While a growing number of firms are being evaluated on environment, social and governance criteria by sustainability rating agencies, comparatively little is known about companies’ responses. Drawing on semi-structured interviews with companies operating in Italy, the present paper seeks to narrow this gap in current understanding by examining how firms react to ESG ratings, and the factors influencing their response. Unique to the literature, we show that firms may react very differently to being rated, with our analysis yielding a fourfold (...) typology of corporate responses. The typology captures conformity and resistance to ratings across two dimensions of firm behaviour. We furthermore show that corporate responses depend on managers’ beliefs regarding the material benefits of adjusting to and scoring well on ESG ratings and their alignment with corporate strategy. In doing so, we challenge the idea that organisational ratings homogenise organisations and draw attention to the agency underlying corporate responses. Our findings also contribute to debates about the impact of ESG ratings, calling into question claims about their positive influence on companies’ sustainability performance. We conclude by discussing the wider empirical, theoretical and ethical implications of our paper. (shrink)

El objetivo propuesto en el siguiente trabajo es elucidar cómo desde la finitud de la existencia puede establecerse la problemática de la temporalidad dentro del entramado de pensamiento de Martin Heidegger. Para ello realizaremos un análisis de la conferencia de 1924 Der Begriff der Zeit, uno de los textos que allanan el camino a Sein und Zeit, en lugar de centrar la investigación en la considerada obra magna de Heidegger. Una reflexión acerca de este texto previo permitirá avanzar en el (...) análisis de la existencia al mostrar cómo el tiempo está arraigado en la existencia individual, no como un solipsismo, sino como apertura de posibilidades respecto del mundo (a la postre compartido con los otros). Una descripción fenomenológica de la muerte posibilitará la apertura al mundo, definiendo una temporalidad existencial que incluye no sólo al instante presente, sino también al pasado (concebido bajo la forma del «haber-sido») y al futuro. This paper reports a European Forum for Good Clinical Practice workshop held in 2011 to consider a research ethics committee training syllabus, subsequent training needs and resources. The syllabus that was developed was divided into four competencies: committee working; scientific method; ethical analysis and the regulatory framework. Appropriate training needs for each, with possible resources, were discussed. Lack of funding for training was reported as a major problem but affordable alternatives were debated. Strengths and weaknesses of this approach were discussed (...) and the resultant proposal will be disseminated through the European Forum for Good Clinical Practice and the research ethics committees of member states. Since the enactment of the first Hong Kong bilingual ordinance in 1989, tremendous effort and resources have been put to translating English legal documents into Chinese. Long before the implementation of bilingual legislation, the provision of interpreting services has remained an entrenched practice in the courtrooms of Hong Kong. This study has adopted a corpora approach to re-examine what seems to be reasonable and routine practices of the bilingual, legal system, the impacts of bilingual legislation, translation, and interpretation on trial (...) proceedings. Results generated from the corpus show the problems of anglicized Chinese translation of the Sexual Offences Ordinance under the British Common Law system; and interpreters’ performance which is intricately bound by the discourse practices of the legal professionals as well as the ideology of the bilingual legal system in Hong Kong. Legal interpreting and translation are some of the oldest and most frequently practised bilingual activities in Hong Kong. The principles and operation of the bilingual legal system actually impinge on the legal interpreting services and the practices of legal interpreting services also in ways impact on the system itself. This study adopts a historical approach to analyse the jurisprudence and administration of legal interpreting in Hong Kong courts from 1966 to 2016, across the 1997 dividing line between British colonial rule (...) and the return of Hong Kong to the government of mainland China. It focuses on the opinions of judges and other participants in courtroom proceedings as recorded in Hong Kong case reports. It is discovered that the jurisprudence of having an interpreter to interpret for participants who do not speak the language of the court is clearly indicated and well versed in the precedents. However, there is a gap between the jurisprudence and the actual interpreting services, mainly caused by the malpractices of the concerned administration department and some of the law enforcement agents working in the frontline. Samuel Scheffler has recently argued that some relationships are non-instrumentally valuable; that such relationships give rise to “underived” special responsibilities; that there is a genuine tension between cosmopolitan egalitarianism and special responsibilities; and that we must consequently strike a balance between the two. We argue that there is no such tension and propose an alternative approach to the relation between cosmopolitan egalitarianism and special responsibilities. First, while some relationships are non-instrumentally valuable, no relationship is unconditionally valuable. Second, whether such relationships (...) give rise to special responsibilities is conditional on those relationships not violating certain moral constraints. Third, these moral constraints arise from within cosmopolitan egalitarianism itself. Thus the value of relationships and the special responsibilities to which they give rise arise within the parameters of cosmopolitan egalitarianism itself. The real tension is not between cosmopolitan equality and special responsibilities, but between special responsibilities and the various general duties that arise from the recognition, demanded by cosmopolitan egalitarianism, of a multiplicity of other basic goods. Indeed, even the recognition of special relationships itself gives rise to general duties that may condition and/or weigh against putative special responsibilities. (shrink)

High-quality arguments have strong and lasting persuasive effects, suggesting that people can distinguish high- from low-quality arguments. However, we know little of what norms people employ to make that distinction. Some studies have shown that, in evaluating arguments from consequences, people are more sensitive to differences with respect to the desirability of these consequences than to differences in the likelihood that these consequences will occur. This raises the question of whether people lack the criteria to distinguish high-quality from low-quality arguments (...) in support of such claims. In an experiment, 196 participants without any training in argument theory rated their acceptance of 30 claims about the likelihood that a certain outcome would result from a certain action. These claims were supported by an argument from authority, or from cause to effect, or from example. Arguments were systematically manipulated to violate nine specific criteria. For seven out of the nine criteria violation decreased acceptance of the claim supported. These findings show that people can use argument type specific criteria to distinguish high- from low-quality arguments. (shrink)

La diffusione del libro nel Medioevo potrebbe essere riletta alla luce di una metafora attuale sebbene non scevra di aspetti dialettici: quella della “rete”. All’ubicazione spazio-temporale del libro nei monasteri medievali, contraddistinta da fisicità e permanenza, si sotituisce oggi un formato digitale e virtuale, che porta ad una sorta di decontestualizzazione e alla continuità del flusso di informazioni, contribuendo alla diffusione capillare del sapere. L’ottica di universalità e globalità accomuna tuttavia entrambe le epoche. Alcuni concetti-chiave dell’informatica potrebbero infatti declinarsi in (...) ambito medievale: Server-Client per la raccolta, la conservazione e la trasmissione delle conoscenze da parte dei monasteri, quali centri del sapere in Europa, agli uomini di cultura; Firewall , per alludere alla necessità di tutelare i manoscritti, mediante la copiatura e la diffusione dei codici; Community , ad indicare non solo la comunità religiosa o monastica in senso stretto, bensì l’apertura ad una costruzione del sapere mediante un’azione partecipativa . I problemi dell’autenticità delle fonti, dell’acriticità delle informazioni e la pratica delle citazioni trovano un precedente significativo nelle Sententiae di Pietro Lombardo: una sorta di “biblioteca virtuale” grazie alla collezione di passi dalla Sacra Scrittura e da fonti latine e greche, paragonabile a un moderno modello enciclopedico di sapere. The diffusion of the book in the Middle Ages could be critically read through a modern metaphor: the “net”. The space-temporal coordinates of the book shift from being physical and permanent in the Medieval monasteries, to being de-contextualized and continue in the flow of information of digital and virtual format. However the universal and global perspective is common to the contemporary and the Medieval periods. In fact some key-words of computer science could be applied to the Medieval context: Server-Client , for the collection, the preservation and the transmission of knowledge from monasteries, as cultural centers in Medieval Europe, to men of culture; Firewall , for the necessary protection of manuscripts, through copying and diffusing codes; Community , referred not only to the monastic and religious groups, but also to an open sharing of the building of knowledge. Problems like the authenticity of the sources, the lack of criticality in the reception of data, and the practice of quotations are well represented in Peter Lombard’s Sententiae : this work can be compared to a modern encyclopedia thanks to the collection of passages from the Holy Scripture and from Latin and Greek sources, as well as a “virtual library”. O tratamento desumano que recebem, o crescente número de crianças e adolescentes invisibilizados que sonham com um imaginário de vida melhor no Brasil, como o “pais do futebol”, e/ou uma passagem provisória para chegar ao primeiro mundo em países considerados de colonização europeia como EUA ou Canada. This essay explores the relation between two perspectives on the nature of human rights. According to the "political" or "practical" perspective, human rights are claims that individuals have against certain institutional structures, in particular modern states, in virtue of interests they have in contexts that include them. According to the more traditional "humanist" or "naturalistic" perspective, human rights are pre-institutional claims that individuals have against all other individuals in virtue of interests characteristic of their common humanity. This essay argues that (...) once we identify the two perspectives in their best light, we can see that they are complementary and that in fact we need both to make good normative sense of the contemporary practice of human rights. It explains how humanist and political considerations can and should work in tandem to account for the concept, content, and justification of human rights. (shrink)

What should our theorizing about social justice aim at? Many political philosophers think that a crucial goal is to identify a perfectly just society. Amartya Sen disagrees. In The Idea of Justice, he argues that the proper goal of an inquiry about justice is to undertake comparative assessments of feasible social scenarios in order to identify reforms that involve justice-enhancement, or injustice-reduction, even if the results fall short of perfect justice. Sen calls this the “comparative approach” to the theory of (...) justice. He urges its adoption on the basis of a sustained critique of the former approach, which he calls “transcendental.” In this paper I pursue two tasks, one critical and the other constructive. First, I argue that Sen’s account of the contrast between the transcendental and the comparative approaches is not convincing, and second, I suggest what I take to be a broader and more plausible account of comparative assessments of justice. The core claim is that political philosophers should not shy away from the pursuit of ambitious theories of justice (including, for example, ideal theories of perfect justice), although they should engage in careful consideration of issues of political feasibility bearing on their practical implementation. Ocupa-se do problema do começo em filosofia e o relaciona com as dificuldades de pôr em curso o ensinar e o aprender a filosofar. Apresenta as tentativas de fundar um começo absoluto do pensar feitas por Descartes, Kant, Fichte, Hegel e Feuerbach, para, então, tratar do começo da filosofia e do pensar no pensamento problematizado por Deleuze.

Este artigo considera a marcante instabilidade da Filosofia nos currículos da Educação brasileira, assim como seu desaparecimento como disciplina, na versão aprovada da Base Nacional Comum Curricular. Apresenta as prováveis alterações que esse documento promoverá na Educação, referente à formação de professores, ao impacto político e à autonomia docente na criação de aulas, para, então, dedicar-se aos espólios filosóficos restantes na Base, sobretudo àqueles relativos à ética. Mostra que a dimensão ética atravessa o documento e está presente nas “Competências Gerais” (...) a serem desenvolvidas ao longo da Educação Básica, sendo, portanto, uma preocupação de todas as áreas do conhecimento, sobretudo no que se refere às Tecnologias Digitais de Informação e Comunicação e à sustentabilidade ambiental. Volta à definição de ética no documento e às suas bases, a saber, justiça, solidariedade e livre-arbítrio; problematiza seus sentidos e marca algumas incoerências. Evidencia que o documento, apesar de incentivar que a Educação dos jovens esteja, de um lado, voltada àquilo que fizemos e sabemos do mundo, por outro, para o aberto e indeterminado; dá ênfase excessiva à busca de soluções e ao aprendizado de respostas, dando prioridade, no que respeita à Filosofia, à resposta socrática para a questão “O que é o ser humano?” Destaca a ideia apresentada no documento de que o nosso tempo requer uma “nova mentalidade”, regida por uma “ética diferente”, e defende que é por meio do contato com modos de pensar filosóficos, presentes nos textos primários de Filosofia, trabalhados por professores habilitados para isso, que os estudantes tornar-se-ão competentes e hábeis nos dois principais sentidos éticos da Base – 1) da nossa relação com a natureza, com o Planeta e seus bens finitos; e 2) da relação consigo mesmo, o modo de ser. The conditional analysis of ability faces familiar counterexamples involving cases of volitional incapacity. An interesting response to the problem of volitional incapacity is to try to explain away the responses elicited by such counterexamples by distinguishing between what we are able to do and what we are able to bring ourselves to do. We argue that this error-theoretic response fails. Either it succeeds in solving the problem of volitional incapacity at the cost of making the conditional analysis vulnerable to obvious (...) counterexamples to its necessity. Or, it avoids the counterexamples to its necessity but fails to solve the problem of volitional incapacity. (shrink)

Do we have positive duties to help others in need or are our moral duties only negative, focused on not harming them? If these positive duties exist, are they strong and strict demands or are they weak and discretionary? Can we say that at least some positive duties of assistance are also duties of justice worthy of institutionalization and coercive enforcement by legal institutions? Can the scope of some of such duties be cosmopolitan or should all of them be circumscribed (...) to what we owe to our compatriots? This paper addresses these questions from a Kantian perspective, and argues that Kant’s practical philosophy provides sufficient resources to develop and defend the claim that there are basic positive duties of justice, some of which have a global scope. This paper offers an account of human dignity based on a discussion of Kant's moral and political philosophy and then shows its relevance for articulating and developing in a fresh way some normative dimensions of Marx’s critique of capitalism as involving exploitation, domination, and alienation, and the view of socialism as involving a combination of freedom and solidarity. What is advanced here is not Kant’s own conception of dignity, but an account that partly builds on that conception and partly criticizes (...) it. The same is the case with the account of socialism in relation to Marx’s work. As articulated, Kantian dignity and Marxian socialism turn out to be quite appealing and mutually supportive. (shrink)

The idea of dignity is pervasive in political discourse. It is central to human rights theory and practice, and it features regularly in conceptions of social justice as well as in the social movements they seek to understand or orient. However, dignity talk has been criticized for leading to problematic exclusion. Critics challenge it for undermining our recognition of the rights of non-human animals and of many human individuals (such as children, the elderly, and people with disabilities). I argue that, (...) on a plausible articulation of it, the idea of dignity does not lead to these exclusions and that it in fact helps defend an appropriately inclusive moral and political treatment of all individuals. Difficult issues about equality and diversity indeed arise, but a dignitarian approach can provide good answers to them or at least help make them clearer and more tractable. (shrink)

In the last decades the concept of objectivity has been criticized by the "new epistemologies". These criticisms favour the consolidation of relativist and subjective positions, which condition the objectivity of scientific knowledge to such an extent that it seems to be a goal impossible to achieve.

Human dignity: social movements invoke it, several national constitutions enshrine it, and it features prominently in international human rights documents. But what is it, why is it important, and what is its relationship to human rights and social justice? Pablo Gilabert offers a systematic defence of the view that human dignity is the moral heart of justice. In Human Dignity and Human Rights (OUP 2019), he advanced an account of human dignity for the context of human rights discourse, which (...) covers the most urgent, basic claims of dignity. This book extends the dignitarian approach to more ambitious claims of maximal dignity of the kind encoded in democratic socialist conceptions of social justice. In particular, this book focuses on the just organization of working practices. It recasts in a dignitarian format the critique of capitalist society as involving exploitation, alienation, and domination of workers, and revamps a neglected but inspiring socialist principle. In its dignitarian interpretation, the Abilities/Needs Principle (‘From each according to their ability, to each according to their needs!’) yields reasonable and feasible requirements on social cooperation geared to empowering each human being to lead a flourishing life. While Human Dignity and Human Rights offered the first systematic philosophical account of human dignity in human rights discourse, Human Dignity and Social Justice presents the first systematic application of the dignitarian framework to the core ideals of democratic socialism. This paper offers a normative exploration of what exploitation is and of what is wrong with it. The focus is on the critical assessment of the exploitation of workers in capitalist societies. Such exploitation is wrongful when it involves a contra-solidaristic use of power to benefit oneself at the expense of others. Wrongful exploitation consists in using your greater power, and sometimes even in making other less powerful than you, in order to get them to benefit you more than they (...) ought to. This account of exploitation is appealing because it simultaneously captures three morally significant dimensions of exploitation—its material and social background, the relational (interpersonal and systemic) attitudes it enacts, and the final distributive results it generates. Exploitation is indeed a multidimensional social process. The flipside of the proposed critical characterization of this process is a positive ideal of solidaristic empowerment in the allocation and use of economic power, which the paper articulates in terms of the socialist Abilities/Needs Principle (“from each according to their abilities, to each according to their needs”). The Abilities/Needs Principle is grounded in human dignity. (shrink)

The current legal and political practice of human rights invokes entitlements to freely chosen work, to decent working conditions, and to form and join labor unions. Despite the importance of these rights, they remain under-explored in the philosophical literature on human rights. This article offers a systematic and constructive discussion of them. First, it surveys the content and current relevance of the labor rights stated in the most important documents of the human rights practice. Second, it gives a moral defense (...) of these rights arguing that their support involves an appropriate response to important human interests and to the human dignity of workers. Finally, it explores central normative issues about the relation between labor rights and human dignity. It responds to some objections about the importance of work, explains why labor human rights may not exhaust the demands of dignity regarding labor and arbitrates a common tension between independence and solidarity within our practical affirmation of human dignity. Perfectionism about well-being is, at a minimum, the view that people’s lives go well when, and because they realize their capacities. It is common to link perfectionism with an idea of human essence or nature, to yield the view that what constitutes people’s well-being is the development and exercise of characteristically human capacities. The first part of this paper considers the very serious problems associated with the idea of human nature or essence, and argues that perfectionism would be more plausible (...) if it abandons reliance on it and focuses instead on the unfolding of some valuable capacities that need not be unique to, or shared by all human beings. This revised perfectionism is evaluative all the way down, pragmatic but not unprincipled, and holistic. In its second part, the paper articulates this account in terms of the dignitarian approach—the view that we have reason to organize our personal and social life in such a way that we respond appropriately to the valuable features of individuals that give rise to their dignity. Dignity is a non-conventional, normative status based on a diverse and disjunctive set of valuable capacities. The dignitarian approach helps develop, defend, and identify the implications of the revised perfectionism suggested in the previous part of the paper while also allowing us to make sense of the role of some generalizations that animated some of the plausibility of traditional perfectionism—and this without the pitfalls of reliance on an idea of human nature. On this paper’s proposed view—Dignitarian Perfectionism—human individuals’ well-being consists, at least in part, in developing and exercising the capacities at the basis of their dignity. (shrink)

Este texto, aprovechando la reciente publicación del último Premio Espasa de Ensayo, Lenguas en guerra, de Irene Lozano, hace un recorrido por las ideas más destacables del libro, tanto sobre el origen filogenético del lenguaje como sobre la problemática relación que este origen supone, según la autora, para las justificaciones al uso sobre los nacionalismos fundamentados en la singularidad de la lengua propia, y sitúa estas ideas en el contexto de los conocimientos que se tienen hoy sobre evolución, genética e (...) historia del pensamiento. El texto también hace una crítica a algunos de los razonamientos de Lozano y presta atención al contraste entre su perspectiva idealista sobre la funcionalidad y el uso recto del lenguaje y su visión más pragmática y posibilista sobre el nacionalismo y el conservacionismo lingüístico. What is a duty of justice? And how is it different from a duty of beneficence? We need a clear account of the contrast. Unfortunately, there is no consensus in the philosophical literature as to how to characterize it. Different articulations of it have been provided, but it is hard to identify a common core that is invariant across them. In this paper, I propose an account of how to understand duties of justice, explain how it contrasts with several proposals (...) as to how to distinguish justice and beneficence, respond to some objections and suggest further elaborations of it. The conceptual exploration pursued in this paper has practical stakes. A central aim is to propose and defend a capacious concept of justice that makes a direct discussion of important demands of justice (domestic and global) possible. Duties of justice can be positive besides negative, they can be imperfect as well as perfect, they can range over personal besides institutional contexts, they can include multiple associative reasons such us non-domination, non-exploitation and reciprocity, and they can even go beyond existing national, political, and economic associative frameworks to embrace strictly universal humanist concerns. We should reject ideological abridgments of the concept of justice that render these possibilities, and the important human interests and claims they may foster, invisible. (shrink)

It is common in political theory and practice to challenge normatively ambitious proposals by saying that their fulfillment is not feasible. But there has been insufficient conceptual exploration of what feasibility is, and very little substantive inquiry into why and how it matters for thinking about social justice. This paper provides one of the first systematic treatments of these issues, and proposes a dynamic approach to the relation between justice and feasibility that illuminates the importance of political imagination and dynamic (...) duties to expand agents’ power to fulfill ambitious principles of justice. Are any of the former positive duties, duties of justice that respond to enforceable rights? Is their scope global? Should we aim for global equality besides the eradication of severe global poverty? Is a humanist approach to egalitarian distribution based on rights that all human beings as such have defensible, or must egalitarian distribution be seen in an associativist (...) way, as tracking existing frameworks such as statehood and economic interdependence? Are the eradication of global poverty and the achievement of global equality practically feasible or are they hopelessly utopian wishes? -/- This book argues that there are basic positive duties of justice to help eradicate severe global poverty; that global egalitarian principles are also reasonable even if they cannot be fully realized in the short term; and that there are dynamic duties to enhance the feasibility of the transition from global poverty to global equality in the face of nonideal circumstances such as the absence of robust international institutions and the lack of a strong ethos of cosmopolitan solidarity. The very notion of feasibility is crucial for normative reasoning, but has received little explicit philosophical discussion. This book offers a systematic exploration of that concept as well as of its application to global justice. It also arbitrates the current debate between humanist and associativist accounts of the scope of distributive justice. Drawing on moral contractualism (the view that we ought to follow the principles that no one could reasonably reject), this book provides a novel defense of humanism, challenges several versions of associativism (which remains the most popular view among political philosophers), and seeks to integrate the insights underlying both views. Could a robot be a good actor? Could it build an effective relationship of understanding and empathy with other actors or spectators? This paper offers just a glimpse, a first trace of research of a now important phenomenon that affects the Performing Arts, namely the integration of artificial agents both in the creative process and in the theatrical performance. It will be treated for this purpose by the example of the android Geminoid F, protagonist of the play Sayonara (2010) by (...) Japanese director Oriza Hirata, created by Osaka University’s robotics expert Professor Hiroshi Ishiguro, whose gestures have been learned by imitating those of a real professional actress. Watching this android act is an alienating aesthetic experience: from the position of the audience, the boundary between human and robot is unclear. Geminoid F was chosen as co-star in the film of the same name, shot in 2015 by the internationally acclaimed Japanese director Koji Fukada, precisely because of her expressive qualities, as effective as those of a human actor, capable of arousing an empathic reaction in the viewer. Keller & Miller (K&M) briefly mention and promptly dismiss the idea that genes for harmful mental disorders may confer certain advantages to affected individuals. However, the authors fail to consider that the same genes (in low doses or reduced penetrance) may be adaptive for relatives, and that this may in part explain why they are retained in the gene pool.
