginning and an end that carries on a meaning, Maddalena explains that it is a dense blending of all kinds of phenomena - feelings and vague ideas, actual actions, habits of actions - and of signs - icons, indexes, and symbols. When the blending of phenomena and signs is densest, the gesture is "complete," and its power of introducing something new in knowledge is at its highest level. Examples of complete gestures are religious liturgies, public and private rites, public and private actions that establish an identity, artistic performances, and hypothesizing experiments. A departure from a traditional Kantian framework for understanding the nature and function of reason, The Philosophy of Gesture proposes an approach that is more attuned with our ordinary way of reasoning and of apprehending new knowledge. We examine the ontogeny and phylogeny of object and fantasy play from a functional perspective. Each form of play is described from an evolutionary perspective in terms of its place in the total time and energy budgets of human and nonhuman juveniles. As part of discussion of functions of play, we examine sex differences, particularly as they relate to life in the environment of evolutionary adaptedness and economic activities of human and nonhuman primates. Object play may relate to foraging activities. (...) Although fantasy play has been viewed as limited to humans, we speculate that certain types of fantasy play may be present in some nonhuman primates. Fantasy play may enable juveniles to see situations from different perspectives. We conclude that fantasy play may have immediate effects and object play may have deferred effects. (shrink)

2013 sees the centenary of Jaspers' foundation of psychopathology as a science with the publication of his magnum opus the Allgemeine Psychopathologie (General Psychopathology), Many of the issues concerning methodology and diagnosis are today the subject of much discussion and debate. This volume brings together leading psychiatrists and philosophers to discuss the impact of this volume, its relevance today, and the legacy it left.
