Recent national and international debates on truth and reconciliation in Uganda have emphasized the importance of incorporating local-level mechanisms into a national transitional justice strategy. The Juba Peace Talks represented an opportunity to develop and articulate sufficient and just alternatives and complementary mechanisms to the international criminal model. The most commonly debated mechanism is the Acholi process known as mato oput (drinking the bitter root), a restorative justice approach to murder. Drawing on 2 months of research in nine internally displaced (...) persons’ camps in 2007, we examine local justice practices in the region of northern Uganda to consider their potential, promise and pitfalls to realizing a successful truth-telling process. We find that although local mechanisms could help facilitate reconciliation in the region, truth-telling is but one part of a conciliatory process complicated by a national context of fear and the complexity of the victim–perpetrator identity at the community level. These locally informed insights help move forward the debate on such mechanisms in Uganda and add useful insights into community processes in the field of transitional justice more generally. This book offers the first sustained jurisprudential inquiry into Islamic natural law theory. It introduces readers to the central figures in the Islamic natural law tradition and their canonical works, analyses the historical development of Islamic jurisprudence and explains the major contrasts with Western traditions of natural law.

In an attempt to think through the Islamic alongside the Christian, this article draws upon the political theology of Carl Schmitt to reflect on the salience of sovereignty. But in doing so, the article re-reads Schmitt’s political theology for its Protestant voluntarism, and adopts a more robust theological voluntarism as a vehicle for reflecting on political thought across both Christian and Islamic history. Moreover, this approach to political theology makes possible reflections on how political theology, whether in Christian or Islamic (...) thought, may offer a critical lens by which to gain new analytic insights into the operation of sovereignty in presumably secularised regimes of thought, such as international law. This book critically and constructively explores the resources offered for natural law doctrine by classical thinkers from three traditions: Jewish, Christian, and Islamic. Three scholars each offer a programmatic essay on natural law doctrine in their particular religious tradition and then respond to the other two essays.

A decision maker relies on information of parties affected by her decision. These parties try to influence her decision by selective disclosure of facts. As is well known from the literature, competition between the informed parties constrains their ability to manipulate information. We depart from this literature by introducing a cost to communicate. Our parties trade off their reporting cost against the effect on the decision. Some information is never revealed. In contrast to setups without communication costs, our decision maker (...) can benefit by ex ante committing to an ex post suboptimal decision rule. Moreover, committing ex ante not to listen to one of the parties may also be beneficial for the decision maker. (shrink)

This article offers an Islamic legal perspective on the question posed by this symposium issue, namely the future of theological ethics. Concerned that abstract statements of value all too often play into an apologetics that hides more than it reveals, the article offers a paradigm that makes two specific contributions to the question of this symposium in a context of increasing tension over religious diversity in Europe and North America. First, it adopts a context-rich form of ethical engagement that weaves (...) together commitments to theology and to our place in the world. Second, it provides a model by which to interrogate the assumptions and even the secular apologetics that arise in legal disputes involving contests about religion and the public sphere. (shrink)

This article contributes to the contemporary debate on land and water grabbing through a detailed, qualitative case study of horticultural agribusinesses which have settled in Tanzania, disrupting patterns of land and water use. In this paper we analyse how capitalist settler farms and their upstream and downstream peasant neighbours along the Nduruma river, Tanzania, expand and defend their water use. The paper is based on 3 months of qualitative field work in Tanzania. We use the echelons of rights analysis framework (...) combined with the concept of institutional bricolage to show how this contestation takes place over the full spectrum of actual abstractions, governance and discourses. We emphasise the role different national development narratives play in shaping day-to-day contestations over water shares and rule-making. Ultimately, we emphasise that water grabbing is not a one-time event, but rather an on-going struggle over different water resources. In addition, we show how a perceived beneficial development of agribusinesses switching to groundwater allows them to avoid peasant-controlled institutions, avoiding further negotiation between the different actors and improving their image among neighbouring communities. This development illustrates how complex and obscured processes of water re-allocation can be without becoming illegal per se. (shrink)

BackgroundA proposal to encourage the preregistration of research on research integrity was developed and adopted as the Amsterdam Agenda at the 5th World Conference on Research Integrity. This paper reports on the degree to which abstracts of the 6th World Conference in Research Integrity reported on preregistered research.MethodsConference registration data on participants presenting a paper or a poster at 6th WCRI were made available to the research team. Because the data set was too small for inferential statistics this report is (...) limited to a basic description of results and some recommendations that should be considered when taking further steps to improve preregistration.Results19% of the 308 presenters preregistered their research. Of the 56 usable cases, less than half provided information on the six key elements of the Amsterdam Agenda. Others provided information that invalidated their data, such as an uninformative URL. There was no discernable difference between qualitative and quantitative research.ConclusionsSome presenters at the WCRI have preregistered their research on research integrity, but further steps are needed to increase frequency and completeness of preregistration. One approach to increase preregistration would be to make it a requirement for research presented at the World Conferences on Research Integrity. (shrink)

_Demons in the Consulting Room: Echoes of Genocide, Slavery and Extreme Trauma in Psychoanalytic Practice_ isthe second of two volumes addressing the overwhelming, often unmetabolizable feelings related to mourning, both on an individual and mass scale. Authors in this volume explore the potency of ghosts, ghostliness and the darker, often grotesque aspects of these phenomena. While ghosts can be spectral presences that we feel protective of, demons haunt in a particularly virulent way, distorting experience, our sense of reality and our (...) character. Bringing together a collection of clinical and theoretical papers, _emons in the Consulting Room_, reveals how the most extreme types of trauma can continue to have effects across generations, and how these effects manifest in the consulting room. Essays in this volume consider traumas that have affected multiple generations of people, such as the Holocaust, experiences in the gulags, and the experience of slavery. Authors here consider the clinical challenges of working with the demonic force in severe childhood abuse and the effects of serious and prolonged physical injury and illness. Inevitably, there is in such difficult clinical work, the combined effects of hauntings in the analysts and in patients and often in the surrounding culture. In this book, distinguished psychoanalysts explore the myriad forms of ghosts and the demonic, which interfere and disrupt the endlessly difficult psychic work of mourning. The focus of this paper is to discuss the semiotic aspects of our findings from a project we conducted in the frame of Emotional Text Analysis paradigm. In the project, we intended to create a computer text classifier capable of effectively classifying texts into emotional categories. We agreed that we would need discrete data samples to input into it. For this, we asked 178 informants to give a verdict on the dominant emotion of 48 sample texts. Prior to their assessment (...) of the texts, the informants responded to a questionnaire used to estimate their empathic tendency. A detailed analysis of the informants’ assessments and personal empathetic tendency scores showed a positive correlation. Subsequently, our interest was piqued by the issue of how emotions could be triggered by conventional signs. Our findings seem to suggest that words are only used as an expression form insofar as they embody another type of semiotic complexity, thus diverging from the traditional Pearcian triad. In order to develop on these findings, it is therefore the main objective of this paper to provide a biosemiotic model of representation/interpretation of emotions, with particular attention paid to the eliciting of emotions as sign types. In this endeavour, we draw upon K. Kull’s concept of emonic semiotic model realization. Our suggestion is that, when one processes a text that elicits an emotional response, two semiotic facets are relevant: indexicality and emonicity. We argue that it is a main empathetic function to enforce the emonic model of semiosis over the indexical in situations where the interpreter has a choice between the two. As such, the hypothesis of the study is that emotions facilitate a particular type of semiotic mechanism, relying on the mimesis principle. (shrink)

It is shown that no concrete particle can have zero rest mass. A separate photon is proven to be a concrete particle. The nonexistence of the electromagnetic field as an independent physical reality is demonstrated. The existence of a subatomic electromagnetic particle of a very small rest mass, theemon, instead of the electromagnetic field, is stated. The compatibility of the notion of the emon with the special relativity theory is elucidated. Some corollaries of the existence of the emon (...) as well as the possibilities of determining its rest mass are discussed. The explanations of the relativity aberration and Doppler effect in terms of the emon are given. The importance of the principle of concreteness of experiments is emphasized and illustrated.
