BackgroundEthics consult services are well established, but often remain underutilized. Our aim was to identify the barriers and perceptions of the Ethics consult service for physicians, advance practice providers (APPs), and nurses at our urban academic medical center which might contribute to underutilization.MethodsThis was a cross-sectional single-health system, anonymous written online survey, which was developed by the UCSD Health Clinical Ethics Committee and distributed by Survey Monkey. We compare responses between physicians, APPs, and nurses using standard parametric and non-parametric statistical (...) methods. Satisfaction with ethics consult and likelihood of calling Ethics service again were assessed using a 0–100 scale using a 5-likert response structured (0 being “not helpful at all” to 100 being “extremely helpful”) and results presented using box plots and interquartile ranges (IQR).ResultsFrom January to July 2019, approximately 3800 surveys were sent to all physicians, APPs and nurses with a return rate of 5.5—10%. Although the majority of respondents had encountered an ethical dilemma (85–92.1%) only approximately half had ever requested an Ethics consult. The primary reason for physicians never having requested a consult was that they never felt the need for help (41%). For APPs the primary reasons were not knowing an Ethics consult service was available (33.3%) or not knowing how to contact Ethics (27.8%). For nurses, it was not knowing how to contact the Ethics consult service (30.8%) or not feeling the need for help (26.2%). The median satisfaction score (IQR) for Ethics consult services rated on a 0–100 scale, from physicians was 76 (29), for AAPs 89 (49), and nurses 70 (40) (p = 0.62). The median (IQR) of likelihood of consulting Ethics in the future also on a 0–100 scale was 71 (47) for physicians, 69 (45) for APPs, and 61 (45) for nurses (p = 0.79). APP’s and nurses were significantly more likely than physicians to believe that the team did not act on the Ethics consult’s recommendations.ConclusionsBased on the results presented, we were able to identify actionable steps to better engage healthcare providers—and in particular APPs and nurses—and scale up institutional educational efforts to increase awareness of the role of the Ethics consult service at our institution. Actionable steps included implementing a system of ongoing feedback that is critical for the sustainability of the Ethics service role. We hope this project can serve as a blueprint for other hospital-based Ethics consult services to improve the quality of their programs. (shrink)

This chapter sets out the traditional natural law defense of the claim that the death penalty can in principle be a just punishment for certain offenses. It begins by explaining the relevant principles of traditional natural law theory and how they are grounded in a broadly Aristotelian-Thomistic metaphysics. It then shows how the goodness of retribution follows from these principles, and thus is intelligible given that metaphysical picture. According to the offense principle, the fact that wrongs are offensive makes them eligible for criminalization. Section “Introduction” unpacks this principle. Section “Offense and Offensiveness” discusses what it is for X to be offensive. Section “Offensiveness and Criminalization” argues that, whether we interpret offensiveness subjectively or objectively, the offense principle is not a sound principle. The fact that a wrong is objectively offensive does not bear on whether it should be criminalized. The fact that a wrong is subjectively offensive is (...) no reason to tackle it using the criminal law. Section “The Value of Offense” considers the conditions under which offense has value. It argues that, under some conditions, the fact that X is subjectively offensive counts against criminalizing X, while the fact that X is not subjectively offensive counts in favor of criminalization. Clinical research under the usual regulatory constraints may be difficult or even impossible in a public health emergency. Regulators must seek to strike a good balance in granting as wide therapeutic access to new drugs as possible at the same time as gathering sound evidence of safety and effectiveness. To inform current policy, I reexamine the philosophical rationale for restricting new medicines to clinical trials, at any stage and for any population of patients (which resides in the precautionary principle), to (...) show that its objective to protect public health, now or in the future, could soon be defeated in a pandemic. Providing wider therapeutic access and coordinating observations and natural experiments, including service delivery by cluster (wedged cluster trials), may provide such a balance. Es wird gezeigt, inwiefern eine nachhaltige interkulturelle Öffnung der Vereine von der programmatischen Anbindung an den Vereinszweck, von der kontinuierlichen Behandlung in den Kommunikationswegen, von spezifischen Personalentscheidungen und der Kompatibilität mit der Organisationskultur abhängig ist.

What sense could it make to describe your life as ‘unlivable’? What is it not only to be alive but to have a life that you live or lead? I answer by developing a social understanding of the pursuit of meaning in life. True to other uses of ‘meaning,’ I propose, meaning in a life is communicative. If you experience your life as ‘unlivable,’ recovery can lie in this communicative dynamic: you regain the experience of leading your life by letting (...) others remind you of meanings you have communicated to them in leading it. My argument develops an analogy between two dimensions in which you project an investment – a care, concern, love, or the like – when you form an intention or plan. Intrapersonally, you project your investment as communicatively intelligible to your own future self at ‘plan’s end.’ Interpersonally, you project it as communicatively intelligible to others who might come to love this thing that you love simply because you love it, as an expression of love for you. The normativity of meaning in your life puts rational pressure on you not only to abandon investments that you cannot communicate but to experience the meaning in investments that you retain. This book presents a systematic account of the role of the personal spiritual ideal of wu-wei--literally "no doing," but better rendered as "effortless action"--in early Chinese thought. Edward Slingerland's analysis shows that wu-wei represents the most general of a set of conceptual metaphors having to do with a state of effortless ease and unself-consciousness. This concept of effortlessness, he contends, serves as a common ideal for both Daoist and Confucian thinkers. He also argues that this concept contains within itself (...) a conceptual tension that motivates the development of early Chinese thought: the so-called "paradox of wu-wei," or the question of how one can consciously "try not to try." Methodologically, this book represents a preliminary attempt to apply the contemporary theory of conceptual metaphor to the study of early Chinese thought. Although the focus is upon early China, both the subject matter and methodology have wider implications. The subject of wu-wei is relevant to anyone interested in later East Asian religious thought or in the so-called "virtue-ethics" tradition in the West. Moreover, the technique of conceptual metaphor analysis--along with the principle of "embodied realism" upon which it is based--provides an exciting new theoretical framework and methodological tool for the study of comparative thought, comparative religion, intellectual history, and even the humanities in general. Part of the purpose of this work is thus to help introduce scholars in the humanities and social sciences to this methodology, and provide an example of how it may be applied to a particular sub-field. The so-called ergodic hierarchy (EH) is a central part of ergodic theory. It is a hierarchy of properties that dynamical systems can possess. Its five levels are egrodicity, weak mixing, strong mixing, Kolomogorov, and Bernoulli. Although EH is a mathematical theory, its concepts have been widely used in the foundations of statistical physics, accounts of randomness, and discussions about the nature of chaos. We introduce EH and discuss its applications in these fields.

Moral naturalists are often said to have trouble making sense of inter-communal moral disagreements. The culprit is typically thought to be the naturalist’s metasemantics and its implications for sameness of meaning across communities. The most familiar incarnation of this metasemantic challenge is the Moral Twin Earth argument. We address the challenge from the perspective of analytic naturalism, and argue that making sense of inter-communal moral disagreement creates no special issues for this view.

Zusammenfassung Der Beitrag verfolgt das Ziel, Mechanismen der Inklusion und Exklusion in Sportvereinen zu identifizieren, die die Partizipation von Personen mit Migrationshintergrund am organisierten Sport erklären können. Im Lichte von theoretischen Überlegungen zur „symbolischen Grenzziehung“ und „Zugehörigkeit“ werden Ergebnisse aus Fallstudien in Nordrhein-Westfalen und Baden-Württemberg präsentiert.

Zusammenfassung Der Beitrag untersucht den Gebrauch von Moral in der Kommunikation zwischen Trainer und Ath­leten im Spitzensport. Dabei wird moralische Kommunikation aus systemtheoretischer Perspektive als soziale Tatsache konstruiert, um im Lichte dieser Konstruktion konkrete Beispiele aus den Sport­arten Handball und Hockey analysieren und im Hinblick auf ihre Funktionen und Folgen reflektie­ren zu können. Die Ergebnisse dieser Analysen münden in Empfehlungen an Trainer, die zu einem sensiblen Umgang mit Moral raten, da insbesondere dem polemogenen Charakter moralischer und moralisierender Kommunikation Rechnung zu (...) tragen ist. Zusammenfassung Die Vereinbarkeit von Spitzensport- und Schulkarriere gestaltet sich für schulpflichtige Nachwuchsathleten sehr schwierig. Der vorliegende Beitrag konstruiert diese Unvereinbarkeit zunächst als Inklusionsproblem und beschreibt dann prinzipielle Lösungsmöglichkeiten im Rahmen einer Funktionalisierung von Schulen. Dabei wird insbesondere die sachliche Funktionalisierung in Form der strukturellen Kopplung von Spitzensport und Schule in den Blick genommen. Am Beispiel der „NRW-Sportschulen" und der „Spezialschulen Sport" in Brandenburg werden schließlich Möglichkeiten und Grenzen dieser strukturellen Kopplung diskutiert und Barrieren der sachlichen Funktionalisierung von Schulen identifiziert.

Zusammenfassung Spitzensport zu betreiben und gleichzeitig ein Hochschulstudium zu absolvieren, scheint unter den derzeitigen Umständen nahezu unmöglich. Der Artikel konstruiert dieses Phänomen der Unvereinbarkeit zweier Karrieren zunächst gesellschaftstheoretisch als Inklusionsproblem. Da eine merkliche Verbesserung der Situation der Athleten letztlich nur auf Seiten der Hochschule erwartet werden darf, werden anschließend aus organisationstheoretischer Perspektive die dortigen Möglichkeiten und Grenzen interner Strukturveränderungen reflektiert. Schließlich wird diskutiert, wie Hochschulen mit den Erwartungen des Spitzensports umgehen können und in welcher Weise sich im Rahmen von Netzwerken (...) womöglich doch Kooperationsbeziehungen zwischen den beteiligten Organisationen zugunsten studierender Spitzensportler aufbauen lassen. Zusammenfassung Der Beitrag analysiert auf der Basis theoretischer Überlegungen sowie empirischer Ergebnisse Möglichkeiten und Grenzen der Steuerung interkultureller Öffnung von Sportvereinen durch Sportverbände. Es wird gezeigt, dass die interkulturelle Öffnung der Vereine funktional ausgerichteter Strategien seitens der Sportverbände bedarf, die an die Ziele und Zwecke der Vereine anschließen, und dass Netzwerke den zentralen Mechanismus bei der Koordination der Interorganisationsbeziehungen zwischen Sportverbänden und Sportvereinen darstellen.

Zusammenfassung Dem deutschen Fußball scheint es geradezu mühelos zu gelingen, Spielerinnen und Spieler mit Migrationshintergrund zu integrieren, was sich deutlich in der Zahl betreffender Spielerinnen und Spieler in den Auswahlmannschaften des Deutschen Fußball Bundes zeigt. Die Mannschaften des Deutschen Handball Bundes dagegen rekrutieren sich bislang ausschließlich aus rein deutschstämmigen Spielerinnen und Spielern. Beim Handballsport scheint es sich hierzulande bislang um etwas ausgesprochen „Deutsches“ zu handeln, mithin um eine Sportart, die fast 20 % der Bevölkerung kaum erreicht und dabei offenkundig sogar (...) die größte Migrantengruppe, nämlich diejenige mit muslimischem Hintergrund, so gut wie vollständig ausschließt. Der Aufsatz steckt sich das Ziel, all jene Mechanismen der Exklusion von Migranten im Handball zu identifizieren und in einem theoretischen Modell zusammenzufassen, die in Deutschland zur Unter- bzw. Nichtrepräsentanz von Spielerinnen und Spielern mit unterschiedlichem Migrationshintergrund im Handballsport beitragen. Aufbauend darauf werden Leitfragen für eine empirische Untersuchung der Exklusionsmechanismen abgeleitet. (shrink)

ABSTRACT:Officials must understand why and how the public lost confidence in the federal government’s ability to manage financial turmoil. Officials outsourced to private parties responsibility for monitoring and policing the safety-net exposures that were bound to be generated by weaknesses in the securitization process. When the adverse consequences of this imprudent arrangement first emerged, officials claimed for months that the difficulties that short-funded, highly leveraged firms were facing in rolling over debt reflected only a shortage of aggregate liquidity and not (...) individual-firm shortages of economic capital. Then, in September 2008, the president and other officials created an unwise sense of urgency that delays in implementation show to have been greatly exaggerated.That authorities and financiers violated common-law duties of loyalty, competence, and care they owe to taxpayers indicates a massive incentive breakdown in industry and government. Taxpayers deserve a thorough-going reorientation of: (1) how regulatory agencies report on their regulatory performance and back-room interactions with Congress and the Treasury, and (2) the contract structures and performance measures used by the financial industry and its government overseers. This paper investigates the question of, and the degree to which, Newton’s theory of space constitutes a third-way between the traditional substantivalist and relationist ontologies, i.e., that Newton judged that space is neither a type of substance/entity nor purely a relation among such substances. A non-substantivalist reading of Newton has been famously defended by Howard Stein, among others; but, as will be demonstrated, these claims are problematic on various grounds, especially as regards Newton’s alleged rejection of the traditional substance/accident dichotomy (...) concerning space. Nevertheless, our analysis of the metaphysical foundations of Newton’s spatial theory will strive to uncover its unique and innovative characteristics, most notably, the distinctive role that Newton’s “immaterialist” spatial ontology plays in his dynamics.
