This article addresses the contributions of the literature on the new mechanistic philosophy of science for the scientific practice of model building in ecology. This is reflected in a one-to-one interdisciplinary collaboration between an ecologist and a philosopher of science during science-in-the-making. We argue that the identification, reconstruction and understanding of mechanisms is context-sensitive, and for this case study mechanistic modeling did not present a normative role but a heuristic one. The act of iudicare hostes (‘declare public enemy’) was a formal pronouncement of the Roman Senate, voted for the first time in 88 BCE following a proposal by L. Cornelius Sulla after his first march on Rome. Legal historians have generally interpreted it as an emergency measure intended to preserve legality in a situation of civil strife and viewed it as a consistently defined institutional framework throughout the final decades of the Republic. Through an analysis of Sulla’s performative political communication, (...) before, during and in the immediate aftermath of the march, this paper argues that the act of judging (iudicare) someone a public enemy (hostis publicus) was first deployed as a political action, void of legal effects. Later instances of iudicare suggest that this act underwent a process of institutionalization after 63 BCE. (shrink)

The topic of the present reflection is Christian religious belief. Specifically, we will use Husserlian tools in order to examine the positional nature of this particular type of belief. We will be less interested in the question concerning the success conditions of this experience and more in its noetic structure. According to our proposal, to believe by faith supposes (although it is not exhausted by) accepting the existence of mundane evidence speaking against this fundamental belief. The believer acknowledges the existence (...) of this contradicting en-doxical basis and nevertheless believes what she believes. We will refer to this simultaneous movement of accepting and cancelling as the concessive structure of the religious attitude. The para-doxical movement of experiencing conflicting evidence as being subjectively ineffective is a key component of this attitude. At least some inchoative conflict with the world is required in order for the religious belief to be religious. Lastly, we will try to show that, with a distinctive terminology, the idea that the Christian religious attitude involves a conflict between subjectivity and world is present not only in Kierkegaard but also in phenomenological figures like Scheler and even Husserl. In this paper I attempt to bring together (at least) two very different debates: one on justice, mercy and particularity, the other on the play of exclusionary reasons. My aim is to show how the discussion of the uneasy co-existence of justice and mercy pivots on the question of particularity. And, secondly, that the debate on exclusionary reasons can show us why law may fail to do justice in this context.

This article aims to present four case studies of the different responses to governmental measures to fight the COVID-19 pandemic by supreme and constitutional courts, especially in cases of jurisdictions that have been facing democratic erosion. The spread of the COVID-19 pandemic demanded immediate public policies and other political decisions from the branches of government. Executive authorities were the main actors in effecting constitutional public health norms. The expectation was that they will abide by the rule of law in fulfilling (...) their duties; that has not been the case under governments that promoted democratic erosion. The different contexts of the threats posed to the constitutional democracies led populist and illiberal leaders to opportunistically either try to—and then be contained by courts—or effectively consolidate the expansion of powers under the conditions of the pandemic. Concentrating on four jurisdictions (the USA, Hungary, El Salvador, and Brazil), the article demonstrates that courts can effectively work as bulwarks against waves of democratic erosion, especially in situations of stress, as it was the case in the global COVID-19 pandemic. This hypothesis is also proven by episodes in which courts did not sufficiently operate to curb illiberalism because they were already captured. The analyses enable classifying the court’s responses to the COVID-19 executive measures in a threefold pattern: deferential, restrictive, and of forced capitulation. (shrink)

Esse artigo investiga um possível contraponto à primeira analogia kantiana: as reações químicas. Para tanto se define lei de conservação em geral de acordo com o entendimento da ciência. Essas leis tem uma forma definida constante para todas elas e conteúdos que as diferenciam. Explica-se a primeira analogia da experiência ou doutrina da substância de Kant mostrando que qualquer mudança que notamos em nossas percepções num dado evento, só é possível se algo nesse mesmo evento não sofrer mutação. O elo (...) de ligação da doutrina da substância com as equações químicas é feito a partir do exemplo da queima da lenha na CRP de Kant. Para descobrir qual seja a substância de qualquer evento (inclusive reações químicas) aborda-se a diferença entre pesquisa transcendental (filosófica) e pesquisa empírica (científica). A pesquisa empírica é entendida como subordinada à pesquisa transcendental, dessa maneira prova-se que a química é compatível com a doutrina da substância de Kant. (shrink)

In this paper, I discuss how the principle of identifying knowledge which Strawson advances in ‘Singular Terms and Predication’ (1961), and in ‘Identifying Reference and Truth-Values’ (1964) turns out to constrain communication. The principle states that a speaker’s use of a referring expression should invoke identifying knowledge on the part of the hearer, if the hearer is to understand what the speaker is saying, and also that, in so referring, speakers are attentive to hearers’ epistemic states. In contrasting it with (...) Russell’s Principle (Evans 1982), as well as with the principle of identifying descriptions (Donnellan 1970), I try to show that the principle of identifying knowledge, ultimately a condition for understanding, makes sense only in a situation of conversation. This allows me to conclude that the cooperative feature of communication (Grice 1975) and reference (Clark andWilkes-Gibbs 1986) holds also at the understanding level. Finally, I discuss where Strawson’s views seem to be unsatisfactory, and suggest how they might be improved. (shrink)

Primero documentamos la tendencia de las utopías a plasmarse en proyectos espaciales y esbozamos posibles causas de este hecho: la impronta griega, la preeminencia de la forma socio-política “ciudad” y el influjo del _ars memoriae_ basado en tipos arquitectónicos. Después interpretamos la evolución histórica de la cuestión, reconociendo un punto de inflexión en el siglo XIX con el determinismo espacialista (...) e identificando dos planteamientos que denominamos terapéutica del espacio y poética del espacio. Uno ambiciona solucionar los problemas más urgentes de las ciudades industriales mediante la organización espacial. El segundo dispone los diseños espaciales para instaurar un modelo utópico de sociedad, que gracias a la extensión de la ciencia y a la idea de progreso, se consideraba realizable, siendo uno de sus modelos más emblemáticos el Familisterio de Guisa. «Greek Love is a modern invention», asserts the classical scholar. David Hume can claim the title of inventor. In his 1751 Dialogue on morals he used the phrase to account for the relationship between a university boy and a man of merit. How did Hume come to this expression? Pederasty was a traditional sceptical topic against a universal standard for morals. What did Hume think of this practice and its origin? When he accounts for pederasty and homosocial arrangements by negative (...) epithets, is Hume seriously condemning them or he is «only» and prudentially following the common use? The Article tries to give a first answer to these questions by examining Hume's writings and their sources, and the views of the modern authors. The Article delineates the eighteenth-century debate, without projecting on it our views, and maintains that, like some ancient philosophers according to Sextus Empricus, and possibly like Smith, Hume would have declared practice in itself «indifferent». This paper discusses the limitations, omissions and value judgements of the application of conventional economic analysis in the evaluation of climate change mitigation policies. It is argued that these have biased the result of the assessment models towards the recommendation of less aggressive mitigation strategies. Consequently, this paper questions whether they provide appropriate policy recommendations. The unequal distribution of rights implicitly assumed in conventional economic analyses applied to climate change is questioned and an alternative approach considering a distribution of rights (...) consistent with sustainable development is put forward. Finally, the points that an analysis consistent with sustainable development should take into account are presented. (shrink)

Information entities are used in ontologies to represent engineering technical specifications, health records, pictures or librarian data about, e.g., narrative fictions, among others. The literature in applied ontology lacks a comparison of the state of the art, and foundational questions on the nature of information entities remain open for research. The purpose of the paper is twofold. First, to compare existing ontologies with both each other and theories proposed in philosophy, semiotics, librarianship, and literary studies in order to understand how (...) the ontologies conceive and model information entities. Second, to discuss some open research challenges that can lead to principled approaches for the treatment of information entities, possibly by getting into account the variety of information entity types found in the literature. To think a Deleuzian politics requires to understand the philosophical markleft in his work by Spinoza. Both philosophers’ paths crisscross in their problems, questions and consequences. In this paper three concepts will be put in relation: critique, right and crowd. The aim is to elucidate how man can open new ways of political experience from the conjunction of two philosophies articulated upon a common ground: immanence and life.

The Cognitive Reflection Test (CRT) is a measure of analytical reasoning that cues an intuitive but incorrect response that must be rejected for successful performance to be attained. The CRT yields two types of errors: Intuitive errors, which are attributed to Type 1 processes; and non-intuitive errors, which result from poor numeracy skills or deficient reasoning. Past research shows that participants who commit the highest numbers of errors on the CRT overestimate their performance the most, whereas those with the lowest (...) error-rates tend to slightly underestimate. This is an example of the Dunning-Kruger Effect (DKE). The present study examined how intuitive vs. non-intuitive errors contribute to overestimation in the CRT at different levels of performance. Female undergraduate students completed a seven-item CRT test and subsequently estimated their raw score. They also filled out the Faith in Intuition (FI) questionnaire, which is a dispositional measure of intuitive thinking. Data was separated into quartiles based on level of performance on the CRT. The results demonstrated the DKE. Additionally, intuitive and non-intuitive errors predicted miscalibration among low, but not high performers. However, intuitive errors were a stronger predictor of miscalibration. Finally, FI was positively correlated with CRT self-estimates and miscalibration, indicating that participants who perceived themselves to be more intuitive were worse at estimating their score. These results taken together suggest that participants who perform poorly in the CRT and also those who score higher in intuitive thinking disposition are more susceptible to the influences of heuristic-based cues, such as answer fluency, when judging their performance. O artigo se propõe a pensar o retorno dos adolescentes às escolas após a pandemia fazendo a articulação entre conceitos psicanalíticos e a importância da escola na transição que a adolescência representa para a constituição psíquica do sujeito. A partir de uma experiência de pesquisa-extensão em uma escola com estudantes do Ensino Médio, pensamos sobre como o laço social contemporâneo impacta os modos de subjetivação e a educação, relacionando-o ao mal-estar nos estudantes adolescentes nos contextos educativos brasileiros.
