Performance Anxieties looks at the on-going debates over the value of psychoanalysis for feminist theory and politics--specifically concerning the social and psychical meanings of racialization. Beginning with an historicized return to Freud and the meaning of Jewishness in Freud's day, Ann Pellegrini indicates how "race" and racialization are not incidental features of psychoanalysis or of modern subjectivity, but are among the generative conditions of both. Performance Anxieties stages a series of playful encounters between elite and popular performance texts--Freud meets (...) Sarah Bernhardt meets Sandra Bernhard; Joan Riviere's masquerading women are refigured in relation to the hard female bodies in the film Pumping Iron II: The Women ; and the Terminator and Alien films. In this work, we discuss how both contractualism, in the Western tradition, and communitarianism, in the African interpretation based on the idea of Ubuntu, conceptualise intergenerational justice. Even though both philosophical theories, taking into account differences and shortcomings, provide theoretical answers to intergenerational justice dilemmas, the implementation of actual policies in the interest of future individuals does not follow straightforwardly. Accordingly, in the second part of the chapter, we analyse what policy tools have been implemented or conceived to deliver intergenerational (...) justice and we advocate a pragmatic approach pointing towards a mix of different policy tools. In this article, we explore the learning of newcomers in a religious community through a micro-sociological approach, making use of Jean Lave and Etienne Wenger’s (1991) notion of “legitimate peripheral participation” to conceptualize initial stages of inclusion and involvement in social practice. Our case study concerns Orthodox Christianity and is based on material gathered through fieldwork in a course targeting potential new members organized by a Finnish Orthodox parish. In the analysis, we inquire into how beginners learn skilful participation in (...) Orthodox liturgical life, and specifically embodied ritual conduct. This learning takes place primarily through participation in real-life divine services. The article highlights challenges faced by beginners in acquiring the embodied repertoire of Orthodox ritual, including adapting to the artistic use of ritual gestures, and negotiating the meanings produced through them. Furthermore, it also illustrates how nuanced dynamics between newcomers and old-timers influence the learning process. (shrink)

Recent theories on cognitive science have stressed the significance of moral intuition as a counter to and complementary part of moral reasoning in decision making. Thus, the aim of this paper is to create an integrated framework that can account for both intuitive and reflective cognitive processes, in order to explore the antecedents of ethical decision making. To do that, we build on Scholasticism, an important medieval school of thought from which descends the main pillars of the modern Catholic social (...) doctrine. Particularly, the focus will be on the scholastic concept of synderesis, which is an innate human faculty that constantly inclines decision makers toward universal moral principles. Managerial implications are discussed, stressing how a rediscovery of decision makers’ intuitive moral judgments could be relevant in the reflective thinking practice of managers’ ethical reasoning, thus saving them from rational insensitivity to ethical dilemmas. This book addresses the European Court of Human Rights’ fairness standards in criminal appeal, filling a gap in this less researched area of studies. Based on a fair trial immediacy requirement, the Court has found several violations of Article 6 of the European Convention on Human Rights at the appellate level by at least eighteen States of the Council of Europe in a vast array of cases, particularly in contexts of first instance acquittals overturning and of sentences increasing on appeal. (...) -/- On the one hand, the book critically engages this case-law with the law revisions it has recently inspired in European countries, as well as with the critiques and difficulties that it continues to raise. This essay aims at clarifying our understanding of human participation in sustainability transitions from the pragmatist aesthetics perspective. By sustainability transitions, I refer to processual changes that move towards enhanced environmental and/or social sustainability. At the risk of inappropriateness, I argue that the cultivation of aesthetic sensibility manifests in experiencing sustainability. To understand those ordinary experiences that convey vistas for sustainability transition management, I return to John Dewey’s Art as Experience (1934). I first show that Dewey’s conception of sensibility is (...) two-sided, marking both adaptation and expression. Second, by building on the two sides of sensibility together with the contemporary pragmatist aesthetics discussion, I propose that aesthetic sensibility means a shared practice of attuning to transformation. My analysis suggests that acknowledging aesthetic sensibility in experiencing sustainability stands for a transition towards an enhanced conception of the human being as one whose ameliorative practices evolve in collaboration with other beings, living and non-living. For the fruition of sustainability transitions and subsequent expected transformations, aesthetic sensibility should then be acknowledged as a significant dimension of the sensory approach. (shrink)

We propose a synthetic description of Merleau-Ponty’s phenomenology with the aim of providing physicists and philosophers with an alternative linguistic and conceptual framework to address the logical and ontological problematics emerged in quantum mechanics. Phenomenology’s cognitive devices such as the dynamical relationship between object and horizon, the presumptive synthesis and the constitution of an ontology based on the indivisibility of object and subject, not only show hermeneutic efficacy when applied to the study of human perception, but may prove to be (...) sufficiently innovative to lead to novel insights towards the understanding of the quantum mechanical theoretical structure: the traditional tenet of quantum physics being in discontinuity with the major characteristics of classical physics is shaken at its fundaments and a new perspective of continuity between the two worlds is opened. Business Ethics: A European Review, EarlyView.

The concept of an artefact is central to several bioethical arguments. In this paper, I analyse this concept with respect to living and also non- living entities. It is shown that a close relationship between bringing an entity into existence and its intentional modification is necessary for its artefactuality. The criterion is further improved by analyses of the nature of intentionality in artefact production and the differences between artefacts and their side-effects. Further, in order to clarify the meaning of the (...) term 'bring into existence', issues related to sortal terms and functions of artefacts are considered. As the result of these analyses, the criterion for being an artefact is founded on the following double condition: An entity x is an artefact only if x has been intentionally brought into existence by intentionally causing the coming artefact x to have certain properties. An entity x is an artefact only if causing x to have certain properties has led x to have some new functions – that is, functions that are not present in the raw materials of x. The double condition is used for clarifying the status of several biotic entities such as gardens, commercial fields, polluted natural areas, ecosystems including alien species, restored ecosystems and transgenic organisms. Purpose The purpose of this paper is to report on empirical work conducted to open up algorithmic interpretability and transparency. In recent years, significant concerns have arisen regarding the increasing pervasiveness of algorithms and the impact of automated decision-making in our lives. Particularly problematic is the lack of transparency surrounding the development of these algorithmic systems and their use. It is often suggested that to make algorithms more fair, they should be made more transparent, but exactly how this can be (...) achieved remains unclear. Design/methodology/approach An empirical study was conducted to begin unpacking issues around algorithmic interpretability and transparency. The study involved discussion-based experiments centred around a limited resource allocation scenario which required participants to select their most and least preferred algorithms in a particular context. In addition to collecting quantitative data about preferences, qualitative data captured participants’ expressed reasoning behind their selections. Findings Even when provided with the same information about the scenario, participants made different algorithm preference selections and rationalised their selections differently. The study results revealed diversity in participant responses but consistency in the emphasis they placed on normative concerns and the importance of context when accounting for their selections. The issues raised by participants as important to their selections resonate closely with values that have come to the fore in current debates over algorithm prevalence. Originality/value This work developed a novel empirical approach that demonstrates the value in pursuing algorithmic interpretability and transparency while also highlighting the complexities surrounding their accomplishment. The European Commission has recently proposed the introduction of legally binding quotas for women on corporate boards of European companies. This proposal has put the spotlight on the question of whether increasing female representation on the board brings economic benefits to the firm. In order to shed light on the issue, this study investigates the direct and indirect effects of women on the board on firm value. We use a simultaneous equation model to estimate the effects of women on the (...) board on firm value, financial performance, and compliance with ethical and social principles adopted by the firm. We find no evidence that a higher female representation on the board directly affects firm’s value. However, we find indirect effects. Women on the board are positively related with financial performance (measured in terms of return on assets and return on sales) and with ethical and social compliance, which in turn are positively related with firm value. The findings in this study suggest that greater female representation on corporate boards of large European firms can increase firm value indirectly. Further, part of the indirect effect comes from stronger compliance with ethical principles, something that is not captured by accounting-based financial performance. (shrink)

In this article, we deal with the evaluation of the losses suffered by persons living in urban areas as a result of energy services. In the first part, we analyse how by adopting different informational foci we obtain contrasting interpersonal evaluations regarding the same loss. In the second part, we distinguish between a diachronic and a hypothetical/moralised threshold for harm in order to assess whether individuals are benefiting from or being harmed by a given energy service. Our argument is that (...) the most accurate evaluation of an individual damage caused by an energy service can be obtained by using capabilities as informational focus, instead of realised wellbeing or means to wellbeing, and by interpreting the loss in relation to a hypothetical/moralised threshold that corresponds to a list of central capabilities. In the last part, we address monetary and non-monetary compensations for a loss that is evaluated in terms of capabilities. Accordingly, we expound how compensation policies can either restore the capabilities lost due to energy services or monetarily compensate the individual for the fact that a given capability (or set of capabilities) has been irremediably lost. Servant leadership offers a compelling ideal of self-sacrificing individuals who put the needs of others before their own and cultivate a culture of growth in their organisations. Although the theory’s attempts to emphasise the moral, emotional and relational dimensions of leadership are laudable, it has primarily assumed a decontextualised view of leadership untouched by power. This article aims to problematise servant leadership by undertaking an intersectional analysis of an Asian cis-male heterosexual senior manager in Australia. Through in-depth interviews with the (...) manager and his staff, the article shows how his attempts to practice servant leadership were informed by intersecting power dynamics of race, gender, sexuality, age and class that subordinated him to white power. The findings demonstrate the ways servant leadership is necessarily embedded in wider power structures that shape who gets to be a “servant leader” and who remains merely a “servant”. (shrink)

Decision-making capacity is the gatekeeping element for a patient’s right to self-determination with regard to medical decisions. A DMC evaluation is not only conducted on descriptive grounds but is an inherently normative task including ethical reasoning. Therefore, it is dependent to a considerable extent on the values held by the clinicians involved in the DMC evaluation. Dealing with the question of how to reasonably support clinicians in arriving at a DMC judgment, a new tool is presented that fundamentally differs from (...) existing ones: the U-Doc. By putting greater emphasis on the judgmental process rather than on the measurement of mental abilities, the clinician as a decision-maker is brought into focus, rendering the tool more of an evaluation guide than a test instrument. In a qualitative study, the perceived benefits of and difficulties with the tool have been explored. The findings show on the one hand that the evaluation aid provides basic orientation, supports a holistic perspective on the patient, sensitizes for ethical considerations and personal biases, and helps to think through the decision, to argue, and to justify one’s judgment. On the other hand, the room for interpretation due to absent operationalisations, related ambiguities, and the confrontation with one’s own subjectivity may be experienced as unsettling. (shrink)

A distinction between nature and culture is usually thought to be a condition of possibility of criticism. The idea is that, in comparison to natural laws, norms and conventions are merely relative and, therefore, susceptible to criticism and change. This paper contests this view and argues that critical practice is still possible, and even more productive, when nature and culture are seen to be continuous with one another. A general contrast is developed between 'dogmatic' and 'sceptical' modes of criticism. The (...) suggestion is that theorists as diverse as Jürgen Habermas and Judith Butler adopt the dogmatic approach. An alternative, sceptical critical mode is elaborated in connection with Nietzsche and the ancient sceptics.This sceptical approach is based upon an identity between nature and culture, and has affinities with the aesthetic emphasis of some contemporary political theory. The main question informing this paper is whether it is possible to extend democracy beyond its liberal forms. The paper reflects upon this question with regard to its implications for the individual. For the radicalization of democracy implies a need for self-transformation, if the everyday egoism of contemporary citizens is not to thwart reasonable discussion and participation. Theorists such as Richard Rorty argue that the philosophical resources required to guide such self-transformation can be made available only by sacrificing the political (...) freedom and cultural diversity liberalism has been able to precariously establish. Other theorists insist that the thresholds of pluralism and tolerance that existing liberal democracies are struggling to maintain actually require an extension of democracy. The paper evaluates two different theoretical strategies that aim to identify potentials for democratization without falling prey to the dilemma identified by Rorty: a ‘ deliberative’ strategy explicated with reference to Jürgen Habermas and an ‘existential’ approach represented here by William Connolly. The aim of this paper is to provide a nuanced and structured overview of the arguments provided in the literature emphasizing the importance of these factors and arguing for their inclusion in competence evaluations. Specific difficulties of formulating and measuring emotional and valuational factors are discussed inviting reflection on the possibility of handling relevant factors in a more flexible, case-specific, and context-specific way rather than adhering to a rigid set of operationalized criteria. This article explores how meanings around risk, health/safety, and workers’ bodies are constructed in an academic context. I do so through the study of a single academic in Australia who sustained a back injury at work. Through an analysis of in-depth interviews and documents, I attempt to show the embodied experience of an injured worker’s struggle for care, recovery, and survival in the neoliberal academy. Writing from the nexus of workplace health and safety and critical management literatures, the raw testimony (...) of this injured academic lays bare the violences that are enabled within a wider culture of self-discipline, individualism, and performativity in the university. The story presented in this article exposes how physiological and psychological injuries can be exacerbated through the very health and safety procedures that are designed to prevent and alleviate harm.
